Why Big Tech deplatforming should be deeply disturbing for everyone, regardless of your politics

The solution: strong antitrust laws and people willing to enforce them

Stronger legislation is needed so that businesses can feel confident that a monopolist won’t unfairly undermine them and regulators can step in to ensure that Big Tech follows rules that ensure a fair and open internet.

 

However, the real solution is to eliminate the monopolies altogether. Progress is being made, and there are things you can do to fight back:

 

While it is not perfect, we support the European Union’s proposal, the Digital Markets Act. If vigorously and swiftly enforced, it could effectively curb Google’s and the other monopolists’ anticompetitive behavior. If you live in Europe, write or call your MEP and tell them you are in favor of a strong DMA.

And we are encouraged by the dozens of US state attorneys general who have filed suit against Google, Facebook, and other Big Tech companies for antitrust violations. If you live in the United States, write or call your elected representatives and tell them you are in favor of strong antitrust investigations into Big Tech.

Finally, you can choose to do business with companies and organizations that respect your privacy and freedom.

We must hold our elected representatives accountable for defending our interests, as opposed to Big Tech’s interests. If we fail to do so, we will only have ourselves to blame when tech giants continue to put profits over fundamental human rights.

 

We can make the internet free and fair once more, but there is not a moment to spare. This is not just a fight to rein in monopolies and allow innovation and the markets to flourish; It is a fight to preserve democracy.

A AAAS statistician testified early this week in the war crimes trial

against former Yugoslav president Slobodan Milosevic. In the face of a

combative cross-examination by Milosevic, who is serving as his own

attorney, Patrick Ball, deputy director of the AAAS Science and Human

Rights Program , defended his 67-page analysis of data that suggests that

from March through June 1999, Yugoslav forces carried out a systematic

campaign of killing and expulsions of Kosovar Albanians that led to the

deaths of more than 10,000 people. Ball's testimony seems to rule out other

potential causes that had been proposed by Milosevic and his defenders –

that the dead had been killed by members of the Kosovo Liberation Army

(KLA) or during NATO air attacks.

 

"The findings of this study are consistent with the hypothesis that action

by Yugoslav forces was the cause of the killings and the refugee flow,"

Ball and his co-authors wrote in their report to the tribunal, Killings and

Refugee Flow in Kosovo: March-June 1999. "Killings were used either to

motivate the departures, or the killings were a result of the campaign."

 

Interviews, Exhumation Records Among Data Sources

 

To produce their report, Ball and his co-authors analyzed data on Kosovar

refugees from the registries of Albanian border guards in the Albanian

village of Morina, and complemented it with the records of other Albanian

governent agencies and the U.N. High Commission for Refugees. The data on

killings were drawn from exhumation records, and from interviews with

refugees conducted by the Human Rights Watch, the Organization for Security

and Cooperation in Europe and the American Bar Association's Central and

East European Law Initiative, co-sponsor with AAAS of the Ball report. Ball

explains that the data on killings and refugee flows, based on 15,000

interviews and exhumation records, reveal that both seemed to occur in the

same place, at the same time, and in distinct surges that suggest "the

existence of an external cause."

 

Patterns in Refugee Flow and Killings

 

"When the overall estimates are compared at the regional level, a clear

relationship remains between the patterns of refugee flow and killings,"

according to Ball's report to the tribunal. "The structure of the patterns

in both refugee flow and killings over the time period in question is the

key component for the findings of the present study…They correlated,

nearly simultaneous variations in the social phenomena being measured in

time and location strongly suggest a common, systematic cause of which the

patterns are a result." Ball and his co-authors, Wendy Betts, Fritz

Scheuren, Jana Dudukovich and Jana Asher, tested the data against what they

knew about patterns of KLA activity and NATO airstrikes, and found that

NATO and the KLA increased their activities after clear spikes in the

number of killings and level of refugee flows, and not before. In contrast,

the study's authors note that the only time there was "a drastic reduction

in killings and refugee movement" came during a ceasefire that the Yugoslav

government called to coincide with the celebration of the Orthodox Easter.

"We Expect The Worst" - German Towns To Lose Millions In Greensill Bank Collapse

 

Germany's Bafin has frozen accounts at Greensill's Gremany-based bank as its parent company's debt-repackaging business has tumbled into administration. And unfortunately, the demise of the bank will likely take tens of millions of euros of public money that had been invested in short-term high-interest accounts.

 

Millions of dollars belonging to German municipalities had reportedly been parked at the Bremen, Germany-based bank. And because towns and cities aren't protected by a German deposit-protection scheme that shields assets belonging to individuals, town managers and elected officials fear they won't be able to recover the taxpayer money, adding to the financial strain as the world struggles to recover from the COVID-19 pandemic.

 

Germany's economy is still in a partial COVID-19-inspired lockdown. After losing out on countless tax revenue, towns may be forced to do without deposits parked at Greensill Bank, which apparently had been recommended to dozens of Germany towns by a pair of brokerages that help municipalities park their cash.

 

One town, Monheim on Rhein, parked €38M with Greensill Bank.

 

Monheim am Rhein disclosed it parked 38 million euros in funds with Greensill Bank, nearly 1,000 euros per resident.

 

Its mayor Daniel Zimmermann said he was in touch with 19 municipalities who together hold 200 million euros ($238 million) in investments with the bank.

 

An emergency meeting in Monheim on Tuesday discussed the fallout, and whether internal mistakes were made or whether brokers who helped make the investments should bear some of the blame.

 

"We don’t want to shun responsibility, but others may be at fault," Zimmermann told Reuters.

 

Zimmermann said that two of the brokers it used CC Gesellschaft fΓΌr Geld- und Devisenhandel mbH and Witt GmbH & Co. KG were also used by other towns.

 

Another town that lost €2M said it's hoping for the best - but expects to lose it all.

 

β€œWe have to find out what happened,” Alexander Stengelin, a Bad Duerrheim official told Reuters.

US declares Huawei threat to national security, pouring cold water on Beijing’s hopes for reset with Washington

 

The Federal Communications Commission (FCC) has deemed Chinese telecom giant Huawei a threat to US national security, maintaining pressure on Beijing that some believed could ease under the new Biden administration.

 

The FCC announced on Friday that the firm, as well as four other Chinese companies, pose β€œan unacceptable risk to US national security or the security and safety of US persons.”

 

The regulator’s acting chief, Jessica Rosenworcel, said that the move would help β€œrestore trust” in US communications networks. She did not explain what specific actions would be taken against the Chinese companies. Huawei has not yet responded to the designation.

 

The decision comes just a day after Bloomberg reported that the Biden administration issued new restrictions on Huawei, preventing US firms from supplying the Chinese telecom with products that can be used in 5G devices. American businesses had previously been allowed to supply Huawei with components, provided that they sought permission from the US government.

 

Beijing slammed the new rule as β€œunreasonable suppression” aimed at Chinese companies, and accused Washington of β€œviolating the principles of market economy and fair competition.”

 

Huawei’s designation as a national security threat matches the hardline policy implemented by the preceding administration under Donald Trump. In June, the FCC blacklisted the firm as a danger to US interests, blocking American firms from using an $8.3 billion government fund to purchase equipment from companies. Huawei filed a legal challenge against the designation last month.

 

The Chinese tech giant had expressed hope that the new administration would take a different approach to trade issues. Victor Zhang, the company’s vice president, said in an interview in November that the attacks on Huawei were politically motivated and part of a β€œtrade war” between the US and China, adding that Washington’s tune might change once Biden takes office.

US judge temporarily removes China’s Xiaomi from Trump-era blacklist

 

A US judge has temporarily removed Chinese smartphone giant Xiaomi from a Trump-era blacklist prohibiting American investment in β€œCommunist Chinese military companies.”

 

The ruling was announced by US District Judge Rudolph Contreras in Washington on Friday. The judge argued that the US Departments of Defense and Treasury β€œhave not made the case that the national security interests at stake here are compelling,” issuing a preliminary injunction removing Xiaomi from the blacklist.

 

Xiaomi was hit with the ban as then-President Donald Trump took a fresh series of hostile moves against China during his last days in office. The smartphone maker and several other China-based businesses have been classified as β€œCommunist Chinese military companies” by the Pentagon and barred from receiving American investment.

 

The company challenged the ban in the US courts this January, arguing that the Trump administration’s actions were β€œincorrect” and β€œdeprived the company of legal due process” altogether. A defense attorney predicts Derek Chauvin will be acquitted after jurors learn George Floyd died of a lethal combination of methamphetamine and fentanyl.

 

Former defense attorney Edward Woodson appeared on Patriotically Correct with Stew Peters, a conservative Minneapolis-based radio host, to discuss the likelihood that former Minneapolis police officer Derek Chauvin will be acquitted on charges relating to the death of fentanyl user and alleged fraudster George Floyd.

 

Woodson began by noting that, in a last minute move, the prosecution is now charging Chauvin with third degree murder. They brought back the third degree murder charge because the second degree was imploding,” said Woodson. β€œIt’s a Hail Mary, they knew that the case wasn’t supporting the facts.”

 

β€œIf you look at more of the video, [Floyd] was talking about how he couldn’t breathe… Right when he’s getting out of the car, and they’re trying to get him into the police car, he’s complaining he can’t breathe,” said Woodson. β€œThat’s one of the signs of fentanyl overdose. The toxicology report has now come out, where he had 3 times the level of fentanyl needed to kill a human being, that and methamphetamine.”

 

The Minneapolis medical examiner found Floyd had a toxic amount of fentanyl and methamphetamine in his system, which almost certainly would have resulted in his death regardless of any actions by police. Still, Chauvin became nationally despised after video of him kneeling on Floyd’s back and neck went viral online.

 

β€œIt’s interesting because if you look at Minneapolis and their manual, he was following textbook, exactly how they’re trained,” said Woodson. Peters, who spent years apprehending dangerous fugitives in partnership with law enforcement in Minneapolis, elaborated on the tactics used by Chauvin.

 

β€œThis is part of Minneapolis procedures, use of force training, it’s in their policy. This is a lateral neck restraint, commonly referred to as an LNR, LVNR, or VNR, a lateral vascular neck restraint, which in this case was more of just a straight vascular neck restraint,” Peters explained. β€œIt restricts blood flow to the brain, but does not commonly result in death. As a matter of fact, there are no cases where it’s proven that this restraint has caused any death.”

 

Woodson suggested that once a jury, unable to be reached by sensationalist media reports and confronted with the solid facts surrounding Floyd’s death, may be shocked to learn how normal the arrest would have been if not for Floyd’s drug use.

 

β€œThe facts have not come out. I think once a jury hears the facts of the case, because think about this,” Woodson began, β€œIf he died as the result of an overdose, in fact it was said, the ME in Minneapolis had said, if they had found him, let’s say at his home, and they found him dead, they would have declared he died of an overdose.”

 

β€œAgain, he had enough fentanyl – just the fentanyl – in his system to kill three human beings.”

 

In fact, Floyd had ingested a chemical cocktail of both fentanyl and methamphetamine that almost certainly would have resulted in death, barring immediate medical intervention.

 

Woodson went on to suggest that the Minneapolis prosecutors likely felt political pressure from the media and local elected officials to β€œover charge” in the case, regardless of the reality of Floyd’s death.

 

β€œWith these very high profile cases, where you see, a lot of times the prosecution will over charge, because they have to politically,” said Woodson. β€œThis whole country changed because of, supposedly, because of George Floyd. The whole country.”

 

β€œWe’ve gone through this whole metamorphosis now, where we’re embroiled in the French Revolution.” Woodson elaborated, β€œIf the premise of this, ie the murder of George Floyd, isn’t a murder, and it is an actual overdose, then you’ve got that whole narrative now flipped, and we’ve got to question, now, the last year.”

In the first 50 days of the Biden administration, the US House of Representatives has passed major legislation to strengthen voting rights, reform police departments, empower labor unions and tighten gun laws.

The public strongly supports each measure, and Biden is poised, pen in hand, to sign each bill into law. It could seem like the dawn of a new progressive era.

But most analysts think the popular bills are doomed, because to get to Biden, they must first pass the Senate, where Democrats may have a slim majority, but where Republicans are widely seen as having the upper hand.

On a field of fair democratic play, any legislation might fall short of the votes needed to become law.

But critics of the US Senate say that for years now, the chamber has not been a field of fair democratic play, paralyzed by its own internal rules and insulated from the popular will by a 230-year-old formula for unequal representation.

Instead, its critics say, the Senate has become a firewall for a shrinking minority of mostly white, conservative voters across the country to block policies they don’t agree with and safeguard the voter suppression tactics that shore up Republican power.

The numbers are staggering. Currently Democratic senators represent nearly 40 million more voters than Republican senators – but the Senate is split 50-50, with the vice-president, Kamala Harris, wielding the tie-breaking vote. By 2040, 70% of Americans are expected to live in the 15 largest states, and to be represented by only 30 senators, while 30% of Americans will have 70 senators voting on their behalf, according to analysis by David Birdsell of Baruch College’s School Of Public And International Affairs. The Senate has counted only 11 African American members in its history, out of almost 2,000 total.

β€œThere’s no doubt that the Senate is broken and has been broken for a long period of time,” said Ira Shapiro, a former Senate staffer, Clinton administration trade official and the author of Broken: Can the Senate Save Itself and the Country?. β€œIt’s been in decline probably for 30 years, and that decline has deepened over the last 12 years.”

Structural problems with the Senate in the past have been treated as too ingrained to be fixed. But as urgent social movements struggle toward fruition, a focus on the chamber as the last and greatest obstacle to the free exercise of democracy in the United States has sharpened.

More than two centuries ago, to incentivize small states to join the union, the framers of the US constitution gave every state two senators, an arrangement that has always left some citizens vastly overrepresented in the body. But not until recent decades did a clear partisan split emerge in which Democrats were far more likely to represent bigger states, while Republicans represented many small states.

The trend has created an immense discrepancy in the influence that voters from less populous, mostly rural – and white, and Republican – states wield in the Senate, compared with voters from states with big cities and more voters of color.

Today, thanks to urbanization and related shifts, the state of California has 70 times as many people as the state of Wyoming – but each state still gets two senators, giving the small, conservative state the ability to counterbalance the giant, liberal state in any vote on energy policy, taxation, immigration, gun control or criminal justice reform.

As part of this dynamic, Democratic Senate candidates regularly rack up millions more votes overall than Republican candidates – but the Republican caucus, as if by magic, does not shrink, and sometimes even grows.

Few analysts think the basic formula for the Senate will change anytime soon. β€œI think that of all the things that will not change, the equal representation of every state is at the top of that list,” said Shapiro. β€œThat’s baked into the constitution.”d.

β€œAnd so in this Congress, in the Senate, we expect it to be used to halt progress on many major policy initiatives that would improve the lives of Black people in particular.”

The filibuster is not the only bulwark of white power built into the Senate, which currently counts only three African American members out of 100 total, next to 68 white men.The disproportionate power of rural states in the chamber translates to a disproportionate power for white voters in general….

In a striking blow to Gov. Greg Abbott, the Texas Republican Party has officially come out in support of the First Amendment and Free Speech, disagreeing with the demanded censorship by Texas Governor Greg Abbott. The Texas Republican Party created a Gab account in January of 2021.

 

β€œThe [Republican Party of Texas] will always fight censorship,” the party said in a statement. β€œWe support the 1st Amendment, including free speech platforms.” They added, β€œTexasGOP has no plan to deplatform from any of our social media accounts. UK Foreign Secretary Dominic Raab declared China to be in a state of non-compliance with the Sino-British Joint Declaration, accusing the nation of restricting democracy in Hong Kong.

 

β€œBeijing’s decision to impose radical changes to restrict participation in Hong Kong’s electoral system constitutes a further clear breach of the legally binding Sino-British Joint Declaration,” Raab said in an official government press release on Saturday, accusing China of trying to β€œharass and stifle all voices critical” of its policies.

 

Raab went on to declare that the UK, which controlled Hong Kong from 1841 to 1997, now officially β€œconsiders Beijing to be in a state of ongoing non-compliance with the Joint Declaration,” which he called β€œa demonstration of the growing gulf between Beijing’s promises and its actions,” and said the country β€œmust act in accordance with its legal obligations and respect fundamental rights and freedoms in Hong Kong.”

 

The Sino-British Joint Declaration, which was signed in 1984 by former UK Prime Minister Margaret Thatcher and former Chinese Premier Zhao Ziyang, declared that Hong Kong would be allowed to follow a separate political system to that of mainland China despite being a Chinese territory.

 

Raab’s statement comes after China passed the β€˜patriots governing Hong Kong’ resolution on Thursday, β€œimproving the electoral system” in the territory by introducing a requirement that will only allow β€˜patriots’ to govern if they pledge their loyalty to the Chinese Communist Party.

 

Critics have claimed that the changes are designed to suppress opposition in the region, while Beijing has defended the new measures by claiming they’re necessary to protect stability and national security, arguing that individuals who aren’t β€˜patriots’ could work with foreign powers to undermine and weaken the nation to the benefit of the West.

House Minority Leader Kevin McCarthy warned Friday that House Democrats are trying to "steal" a House seat from Republicans.

 

The Democrat-controlled House Administration Committee announced Wednesday they would not dismiss Democrat Rita Hart's claims that she is the rightful winner of Iowa's second congressional district in the 2020 election. Hart lost to Republican Mariannette Miller-Meeks by just six votes.

 

Miller-Meeks sought to dismiss Hart's challenge, but the Administration Committee voted down party lines to reject Miller-Meeks' motion.

 

Hart challenged the election outcome in December under the Federal Contested Election Act. Hart claims 22 legally cast ballots went uncounted in the election, but if they were counted, the net result would make her the winner of the election.

 

Hart's challenge is particularly controversial because Miller-Meek's victory was confirmed by a recount and a "bipartisan canvassing of the ballots cast in the race," the Iowa City Press-Citizen reported. Hart also refused to exhaust her legal remedies in Iowa courts before appealing directly to the House.

 

What did McCarthy say?

 

Speaking with Fox News host Sean Hannity, McCarthy said House Democrats are seriously considering Hart's claims because they want to "steal" the seat from Miller-Meeks and expand their slim five-seat majority over Republicans.

 

"Congresswoman Miller-Meeks not only won on Election Day, she is the duly elected congresswoman. She also won the recount. She is certified; she is serving," McCarthy said. "She's on the [House Veterans' Affairs] Committee as well, she has offered an amendment against that COVID bill to help the vets. The Democrats voted against it."

 

"But what is really happening here, Sean, you know it," McCarthy continued. "The Democrats have the smallest majority in their history in the last 100 years β€” only five seats."

Twitter is requesting that a federal court in Florida dismiss a lawsuit filed by a child sex trafficking victim, who alleged that the social media giant refused to immediately remove explicit content depicting the child on its platform.

 

The January lawsuit is accusing the Silicon Valley company of knowingly benefiting financially from the dissemination of sexual abuse material in failing to act on multiple complaints and correspondences asking it to remove the illegal and hurtful content.

 

The content was eventually removed about nine days after the child

 

and his family placed complaints to Twitter. The family and the child victim allege that Twitter only took action because a Department of Homeland Security agent issued a β€œtake-down demand” against the company when other methods to get the company to remove the content failed.

 

β€œTwitter is not a passive, inactive, intermediary in the distribution of this harmful material; rather, Twitter has adopted an active role in the dissemination and knowing promotion and distribution of this harmful material,” the lawsuit states.

 

It further alleges that β€œTwitter’s own policies, practices, business model, and technology architecture encourage and profit from the distribution of sexual exploitation material.”

 

The lawsuit claims that Twitter failed in its duty to report child sexual abuse material, and was negligent in refusing to take action, allowing the content to be viewed over 167,000 times and re-tweeted 2,200 times before it was taken down.

 

β€œTwitter’s conduct is an extreme departure from what a reasonably careful person would do in the same situation to prevent harm

 

to others,” the lawsuit argues.

 

In a court filing on Wednesday, Twitter did not address allegations that it had β€œrefused” to immediately remove the content after the complaints were made.
