Here is some advice for anyone following Tuesday's U.S. midterm elections: Be ready for a long night and maybe days of waiting before it's clear whether Republicans or President Joe Biden's Democrats will control Congress.

All 435 seats in the U.S. House of Representatives are up for grabs, as are 35 U.S. Senate seats and 36 governorships.

Republicans would need to pick up five seats to take a majority in the House and just one to control the Senate. Nonpartisan election forecasters and opinion polls suggest Republicans have a very strong chance of winning a House majority, a result that could become clear Tuesday evening, with control of the Senate likely to be closer fought and likely to take longer to be resolved.

A massive wave of Republican support could lead to declarations of victory hours after polls close.

But with dozens of races expected to be close and key states like Pennsylvania already warning it could take days to count every ballot, experts say there's a good chance America goes to bed on election night without knowing who won.

"When it comes to knowing the results, we should move away from talking about Election Day and think instead about election week," said Nathan Gonzales, who publishes the nonpartisan newsletter Inside Elections.

The legal fight in Pennsylvania over mail-in ballots with missing or incorrect dates could drag on for weeks after Election Day, forcing courts to make the final decision on whether thousands of votes can be counted.

The battle is playing out in both in state and federal court against the backdrop of a very close U.S. Senate race that may decide control of the upper chamber. On one side are Democrat officials and activist groups who want to allow mail-in votes to count despite "minor errors." On the other are state, local and national Republican committees insisting on strict adherence to state law on how to fill out these ballots.

"Past experience tells us these kinds of things can drag on for what seems like an eternity," Pennsylvania Republican Party general counsel Tom King told Fox News Digital.

"What we have going on is a mad scramble as we speak," King added.

The most high-profile ongoing litigation is a federal lawsuit from the NAACP and other groups – represented by the ACLU – that seeks to force officials to count mail ballots with incorrect or missing dates, despite a Pennsylvania Supreme Court ruling mandating they be sequestered. Democratic U.S. Senate candidate and Lt. Gov. John Fetterman, who is running against Republican Mehmet Oz, later filed a similar federal suit.

Information already released by major metropolitan areas indicates the number of ballots that fall into those categories could be significant. Allegheny County, where Pittsburgh is located, and Philadelphia County released lists of voters with date-related issues on their ballots, aiming to give those voters a chance to fix them. In Philadelphia, the number was over 2,300, and in Allegheny County it was about 1,000.

Those two counties make up just over one-fifth of Pennsylvania's population. Assuming similar rates of ballot issues elsewhere, the total number of deficient ballots could potentially exceed 10,000 and approach 15,000 or more.

ACLU lawyers argue that disqualifying votes based on "minor errors" like incorrect or missing dates runs afoul of the Civil Rights Act. The law, they say, makes it illegal not to count votes based on paperwork mistakes "not material" to whether a voter is eligible.

"There's a certain amount of common sense here that should say these votes should count," R Street Institute resident elections fellow Matthew Germer told Fox News Digital. "If a ballot arrives in advance of Election Day, it's pretty clear to me at least that that ballot should be counted."

Germer said it is possible court cases related to Pennsylvania's elections continue for days or weeks after Election Day, and could potentially make it to the Supreme Court. However, he argued, that is not necessarily a bad thing – and that it is likely the courts will come to a conclusion well before the results legally must be certified.

"I would expect the first kind of ruling within a week. And then if there are any appeals that move forward from there, that it jumps to the top of the docket for almost any court that's going to be handling it," Germer said.

Germer also noted that if the state's U.S. Senate race between Fetterman and Oz is not close, the sequestered mail ballots may not matter at all.

Meanwhile, Pennsylvania Acting Secretary of State Leigh Chapman is asking counties to go through mail-in ballots and report to the state how many had missing or incorrect dates. She also says she wants counties reach out to and help voters who made mistakes to fix them.

"It is the Department of State's position that voters who make, you know, minor errors on their ballot – if they forget to sign it, if they forget to date it – you know, they should be able to go to their county, fix that issue," Chapman said Monday.

However, Republicans argue that scheme violates state law, which they say requires mail ballots to be stored in secure locations until official are allowed to start processing them at 7 a.m. on Election Day. The Monroe County GOP, with backing from King, sued the Monroe County Board of Elections over that last week.

A judge Monday ruled against a GOP request for a preliminary injunction against the county. He said where election law is unclear, it should be interpreted in a way that avoids disenfranchising people.

"Given that our Supreme Court's policy has been to enfranchise the voter when interpreting ambiguous statutes… I find that MCRC has not shown a strong likelihood of success at this very early stage of litigation," wrote Monroe County Court of Common Pleas Judge Arthur L. Zulick.

King said after the ruling came down that the GOP would wait until after election results come in before deciding how to move forward on that legal issue. He said it is "a basis upon which to challenge votes if it's appropriate."

"In the event of close elections, there will be numerous challenges across the state of Pennsylvania to any of these ballots that were processed in this way," King said.

Maryland voters deciding recreational marijuana legalization

ANNAPOLIS, Md. —Maryland voters are deciding whether to legalize recreational marijuana in a constitutional amendment Tuesday.

Lawmakers already approved legislation this year to take steps to implement recreational marijuana with voter approval, but the General Assembly left matters of licensing and taxes for lawmakers to decide next year.

The constitutional amendment states that recreational marijuana would not be legal until July 2023 for people 21 and over. If voters approve, the law includes provisions spelling out a transitional period between Jan. 1 and July 1 that would include a fine of up to $100 for possession of marijuana of under an ounce and a half.

In addition, legislation will remove criminal penalties for up to 2.5 ounces and create a civil citation. Existing laws on marijuana possession would apply to possession of more than 2.5 ounces.

It also makes changes in criminal law and creates a process for expungement of past marijuana possession convictions.

Starting Jan. 1, a person who is convicted of possession of cannabis may file a petition for expungement after the completion of the sentence and probation. By July 1, 2024, the state’s department of corrections would be required to expunge all cases in which the possession of cannabis is the only charge in the case, and if the charge was issued before July 1, 2023.

In addition, the law allows for resentencing of those convicted of marijuana charges. Starting Jan. 1, a person incarcerated for a conviction related to cannabis would be able to apply for resentencing. The court would be required to grant the application and resentence the person to time served. If the person is not serving another sentence, the person would have to be released.

Now, the possession of up to 10 grams of marijuana is a civil violation in Maryland, with a fine of up to $100 for a first offense.

Currently, 19 states, along with the District of Columbia, have fully legalized marijuana. There also are 37 states, including Maryland, that have legalized medical marijuana.

Voters also are deciding other ballot questions in Maryland.

One would change the names of the state’s appellate courts. Maryland’s highest court - the Court of Appeals - would be renamed the Supreme Court of Maryland. The state’s intermediate appellate court - the Court of Special Appeals - would be renamed the Maryland Appellate Court.

Another proposed change would add on to the residency requirement for someone to run for the state legislature: A candidate would have to make their place of residence in the district he or she is running in their “primary place of abode” for six months. That would eliminate the option of renting a residence in the district as a second home to qualify.

Voters are also deciding whether to raise the threshold for a right to a circuit court jury trial in civil proceedings to be at least $25,000, instead of $15,000.

Judge Temporarily Suspends Steve Bannon’s Prison Sentence

Steve Bannon, former chief strategist for President Trump’s White House and current head of the War Room, the most compelling show on the Internet about current events, will not be going to jail today.

Yesterday the judge overseeing his case suspended Bannon from going to jail while his case is being appealed through the courts.

Former Trump White House strategist Steve Bannon will be allowed to remain free as he appeals his conviction for defying a subpoena from the House committee investigating the Jan. 6 Capitol riot.

Bannon was sentenced to four months in prison and ordered to pay a $6,500 fine after being found guilty on two counts of contempt of Congress last month.

US District Judge Carl Nichols formally stayed Bannon’s sentence on Monday as he appeals, explaining in a court filing that Bannon “is not likely to flee or pose a danger to the safety of any other person or the community if released.”

Nichols also wrote that Bannon’s appeal “is not taken for the purpose of delay but rather raises a substantial question of law that is likely to result in a reversal or an order for a new trial.”

If a higher court upholds Bannon’s conviction on the two misdemeanor counts, he will only then be forced to serve his sentence.

Bannon had refused to comply with the Jan. 6 panel’s order for him to testify and provide documents citing executive privilege.

Bannon’s arrest was not the precedent. Under Obama, his Attorney General Holder and Head of the IRS Lerner were subpoenaed by Congress but never showed up. Holder was accused of running guns to Mexico while Lerner was preventing conservative groups from obtaining non-profit status like far-left groups were.

The ballots weren't printed with the right kind of ink. They weren't scanning properly. In Ewing, machines were unplugged. In Hamilton, they are requiring the use of Sharpies. Washington state is a vote by mail state, so all registered voters receive a ballot by mail. Absentee ballots only need to be requested if you will not be at your registered address during the 18 days before an election. If you are away from your registered address before an election, you can contact your county election official to see if they are able to forward your mail ballot to your new, temporary address. Your ballot is mailed to you at least 18 days before each election. Voted ballots must be postmarked or received by Election Day in order to be counted. You can sign up to track your mail ballot on your Secretary of State website. Absentee ballots begin being counted on Election Day. If you have any questions contact your Secretary of State.

Trump said on Tuesday that he voted to re-elect Florida Gov. Ron DeSantis.

"No matter who you vote for, you have to vote," Trump told people outside a Palm Beach polling site.

DeSantis is running against Democrat Charlie Crist.

Former President Donald Trump headed to the polls for Tuesday's midterm elections and said he voted to re-elect Republican Florida Gov. Ron DeSantis.

When asked whether he voted for DeSantis after he cast his vote at the Morton and Barbara Mandel Recreation Center in Palm Beach, Florida, Trump replied: "Yes, I did," according to a video shared on Twitter.

At an Ohio campaign event on Monday, Trump once again teased a possible 2024 bid for the White House and added that he has a "big announcement" planned for November 15 at his Mar-a-Lago resort in Florida.

"I think Tuesday will be a very exciting day for a lot of people, and I look forward to seeing you at Mar-a-Lago," Trump said after casting his vote for DeSantis.

When asked whether he is planning to again run for president and why, Trump said, "The country has gotten very bad. It's lost its way. It's lost its confidence."

Poll Worker Fired For Selecting Straight Democrat Ticket On Voter’s Ballot, Calling Republicans ‘Racist’

A Democrat poll worker in Indiana has reportedly been fired after allegations surfaced that he had pressured voters into voting against Republican candidates and selected the “straight Democrat ticket” option when helping an individual fill out their ballot.

James Zheng, a poll worker in Carmel, Indiana, is allegedly being investigated by the Hamilton County Sheriff’s Office for incidents of “electioneering and election interference.”

On Thursday, as a group of pro-parental rights education activists stood outside the Carmel polling place, Zheng allegedly told two black voters that they should not vote for the pro-parent, Republican candidates because the activists outside were “racist.” After the voters submitted their ballots, they alerted the activists to what Zheng had told them. The activists then complained to election officials.

Later, a second incident was reported. According to Hamilton County election administrator Beth Sheller, when Zheng was assisting a voter with an electronic ballot, he pressed the straight Democrat ticket option when explaining to the voter how to use the voting machine. The voter was “then confused about how to change the selection” and asked another poll worker for help. That poll worker resolved the issue and alerted the polling location’s election inspector about the incident.

Zheng had been removed from his post as of Friday.

Hamilton County GOP chairman Mario Massillamany told Fox News that Zheng’s conduct raises questions as to how many voters had been confused after he had attempted a similar maneuver but did not alert election officials.

“This should serve as a cautionary reminder that those desperate to hold onto power or gain power will do anything – including breaking the law – to thwart the efforts of parents and taxpayers to replace our school boards with officials who more accurately reflect the values of our community,” he said.

The incidents come after Democrats and their allies in the corporate media launched a nonstop propaganda campaign claiming GOP poll workers represent an existential threat to democracy (despite the fact that actual threats of violence and intimidation are extremely rare). Yet when a Democrat poll worker engages in election interference, Democrats are silent.

As Republicans are expected to make massive gains on Tuesday, expect Democrats to pull out all stops including using their minions (like Zheng) to influence voters, buying votes, interfering in the administrative process, and questioning election results. (According to the corporate media narrative, after all, it’s only acceptable to question elections if they favor GOP candidates.)

Poll workers removed in Johns Creek because of social media posts, according to officials

ATLANTA, Ga. (Atlanta News First) - Two poll workers, a mother and son, were removed from the Johns Creek voting site shortly before polls opened this morning, according to Fulton County Interim Elections Director Nadine Williams.

Fulton County held a press conference this morning at 10 a.m. to talk about voting in Fulton County.

COMPLETE ELECTION 2022 COVERAGE

Fulton County has approximately 800,000 registered voters, 249 polling places, and nearly 3,000 volunteers.

Officials say that a “peer” of the female poll worker reported comments made by the woman during a poll worker event and on social media.

Officials looked into the report and contacted the Secretary of State with their concerns. The Secretary of State reportedly agreed with their concern and officials decided to remove the woman and her son, both of whom were poll workers in Johns Creek.

The woman and her son were removed before polls opened on Tuesday morning.

The pair were not identified and officials say they were not at liberty to report exactly what the comments were. However, they did say that it concerned a threat to election security and may have involved videos and photos that should not have been posted online.

Fulton County election officials also discussed a problem at a poll location in Chattahoochee Hills.

Approximately 20 voters could not vote because records indicated they were registered to vote in Cobb County. Election officials say those voters were given provisional ballots and they are investigating the incident.

Officials say they are pleased overall with how the day has started and no other issues have been reported.
