The status of belligerent occupation ends when the conditions for its application are no

longer met. Certain GC obligations with respect to occupied territory continue for the duration

of the occupation after the general close of military operations.

11.3.1 End of Occupation. Belligerent occupation ceases when the conditions for its

application are no longer met.81

In particular, as discussed below, the status of belligerent occupation ceases when the invader no longer factually governs the occupied territory or when a

hostile relationship no longer exists between the State of the occupied territory and the

Occupying Power.

Belligerent occupation ends when the Occupying Power no longer has effectively placed

the occupied territory under its control.

prevent the Occupying Power from actually enforcing its authority over occupied territory.

Similarly, the Occupying Powerโ€™s expulsion or complete withdrawal from the territory would

also suffice because the former Occupying Power generally would not be able to control

Belligerent occupation also may end when a hostile relationship no longer exists between

the Occupying Power and the State of the occupied territory (although, as discussed in the

following subsection, certain GC obligations may continue to apply).

independent government of the previously occupied territory assumes control of the territory and

consents to the presence of the previously occupying forces, then such a situation would no

Israel Rejects "With Disgust" South Africa's Gaza-Related Genocide Case At World Court

 

Israel is seething with outrage after South Africa has formally asked the International Court of Justice (or "World Court") to open a case for alleged war crimes against Israel related to its Gaza military operation. Specifically, South Africa is accusing Israel of violating the UNโ€™s Genocide Convention.

 

Pretoria asked the court to issue provisional measures demanding that Israel immediately halt its military campaign in Gaza, with a statement saying this is "necessary in this case to protect against further, severe and irreparable harm to the rights of the Palestinian people."

 

The submission to the World Court alleges "acts and omissions by Israel" which are "genocidal in character" as they are committed with the intent "to destroy Palestinians in Gaza" - which in essence targets a national, racial and ethnic group.

 

Israel's Foreign Ministry issued a blistering rebuke in response, rejecting the filing "with disgust" and called Pretoria's accusations a "blood libel" - essentially saying the South African government's charge is being fueled by antisemitism.

 

Israel also blasted Pretoria for sympathizing with terrorists who massacred civilians:

 

โ€œSouth Africaโ€™s claim has no factual and judicial basis and is a despicable and cheap exploitation of the court,โ€ the ministry says in a statement. โ€œSouth Africa is collaborating with a terror group that calls for the destruction of the State of Israel.โ€

 

The ministry blames Hamas for the suffering of Palestinians in the Gaza Strip by attempting โ€œto carry out genocideโ€ on October 7, when terrorists from the Strip killed some 1,200 people and took around 240 hostages after invading southern Israel.

 

"We call on the International Court of Justice and the international community to reject the baseless claims of South Africa out of hand," the response statement said further.

 

The irony in all this is that the 1948 Genocide Convention at issue here was drafted in the wake of the Holocaust, toward the end that targeting an entire people for destruction would 'never again' happen. South Africa, itself long under an apartheid government, has also at times accused Israel of setting up an apartheid system to discriminate against Arabs and Palestinians.

 

All of this is also part of the international pressure campaign - particularly from the Global South - which Tel Aviv and Washington have felt of late, pushing back on and denouncing the Gaza offensive which Palestinian sources say have taken over 21,000 mostly civilian lives.

Israel sued for โ€˜genocideโ€™ in The Hague

South Africa has asked the International Court of Justice to intervene in Gaza conflict

 

South Africa has filed an appeal before the International Court of Justice (ICJ) in The Hague, alleging that Israeli actions in Gaza amount to โ€œgenocideโ€ and asking for โ€œprovisional measuresโ€ to stop it, the top UN court announced on Friday.

 

The application claims โ€œacts and omissions by Israelโ€ฆ are genocidal in character, as they are committed with the requisite specific intent โ€ฆ to destroy Palestinians in Gaza as a part of the broader Palestinian national, racial and ethnical group,โ€ the ICJ said in a statement.

 

Israelโ€™s conduct towards the Palestinians in Gaza โ€œis in violation of its obligations under the Genocide Convention,โ€ the government in Pretoria said. They also accused Israel of having โ€œfailed to prevent genocideโ€ and โ€œfailed to prosecute the direct and public incitement to genocideโ€ since October 7.

 

South Africa also asked the ICJ to โ€œindicate provisional measuresโ€ in order to โ€œprotect against further, severe and irreparable harmโ€ to Palestinians under the Genocide Convention. The ICJ also published the 84-page document that lists these measures in detail, first of which is for Israel to โ€œimmediately suspend its military operations in and against Gaza.โ€

 

Pretoria also demands of West Jerusalem to stop any and all attacks on Palestinians, and to revoke any orders whose goal is โ€œthe expulsion and forced displacement from their homesโ€ or deprivation of access to food, water, fuel, shelter, medical supplies and other humanitarian needs.

 

Anyone who engages in โ€œdirect and public incitementโ€ to genocide or conspiracy to commit it must be brought to justice, the appeal insists. South Africa demanded Israel submit a report on complying with all these demands within one week.

 

Under the ICJโ€™s rules, South Africaโ€™s application has priority over all other cases, because of the request for provisional measures.

 

South Africa has previously sought to charge Israel with war crimes before the International Criminal Court (ICC). West Jerusalem is not a signatory party to the ICC, but the court โ€“ also based in The Hague โ€“ has previously declared it had jurisdiction over Gaza and the West Bank.

 

On the other hand, both South Africa and Israel are signatories of the Convention on the Prevention and Punishment of the Crime of Genocide, which was first adopted in 1948, in response to the Nazi mass murder of Jews during WWII.

The aide to Kievโ€™s top general has made a novel argument for mobilization

 

A death in battle is preferable to a car crash, Alla Martinyuk, an aide to the supreme commander of the Ukrainian Armed Forces, General Valery Zaluzhny, said in an interview on Friday.

 

Martinyuk, 37, is a former theater and TV actress who currently serves as an โ€œexternal adviserโ€ to Zaluzhny. In a broadcast shared on social media by the Kiev-based news agency UNIAN, she argued against the reaction of most Ukrainians to getting mobilized into the military.

 

โ€œI now see when someone gets a summons, the mothers immediately write [that] they are already hysterical and almost immediately say goodbye to the lives of their sons,โ€ Martinyuk said on air. โ€œBut I will tell you, this is not right. All this hysteria is not needed. You need to believe that your son is a hero and the flower of the nation.โ€

 

โ€œWe will all die anyway. Leaving this life with dignity is much better than walking down the street and [having] a brick fall on you or a car run you over,โ€ she added.

 

Zaluzhny has distanced himself from Martinyukโ€™s words, saying on social media that โ€œunpaid aides were not authorized to make public commentsโ€ on his behalf. He added he did not have any โ€œunpaid aides and consultantsโ€ since Thursday.

 

President Vladimir Zelensky recently announced a plan to mobilize 500,000 additional troops to make up the battlefield losses, even as officials across the country admitted difficulties with meeting draft quotas.

 

Zelensky and Zaluzhny have tried to pass the blame for this situation onto each other as the Ukrainian parliament debated lowering the draft age to 25 and allowing the mobilization of women into combat roles. Some regional governors have proposed even more drasticmeasures.

 

Former PM Yulia Tymoshenko, who now leads a small opposition party in the Verkhovna Rada,has argued that Zelenskyโ€™s mobilization proposal was both ineffective and unconstitutional. She also said Ukraine would be better off deploying police and trained security personnel to the front lines instead.

Government Censorship of Natural

Health Products on the Rise

Hundreds of letters have been sent to natural products companies warning them that if they fall afoul of the FTCโ€™s ridiculous rules by sharing information that can benefit your health, there will be hell to pay. Action Alert!

 

Once again, the government is trying to limit access to the information we have about the benefits of natural products. The FTC sent letters to 670 companies, including those selling dietary supplements, homeopathic products, and functional foods, warning them that if they make claims without proper scientific substantiation, they will face large civil penaltiesโ€”up to $50,120 per violation. This unprecedented move is a warning shot to the natural health industry signaling that weโ€™re entering a new era of enforcement in which the government will be even more aggressive than it has been in censoring speech about the benefits of natural products. We must push back.

 

This is a complex issue that is quite technical, but what weโ€™re facing is a government-led campaign to conceal the remarkable truth about the healing and disease-preventing powers of foods and nutrients, ultimately misleading the public so that they spend their money on drugs rather than natural supplements.

 

The crux of the issue is that the FTC, in conjunction with the FDA, is trying to impose drug standards on supplements, requiring expensive clinical trials in order for supplement companies to make most health claims. Not only are clinical trials often inappropriate for studying nutrients, they are not economically feasible. As weโ€™ve explained many times, clinical trials are incredibly expensive. Drug companies can afford them because drugs are patentable and the costs can be recouped when the drug is approved and sold for exorbitant prices. Nutrients generally cannot be strongly patented, so the costs of clinical trials cannot be recouped. The government knows this, so the attempt to require clinical trials for supplement claims is a backdoor ban on most claims. This makes sense if your goal is to protect the drug industry from competition, but not if you want to promote public health by empowering consumers with information so they can take control of their own health.

The salvo of FTC letters was preceded by a revision to the agencyโ€™s Health Products Compliance guidance in December 2022, which includes a crucial change. Companies must have โ€œcompetent and reliableโ€ scientific evidence in support of health claims in advertising. Previously, this could include all kinds of studies, such as animal, in vitro, or epidemiological studiesโ€”though clinical trials were considered โ€œbest.โ€ The revised guidance states that,

 

substantiation of health-related benefits will need to be in the form of randomized, controlled human clinical testing (RCTs) to meet the competent and reliable scientific standardโ€ฆAnimal and in vitro studies may provide useful supporting or background information, but, without confirmation by human RCTs, they arenโ€™t sufficient to substantiate health-related claims.

 

This change can be traced to the lawsuit brought by the FTC against Pom Wonderful, the pomegranate juice company, in 2014. Recall that the agency went after Pom Wonderful for advertising the health benefits of its productsโ€”even though the company spent $35 million on studies to back up its claims. But this wasnโ€™t enough for the FTCโ€”they wanted two RCTs, a drug standard, to substantiate health advertising claims. The courts rejected the two RCT standard but said one RCT could be required. The FTC is now alerting companies that it plans to enforce this ridiculous standard.

 

In the FTCโ€™s updated guidance there is even an indication that the agency will, in practice, require two RCTs, not just oneโ€”contrary the opinion delivered by the Court in the Pom case:

Although there is no requirement for a specific number of RCTs, the replication of research in an independently conducted study adds to the weight of the evidence. Replication in a second study by independent researchers reduces the chance that the results of a single RCT may be influenced by unanticipated, undetected, systematic biases that may occur despite the best intentions of sponsors and investigators.

 

Note that the FDA and the FTC work together to regulate health claims, and both apply a similar framework that heavily weights evidence provided by clinical trials when reviewing health claims. FDA rules state that there must be โ€œsignificant scientific agreementโ€ among qualified experts that health claims are supported by the totality of publicly available science. Like the FTC, the FDA categorically rejects most kinds of evidence other than clinical trials in determining what constitutes โ€œsignificant scientific agreement.โ€

 

Given these agenciesโ€™ history, the outlook for free speech isnโ€™t good. The government has a proven track record in egregiously restricting truthful claims about supplement benefits. Weโ€™ve reported on the FDAโ€™s attack on cherry and walnut growers for listing the health benefits of those foods on their websites. Weโ€™ve told you about the FDAโ€™s restriction of legal structure/function claims because they are โ€œimplied disease claimsโ€โ€”an FDA fabrication that isnโ€™t in the law. There was the massive, coordinated censorship campaign launched during COVID by the FDA and the FTC threatening doctors and clinics that told us about the benefits of natural products like vitamin D and zinc for COVID treatment and prevention. We reported on the FTCโ€™s campaign against Xlear, a nasal spray company, for discussing the results of more than a dozen studies demonstrating the plausibility of using its nasal spray to help with COVID. There are many more examples.

 

This is also another instance of US regulators trying to โ€œharmonizeโ€ US law with the European Unionโ€™s (EU) draconian system. As our friends at ANH-International have pointed out, most botanicals in the EU arenโ€™t allowed any health claims, and there are only a handful of approved claims for vitamins and minerals. The EUโ€™s FDA equivalent rejected the vast majority of some 44,000 proposed nutrient health claims because they didnโ€™t have what they considered to be the proper substantiation. We cannot allow the US government to follow this model.

Itโ€™s a political clichรฉ, but triteness doesnโ€™t make it any less true: losing candidates do desperate, stupid things.

 

Ron DeSantis is losing. Over nine months, he and his allies have spent $100 million only to lose half his support in the polls. Now, a month away from the Iowa caucuses, heโ€™s boxed himself into an Iowa-or-bust corner with his presidential ambitions hanging by a thread.

 

As a result, he is also desperate. DeSantis is throwing a wide variety of attacks at the wall in the hopes that something โ€” anything โ€” will stick. The problem is many of the attacks on Nikki Haley reek of hypocrisy because DeSantis had the exact same positions.

 

Bathroom Bills

 

Ron DeSantis will tell you that he signed a bill directing people to use the bathroom that aligns with their gender at birth. Thatโ€™s true โ€” he signed a bathroom bill on the cusp of launching his presidential campaign. Now rewind four years.

 

In 2018, as a gubernatorial candidate โ€” before he refashioned himself into an anti-woke warrior โ€” DeSantis was dismissive of government meddling in the bathroom issue. He told Frank Luntz, โ€œI think getting into the bathroom wars โ€” I donโ€™t think thatโ€™s a good use of our time.โ€ That hasnโ€™t stopped DeSantis from attacking Nikki Haley from having the same stance in 2016.

 

The truth is that the bathroom issue wasnโ€™t as widespread in 2016 and 2018. Both Haley and DeSantis were aligned with the times when they argued it wasnโ€™t necessary for the government to get involved. But DeSantis has doubled down on this line of attack even as fact checkers point out this inconvenient truth.

 

Social Security

 

In a CNN town hall, Ron DeSantis attacked Haley for proposing an increase in the retirement age for workers in their 20s in order to deal with the Social Securityโ€™s looming insolvency. Has DeSantis forgotten that he called for raising the retirement age in 2012 as a congressional candidate because โ€œthe system was not originally designed for people to be on it for 30 yearsโ€? Has DeSantis forgotten that he voted for budget resolutions that would have raised the retirement age to 70 in 2013, 2014, and 2015?

 

Iโ€™m sure, his memory is just fine. More likely, his desperation is just getting worse by the day.

Haley has admitted that she recruited Chinese businesses to South Carolina 10 years ago and also acknowledged that Americaโ€™s approach to China has rightly shifted since then. That hasnโ€™t stopped Ron DeSantis from spending millions of dollars attacking Haley on China. Nor has it stopped him from denying his own ties to Chinese businesses as governor.

 

In the third presidential debate, DeSantis went after Haley, claiming that, โ€œYou gave [China] stuff, I didnโ€™t give them anything.โ€ This is demonstrably false. The DeSantis administration gave hundreds of thousands of dollars in state subsidies to Jinko Solar, a Chinese company that was raided by the Department of Homeland security six months ago.

 

DeSantis also accepts campaign contributions from a Chinese-backed company while denying Chinaโ€™s role in the company. And he recruited Chinese businesses for several years and boasted about his administrationโ€™s efforts in promotional reports.

 

George Floyd

 

Ron DeSantis criticizes Haleyโ€™s initial reaction to George Floydโ€™s death, in which she said that his death should be โ€œpainful and personalโ€ for everyone. This empathetic response to a graphic case of police brutality is somehow supposed to prove that Haley is too woke or too liberal to be president. Never mind that Haley has been extremely outspoken in her criticism of the Black Lives Matter movement and the riots and violence that ensued. Never mind also that Ron DeSantis had an eerily similar response to the Floyd video.

 

โ€œWhen I saw the video of that cop murdering George Floyd, I was just absolutely appalled by what I saw,โ€ DeSantis told a group of reporters at the time. โ€œBut I immediately asked folks at [the Florida Department of Law Enforcement] and others, โ€˜How in the hell could you get away with even doing that tactic?โ€™ And sure enough, [in the] State of Florida, you do not put knee on a neck like that. That is not good training โ€ฆ I think everyone agrees thatโ€™s totally intolerable what happened.โ€

 

The campaign trail is littered with the political corpses of candidates who failed to live up to their great expectations. Ron DeSantis will go down in the history books as a prime example. In his case, it wasnโ€™t a lack of resources or institutional support that felled him. It was his inauthenticity.

 

At the presidential level, where candidates are forced to talk to voters face to face โ€” not once, but over and over โ€” voters can sniff out a phony. DeSantisโ€™ disingenuous attacks on Nikki Haley are solid proof of this.

Posting on Night Shift one last time, just in an effort to get as many eyes on as possible. Whether you help me or not is your choice.

 

This is long but please read because I need help from real anons.I am just a plain American citizen and have been participating here in some way since the beginning, lurking, digging, shit posting, whining, etc., and I have had some notables as well.

 

I have been given some information related to criminal activity in several states, which is in my opinion a national security threat and I really believe President Trump could be in danger.

 

I tried to call President Trump at Bedminster and at Mar-a-Lago without any success, and then I wrote a two-page letter to LT. Governor Dan Patrick - TX, which I did not include here, explaining the scope and nature of the information I have in my possession, thinking he was the most appropriate person in my state to give the information to and also believing he would pass it on to Governor Abbott, Senator Ted Cruz, and other Republican Governors who I thought would be concerned and take action, which of course would include getting it to President Trump. Giant red pill. I never heard from him, despite having sent the letter to his personal residence because he lives very close to where I lived and because I thought there was a better chance of the letter actually getting into his hands.

 

About two weeks later, I then took the letter that I wrote to LT. Governor Patrick and wrote a cover letter, addressed to President Trump (CoverLetterPresidentTrump.jpg), and sent it to General Flynn at his personal residence, along with my contact info, hoping he would read between the lines, and realize I was trying to get very important and time sensitive information to President Trump, and needed someone with direct access to him to deliver it to him ASAP. Red pill 2, nothing happened.

 

Then, I revised the cover letter, addressed to President Trump, (RevisedCoverLetterPresidentTrump) explaining that I had sent the letter first to the LT. Governor and then to General Flynn, and sent it to President Trump at Mar-a-Lago, on May 21, and ultimately got the same response. Nothing.

 

At this point, I don't believe President Trump received any of my messages or my letter, and the thought occurred to me that the Q post that said POTUS was 100% insulated might not be entirely a good thing. It could mean nothing gets to him unless whoever is insulating him thinks he should see it.

 

In addition, I am in some trouble, I think serious trouble, for having this information, because some of the criminals know I have it, and are stalking me, and my phone is totally compromised. My family members donโ€™t get my phone calls, and I donโ€™t get any from them, and it seems like they are preventing me from getting this information to law enforcement, and as difficult as it is for me to believe this, I think some law enforcement is actually involved and others are helping cover for them. I think my life is in danger.

 

I donโ€™t know if I believe President Trump or Dan Scavino ever check in on this place, but I am posting the images of the cover letters that I mailed to General Flynn and President Trump here, and I am hoping anons will share these on other sites, like you would a meme, and also hoping that President Trump will somehow see them and has a magic way to find out where I am, because I donโ€™t have a permanent address right now (not for three years โ˜น) and my phone is fucked.

The law bans books depicting sex acts from school libraries and classrooms and blocks teachers in Iowa classrooms from discussing gender identity and sexual orientation issues with students through the sixth grade.

 

 

A federal judge issued a ruling Friday that will temporarily block enforcement of an Iowa law that bans pornographic books from school libraries and prohibits teachers from raising LGBTQ+ issues.

 

The law, the Associated Press reports, was passed in early 2023 by the stateโ€™s Republican-led Legislature and Republican Gov. Kim Reynolds. It bans books depicting sex acts from school libraries and classrooms. It also blocks teachers in Iowa classrooms from discussing gender identity and sexual orientation issues with students through the sixth grade.

 

Judge Stephen Locher issued the preliminary injunction stopping enforcement of the law, which was set to take effect on Jan. 1. The ruling blocks both provisions of the law.
