Alan Dershowitz: It was unethical. Why was it unethical? Take for example President Trump’s speech on January 6th. I opposed that speech. I don’t think it was done well. I don’t think he should have done it. But he said at the end of the speech he wanted people to show their voices patriotically and peacefully. They doctored the tape! They edited those words out. If a prosecutor ever did that they’d be disbarred! You can’t present part of the tape and deliberately omit the rest of the tape in order to mislead the audience. Especially when the other side has no opportunity to cross-examine. And has no opportunity to put on its own evidence. There is a special obligation not to cheat! Not to defraud the viewers. That’s exactly what they did… And Donald Trump committed no crimes.

Sweeping internet outage hits Google, Fidelity, Amazon, major websites

A sweeping internet outage briefly took down several major websites on Thursday, including Google, Amazon, Fidelity, Costco, Delta Air Lines, British Airways, Capital One and Vanguard.

 

Many of the sites were loading slowly or showing “DNS failure” messages, but by 1 p.m. ET, most of the affected sites had restored service, according to DownDetector.

 

Akamai, a cloud computing company that operates a content delivery network service, which helps move data across the internet, said it was experiencing some problems that appeared to be responsible for the outages.

 

“We are aware of an emerging issue with the Edge DNS service,” the company said in a statement. “We are actively investigating the issue

 

DNS stands for Domain Name System, which connects domain names to the right IP addresses so that people can access popular websites.

 

The Edge DNS service from Akamai services various apps and websites and keeps them secure from certain cyberattacks called distributed denial-of-service, or DDoS, attacks.

Last month, a seemingly similar episode played out when Fastly, another cloud computing company that operates a content delivery network service, experienced a temporary outage that brought down a slew of major websites.

Ex-Attorney General Jeff Sessions rescinded an Obama-era rule that prevented state and local law enforcement from using federal asset forfeiture laws to evade local reform efforts. As a result, sheriffs are now free to use asset forfeiture by citing federal law even if local rules prevent the practice. Forfeiture funds, like many other fees and fines, are often at the complete disposal of sheriffs and other officials, which can lead to abuses and corruption. Ukraine won’t pursue NATO membership – Zelensky adviser

However, Kiev wants the alliance to acknowledge its role as a “cornerstone” of European security

 

Ukraine has accepted that NATO membership is off the table, and will not take any further steps toward joining the US-led military alliance, Igor Zhovkva, an adviser to President Volodymyr Zelensky, told the Financial Times on Saturday. Nevertheless, Kiev wants a say in NATO’s policies.

 

NATO leaders are set to meet in the Spanish capital of Madrid next week, and during two days of meetings and consultations, the alliance will unveil its Strategic Concept – a document that outlines the alliance’s mission and stance toward non-members, including China and Russia.

 

Zhovkva told the Financial Times that Zelensky’s government wants the alliance to acknowledge that Ukraine is “a cornerstone of European security,” and to reaffirm its partnership with Kiev, first established in 1997.

 

However, he said that Ukraine will not push to become a member of NATO.

 

“Nato members have declined our aspirations. We will not do anything else in this regard,” he said.

 

Ukraine’s prospective membership in the alliance was a key factor behind the current conflict with Russia. Ukraine wrote its goal of becoming a NATO member into its constitution in 2019, despite Moscow’s warnings that having the alliance’s forces and weapons on its border would constitute an unacceptable security threat.

 

NATO Secretary General Jens Stoltenberg has insisted that the alliance’s membership books remain open for interested nations, but has not promised or ruled out membership for Ukraine in the near term. Under the 2008 Bucharest Declaration, NATO’s official position is that Georgia and Ukraine “will become members of NATO” at an unspecified future date.

 

NATO’s Strategic Concept has not been updated since 2010, with that version of the document stating that the alliance seeks “a true strategic partnership” with Russia.

 

Zhovkva wants NATO to purge any mention of Russia as a “partner” from the coming update.

 

“We expect in the Nato strategic concept . . . there will be more strict and severe warnings to the Russian aggressor,” he said, urging the alliance “Don’t be shy” in inserting anti-Russian text.

 

Furthermore, Zhovkva said that he wants the Ukrainian conflict to be described in the strategy document, arguing “it’s not enough just to cross out the word ‘partner.’”

US Airman Arrested Over Insider Attack On Base In Syria That Wounded Four Americans

 

An airman has been arrested by US military law enforcement in connection to the April 7 attack on the US-led coalition’s Green Village base in northeaster Syria.

 

The attack wounded at least four American service members. Initially, indirect fire was thought to be responsible for the attack. Sources affiliated with the US-backed Syrian Democratic Forces blamed Iran’s Islamic Revolutionary Guard Corps and its allies in Syria. Nevertheless, the US-led coalition acknowledged around a week later that sabotage was behind the attack.

 

“As part of an ongoing investigation, on June 16, an Airman was taken into custody stateside in conjunction with the attack in Green Village, Syria. After reviewing the information in the investigation, the Airman’s commander made the decision to place him in pretrial confinement,” according to a statement provided to CNN on June 22 by Ann Stefanek, an Air Force spokesperson.

 

According to CNN, the investigation into the attack on the Green Village base is being carried out by the Army’s Criminal Investigation Division and the Air Force Office of Special Investigations.

 

US military investigators believe that the attack was the result of deliberate placement of explosive charges by one or more individual at an ammunition holding area and a shower facility in the base.

 

The explosives used were described to CNN by two officials as “not insignificant” but as being of a “military grade”. The officials said the attack took place in the middle of the night and have uncovered security footage showing two instances of a figure moving quickly. They are also looking into whether sentries were posted at either location.

 

The officials say it’s not clear if the timing of the attack suggests the perpetrator was not trying to cause mass casualties or was looking to get away as quietly and quickly as possible.

 

The four service members wounded in the attack were diagnosed and treated for traumatic brain injuries. They all returned to duty later in April.

 

The US maintains some 900 troops in Syria, most of them are deployed in key gas and oil fields in the northeastern region. The Green Village base for example is located in the center of al-Omar oil fields. Despite of the threats facing American troops in Syria, Washington does not appear to be planning to withdraw from the country any time soon.

The War on Boats is quite deliberate and was thoroughly planned. In some cases, defining their true ownership may have taken some effort. Here is a case in point–the 348-foot superyacht, "Amadea."

 

US law enforcement agencies sailed the Amadea out of Fiji yesterday, after a ruling by the country's Supreme Court. During the court proceedings, it was argued that the Amadea was owned by Eduard Khudainatov, a Russian oil executive who has not been sanctioned by the U.S., and therefore, the US government had no claim to seize the yacht.

 

However, the US lawyers responded: "Khudainatov is a second-tier oligarch (at best) who would not have anywhere near the resources to purchase and maintain more than $1 billion worth of luxury yachts," an FBI agent wrote in the warrant application, after noting that Khudainatov is not included on Forbes' billionaires list.

 

The Justice Department says the $300 million Amadea's true owner is Suleiman Kerimov, a sanctioned billionaire oligarch who made his money in gold mining. The court accepted the validity of the US warrant and agreed that issues concerning money laundering and ownership need to be decided in the court of original jurisdiction, in this case, the U.S. District Court in Washington, D.C.

 

The crew, whose pay had already been frozen due to sanctions, were "refusing to sail on the Amadea with the U.S. authorities to an unknown destination," the captain wrote in his affidavit. He added that they feared cooperating with the U.S., in breach of their contracts with the ship's owner, would damage their reputations in the yachting industry. By the end of May, contractors for the U.S. had hired a new crew of 24, led by a captain who had previously been at the helm of the Amadea.

A massive leak of personal information from a California state database for permits to carry concealed weapons is larger than initially reported, officials said Wednesday.

 

The revelation came a day after the Fresno County Sheriff's Office said it was informed of a data breach affecting every person with a California concealed-carry permit.

 

On Wednesday, the California Department of Justice said the leak was more extensive, affecting not only current permit holders but anybody who was granted or denied a permit to carry a concealed weapon between 2011 and 2021.

 

The data were exposed when the Department of Justice updated its Firearms Dashboard Portal on Monday, state Atty. Gen. Rob Bonta's office said in a statement.

 

The information included names, dates of birth, gender, race, driver's license numbers, addresses and criminal histories, according to the statement. Social Security numbers and financial information were not exposed.

 

In addition to information from the concealed-carry permit applications, data on the Assault Weapon Registry, Handguns Certified for Sale, Dealer Record of Sale, Firearm Safety Certificate and Gun Violence Restraining Order dashboards were "also impacted," Bonta's office said, but authorities are investigating whether any personally identifiable information was exposed from those dashboards.

SUPREME COURT RESTORES THE TRUE MEANING OF THE FIRST AMENDMENT AND ABANDONS LEMON TEST FOR RELIGIOUS RIGHTS CASES

 

Coach Kennedy Wins Prayer Case

 

In a landmark case, Kennedy v. Bremerton School District, Professor William Wagner and Great Lakes Justice Center represented NFL Hall of Fame athlete (two-time Superbowl Champion) Darrell Green. We filed a Supreme Court brief in support of a high school coach urging the Court to abandon the Lemon test. Coach Kennedy lost his job because he took a knee and prayed after football games. The government claimed it needed to stop the coach from praying, saying if it did not do so it would be violating the First Amendment’s Establishment Clause. In an historic decision, the U.S. Supreme Court reversed the infamous legal rule that said the Establishment Clause required government actors to have a secular reason for every action, and to not even symbolically endorse a religious view. The Court returned our nation to the plain meaning of the First Amendment. Praying on a football field does not establish a religious government; when read together with the First Amendment free exercise and speech clauses, praying does not, therefore, violate the Establishment Clause. The Court specifically abandoned the Lemon Test to analyze cases under the First Amendment.

In its opinion SCOTUS further ruled: “An Establishment Clause violation does not automatically follow whenever a public school or other government entity “fail[s] to censor” private religious speech. Nor does the Clause “compel the government to purge from the public sphere” anything an objective observer could reasonably infer endorses or “partakes of the religious.” … But learning how to tolerate speech or prayer of all kinds is “part of learning how to live in a pluralistic society,” a trait of character essential to “a tolerant citizenry.”

 

Constitutional Law Professor William Wagner, President of Great Lakes Justice Center, stated: “When freeing human beings atrociously held as slaves, Lincoln invoked the favor of Almighty God in the Emancipation Proclamation. Today the Supreme Court reversed a legal rule that would have held Lincoln's action, and praying, unconstitutional. In doing so, the Court returns the First Amendment to its true meaning."

 

David Kallman, Senior Legal Counsel for Great Lakes Justice Center, stated: “We are pleased that the Court accepted our argument to finally bury the Lemon Test. The role of atmosphere in absorbing particles of cosmic rays is taken into account. An estimate of radiation danger to humans is obtained for the ground level and for the International Space Station altitude of ~400 km. It is shown that in the most unfavorable, minimum field, part of the inversion process the galactic cosmic ray flux increases by no more than a factor of three, implying that the radiation danger does not exceed the maximum permissible dose. Thus, the danger of the magnetic inversion periods for humans and nature generally should not have fatal consequences for humans and nature despite dramatically changing the structure of the Earth's magnetosphere.

I had so many stray thoughts while reading this that I don't even know where to begin. I guess the big takeaway is that this makes perfect sense. It's what you would have expected.

 

From the woke protests at the University of Missouri in 2015-2016 to the campus takeover at Evergreen State to the shouting down of speakers at various campuses, wokeness was always concentrated in spaces that were already on the left.

 

So it makes perfect sense that wokeness would jump from there to progressive institutions where you have a preponderance of like-minded people, all of whom have been trained in the foundational beliefs that make up wokeness (anti-racism, intersectionality, critical theory, etc.)

 

What Ryan Grim reveals is that this has been going on for a while but the people confronting it haven't wanted to talk about it because even the language to criticize comes from the right. They're ashamed to admit it's all true.

 

Another random thought I had was about

. Reading Grim's piece one of the things that comes across is the degree to which wokeness in action is destructive of hierarchies. It puts an end to group cohesion for a common cause.

 

Peterson came along around this same time talking about the need for hierarchies and how they are inevitable (This was the point of his story about lobsters). And of course the left hated him for it. He was fundamentally contradicting their woke project.

 

And of course it infuriated them even more that when challenged, he could usually win the debate.

 

There's a lot of talk in the latter half of the story about attempts by management of these left-wing groups to push back on the woke activists in their organizations. But Grim admits this is still in the "embryonic" stage.

 

The use of "embryonic" in this article, which focuses heavily on "reproductive justice" groups, seems pretty awkward. My own prediction is that these embryonic efforts will never come to term. The woke mob will make sure they are aborted.

 

I'm not just saying that because I'm on the right. I think the logic of wokeness, such as it is, is based on this idea that it's each individual's job to call-out and cancel that which opposes their view of the world. No other goal can take precedence for long.

 

The woke also aren't interested in debate, they're interested in compliance. We've seen this over and over. It's why they shout down speakers rather than listen and ask questions. Silencing "harmful" voices is the point, not finding common ground.

 

So you can't argue when you've been called out. The Robin DiAngelo-style Kafka trap explicitly won't allow that. You can only apologize and admit failure. Wokeness is ultimately a demand for control. When anyone can seize control, no one is in control for long.

 

All that to say, I don't think this is going to work itself out and reach a new equilibrium. The current rules of wokeness don't allow for the kind of stability needed to run a large organization.

 

At Evergreen State, the campus takeover led to a decimation of enrollment that continued for years and left the school a shell of its former self. That's what I think the future holds for many of these groups unless they resist.

I'm a father figure to many kids in my neighborhood.

They have no other father to see.

I fix their bikes. I give them clothing. I have fed them.

Wifeanon calls them my Farrel Children.

I cry a lot over what they are going "home" to.

The issue of how to arrest China’s rise is primordial (for Team Trump), and in a certain sense has led to an American ‘retrospective’: America now may only account for 14% of global output (PPP – Purchasing Power Parity basis), or 22% on a nominal basis (as opposed to near half of global output, for which the US was responsible at the close of WW2), but American corporations, thanks to the dollar global hegemony, enjoy a type of monopoly status (i.e. Microsoft, Google and Facebook amongst others), either through regulatory privilege or by marketplace dominance. Trump wants to halt this asset from decaying further and to leverage it again as a potent bargaining chip in the present tariff wars. This is clearly a political ‘winner’ in terms of US domestic grass-roots, politics, and the upcoming November mid-term elections.

 

The second strand seems to be something of a Middle East ‘retrospective’: to restore the Middle East to the era of The Shah, when ‘Persia’ policed the Middle East; when Israel was a regional ‘power’ implementing the American interest; and when the major sources of energy were under US control. And, further, when Russian influence was being attenuated, by leveraging radical Sunni Islam against Arab socialism and nationalism.

I've always thought that a number of The Bill of Rights had their roots started in the French & Indian War, which was really a continuation of The Hundred Years War, by proxy. Appeals court reinstates civil rights lawsuits of dozens of bikers arrested in 2015 Twin Peaks shootout

 

WACO, Texas (KWTX) - The 5th U.S. Circuit Court of Appeals has reinstated the lawsuits – at least temporarily – of about 90 bikers arrested in the 2015 Twin Peaks shootout whose civil rights cases were thrown out last year by U.S. District Judge Alan Albright.

 

 

A three-judge panel of the federal appeals court reversed Albright’s previous ruling that a grand jury’s indictment of the 90 bikers “served to break the chain of causation” for their false arrest claims and sent the cases back to Albright for further consideration in light of the court’s ruling.

 

 

The panel’s complex, 17-page opinion puts the civil rights cases of about 90 bikers back in play and instructs Albright to determine if each defendant has alleged adequate claims that they were falsely arrested after the melee that left nine dead and 20 injured.

 

 

By dismissing the suits of the indicted bikers, Albright did so through “a legal erroneous application” of the independent intermediary doctrine, the panel ruled. The doctrine, as interpreted by the 5th Circuit, states that even if an officer makes a false arrest and violates the detainee’s Fourth Amendment rights, the officer will not be liable if the facts supporting the arrest are put before an impartial intermediary, such as a magistrate or a grand jury, and the intermediary finds probable cause.

 

 

“Because the district court concluded that the independent intermediary doctrine applied, it did not discuss the merits of the plaintiffs’ false arrest claims,” the opinion states. “But the nature of the plaintiffs’ false arrest claims is relevant to our inquiry here because they argue, in essence, that the independent intermediary doctrine should not apply to the grand jury’s indictment because the grand jury was misled in the very same way as the magistrate who issued the arrest warrants.”
