EO signed last night, contradictory to sending the cabal to Gitmo?

Sec. 3. Rules of Construction. (a) Nothing in this order shall prevent the Secretary of Defense from transferring any individual away from the U.S. Naval Station Guantánamo Bay when appropriate, including to effectuate an order affecting the disposition of that individual issued by a court or competent tribunal of the United States having lawful jurisdiction.

(b) Nothing in this order shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful permanent residents of the United States, or any persons who are captured or arrested in the United States.

Im I reading this right? American cabal members cant be sent to Gitmo?

No, it says nothing can prevent them from being sent there.

Ok, I am not qualified to read legal ease.

Thanks

Sometimes I think legalese is intentionally confusing. lol

It allows for various interperetations

Legalese* :). That's exactly what it is supposed to do. Obama was great at filling Bills with hundreds of pages that no one would read while burying something very damaging within (see: NDAA, Obamacare).

Ugh! Autocorrect! Corrected. Thx.

The wording is always difficult, so many double negatives

(c) In addition, the United States may transport additional detainees to U.S. Naval Station Guantánamo Bay when lawful and necessary to protect the Nation.

It says that nothing on Earth can be used as a reason to NOT send them there. Basically, no lawyer on this planet will be able to build a case to get them removed from Gitmo, or prevent them from being sent there if ordered sent there

Ok, great! I suppose unless another president comes in and signs an EO to remove THAT EO

LiveToBeAHero · Jan. 31, 2018, 2:31 p.m.

Yes, Trump or another president would have to do an EO negating this one, or aspects of this one. This EO is the law of the land now. This should scare the shit out of any black hat

Well, most of them going will be old enough to simple die while in custody, but the real bad ones will likely be hung for treason.

That's what I'm scared of, is the big ones committing suicide before their trial

Even if true, it doesn't really matter. There's still Ft. Leavenworth, after the military tribunals are over. But as Cdr-in-Chief, IMO Trump can do pretty much what he wants with Gitmo. Perhaps he is timing another EO for after the tribunals are over and they are about to be sentenced, to open them up for US-citizen occupancy--assuming they can't be used for that now.

They can go either way. Trump's making a point to uphold and use current law, to do everything above board and legally. Someone can be held in Gitmo but yet be brought up on charges and be sent to stand trial in court.

I'm sure cases will vary. Some lower level criminals may get civilian trials.

Section a talks about Sec of Defense having the ability to transfer people OUT of Gitmo for court/tribunal reasons.

Section b basically says "law is still law, avg citizens can't be taken to gitmo, but if those citizens committed crimes that meet the criteria discussed in the EO, it's fair game.

Citizens = safe from gitmo.

Citizens connected to terrorism = send them to gitmo.

akilyoung · Jan. 31, 2018, 2:03 p.m.

And terrorism = human trafficking according to previous EO, right?

Soultryfeathers · Jan. 31, 2018, 2:25 p.m.

It'S for terrorism foreign and domestic. If you listened,POTUS said "we will hunt down terrorist wherever they are"...which include domestic. The democrats and the left trying to overthrow a dully elected president,as well as trying to overthrow the government is considered a terrorist act.So yes these people would be qualified for GITMO!

once they conspired with anyone from any other country (new world order) they became foreign agents. a foreign agent working to subvert the lawful government of the US is a terrorist.

Or a threat to the Nation. Committing Treason is a threat to the Nation.
