Trump appeals court order appointing monitor to oversee company

 

Former President Donald Trump has not been directly charged.

 

Former President Donald Trump on Monday appealed a court order appointing an independent monitor to oversee major financial dealings and asset transfers of the Trump Organization pending the outcome of New York Democratic Attorney General Letitia James's civil fraud case against the organization and its top leadership.

 

"The preliminary injunction imposed by the court is overly broad, overreaching, and unenforceable on its face," Trump attorney Alina Habba said, according to The Hill. "We trust that the Appellate Division will rein in the Attorney General's unbridled desire to exert control over the Trump Organization."

 

Last week, New York Judge Arthur Engoron issued a court order appointing the monitor and requiring the organization to secure court approval prior to any major asset transfers. The monitor will need 30 days' notice prior to any organizational restructuring plans for "disposing or refinancing of significant Trump Organization assets."

 

James's office had filed the request, arguing that the Trump Organization was restructuring to avoid its legal obligations. James has filed a civil fraud case alleging that the organization inflated the value of its major assets. The case is separate from Manhattan District Attorney Alvin Bragg's criminal case against the organization over an alleged scheme by its major executives to avoid paying taxes.

 

Former President Donald Trump has not been directly charged in either case.

 

At the time of Engoron's order, the Trump legal team had denounced James's request as a naked attempt to seize control of the company, a claim Habba echoed.

 

James is seeking reelection and faces a strong challenge from Republican Michael Henry. Trump has asserted that her case is a political witch hunt and has backed her opponent.

Poland to expand US air base – Defense Minister

 

The base expansion comes as part of an agreement securing a “permanent” US presence in Poland, the Defense Ministry says

 

Poland will expand a military base hosting the US Combat Aviation Brigade in the coming years, the nation’s defense minister, Mariusz Blaszczak, announced on Monday during a visit to the facility. Located in the central Polish city of Powidz, the base is expected to strengthen the US Air Force operation capabilities in support of Polish and NATO forces in the region, he said.

 

The facility will get new hangars and warehouses as well as a bulk fuel storage facility nearby, the minister said, accompanied by US ambassador to Poland, Mark Brzezinski. The Powidz base hosts the US Apache strike helicopters.

 

Powidz “is turning into a military complex, preparing to support Polish and NATO forces on the eastern flank of the North Atlantic Alliance,” Blaszczak said amid unprecedented tensions between NATO and Russia over Moscow’s continued military offensive in Ukraine.

 

The base expansion comes as part of the 2020 Enhanced Defense Cooperation Agreement between Washington and Warsaw. The accord “creates conditions for a permanent, long-term presence of the US Armed Forces in Poland,” the Polish Defense Ministry said, adding that it would “strengthen” national security.

 

A total of 114 infrastructure projects at 11 locations are included into the agreement, which the ministry said will “enable the rapid development of additional combat capabilities in Central and Eastern Europe.”

 

According to Blaszczak, Warsaw also plans to build its own military potential by purchasing helicopters and tanks from the US. It is expected to receive Abrams tanks as early as next year. A purchase order for 96 attack helicopters has also been placed, according to the defense minister.

 

Last week, Us President Joe Biden said that the US forces that were “temporarily” deployed to Poland are likely to stay there for a “long time.” Warsaw previously asked Washington to permanently garrison troops in Poland, but that would technically violate a NATO treaty with Russia.

 

It is unknown how many US troops are currently in Poland, NATO’s main logistical hub for supporting the government in neighboring Ukraine. In May, the US ambassador in Warsaw revealed that over 12,600 American military personnel were in the country, the largest number in history.

British nuclear submarine caught fire – The Sun

 

The HMS Victorious was reportedly carrying Trident 2 nuclear ICBMs when the fire broke out

 

One of the British Navy’s Vanguard-class nuclear submarines was forced to abort a “top secret mission” after it sustained fire damage, according to a Sunday article published by The Sun.

 

According to the outlet’s sources, it took the efforts of the entire 130-plus crew, including many who were off-duty, to put out an electrical fire aboard the HMS Victorious, which was carrying Trident 2 nuclear ICBMs at the time of the incident.

 

While the fire was reportedly contained relatively quickly, the emergency situation declared by the ship’s captain forced the ship to shoot to the surface at an undisclosed location in the North Atlantic to vent out toxic fumes.

 

A Navy source reportedly explained to The Sun that “every seagoing member of the Royal Navy is a qualified fire-fighter,” and that this ensured that British ships and submarines were able to quickly respond to such incidents without affecting operational outputs.

 

Nevertheless, the damage caused by the fire prompted the submarine’s captain to abandon an unspecified “top secret mission” and order the vessel to return to base at HMNB Clyde in Faslane, Scotland.

When voters cast their votes this November in the 2022 elections, they can feel assured their ballot is secure due to a long-standing partnership between Washington’s Secretary of State and the Washington National Guard.

 

“This on-going relationship since 2014 continues to provide that extra layer of protection to what is already a very secure voting system in our state,” said Col. Thomas Pries, the commander of the 252nd Cyberspace Operations Group.

 

Since 2014, cyber security professionals from the Washington National Guard have assisted the Secretary of State’s office to ensure that when a vote is cast in our state, it is counted correctly and accurately. In September, a team of eight members from the Washington Air National Guard and Washington State Guard spent two-weeks working with the Secretary of State’s office to coordinate cyber security support for the November 8th general election. Getting involved early provides the Guard and the Secretary’s office awareness of any issues and ensures they’re detected early.

As part of an effort to instill faith in the voting process ahead of next month’s midterm elections, the Cybersecurity and Infrastructure Security Agency and the FBI on Wednesday released a joint public service announcement underscoring the extensive controls that are in place to protect election infrastructure from malicious cyber activity that could disrupt or prevent voting.

 

“As of the date of this report, the FBI and CISA have no reporting to suggest cyber activity has ever prevented a registered voter from casting a ballot, compromised the integrity of any ballots cast or affected the accuracy of voter registration information,” the announcement said. “Any attempts tracked by FBI and CISA have remained localized and were blocked or successfully mitigated with minimal or no disruption to election processes.”

 

The Oct. 4-dated announcement noted that election officials use “a variety of technological, physical and procedural controls to mitigate the likelihood of malicious cyber activity” that could impact “the confidentiality, integrity or availability of election infrastructure systems or data that would alter votes or otherwise disrupt or prevent voting.”

 

“Given the extensive safeguards in place and distributed nature of election infrastructure, the FBI and CISA continue to assess that attempts to manipulate votes at scale would be difficult to conduct undetected,” the announcement added.

 

The PSA also said that malicious actors may attempt to “spread or amplify false or exaggerated claims of cybersecurity compromises to election infrastructure,” but added that these claims “would not prevent voting or the accurate reporting of results.” A footnote at the very end of the announcement also noted that “lawful domestic actors in the United States have the right to use arguments originating from any source, even adversary narratives.”

 

Election-related misinformation—including unfounded claims of compromised voting systems and inaccurate vote tabulations—have circulated in some political quarters since the 2020 presidential election. These conspiracies, which have been amplified by bad actors, have in some cases led to threats of physical violence against election administrators and officials.

 

CISA and the FBI also outlined some recommended steps for the public to take ahead of the November midterms, including using reliable sources to verify reports of compromised voting systems or voter information and being suspicious of emails, phone calls and social media posts that “appear to spread inconsistent information about election-related incidents or results.” The PSA also recommended that the public report any suspicious or potentially criminal election-related activities to their local FBI field office.

 

The joint CISA-FBI announcement comes after the Associated Press reported on Tuesday that an unclassified intelligence advisory sent to state and local officials last month warned that China was potentially seeking to influence some midterm races in order to “hinder candidates perceived to be particularly adversarial to Beijing.” The report also noted that Russia is attempting to amplify mis- and disinformation about the security of U.S. elections to sow political discord.

HOUSTON (AP) — An appeals court on Monday ordered the release of the leaders of a Texas-based group that promotes election conspiracy theories after they had been jailed last week for not complying with a court order to provide information in a defamation lawsuit over some of their claims.

 

Catherine Engelbrecht and Gregg Phillips, who run True the Vote, had been detained since Oct. 31 after being held in contempt by U.S. District Judge Kenneth Hoyt in Houston.

 

Engelbrecht, Phillips and their nonprofit organization are being sued by Michigan-based election software provider Konnech Inc. over True the Vote’s claims of a Chinese-related conspiracy involving U.S. poll workers’ information.

 

The lawsuit alleges Houston-based True the Vote’s leaders illegally downloaded from Konnech’s server the personal data of 1.8 million U.S. poll workers. They were jailed by Hoyt after declining to reveal the names of everyone who helped them access the data.

 

In a one-page ruling, the 5th U.S. Circuit of Appeals granted a request by lawyers for Engelbrecht and Phillips to free them while they appeal Hoyt’s order to detain them.

 

It was not immediately known when Engelbrecht and Phillips would be released. Michael Wynne, an attorney for the two, did not immediately return an email seeking comment.

China Is Attempting To Influence US Kids By Offering An ‘Opium Version’ Of TikTok, Expert Says

 

The Chinese government offers its children a more limited, beneficial version of the popular app TikTok than the “opium version” offered to kids in the United States, an expert said in a recent report.

 

Tristan Harris, co-founder of the Center for Humane Technology, told “60 Minutes” Saturday that, according to TikTok’s Chinese parent company, ByteDance, the version of TikTok given to Chinese consumers provides children with a vastly different experience. The Chinese equivalent of TikTok, Douyin, gives kids under 14 years old a 40-minute daily limit and serves them patriotic and educational content.

 

“They don’t ship that version of TikTok to the rest of the world,” Harris said. “It’s almost like they recognize that technology’s influencing kids’ development, and they make their domestic version a spinach version of TikTok, while they ship the opium version to the U.S. and the rest of the world.”

 

Meanwhile, Harris said, children in the U.S. and other parts of the western world use the app for “hours at a time.” To illustrate how TikTok is affecting American children, Harris noted that the number-one dream job for U.S. preteens is social media influencer, while in China, kids in the same age group dream of becoming astronauts.

 

“You allow those two societies to play out for a few generations, I can tell you what your world is going to look like,” he continued.

 

TikTok provides tools for parents to limit their children’s screen time and what they are able to access on the app, but it’s up to parents to use those tools.

 

New national security concerns have led the Federal Communications Commission (FCC) Commissioner Brendan Carr to urge the CEOs of Apple and Alphabet to ban TikTok due to the platform’s extensive mining of user data. Former President Donald Trump issued an executive order in 2020 demanding that ByteDance sever its ownership of TikTok and threatening to ban its use in the United States. A federal judge later blocked the order.

 

“Like many global companies, TikTok has engineering teams around the world. We employ access controls like encryption and security monitoring to secure user data, and the access approval process is overseen by our US-based security team. TikTok has consistently maintained that our engineers in locations outside of the U.S., including China, can be granted access to U.S. user data on an as-needed basis under those strict controls.” TikTok said in a June statement.

Once suspects requested to meet with a child, law enforcement arrived at a predetermined location and arrested them. The operation began last Wednesday and lasted through Saturday. It was carried out across Fresno County in collaboration with multiple law enforcement partners. The arrests have been referred to the Fresno County District Attorney’s Office for potential criminal prosecution.
