Judge Blocks Certification of Pennsylvania Election Results

 

A Pennsylvania judge on Wednesday ordered state officials to not certify the results of the 2020 election until her court holds a hearing on an election contest on Friday. Commonwealth Judge Patricia McCullough ordered the state to not take any further steps to complete the certification of the presidential race, which the state announced on Tuesday. She also blocked the certification of all the other election results. “To the extent that there remains any further action to perfect the certification of the results of the 2020 General Election for the offices of President and Vice President of the United States of America, respondents are preliminarily enjoined from doing so, pending an evidentiary hearing to be held on Friday,” the judge wrote in her order. “Respondents are preliminarily enjoined from certifying the remaining results of the election, pending the evidentiary hearing.”

 

McCullough is presiding over a lawsuit brought by Republican lawmakers and candidates against the Commonwealth of Pennsylvania, Democratic Gov. Tom Wolf, Secretary of State Kathy Boockvar, and the Pennsylvania General Assembly. The plaintiffs alleged that Pennsylvania’s vote-by-mail stature—Act 77—is in violation of the state’s constitution. “Act 77 is the most expansive and fundamental change to the Pennsylvania voting code, implemented illegally, to date,” the lawsuit, filed in the Commonwealth Court of Pennsylvania, states. “As with prior historical attempts to illegally expand mail-in voting by statute, which have been struck down going as far back as the Military Absentee Ballot Act of 1839, Act 77 is another illegal attempt to override the limitations on absentee voting prescribed in the Pennsylvania Constitution, without first following the necessary procedure to amend the constitution to allow for the expansion.” The plaintiffs include Rep. Mike Kelly (R-Pa.), Republican congressional candidate Sean Parnell, and Pennsylvania House of Representatives candidate Wanda Logan. The office of Gov. Wolf did not respond to a request for comment. It is unclear what steps remained as of Wednesday morning to “perfect” the certification of the presidential and vice-presidential races.

 

After the Keystone State announced the certification of the presidential election results on Tuesday, the plaintiffs filed an emergency request just before midnight, arguing that there was no need to act so fast. In 2016, Pennsylvania certified the presidential election on Dec. 12. “It appears that respondents’ actions may have been accelerated in response to the application for emergency relief … in an effort to preclude any remedial action by this court faster than this court was able to evaluate the application for emergency relief and the answers to it,” the plaintiffs wrote. The emergency request underlined that while Pennsylvania completed vote-counting and submitted the signed certification to the U.S. archivist, a number of steps still remain for the formal certification process to be completed. “While Respondents may have proactively attempted to avoid potential injunctive relief granted by this Court, Respondents duties with regard to finalization of the full election results are far from complete,” the filing states.

 

Marc Elias, one of the top attorneys leading the Democrats’ post-election legal battles, called the lawsuit frivolous. “Republican Congressman Mike Kelly has filed a new frivolous lawsuit in Pennsylvania seeking to block the state from certifying the election results and having the state legislature choose electors,” Elias wrote on Twitter on Nov. 21. “This is absolutely shameful.” President Donald Trump responded to Elias, writing: “This is not at all frivolous. It is brought on behalf of one of the most respected members of the United States Congress who is disgusted, like so many others, by an Election that is a fraudulent mess. Fake ballots, dead people voting, no Republican Poll Watchers allowed, & more!” Wolf signed Act 77 into law on Oct. 31, 2019. Eight of the nine sponsors of the bill in the Pennsylvania Senate were Republicans.

Not sure if Barr is black hat or white hat but one thing that has made me raise an eyebrow is Barr's over the top public defense of trump a few months ago, as if he was trying to get Trump to trust him. AG should be much more subtle.

Second Amendment Under Threat After New Third Circuit Decision

 

The Third Circuit has issued an opinion that has received little attention over the right to bear arms, but it should. The decision in Folajtar v. The Attorney General of the United States may be one of the most perfectly tailored case for major Supreme Court decision. Indeed, the only thing lacking from the 2-1 decision is a mailing label directly to Justice Amy Coney Barrett.

 

In ruling that a non-violent tax conviction can result in the denial of gun ownership, the panel presents a clean case to further define the contours of the individual rights recognized in District of Columbia v. Heller, 554 U.S. 570 (2008).

 

The Third Circuit case concerns Lisa Folajtar who was denied the right to own a firearm. The reason was her pleading guilty in 2011 to willfully making a materially false statement on her tax returns. The plea led to a sentence of three-years’ probation, including three months of home confinement, a $10,000 fine, and a $100 assessment. She also paid the IRS over $250,000 in back taxes, penalties, and interest.

 

The case falls into the still grey area around the individual right articulated in 2008. The Supreme Court recognized that this is not an “unlimited” right under the Constitution while affirming the right of “law-abiding, responsible citizens to use arms in defense of hearth and home.” Id. at 635. Moreover, the Court ruled two years later that Heller “did not cast doubt on such longstanding regulatory measures as ‘prohibitions on the possession of firearms by felons.’” McDonald v. City of Chicago, 561 U.S. 742, 786 (2010) (quoting Heller, 554 U.S. at 626–27).

 

The question is whether this means any and all felons, even those never accused of violent acts. The law at issue is 18 U.S.C. § 922(g)(1). Originally, in 1938, the Congress prohibited only gun ownership to those who were convicted of “crimes of violence.” See Omnibus Crime Control and Safe Streets Act of 1968, Pub. L. No. 90-351, tit. IV, § 925, 82 Stat. 197, 233–34; id. at tit. VII § 1202, 82 Stat. at 236 (codified at 28 U.S.C. § 922(g)(1)). That limited the denial of gun ownership to those convicted of murder, manslaughter, rape, mayhem, kidnapping, burglary, housebreaking and various types of aggravated assault. See Federal Firearms Act, ch. 850, § 1(6), 52 Stat. 1250, 1250 (1938).

 

That changed in the 1960s when Congress expanded the bar on gun ownership. That however was long before the Heller decision recognized gun ownership as an individual constitutional right.

 

Judge Thomas Ambro wrote the majority opinion with the support of Judge Cheryl Ann Krause. Judge Stephanos Bibas dissented. Ambro was appointed by President Bill Clinton and Krause by President Barack Obama. Bibas was appointed by President Donald Trump.

 

The majority viewed this determination as appropriately within the discretion of Congress and notes that other core rights can be lost by a felony conviction:

 

“Indeed, we defer to the legislature’s determination that individuals convicted of felonies may forfeit other fundamental rights, such as the right to vote and to sit on a jury, the former being the essence of our democracy. See 28 U.S.C. § 1865(b)(5); Richardson, 418 U.S. at 56; see also Reynolds v. Sims, 377 U.S. 533, 555 (1964) (“The right to vote . . . is of the essence of a democratic society, and any restrictions on that right strike at the heart of representative government.”). As felons are rarely protected by the Second Amendment, Congress is also normally entitled to require disarmament as a result of a felony conviction without engaging in an evaluation of each felon’s rehabilitation and likelihood to engage in further criminal activity of any kind. See Medina, 913 F.3d at 160–61. Accordingly, Congress has the flexibility to decide which crimes are captured by § 922.”

The campaign began with Sherman's troops leaving the captured city of Atlanta on November 15 and ended with the capture of the port of Savannah on December 21.

 

His forces followed a "scorched earth" policy, destroying military targets as well as industry, infrastructure, and civilian property, disrupting the Confederacy's economy and transportation networks. The operation broke the back of the Confederacy and helped lead to its eventual surrender. Sherman's decision to operate deep within enemy territory and without supply lines is considered to be one of the major campaigns of the war, and is considered by some historians to be an early example of modern total war.

 

Sherman's "March to the Sea" followed his successful Atlanta Campaign of May to September 1864. He and the Union Army's commander, Lt. Gen. Ulysses S. Grant, believed that the Civil War would come to an end only if the Confederacy's strategic capacity for warfare was decisively broken.[4] Sherman therefore planned an operation that has been compared to the modern principles of scorched earth warfare. Although his formal orders (excerpted below) specified control over destruction of infrastructure in areas in which his army was unmolested by guerrilla activity, he recognized that supplying an army through liberal foraging would have a destructive effect on the morale of the civilian population it encountered in its wide sweep through the state.[5]

 

The second objective of the campaign was more traditional. Grant's armies in Virginia continued in a stalemate against Robert E. Lee's army, besieged in Petersburg, Virginia. By moving in Lee's rear, Sherman could possibly increase pressure on Lee, allowing Grant the opportunity to break through, or at least keep Southern reinforcements away from Virginia.

 

The campaign was designed by Grant and Sherman to be similar to Grant's innovative and successful Vicksburg Campaign and Sherman's Meridian Campaign, in that Sherman's armies would reduce their need for traditional supply lines by "living off the land" after consuming their 20 days of rations. Foragers, known as "bummers", would provide food seized from local farms for the Army while they destroyed the railroads and the manufacturing and agricultural infrastructure of Georgia. In planning for the march, Sherman used livestock and crop production data from the 1860 census to lead his troops through areas where he believed they would be able to forage most effectively.[6] The twisted and broken railroad rails that the troops heated over fires and wrapped around tree trunks and left behind became known as "Sherman's neckties". The mask mandates are a form of compelled expression. First, as political expression of political sentime - fealling, fear. People are being coerced to express this sentiment; doing so sends a message to fellow citizens many of whom would concur with dissent that is then disguised behind the mask-wearing.

 

But also this is compelled religious expression and even a form of 'worship'. The justification for the mask mandate is that the community well-being is a higher priority than individual or group rights. But the requirment, constitutionally, is that this be balance such that the restrictive measure is narrowly tailored and is limited by due process and equal protection. However, at its root, the mandate is not scientific, the evidence shows it is not effective in stopping the spread in the community, and as such is neither narrowly tailored nor implemented under equal protection and due process. You are coerced and due process is pushed aside. The basic mandate is one imposing a quasi-religious or more starkly a superstitious ritual.

 

Thus your well-being is under assault by the mask mandate. It walks all over constitutional rights, including freedom of religion and conscience rights.

 

Plus there is a sound argument, difficult to make under duress, that there is an assault on the physical well-being of THE INDIVIDUAL and of THE COMMUNITY. Unfortunately, it is on this basis that most people attempt to resist the mandate.

 

Look after your rights. GUARD the rights of those who dissent with the official government desire compel expression of political sentiment and exercise of quasi-religious - or superstitutous - rituals.

Errors, ‘Scams’ Led California To Send Millions In COVID Unemployment Benefits To Prisoners, Death Row Inmates

 

In what a group of California District Attorneys is calling “the most significant fraud on taxpayer funds in California history,” a possible $1 billion in taxpayer-funded COVID unemployment benefits went to convicted murderers, rapists, and death row inmates in the California prison system. The Los Angeles Times reports that the “pandemic relief system administered by the state Employment Development Department” issued checks to hundreds of incarcerated individuals, including high-profile convicted murderer Scott Peterson. “Nine district attorneys across California and a federal prosecutor on Tuesday made these allegations and called for Gov. Gavin Newsom to intervene to stop such unemployment swindling in California jails and prisons,” the outlet reported, noting that the money went to prisoners, who are ineligible for unemployment relief — including COVID unemployment relief — through “fraud that involves identity theft of prisoners as well as alleged scams by individual inmates and organized gangs to game the state system.”

 

So far, investigators have officially discovered at more than $100 million in misdirected funds, but the attorneys who signed Tuesday’s letter say they believe that once a full investigation has concluded, the losses could total around $1 billion. “So far, investigations have uncovered more than $400,000 in state benefits paid to death row inmates, and more than $140 million to other incarcerated people in California’s 38 prisons, according to Sacramento County Dist. Atty. Anne Marie Schubert, who helped organize and lead a task force that uncovered the alleged dupery,” the LA Times notes. “In total, payments to those ineligible due to incarceration in prisons and jails could total nearly $1 billion, the prosecutors claim.” In one county alone, prosecutors anticipate more than $10 million in misdirected funds — enough that they’re calling on Newsom to take immediate action. “Kern County Dist. Atty. Cynthia Zimmer, whose district has five prisons, the most of any county in California, called the scope of the scams shocking. Zimmer said her office had found about $16 million in allegedly fraudulent claims in her county alone,” the L.A. Times reports. One facility — Pleasant Valley State Prison — is home to around 850 questionable claims, potentially totaling $3.6 million in appropriated taxpayer funds.

 

It’s not clear how much of the unemployment money was stolen, the attorneys say, because there are several schemes involved, and there are individual families, unaffiliated with any larger effort, who may have applied for COVID relief money on behalf of incarcerated relatives — a form of identity theft. California Governor Gavin Newsom, already under fire for his handling of the coronavirus pandemic, tried to quash concerns about the fraud in a statement Tuesday, pledging to appoint a statewide task force to investigate, but some state officials noted that there are so many Californians in need of unemployment assistance as a result of continued lockdowns, that the problem may be too big to manage — and Newsom’s efforts may be too late. “To expedite and strengthen these efforts I have directed the Office of Emergency Services to stand up a task force to coordinate state efforts and support investigations by local District Attorneys,” Newsom said. “We will continue to fully partner with law enforcement and direct as many resources as needed to investigate and resolve this issue speedily. While we have made improvements, we need to do more. Seen them 35 or more times + CRB. Chris can def be a dick, but their music kills. I read Steve Gormans book….afterwords hoped they'd never reuinite….wasn't a month later they were buddies again touring for cash (and not long after Neal Casal "suicided"). Still find that troubling and hard to believe. No note I know of. And the last CRB album had occult symbolism. Pyramid/sun. "Servants to the Sun". Only one I haven't listened to yet.

 

Dunno how familiar you are, but nobody seemed to ask questions…just the usual mental health woes when Neal hung himself (or didn't?). He always seemed happy and humble when I saw him.
