Bill Melugin @BillMelugin_ - Politicians keep getting this wrong, it doesn’t matter if Khalil hasn’t been charged with a crime. It’s not required under Section 237 (a)(4)(C) of the INA, which is the statute Rubio is using, which gives him broad discretion. There is prior precedent w/ this rarely used provision.
In 1995, in the Matter of Ruiz-Massieu, the courts sided w/ then U.S. Secretary of State Warren Christopher’s powers to deport a Mexican national under the same provision, though it is extremely rarely used.
Khalil also has not been “disappeared”. You can look him up in the online ICE inmate locator at any time and see where he’s being held.
