It is my understanding that the military are not restricted by the same rules of investigation and gathering evidence when it comes to issues of national defense. If they suspect a domestic criminal, traitor working with a foreign agent to cause we the people and our constitution harm (broad definition applies there), they can use whatever means of surveillance technology allows. What they can't do is act independently, send in the MPs and start arresting and convicting people, regardless the evidence and proof.
They can only act through their established chains of command (Joint Chiefs) and through the office of the presidency. Unless they decide to stage a coup, but that would only happen if the executive branch and DOJ were thoroughly corrupted…which it was under Hussein.
The military doesn't need ankle monitors to follow them. Simple phone and communications monitoring of any given suspect plus all their cohorts, which is how they have been able to say they "have it all."
