Tennessee Joins Brief Asking US Supreme Court to Hear Trump Ballot Eligibility Case

NASHVILLE, TN - Attorney General Jonathan Skrmetti has joined an amicus brief, urging the U.S. Supreme Court to hear an appeal from a Colorado Supreme Court decision that prevented former President Donald Trump from appearing on the ballot for the state's Presidential Primary Elections. The coalition of 27 states, including the Arizona Legislature, argues that the Fourteenth Amendment grants Congress the authority to determine a person's eligibility for office, and state courts should not encroach upon this exclusive power.

 

"The president is chosen by the American people, not a small cadre of insulated elites,” said Attorney General Jonathan Skrmetti in a statement. “It is incredibly dangerous for courts to insert themselves into the democratic process absent a clear legal mandate. The application of the Fourteenth Amendment in the Reconstruction Era is not consistent with the current effort to disqualify Donald Trump.”

 

The lawsuit was initially filed by six Colorado voters who claimed that Trump's alleged involvement in the January 6 incident at the U.S. Capitol disqualified him from office under a Civil War-era insurrection clause in the Fourteenth Amendment. However, a district judge ruled that the insurrection clause does not apply to the presidency, allowing Trump to be included on the ballot. Subsequently, the Colorado Supreme Court issued a ruling barring Trump from the GOP primary ballot under the Fourteenth Amendment.

 

Joining Tennessee in the West Virginia- and Indiana-led brief include: Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, Virginia, Wyoming, and the Arizona Legislature.

The rule number (e.g., 72) is divided by the interest percentage per period (usually years) to obtain the approximate number of periods required for doubling. Time required to double a quantity

 

The doubling time is the time it takes for a population to double in size/value. It is applied to population growth, inflation, resource extraction, consumption of goods, compound interest, the volume of malignant tumours, and many other things that tend to grow over time. When the relative growth rate (not the absolute growth rate) is constant, the quantity undergoes exponential growth and has a constant doubling time or period, which can be calculated directly from the growth rate.

 

This time can be calculated by dividing the natural logarithm of 2 by the exponent of growth, or approximated by dividing 70 by the percentage growth rate (more roughly but roundly, dividing 72; see the rule of 72 for details and derivations of this formula).

 

The doubling time is a characteristic unit (a natural unit of scale) for the exponential growth equation, and its converse for exponential decay is the half-life.

 

As an example, Canada's net population growth was 2.7 percent in the year 2022, dividing 72 by 2.7 gives an approximate doubling time of about 27 years. Thus if that growth rate were to remain constant, Canada's population would double from its 2023 figure of about 39 million to about 78 million by 2050.

One of the key SOCOM and ARSOC missions is what’s known as foreign internal defense (FID), which is building the capacity of key partners to defend themselves.

 

One of the critical actions directed in the 2023 and 2024 National Defense Authorization Act (NDAA) is Section 1309, which establishes training, advising, and institutional capacity building for Taiwan’s military. This section mandates a large-scale training program for Taiwan, where FID is a core element.

 

And which part of the Army force structure specializes and focuses on FID?

 

ARSOC, which makes the targeted cut of ARSOC puzzling.

Not well advertised has been a longstanding effort by the Special Operations community to better organize, train, and equip Taiwanese regular and reserve forces to respond to Chinese gray zone activities before or during a potential invasion by China. This effort is the spearhead of Indo-Pacific Command efforts to build deterrence capacity to discourage communist China from considering a move to open warfare in the Western Pacific.

The proposed cut in ARSOC belies a disconnect between the NDAA and the announced actions of the secretary of the Army and ASD SOLIC. Significant bureaucratic disconnects do happen in the largest bureaucracy in the world, which is where Congress, in its oversight role, needs to identify and act upon such non-sequiturs. Rep. Mike Waltz (R-Fla.) has taken vocal leadership to address the proposed Army actions.

Strategic Reconnaissance Delivers Significant Value for Indo-Pacific Command

 

Another critical mission for ARSOC in support of Indo-Pacific Command is strategic reconnaissance. This is the mission in which ARSOC elements are the indispensable “eyes and ears” of the theater commander, Adm. John Aquilino.

The ARSOC units and elements provide significant capacities and capabilities to Special Operations Command Pacific. The ARSOC elements would give advance warning of any Chinese moves on Taiwan and North Korean moves toward South Korea. In addition, there are special situations, such as Chinese adventurism in the Solomon Islands.

The ARSOC units would be essential in identifying what the Chinese are really up to, especially when Solomon Islands Prime Minister Manasseh Sogavare is openly embracing Beijing and is hostile toward non-Chinese elements. The Solomon Islands represent an interesting scenario in which much of the population is pro-Western, which may enable Western special operators to try to determine the scope and intent of the Chinese Communist Party’s malign activities in the Solomon Islands.

The Western Pacific isn’t the only place where ARSOC will play a crucial role. With the developing possibility of Venezuelan aggression toward Guyana, ARSOC, with the 7th Special Forces Group and the associated enablers, make unconventional warfare capabilities a key deterrent to Venezuela and growing Chinese civil-military fusion operations in the Americas.

The special operators of ARSOC play an irreplaceable role in FID, strategic reconnaissance, and the all-important “SOF Truth #1.” People are more important than hardware. In other words, the most important job for the U.S. Special Operations Forces is to build enduring personal relationships with host countries, which is irreplaceable in the struggle to shape host country decision-making on whether to align with China or the American-led world. This is a key tenet to victory, and within the total Army, this expertise resides in ARSOC.

Hollywood Actor Christian Oliver and His Two Daughters Killed in Plane Crash: Report

January 5, 2024

 

American actor Christian Oliver, known by his stage name Christian Klepser, and his two daughters tragically lost their lives in a plane crash in the Caribbean.

 

The small, one-engine aircraft they were traveling in crashed into the sea shortly after takeoff from an island in St. Vincent and the Grenadines, as confirmed by the Royal St. Vincent and the Grenadines Police Force (RSVGPF).

 

The aircraft went airborne from the J.F. Mitchell Airport in Paget Farm about 12:11 p.m. for St. Lucia as its final destination. Moments after taking off, the aircraft experienced difficulties and plummeted into the ocean,” police stated in a Facebook post.

 

The victims were identified as the aircraft’s owner and pilot, Robert Sachs, a resident of the island of Bequia, along with Klepser and his daughters, Madita, aged 10, and Annik, aged 12.

 

Klepser, who had worked with notable figures like Steven Soderbergh, Brian Singer, Tom Cruise, and the Wachowskis, was recognized for his roles in films such as The Good German, Valkyrie, Speed Racer, and Sense8. He also appeared in the 1995 film adaptation of The Baby-Sitters Club.

 

In a recent Instagram post, Klepser shared an image from a beach, captioning it, “Greetings from somewhere in paradise! To community and love… 2024 here we come!”

 

Actress Bai Ling, who was working with Oliver on the upcoming film Forever Hold Your Peace, expressed her shock and sadness over the news.

 

“He was so nice, works so hard and such a brave actor and a beautiful gentle person, we played lovers in this film, just so so so sad… And his daughters were so so young,” she said.

 

The RSVGPF reported that the bodies were recovered by Coast Guard personnel and pronounced deceased by a medical practitioner. The cause of the crash remains unclear, and an investigation is ongoing.

 

The local news website Searchlight reported that Sachs, who owned a dive business in Bequia, had radioed the airport’s control tower to inform them of difficulties and his intention to turn around. The bodies have been transported to the island of St. Vincent for examination by a medical examiner.

It is used to determine areas of reversible ischemia and infarcted tissue in the heart. It is also indicated to detect changes in perfusion induced by pharmacologic stress (adenosine, lexiscan, dobutamine or persantine) in patients with coronary artery disease. Its third indication is to assess left ventricular function (ejection fraction) in patients thought to have heart disease. No contraindications are known for use of Tc-99m tetrofosmin, but care should be taken to constantly monitor the cardiac function in patients with known or suspected coronary artery disease. Patients should be encouraged to void their bladders as soon as the images are gathered, and as often as possible after the tests to decrease their radiation doses, since the majority of elimination is renal. The recommended dose of Tc-99m tetrofosmin is between 5 and 33 millicuries (185-1221 megabecquerels). For a two-dose stress/rest dosing, the typical dose is normally a 10 mCi dose, followed one to four hours later by a dose of 30 mCi. Imaging normally begins 15 minutes following injection.[3]"

The fraud case brought by James accuses the Republican frontrunner for president of inflating the value of properties, including his Mar-a-Lago home in Florida, to get better terms on loans. James, who Trump has repeatedly attacked as partisan and 'racist,' had originally sued the former president for $250 million.

 

The new bombshell filing Friday argues that the massive sum is warranted due to the former president's 'myriad deceptive schemes' that were employed by his business and co-defendants to 'inflate asset values and conceal facts.' She writes the alleged fraud schemes were 'so outrageous that they belie innocent explanation.'

 

Trump's attorneys fired back, saying that James has 'no evidence' and insisted there was not a single witness who backs up those scathing allegations.

 

Judge Arthur Engoron has already found Trump, and his sons Don Jr. and Eric, liable for fraud. The post-trial briefs followed an 11-week explosive trial to determine how much money Trump and his business should fork over - which winded down last month.

WASHINGTON (AP) — The Supreme Court said Friday it will decide whether former President Donald Trump can be kept off the ballot because of his efforts to overturn his 2020 election loss, inserting the court squarely in the 2024 presidential campaign.

 

The justices acknowledged the need to reach a decision quickly, as voters will soon begin casting presidential primary ballots across the country. The court agreed to take up Trump’s appeal of a case from Colorado stemming from his role in the events that culminated in the Jan. 6, 2021, attack on the U.S. Capitol.

Underscoring the urgency, arguments will be held on Feb. 8, during what is normally a nearly monthlong winter break for the justices. The compressed timeframe could allow the court to produce a decision before Super Tuesday on March 5, when the largest number of delegates are up for grabs in a single day, including in Colorado.

 

The court will be considering for the first time the meaning and reach of a provision of the 14th Amendment barring some people who “engaged in insurrection” from holding public office. The amendment was adopted in 1868, following the Civil War. It has been so rarely used that the nation’s highest court had no previous occasion to interpret it.

 

Colorado’s Supreme Court, by a 4-3 vote, ruled last month that Trump should not be on the Republican primary ballot. The decision was the first time the 14th Amendment was used to bar a presidential contender from the ballot.

Trump is separately appealing to state court a ruling by Maine’s Democratic secretary of state, Shenna Bellows, that he was ineligible to appear on that state’s ballot over his role in the Capitol attack. Both the Colorado Supreme Court and the Maine secretary of state’s rulings are on hold until the appeals play out.

 

The high court’s decision to intervene, which both sides called for, is the most direct involvement in a presidential election since Bush v. Gore in 2000, when a conservative majority effectively decided the election for Republican George W. Bush. Only Justice Clarence Thomas remains from that court.

 

Three of the nine Supreme Court justices were appointed by Trump, though they have repeatedly ruled against him in 2020 election-related lawsuits, as well as his efforts to keep documents related to Jan. 6 and his tax returns from being turned over to congressional committees.

 

At the same time, Justices Amy Coney Barrett, Neil Gorsuch and Brett Kavanaugh have been in the majority of conservative-driven decisions that overturned the five-decade-old constitutional right to abortion, expanded gun rights and struck down affirmative action in college admissions.

 

Some Democratic lawmakers have called on Thomas to step aside from the case because of his wife’s support for Trump’s effort to overturn the results of the election, which he lost to Democrat Joe Biden. Thomas is unlikely to agree, and there was every indication Friday that all the justices are participating. Thomas has recused himself from only one other case related to the 2020 election, involving former law clerk John Eastman, and so far the people trying to disqualify Trump haven’t asked him to recuse.

 

The 4-3 Colorado decision cites a ruling by Gorsuch when he was a federal judge in that state. That Gorsuch decision upheld Colorado’s move to strike a naturalized citizen from the state’s presidential ballot because he was born in Guyana and didn’t meet the constitutional requirements to run for office. The court found that Trump likewise doesn’t meet the qualifications due to his role in the U.S. Capitol attack on Jan. 6, 2021. That day, the Republican president had held a rally outside the White House and exhorted his supporters to “fight like hell” before they walked to the Capitol.

 

The two-sentence provision in Section 3 of the 14th Amendment states that anyone who swore an oath to uphold the constitution and then “engaged in insurrection” against it is no longer eligible for state or federal office. After Congress passed an amnesty for most of the former confederates the measure targeted in 1872, the provision fell into disuse until dozens of suits were filed to keep Trump off the ballot this year. Only the one in Colorado was successful….
