Donald Trump to Rush Limbaugh: When We Are Beating the Left They Call Us Racist

 

President Donald Trump on Friday defended himself and his supporters against allegations that they were “racist.”

Trump spoke about the left during a virtual radio rally with talk radio legend Rush Limbaugh on Friday, in response to a question from a listener.

“When we are beating them they have nothing else to fall back on but the word racist,” he said. “It means that when you’re winning and you’re just knocking the hell out of them, they have nothing else to say, they call you a racist and this has been going on for decades.”

Trump said he and Limbaugh were constantly accused of being racists by the left, but said that many Americans could see through the political tactic.

“I don’t know that you’re going to stop it, but people are wise to it and people are rolling their eyes now. They’re rolling their eyes.” he said, calling the allegation “disgusting.”

The event was described by the Trump campaign as the “largest virtual rally in radio history” offering the president the opportunity to speak directly to Limbaugh’s audience.

The president spoke to Limbaugh for two hours on the program, even taking a few emailed questions from the audience.

Gov. Cuomo: ‘I Don’t Care’ About Your Religion — ‘You Have to Follow the Rules of the State’

 

Friday, New York Gov. Andrew Cuomo (D) responded to religious groups filing separate federal lawsuits against him over his new restrictions limiting attendance at religious gatherings amid a spike in cases in some New York City neighborhoods.

 

Cuomo told “CNN Newsroom” acknowledged that it is a “complicated” situation because of different cultural aspects, but said that everyone has to “follow the rules,” no matter their religion.

 

“They are not following the rules. We know what happens when you don’t follow the rules: the infection rate goes up,” Cuomo advised. “And it just proves our point from the get-go. We know how to control the virus, but you have to control the virus. You have to be disciplined. And when you don’t follow the rules, it goes up. And that’s what’s happening in these very small clusters. Now, these are religious groups, it tends to get more complicated, frankly, because of some cultural aspects. But that’s what we’re seeing in New York.”

 

“The cluster is a predominantly ultra-orthodox cluster,” he continued. “The Catholic schools are closed because they happen to be in that cluster, but the issue is with that ultra-orthodox community. This is not a matter of religious freedom, right? I don’t care if you’re a Roman Catholic, you’re Jewish, you’re Muslim, you’re an atheist, you have to follow the rules of the state, the laws of the state. And I understand the beliefs of the ultra-orthodox, I’ve been very close to them all my life. I’m a big supporter of theirs, but they have to follow the rules, Jim, because we’re seeing the truth. And the truth is if you don’t follow the rules, the infection rate spreads, people get sick, and then you make others sick. You know, we’re talking about Brooklyn. We’re not talking about a hermetically sealed community in a rural area. This is in the middle of Brooklyn. They will make other people sick.”

Customer review site Yelp debuts 'racism alert' to freeze reviews of pages engulfed in discrimination scandals

 

User-generated review site Yelp has unveiled a ‘racism alert’ feature – an icon that will appear on the pages of businesses accused of discrimination. Reviewing is frozen while the accusations are investigated.

 

Trumpeting its “zero tolerance policy to racism,” the site announced the new feature in a blog post on Thursday, explaining that while it’s great that many users have been using Yelp to air their grievances about businesses behaving in a racist manner, this is sometimes done without “actual first-hand consumer experiences with the business.”

 

The icon, they wrote, is designed to protect both customers and businesses. Appearing beneath a warning exclamation point in a red circle, the alert will pop up when the user navigates to the page of a business “accused of racist behavior,” explaining that the media attention has triggered an influx of negative feedback and reviewing capability has temporarily been frozen. Alerts will include a link to a “news article where they can learn more about the incident.”

 

“As the nation reckons with issues of systemic racism, we’ve seen in the last few months that there is a clear need to warn consumers about businesses associated with egregious, racially-charged actions to help people make more informed spending decisions,” the review platform said in the post. The new feature is an expansion of the previous “Public Attention Alert” warning that Yelp placed on the pages of businesses targeted by “social activism” linked by the company to the Black Lives Matter movement.

 

Since May 26, the day after black Minneapolis man George Floyd’s death reignited BLM, Yelp claimed to have placed over 450 such alerts on businesses either targeted by or accused of racism, a 133 percent rise in “media-fueled instances” of review-bombing. Accompanying the rollout is the release of an “inclusive environment” toolkit for small businesses that don’t have the resources to inflict anti-discrimination training on their employees. It's created in partnership with Open to All – an organization that charges businesses $10 to publicize their anti-discrimination policies with a window decal and a “pledge” to welcome all customers regardless of race, ethnicity, gender, or other protected characteristics.

 

The inclusivity materials include an hourlong “unlearning bias training video for employees,” social media “assets,” and “outreach language for customers and employees.” Yelp strongly hinted that those looking to be inclusive should join the half-million-plus businesses boasting an “Open for All” icon on their pages, lest they be seen as discrimination-loving reactionaries and lose customers, stating “Increasingly, consumers across the US are voting with their dollars by supporting businesses that align with their values.”

The Attorney General’s Office has been notified that some New Hampshire residents have received unidentified mailers containing an absentee ballot application form with an allegedly hand written note. The message on the note states, “You are needed please fill this out and mail it in.” The mailer also contains a return envelope with the recipient’s town or city clerk in the address block.

 

An example of this unidentified mailer is attached. State law requires that a mailing such as this contain the identity of the entity mailing and distributing the form. No such identification accompanies the attached mailer.

Former Commander of Naval Station Guantanamo Bay Sentenced to Prison

 

A former Commander of Naval Station Guantanamo Bay (GTMO) was sentenced to 24 months in federal prison following his multiple convictions of obstructing justice and making false statements, in connection with the death of a civilian at the naval base.

 

Following a five- day trial, on Jan. 17, 2020, a federal jury in the Middle District of Florida convicted Captain John Nettleton, 53, of Jacksonville, Florida, of two counts of obstruction of justice, one count of conealment of material facts, one count of falsification of records, and two counts of making false statements, all related to his actions during the Navy’s investigation of the death of Christopher M. Tur, the Loss Prevention Safety Manager at GTMO’s Naval Exchange.

 

Nettleton was sentenced by U.S. District Judge Timothy J. Corrigan who also ordered Nettleton to serve one year of supervised release.

 

Tur, 42, was found drowned in the waters of Guantanmo Bay on Jan. 11, 2015. An autopsy revealed that Tur had suffered injuries prior to his drowning. At the time of Tur’s death, Nettleton was the commanding officer of GTMO.

 

“Nettleton misled and obstructed the investigators attempting to determine what happened to Mr. Tur, and this sentence ensures that he will pay a heavy price,” said Acting Assistant Attorney General Brian C. Rabbitt of the Justice Department’s Criminal Division. “That price, however, pales in comparison to that paid by the family of Mr. Tur, whose pain was compounded by Nettleton’s actions. The Department of Justice was proud to work closely with the Naval Criminal Investigative Service (NCIS) to hold Nettleton accountable for his obstruction, concealment, and false statements.”

 

“By deliberately misleading NCIS in the search for Mr. Tur and the ensuing investigation into the circumstances of his death, Captain Nettleton delayed justice and wasted valuable Department of the Navy resources,” said Special Agent in Charge Thomas Cannizzo of the NCIS Southeast Field Office. “NCIS is dedicated to holding accountable those who unlawfully impede investigations."

The Circle Is Complete: BOJ Joins Fed And ECB In Preparing Rollout Of Digital Currency

 

First it was the Fed, then the ECB, and now the BOJ: the world's central banks are quietly preparing to unleash digital currencies on an unsuspecting population in one final last-ditch attempt to spark inflation and do away with the current monetary orthodoxy which has failed to push living conditions for the masses higher (but most importantly, has failed to inflate away a growing mountain of insurmountable global debt).

 

On Friday, the Bank of Japan joined the Fed and ECB when it said it would begin experimenting on how to operate its own digital currency, rather than confining itself to conceptual research as it has to date.

 

Digitalization has advanced in various areas at home and abroad on the back of rapid development of information communication technology. There is a possibility of a surge in public demand for central bank digital currency (CBDC) going forward, considering the rapid development of technological innovation. While the Bank of Japan currently has no plan to issue CBDC, from the viewpoint of ensuring the stability and efficiency of the overall payment and settlement systems, the Bank considers it important to prepare thoroughly to respond to changes in circumstances in an appropriate manner.

 

The bank explained that it might provide general purpose CBDC if cash in circulation drops "significantly" and private digital money is not sufficient to substitute the functions of cash, while promising to supply physical cash as long as there is public demand for it

 

The move, as Reuters reports, came in tandem with an announcement by a group of seven major central banks, including the BOJ, on what they see as core features of a central bank digital currency (CBDC) such as resilience and a clear legal framework. It also falls in line with new Japanese Prime Minister Yoshihide Suga’s focus on promoting digitalization and administrative reform to boost the country’s competitiveness.

 

In a report laying out its approach on CBDC, the BOJ said it will conduct a first phase of experiments on basic functions core to CBDCs, such as issuance and distribution, early in the fiscal year beginning in April 2021. The experiments will be part of the BOJ’s efforts to look more closely into how it can issue general-purpose CBDCs, intended to be used widely among the general public including companies and households.

 

Naturally, to avoid sparking a panic that paper money is on its way out - and thus prompt the population to hoard it - the BOJ said that CBDCs "will complement, not replace, cash and focus on making payment and settlement systems more convenient." However, how exactly it is "more convenient" for the central bank to be able to remotely extinguish any amount of money in one's digital wallet without notice, remains a mystery.

 

Unlike the Fed, the BOJ plans to have financial institutions and other private entities serve as intermediaries between the central bank and end users, rather than have companies and households hold deposits directly with the BOJ.

 

“While the BOJ currently has no plan to issue CBDC … it’s important to prepare thoroughly to respond to changes in circumstances,” the report said.

More than 1,000 AI scanners are monitoring how close pedestrians get to each other in London, Manchester and other British cities to supply the government with data on social distancing.

 

The sensors were initially intended to track the flow of traffic, cyclists and walkers to work out how roads were being used, but after lockdown in March were fitted with the new feature.

 

Manufacturers Vivacity said the data is used to 'inform policy decisions', and in response to privacy concerns said that none of the footage is saved, streamed or used for enforcement purposes. Its CEO Peter Mildon told BBC Radio Kent: 'They are not recording any footage, they are not streaming any footage and no one is actually watching it,' he said.

'We're creating a set of statistics on how behaviour is changing in terms of how people are staying close together or apart.

  1. Do the so-called anti-corona measures, such as the lockdown, mandatory face masks and quarantine regulations serve to protect the world´s population from Corona? Or do these measures serve only to make people panic so that they believe – without asking any questions – that their lives are in danger, so that in the end the pharmaceutical and tech industries can generate huge profits from the sale of PCR tests, antigen and antibody tests and vaccines, as well as the harvesting of our genetic fingerprints?

 

  1. Is it true, or does the evidence show that the German government was massively lobbied – more so than any other country – by the chief protagonists of this so-called Corona pandemic – German professors Drosten of the Charité hospital in Berlin, and Wieler of the German equivalent of the CDC, the Robert Koch Institute, short: RKI and Mr. Tedros, head of the WHO – because Germany, known as a particularly disciplined country, were chosen by these protagonists and their handlers as a role model for their strict, and, of course, successful adherence to the corona measures?

Facebook removes 276 fake accounts tied to right-wing group Turning Point Action after they were used to pose as conservative Americans commenting on articles in favor of Trump

 

Facebook has removed 276 accounts that used fake profiles to pose as right-leaning Americans and comment on news articles, often in favor of President Donald Trump, the company said on Thursday.

 

The platform said in a statement that it had linked the bogus accounts to Rally Forge, a US marketing firm working on behalf of Turning Point USA, a conservative student group.

 

In a statement to DailyMail.com, Turning Point USA said that Facebook's announcement was actually in reference to Turning Point Action, which it called 'an entirely separate entity.'

 

Turning Point USA and political action committee Turning Point Action were both founded by conservative activist Charlie Kirk.

 

In a statement, Turning Point USA said that Turning Point Action always works hard to operate within social media terms of service on all of its projects, and hopes to work closely with Facebook to 'rectify any misunderstanding.'

 

Facebook said it had permanently banned Rally Forge, the Arizona-based digital communications firm that it said was behind the fake accounts.

 

The move was prompted by reporting last month in the Washington Post that Turning Point Action was paying teenagers to post coordinated messages, a violation of Facebook's rules.

 

At the time, Kirk issued a statement from TPA's field director defending the social media campaign and saying any comparison to a troll farm was a 'gross mischaracterization.'

 

'This is sincere political activism conducted by real people who passionately hold the beliefs they describe online, not an anonymous troll farm in Russia,' the field director, Austin Smith, said in the statement.

 

Facebook removed 200 accounts and 55 pages at the social network and 76 Instagram accounts it said were part of the deception campaign and violated policy against coordinated inauthentic behavior

US, France, Russia Meet to Discuss Nagorno-Karabakh as Fighting Continues

 

Clashes that started on September 27th continue, over 400 reported killed

 

Fighting continued between Armenia and Azerbaijan in the disputed enclave of Nagorno-Karabakh on Thursday as representatives from the US, Russia, and France met to discuss the conflict. Over 400 people have been reported killed in the 12 days of fighting, including dozens of civilians on both sides

 

Azerbaijan’s foreign minister was due to attend the talks in Geneva on Thursday. Armenian Foreign Minister Zohrab Mnatsakanyan is expected to hold separate talks in Moscow on Monday with officials from the US, Russia, and France. So far, no direct talks between Azerbaijan and Armenia have been scheduled.

 

Baku said the city of Ganja had come under fire on Thursday, which is deep inside Azerbaijan’s territory. A cathedral in the town of Shusha in Nagorno-Karabakh was hit on Thursday, and several journalists were injured. Armenia said Azeri forces hit the cathedral, but Azerbaijan denied involvement.

 

Washington, Paris, and Moscow co-chair the Minsk Group, which was set up in 1992 by the Organization for Security and Cooperation in Europe to promote negotiations and peace talks over Nagorno-Karabakh. The three countries have called for a ceasefire since the fighting broke out on September 27th.

 

Russian Prime Minister Mikhail Mishustin spoke to his Azeri counterpart on the phone Thursday and called for “the swift stabilization of the situation … a halt to military action and the relaunch of the negotiation process.”

 

Russia and Armenia are members of the Collective Security Treaty Organization (CSTO), a defense alliance made up of six post-Soviet states. The head of the CSTO, Stanislav Zas, said the alliance would come to the aid of Armenia if its sovereignty was threatened.

 

But Zas does not believe the fighting will spread that far. “I don’t think Azerbaijan or Armenia need the conflict to flare up to regional level, nor is that in the interests of any other country,” he said. Zas also expressed concern over reports of Turkey sending fighters from northern Syria to Nagorno-Karabakh to support Azerbaijan.

 

Nagorno-Karabakh is an ethnic Armenian enclave within the internationally recognized borders of Azerbaijan. The collapse of the Soviet Union turned the border dispute deadly, and tens of thousands were killed until a ceasefire was reached in 1994. Since then, Nagorno-Karabakh has operated as a de facto independent state with Armenian support.

 

The latest clashes are the heaviest fighting Nagorno-Karabakh has seen since the ceasefire was declared in 1994.

Commander at Lewis-McChord Base Hospital Is Suspended, Under Investigation

 

AUSTIN, Texas – Col. Christopher H. Warner was suspended from his duties as commander of Madigan Army Medical Center at Joint Base Lewis-McChord, Washington, after less than three months on the job, base officials confirmed Thursday.

 

Warner's suspension went into effect Oct. 2 and was triggered by "an investigation that is unrelated to Madigan or its personnel," said Lt. Col. Neil Penttila, spokesman for I Corps, which oversees the base. Army Criminal Investigation Command is leading that investigation.

 

"We can provide a further update upon completion of the investigation," he said.

 

Madigan, with 220 beds for in-patient care, is the second largest treatment facility in the Army and one of only two designated Level II trauma centers in the service, according to the hospital website. Col. Scott B. Roofe, Madigan's deputy commander, is acting commander in the interim.

 

"Col. Roofe will ensure there is minimal impact on the hospital's mission and operations," Penttila said.

 

Warner, a medical doctor, took command of the base hospital on July 15, according to an Army news release about the ceremony. During the event, Lt. Gen. R. Scott Dingle, the Army surgeon general and commander of Army Medical Command, described Warner as a "phenomenal leader."

 

Warner is from Toronto, Ohio, and commissioned as a Medical Service Corps officer upon graduation from the U.S. Military Academy at West Point in 1996, according to the Army release. He then graduated from the Uniformed Services University of Health Sciences in 2000. He is certified by the American Board of Psychiatry and Neurology and the American Board of Family Medicine.

 

Before taking command at Madigan, he served as the military deputy and chief of staff for the assistant secretary of defense for health affairs at the Pentagon. Warner has also served as the commander of Winn Army Community Hospital in Fort Stewart, Georgia. His deployments include two rotations to Iraq in support of Operation Iraqi Freedom.

 

Madigan Army Medical Center includes a network of Army medical facilities located in Washington and California that serve more than 100,000 active-duty service members, their families and retirees, according to its website. It provides general medical and surgical care, patient-centered adult and pediatric primary care, a 24-hour emergency room, specialty clinics, behavioral health and wellness services.

 

Each day, Madigan performs more than 45 surgeries, fills nearly 4,000 prescriptions, and delivers eight babies, according to its website.

ATF Reversal Could Turn Millions of Gun Owners into Felons

 

NRA calls on Trump to rein in 'rogue' regulators

 

A declaration from the Bureau of Alcohol, Tobacco, Firearms, and Explosives could leave millions of American gun owners in serious legal jeopardy.

 

In a letter made public on Tuesday, the agency informed a New Hampshire gun company that its AR-15 pistol model equipped with a specialized brace is actually an illegal short-barreled rifle and anyone who owns one could be subject to up to 10 years in prison or $100,000 in fines. Industry insiders put the number of AR-15 pistols equipped with similar specialized braces at about 3 million.

 

The decision appears to conflict with several similar determinations made by the ATF dating back to 2012, when the agency told Sig Sauer that the braces, designed to strap to a shooter's forearm instead of being pressed against their shoulder, could be legally combined with guns that have barrels shorter than the 16-inch federal limit for rifles. The new letter calls into question the basic legality of the devices and leaves gun owners in flux just three weeks before the presidential election.

 

Carolyn Gwathmey, the public affairs officer for the ATF, said the letter only directly applies to the New Hampshire gun company's pistol, but neither she nor the letter offered an explanation for why that model differs from other weapons equipped with the braces. She said the agency would not offer a standard of review of the devices as a whole, but only on a case-by-case basis.

 

"Regarding other firearms or manufacturers, ATF cannot comment until we see the platform and what accessories may be attached to said platform," Gwathmey told the Washington Free Beacon.

 

White House deputy press secretary Brian Morgenstern said the Trump administration is reviewing the ATF's letter.

 

"The White House and leadership at the Department of Justice are reviewing this matter to ensure there is no interference with the ability of law-abiding citizens—including lawful firearms manufacturers—to exercise their constitutionally guaranteed liberties," he told the Free Beacon.

 

Gun-rights groups are pressuring the administration to rein in the ATF.

 

The National Rifle Association attacked the agency's move as "arbitrary, inequitable, and incorrect." The group said it was also in contact with DOJ and Trump administration officials and trying to work through how the change could be made. Amy Hunter, a spokeswoman for the NRA, told the Free Beacon the group is "exhausting all options to overturn this unjust and rogue action by ATF."

 

The NRA, which has committed to spending "tens of millions" on President Donald Trump's behalf in 2020 after spending big to help elect him in 2016, said the ATF's new position is a threat to the Second Amendment.

The couple has faced immense scrutiny since their move to the US, drawing even Trump's ire. Clare Bronfman Files Notice of Appeal of Her Sentence

 

It is not unexpected.

 

Clare Bronfman, through her attorney Ronald Sullivan, has filed a notice of appeal.

 

“Notice is hereby given that Clare Bronfman hereby appeals to the United States Court of Appeals for the Second Circuit from the sentencing judgment of 81 months’ imprisonment entered in this action on the 30th day of September 2020,” the filing says.

 

No details of the arguments Bronfman intends to make is given in the notice.

 

She was sentenced by Judge Nicholas G. Garaufis to 81 months, three times the upper range of the federal sentencing guidelines. In a lengthy sentencing memorandum, which he read at her sentencing hearing on September 30, the judge explained his reasons for the harsh sentence.

One of the issues that almost certainly will be raised in Bronfman’s sentencing appeal is that she objected to many conclusions in her Pre-Sentence Report (PSR) and requested a Fatico hearing so she could have an opportunity to challenge this errors. The judge denied her request, then sentenced her to triple the maximum of the sentencing guidelines based, in part, on the contents of the PSR.

 

Alleged crimes for which she did not plead guilty to were described in the Pre-Sentencing Report – and the judge certainly considered at least some of them in determining Clare’s sentence. Although a judge must “consider” the sentencing range set forth in the sentencing guidelines, the judge is not bound by it.

Russian President Vladimir Putin called the ongoing military face-off in disputed Artsakh (Nagorno-Karabakh) “a tragedy” and indicated his willingness to honor Russia’s long-standing mutual defense treaty with Armenia, if the country required such help.

 

Speaking to the Rossiya TV network, Putin noted that two million Azerbaijanis and over two million Armenians live in Russia, and that a huge number of Russian citizens maintain “close, friendly and even familial relations with both republics”.

 

“This is a tragedy,” the president said, adding, “We are very worried, because Azerbaijan, Armenia, and Nagorno-Karabakh are all territories inhabited by people who are not strangers to us.”

 

Although Russia acts in an official capacity as a meditator of the Armenian-Azerbaijani conflict, Yerevan and Moscow are officially allied as part of the Collective Security Treaty Organization (CSTO), along with Belarus, Kazakhstan, Kyrgyzstan and Tajikistan. According to the organization’s agreement, aggression against one CSTO member is perceived as aggression against all.

 

Therefore, if Azerbaijan attacks Armenia territory, Russia is legally obliged to help Armenia.

 

“As you know, Armenia is a member of the CSTO, and we have certain obligations to Armenia under this agreement,” Putin explained, stating, “To our great regret, the fighting is still going on, but it is not being conducted on the territory of Armenia.”

 

The president noted that Russia will continue to fulfill all of its obligations under the mutual defensive treaty, and has urged Yerevan and Baku to agree on a ceasefire.

 

Along with US President Donald Trump and French President Emmanuel Macron, Putin last week called for “an immediate cessation of hostilities between the relevant military forces”. Russia, the US, and France are chairs of the OSCE Minsk Group, which is tasked with ending the Armenian-Azerbaijani conflict.

 

The dispute between Azerbaijan and Armenia is decades old, with both countries believing they have strong claims over Nagorno-Karabakh. Officially, the region is internationally recognized as part of Azerbaijan, but it has primarily been populated by ethnic Armenians for thousands of years. Baku, on the other hand, considers the area to be “illegally occupied by Armenia”. In the past fortnight, the war has again flared up.

Democrats Outpace Republicans In Early Voting

 

Over 6 million Americans across 27 states have already cast their vote for November's general election -more than 10 times the number who had voted at this time in 2016, according to the Untied States Elections Project, which compiles early voting data.

 

Of those, over two million ballots have been sent through the mail, with registered Democrats returning 1.4 million ballots vs. 653,000 from registered Republicans, according to University of Florida political scientist, Michael McDonald.

 

"We’ve never seen this many people voting so far ahead of an election," McDonald said earlier this week, according to Reuters. "People cast their ballots when they make up their minds, and we know that many people made up their minds long ago and already have a judgment about Trump."

 

The early surge has led McDonald to predict a record turnout of about 150 million, representing 65% of eligible voters, the highest rate since 1908.

McDonald said early voting typically starts strong, then drops before surging just ahead of the election. But in some states, rates of participation already have skyrocketed a month out. -Reuters

 

Overall, around 3.7 million of those who have already voted (around two-thirds) live in states which do not register voters by party, or are unaffiliated with either party. But according to demographic modeling by Democratic firm TargetSmart, 3 million votes have come from Democrats, while 2.1 have come from Republicans, according to The Hill.

 

That said (and it's a big one), early vote tallies aren't a solid indicator of who will win, as Hillary Clinton was trouncing Trump in early voting four years ago - though this year, early leads by Democrats are more substantial than in 2016.

 

In Florida, registered Democrats had out-voted registered Republicans by a slim 37 percent to 35 percent margin by this point in 2016. Today, almost 53 percent of votes cast in Florida have come from registered Democrats, while Republicans account for just 28 percent.

 

In North Carolina, registered Democrats have cast 52 percent of all ballots so far, up from 36 percent four years ago. Registered Republicans account for just 17 percent of the ballots, down from 37 percent in 2016.

China readies new law to ban companies on national security grounds

 

BEIJING – China is set to advance a new export control law that would ban Chinese suppliers from dealing with specific foreign companies on national security grounds, taking a page from the U.S. crackdown on Huawei Technologies and its peers. The Standing Committee of the National People's Congress will deliberate on the legislation, which has a stated goal of protecting national interests, in a session starting Tuesday. The new law could be enacted as early as 2021.

 

The bill uses the same national security arguments that the Trump administration has adopted in measures to isolate Chinese companies, including last month's de facto ban on exports to Huawei of semiconductors built using American technology. China has pushed back against the measures, slamming the U.S. for using national security as an excuse to pressure businesses. Under Beijing's new legislation, authorities could ban exports of strategic materials and advanced technology to specific companies on its equivalent of the U.S. Department of Commerce's Entity List.

 

Such a blacklist would likely include American corporations, further stoking tensions between the U.S. and China. But companies in Japan and other countries could also face a risk if they abide by U.S. export restrictions on China. "Japanese companies have no choice but to follow U.S. export rules, but there's a non-zero chance that will be seen as hurting China's national security," according to the Center for Information on Security Trade Control in Tokyo.

China's Ministry of Commerce first published a draft of this legislation in June 2017. The NPC Standing Committee has deliberated on the text in December 2019 and at the end of June.

 

The new law would designate specific products, technologies and services to be protected under the export curbs. Chinese companies that export items on this list would be required to submit documentation to Chinese authorities on their clients and the intended use of the products and services. The authorities would decide whether to approve the exports based on their impact on national security, potential for military use and the receiving clients. The list of materials protected under the new law "could include rare-earth elements, for China holds a more than 60% share of production," a person familiar with the matter said.

 

China has used trade as a diplomatic tool before, such as when it froze rare-earth shipments to Japan amid heightened tensions over the Japanese-administered Senkaku Islands, claimed by China as the Diaoyu Islands. There is concern that the new export controls could deal an unexpected blow to companies across global supply chains. For example, China produces almost all of the world's dysprosium, a rare-earth element used in magnets for electric cars. According to official Chinese data, 72% of its exports in 2018 went to Japan.

 

Japanese companies use the material to produce magnets, which they sell to clients around the world. Under the new law, China might restrict their supply if one of their U.S. clients were blacklisted. Japan relies on imports from China for 62% of its drones and 52% of its semiconductor devices, according to Daiwa Research Institute. In terms of materials, China supplies roughly 90% of Japan's magnesium - used in alloys for auto parts – and barium carbonate, an ingredient in the capacitors produced by top electronics suppliers like Murata Manufacturing.

 

The new legislation would also include a clause that allows China to hold companies liable for violating its export curbs even outside the country, though the specifics of this remain unclear.
