What government wants to do but cannot, it can require corporations to do for it.

If you’ve read the Parable of the Seasteader, you’ll already know that at sufficient scale the public/private distinction collapses — a private entity of sufficient size can have all the power of a public entity. It is certainly arguable that Facebook and Google have reached such size. Here, however, I want to discuss a different dilemma - government’s use of private entities to regulate freedoms it cannot directly abridge.

We’re going to look at one specific right (the right to free speech) and one specific set of Federal regulations (§ 1604.11) but the pattern I’m describing here has become ubiquitous in our country. Nowadays, almost anything government is forbidden to regulate, it can require corporations to regulate for it. The government has outsourced tyranny. Let’s see how this black magic is performed.

Expression of Viewpoints is Guaranteed to be Free from Government Abridgement, Even if the Viewpoints are Hateful…

The First Amendment to the United States Constitution is a remarkable provision that has, for centuries, protected Americans from the abridgment of their freedom of speech by their government. Even so-called “hate speech” is protected.

The relevant provision states that “Congress shall make no law abridging the freedom of speech.” As written, the guarantee of free speech originally applied only to the federal government. However, the Supreme Court ruled in Gitlow v. New York that the guarantee had been “incorporated” in the Fourteenth Amendment and the guarantee is now applied to all state and local governments as well.

Now, in practice, there are laws regulating speech (you cannot shout “fire” in a crowded theater, and so on), but such regulations are generally “time, place, and manner” restrictions. Our Courts have universally frowned on what is called viewpoint discrimination:

In what is surely a mistake (/s), the address for this specific contract does NOT match the recipient award page. The contract address is actually a single family home in Virginia which shows up in a yellow pages ad (unknown date) as Election Systems Aquisition while the recipient profile lists an address in Florida - 5426 Bay Center Drive, Tampa. UPDATE (2012) from https://archive.vn/PmA6i : "Scytl has emerged as the most mysterious election counting company in this presidential election. Scytl claims to have a Scytl USA division located in Glen Allen, Virginia. … The land deed records show that the ownership of the property at that address is Hugh Gallagher, now listed as the managing director of Scytl USA. Intrasting thing about Vexcel is that the contract designates them as a Federally Funded Research and Development Corporation; their recipient profile does not. For all FYs, Vexcel has rec'd over $13M from the USG, the majority being paid in 2012 ($5.3 M). So the USG pays them for R&D and then pays them again for contracts. Nice work if you can get it. From the Vexcel website: Vexcel, a Microsoft subsidiary acting as a separate legal entity, extends and enhances Microsoft products and services by providing customers with end-to-end solutions including cloud, hardware, software, and services. Mortgage Industry Soars to Record With $4.4 Trillion in Loans

Nearly $4.4 trillion of home mortgages are set to be originated this year, according to data provider Black Knight Inc. That record amount is about $300 billion more than the most optimistic forecast among estimates from Fannie Mae, Freddie Mac, and the Mortgage Bankers Association.

The Federal Reserve has helped fuel a housing rally by keeping interest rates low and buying mortgage bonds to stimulate the economy.The previous originations record was set in 2003, when the Fed cut interest rates and spurred a boom in refinancings that led to $3.8 trillion of new mortgages that year. Roughly 6.4 million homeowners have refinanced their mortgages this year through September, a figure that Black Knight experts to top 9 million by year’s end.

Profit margins are at record levels in the mortgage industry, prompting at least nine companies to either go public this year or plan to do so in the coming months.

Next year could be even better for the industry, with more than $4.5 trillion of projected originations, according to a team of mortgage researchers at Bank of America Corp

World Economic Forum Delayed Until May, Will Take Place In Singapore, Not Davos

Singapore's quest to cement its reputation as the "Switzerland of the East" has just received a huge boost as the World Economic Forum, the international NGO that hosts the eponymous week-long conference in the Swiss ski resort town of Davos. To the financial press and readers alike, the annual event, which has been held every year since the early 70s, has simply become known as "Davos".

In more recent times, the annual extravaganza of panels, events, private parties, etc. has become synonymous with the global monied elite. Every year, the forum attracts not just business leaders and financiers, but academics, politicians, the press - commingling in an orgiastic freak-show of glad-handing and excess.

Every year, big shots from around the world fly to the Swiss mountain villa in droves, their private jets landing and departing by the thousands, as they gather to discuss pressing international problems like 'environmental sustainability', creating a picture of hypocrisy.

Those same jets will need to travel a little further, to Singapore this year.

Last year's forum went off without a hitch, since Davos is the first major event on the calendar in the new year, typically falling in the latter half of January. But this year, organizers have deemed it prudent to delay the event until May, since most of the westerners who typically constitute the vast majority of the audience should already have been vaccinated by then…at least, so they might hope.

The World Economic Forum will hold its 2021 annual meeting in Singapore ("the Switzerland of the east") instead of Switzerland, RTRS reported. Normally held in the ski resort of Davos each Jan, the 2021 gathering had been postponed due to the pandemic and scheduled for May.

Of course, since May isn't exactly ideal ski weather, it's understandable that the forum will need to move this year. And the choice of Singapore, which successfully suppressed several outbreaks rooted in the city-state's community of migrant workers, makes sense.

Merrill to pay $26 million to New Hampshire, former NH Governor to settle churning allegations

New Hampshire is ordering Merrill Lynch to pay $26.25 million in fines and restitution to the state and to an investor, the former Governor of New Hampshire, who claimed he suffered losses at the hands of a former Boston-based broker, to settle allegations including unauthorized and excessive trading.

It is the largest monetary sanction in the state’s history and the second largest FINRA settlement in at least a decade. Merrill Lynch, which is a subsidiary of Bank of America, was also cited for failure to supervise and ordered to maintain compliance undertakings specifically put in place to address the compliance failures uncovered by New Hampshire’s investigation.

Separately, the state securities regulator has permanently barred former Merrill Lynch broker, Charles Kenahan, from the securities business in New Hampshire. The state’s investigation found that Kenahan “traded without authorization, missmarked trade confirmations, excessively traded stocks and Initial Public Offerings, over charged commissions, and inappropriately traded inverse and leveraged products,” according to the press release on Monday.

The misconduct, according to the state regulator, “lead to high commissions for Merrill Lynch and Kenahan and heavy losses for the investor.” “This case is about an abuse of trust committed by Merrill Lynch and Kenahan,” Jeff Spill, the deputy director and head of enforcement for New Hampshire’s Bureau of Securities Regulation, said. “Ultimately, Kenahan’s recommendations benefited Kenahan and Merrill Lynch and not the investor,” Spill said.

“We have enhanced our policies and monitoring systems over the last several years to more closely monitor certain types of client account activity,” a spokesman for Merrill Lynch said in an email to CNBC.

U.S. Slaps Sanctions on 14 Chinese Officials Over Hong Kong Crackdown

The United States on Monday imposed financial sanctions and a travel ban on 14 Chinese officials over their alleged role in Beijing's disqualification last month of elected opposition legislators in Hong Kong. The move, which was first reported by Reuters overnight and sent Asian stock markets lower, targeted the vice chairpersons of the National People’s Congress Standing Committee (NPCSC), the top decision-making body of the Chinese legislature.

The action was widely seen as part of an effort by outgoing President Donald Trump to cement his tough-on-China legacy and also box president-elect Joe Biden, before he takes office on Jan. 20, into hardline positions on Beijing at a time of bipartisan anti-China sentiment in Congress. The Trump administration earlier slapped sanctions on Hong Kong Chief Executive Carrie Lam, the Asian financial hub’s current and former police chiefs and other top officials in August for what it said was their role in curtailing freedoms in a crackdown on the territory’s pro-democracy movement.

"Beijing’s unrelenting assault against Hong Kong’s democratic processes has gutted its Legislative Council, rendering the body a rubber stamp devoid of meaningful opposition," U.S. Secretary of State Mike Pompeo said in a statement.

Hong Kong’s Beijing-backed government last month expelled four opposition members from its legislature after China’s parliament gave city authorities new powers to curb dissent. The move triggered mass resignations by pro-democracy opposition lawmakers in the former British colony.

White House national security adviser Robert O’Brien said in November the expulsion showed the “One Country, Two Systems” formula, under which Hong Kong’s autonomy was to be safeguarded after Britain handed the territory back to China in 1997, was now “merely a fig leaf”, and he promised further U.S. action.

Pompeo said the NPCSC has effectively "neutered" the ability of people in Hong Kong to choose their elected representatives. "These actions demonstrate once again Beijing’s complete disregard for its international commitments under the Sino-British Joint Declaration, a U.N.-registered treaty."

Beijing's action heightened alarm in the West. The Five Eyes intelligence-sharing group - comprised of Australia, Britain, Canada, New Zealand and the United States - said last month the move appeared to be part of a campaign to silence critics, and called on China to reverse course.

The sanctions prohibit the 14 individuals and their immediate members from traveling to the United States. Any assets the officials might have within the United States will be blocked and U.S. individuals and companies will be banned from dealing with them.

This board is not functioning as one would expect and as it has in the past

The most common symptom is you get a page with a lot of posts missing. It might appear that nobody has posted for an hour or two or more.

With luck, you might get the non-appearing posts by posting something, and when the page refreshes showing your post, Voilà! The page now has a slew of posts.

Doesn't always work, though.

If anyone's interested, I just tried this:

Reloaded page using browser (not "back," but reload, getting data from 8kun. That gave me a 5-hour old view of the page.

Cleared cookies and cache with Bleachbit and rebooted OS.

Returned to this page thru the Catalog (which showed R:113, or page has 113 Replies).

But the page, clicking on Catalog to get here had only 23 replies - a ton were missing.

[Now I could be wrong here, but this suggests to me that the 23 reply page that appeared was FOR ME – that is to say as if a cookie had told the 'system' to give me a previously-viewed 23 reply page … but I zapped the cookies.

Don't need cookies, though. The system also tracks us through IP This is how the system can 'remember' (sometimes) your ID even though you change browsers or clear cookies. In this case, my ID appearing is new (it used to be f87098 This is my 2nd post as e1b266.)

That all goes into a confusing rabbit hole, but just making a note of it.]

Ancient Scythians (800 BC - 200 AD) re-emerge in the modern word to take over. This nomadic tribe had their roots in the Altai Mountains where China, Mongolia and Siberia meet. These unique crowns were lost to time as the legend grew that when the crowns were found and returned to their rightful heirs, the Scythians would rise up once again and conquer the world.

The Scythians were defeated in 168 AD by Rome. Half were sent to England to protect Hadrian’s wall. The rest were used by Rome as local mercenaries.

The English Scythians were responsible for the King Arthur legend. Arthur’s ancestors were among the first wave of settlers to populate the Virginia Colony. They grew wealthy from tobacco, sugar and slave trading. The history of the Virginia Colony is covered from its start to the present day.

With the rediscovery of the crowns and their purchase by a tobacco mogul of Royal Scythian descent, the story comes into the 21st century. Since tobacco is a failing commodity, Arthur Alain decides to go into the heroin business. Smuggling heroin from the Golden Triangle in Southeast Asia into the ports of Hampton Roads, Virginia, and the Outer Banks of North Carolina is brilliant. These ports are not on the DEA or customs radar. The golden history of pirates and smuggling in this area is well-known. This will provide enough money and power to bring the Scythians to world conquest.

The government recognizing a new, very brutal player with its tentacles in politics and industry, decides to create an ultra-secret task force, TOSH, to take it down. This is led by two retired SEALs.

Hampton Roads is a military stronghold with Naval Base Norfolk, SEAL teams 2, 4, 6, 8 and 10, Oceana Naval Air Station, Langley Air Force Base and Little Creek Amphibious Base. This area is also the birth place of the United States. Williamsburg, Jamestown and Yorktown are in close proximity. Most of the action takes place in Virginia Beach, the most populous city in Virginia and a growing tourist area.
