LAW & JUSTICE

Issued on: January 18, 2021

 

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

 

Section 1. Purpose. Under the Constitution and Federal law, our Government vests in judges, prosecutors, and law enforcement officers the power to make decisions of enormous consequence. Because of the importance of their work, these public servants face unique risks to their safety and the safety of their families. Some who face or have received an adverse judicial decision have sought to intimidate or punish judges and prosecutors with threats of harm. Moreover, judges, prosecutors, and law enforcement officers are symbols within our communities of law and order and may be targeted for that reason alone. And at times, family members of public servants have become victims. Last year, a former litigant before a Federal judge in New Jersey tragically murdered the judge’s 20-year-old son and critically wounded her husband. Judges, prosecutors, and law enforcement officers’ resiliency in the face of the danger they regularly face is an inspiration for all of us in public service.

 

Judges, prosecutors, and law enforcement officers should not have to choose between public service and subjecting themselves and their families to danger. My Administration has no higher priorities than preserving the rule of law in our country and protecting the men and women who serve under its flag. Accordingly, I am ordering enhanced protections for judges, prosecutors, and law enforcement officers. Federal law already allows Federal and State law enforcement officers to protect themselves by carrying a concealed firearm, but the Federal Government can do more to cut the red tape that Federal law enforcement officers must navigate to exercise their right. The current threat to Federal prosecutors also demands an expansion of their ability to carry a concealed firearm, as allowed under the Department of Justice’s existing authorities. Finally, the Congress should act expeditiously to adopt legislation extending the right to carry a concealed firearm to Federal judges and pass other measures that will expand our capacity to combat threats of violence against judges, prosecutors, and law enforcement officers.

 

Sec. 2. Removing Obstacles to Federal Law Enforcement Officers Qualifying For Concealed Carry Under the Law Enforcement Officers Safety Act of 2004. (a) It shall be the policy of the United States to remove any undue obstacle preventing current or retired Federal law enforcement officers from carrying a concealed firearm as allowed under the Law Enforcement Officers Safety Act of 2004, as amended (18 U.S.C. 926B, 926C) (LEOSA).

 

(b) The heads of all executive departments and agencies (agencies) that employ or have employed qualified law enforcement officers or qualified retired law enforcement officers, as those terms are defined in the LEOSA, shall act expeditiously to implement the policy set by subsection (a) of this section.

A Chinese jet risked international backlash after it fired flares close to a submarine-hunting helicopter from Canada in the South China Sea, the North American country's navy has confirmed.

Canada accused its counterparts in Beijing of acting recklessly, fearing one of its helicopters could have been downed in international waters, after the encounter on Sunday.

The Sikorsky Cyclone helicopter was flying off the Royal Canadian Navy frigate HMCS Ottawa, Maj. Rob Millen - an officer aboard the ship - said.

He added: "The risk to a helicopter in that instance is the flares moving into the rotor blades or the engines so this was categorized as both unsafe and non-standard, unprofessional."

The encounter was the second similar incident on October 29, as a similar incident saw the helicopter and a Chinese People’s Liberation Army Navy J-11 fighter jets get around 100 feet of each other over international waters.

The first showdown, Millen told CNN, occurred 34 miles out from the Parcel Islands chain, in the north of the contentious South China Sea, while the second was 23 miles away from the disputed region.

Canada said while it was not uncommon for Chinese aircraft to get close to fixed-wing aircraft, it was rare for such an action to be made against a helicopter.

According to the authorities, the targeted Canadian helicopter had been searching for a submarine it had detected.

Hours before the Chinese standoff, Millen described how he had been piloting the aircraft when Chinese J-11s intercepted it at close range.

The rival vessel flew in circles of Millen's helicopter, the military man said, but as it drew "closer and closer, at a certain point it became unsafe".

It experienced turbulence emitting from the Chinese jets which also sparked fears for the safety of the helicopter.

He added: "I certainly am not as comfortable as you can be based on the fragility of the rotor system."

The incidents from Sunday came days before the US had its own issues with Beijing in the South China Sea.

Washington reported that a PLA fighter jet came within 10 feet of a US Air Force B-52 bomber flying over the region. This was within weeks of a Chinese fighter jet getting within 16 feet of a Canadian CP-140 reconnaissance and surveillance plane over the East China Sea.

Maj. Gen. Iain Huddleston, the commander of Canada’s 1st Air Division, was on the Canadian craft when it was targeted by the "unprofessional" and "very aggressive" Chinese.

In a statement, Canada's Defense Ministery said: "The Canadian aircraft was subject to multiple close-proximity maneuvers by a PLAAF aircraft that put the safety of all personnel at risk."

If everything were black and white, no lawyer could make any "good faith" argument at all.

 

And arguments have been made against "settled" case law (segregation and abortion come to mind) without the challenging lawyers losing their licenses over it. Quite the contrary, they are celebrated.

 

But, nooo, this administrative judge, Yvette D. Roland, had already made a "preliminary finding of culpability" if I heard her correctly, on November 2, right after Dr. Eastman's rebuttal testimony ended and with no motion before her.

 

Biased, biased, biased, against Dr. Eastman and his attorneys, from Day 1. Making objections from the bench to Dr. Eastman's attorney's questions but never to the State Bar attorney's questions (who led his witnesses too), cutting off lines of testimony "move on," "next question" all the time with Dr. Eastman's witnesses (and asking for relevance all the time) but never of the State Bar's attorney, not letting Dr. Eastman get his full impressive background into the record - cutting him off both on direct and in rebuttal, denying almost all of his expert testimony and allowing anything and everything that the State Bar offered. Just really lopsided. With the judge not only favoring the State Bar but appearing at times to be on the team of the State Bar prosecutors rather than sitting objectively on the bench between the two sides - in this anon's opinion.

 

Not sure what the appeal options are from a disbarment proceeding but I hope there are remedies available to Dr. Eastman from what seems will be an inevitable ruling against him from an apparently biased judge.
