Apollo Slapped With Lawsuit Alleging "Widespread Fraudulent Human Life Wagering Conspiracy"

 

Apollo Global Management has been entangled in a scandalous lawsuit and accused of acquiring illegal life insurance policies on senior citizens through a complex web of shell trusts.

 

The company allegedly used an affiliate, Financial Credit Investment, to manage about a $20 billion portfolio of stranger-originated life insurance policies, effectively engaging in what the lawsuit claims:

 

"In short, Apollo has been carrying out a widespread fraudulent human life wagering conspiracy designed to not only hide its involvement, but to create the false appearance that the policies it owns are somehow legitimate."

 

The complaint continues:

 

"Worse still, when Apollo senses a claim is going to be brought, it attempts to dissolve its shell entities to give itself yet another layer of protection."

 

This scheme was designed to give the policies the illusion of legitimacy. Martha Barotz's estate initiated the legal action filed in Delaware's Chancery Court last Friday. It raises serious questions about Apollo's ethical practices.

 

"In this way, the senior citizens have no idea who owns a policy on their life, and who wants them dead," the suit said, adding, "Apollo was fraudulently and illegally using these shell entities to perpetuate human life wagers not only on the life of Mrs. Barotz, but on the lives of hundreds (if not thousands) of other senior citizens."

 

Bloomberg first reported on the lawsuit. Responding to BBG's note, Joshua Rosner, a Graham Fisher & Co. managing partner, wrote on X that Apollo's actions are "mind-bending and horrifying."

White House Officially ClaimsBiden Has Made 148 Mistakes During 2024Public Remarks

The White House releases an official transcript anytime the president gives a speech or takes questions. Communications staff frequently correct, add to or alter Bidenโ€™s official remarks in order to either bring them into compliance with official White House policy or, in some cases, reality, a Daily Caller analysis showed. In several cases, official statements had to be changed to convey the exact opposite of what Biden actually said.

 

Through 118 statements, speeches and chats with reporters spanning from Jan. 1 to April 24, the White House has officially updated its transcript with corrections to what the president said out loud at least 148 times.

 

Some of the modifications include corrections to names, dates and titles of organizations. Others change verbs and modify the meaning of the presidentโ€™s statement entirely. Words that the president didnโ€™t say, but shouldโ€™ve, according to the White House staff, have also been added to the transcripts.

Presidential Debates Commission sticking to original schedule amid Trump's calls for earlier debates

 

First presidential debate slated for Sep 16 at Texas State University in San Marcos

 

The Commission on Presidential Debates will proceed with its original schedule despite requests from former President Trump's campaign for earlier events.

 

The commission released its schedule in November last year, but Trump's camp has urged organizers to offer earlier and more frequent debates in a bid to outshine Biden onstage.

 

"The CPDโ€™s criteria [โ€ฆ] will be applied in early September; afterward, the Commission will extend debate invitations to qualifying candidates," the CPD told Fox News Digital.

 

The commission added, "The CPD is proceeding with production and broadcast plans at its four debate sites as also announced on November 20, 2023."

 

Radio personality Howard Stern hosted Biden last week for an interview in which the president confirmed his intentions to debate his Republican opponent.

 

"I am, somewhere, I donโ€™t know when," Biden replied. "I'm happy to debate him."

 

Trump pounced on the comment, asserting that he was eager to debate under any conditions and at any time.

 

"Everyone knows he doesnโ€™t really mean it, but in case he does, I say, ANYWHERE, ANYTIME, ANYPLACE, an old expression used by Fighters," the former president wrote on Truth Social.

 

Earlier this year, the Trump campaign wrote a letter to the commission to request that the debate schedule be expanded and moved up on the calendar.

 

"The Commission must move up the timetable of its proposed 2024 debates to ensure more Americans have a full chance to see the candidates before they start voting, and we would argue for adding more debates in addition to those on the currently proposed schedule," Trump advisers Susie Wiles and Chris LaCivita wrote in the letter.

 

Prior to the Stern interview, the Biden camp remained coy about the president's willingness to debate, characterizing Trump's emphasis on the question as desperate.

 

"If I were him, I would want to debate me, too," Biden told reporters in Nevada this year. "Heโ€™s got nothing else to do."

 

The first presidential debate is scheduled for Sept. 16 at Texas State University in San Marcos, Texas. The second debate will be in Petersburg, Virginia, on Oct. 1, and the third will be held in Salt Lake City on Oct. 9. A vice presidential debate is scheduled for Sept. 25 in Easton, Pennsylvania.

I just filed an official ethics complaint against Jack Smith with the Department of Justice's Office of Professional Responsibility for his illegal election interference.

 

Itโ€™s obvious to any reasonable observer that Jack Smith is trying to interfere with the 2024 election and stop the American people from electing Donald Trump. At every turn, he has sought to accelerate his illegal prosecution of President Trump for the clear (if unstated) purpose of trying him before the November election.The Justice Departmentโ€™s own policies clearly prohibit Smith from doing so, and as a DOJ employee he is bound by those policies.Moreover, when thedistrict court imposed a stay on the proceedings, Smith and his office ignored it and continued to file discovery documents. Smithโ€™s conduct has brought disrepute to the Department of Justice and the entire federal government, and the DOJโ€™s Office of Professional Responsibility should impose the discipline that such conduct warrants.

I write today to request an ethics investigation of Biden Justice Department special counsel Jack Smith for abusing the resources of the federal government to unlawfully interfere with the 2024 presidential election. Jack Smithโ€™s multiple attempts to rush to trial the federal January 6th case against President Trump violated long-standing, explicit Justice Department policy. Further, Jack Smithโ€™s repeated violations of the United States District Court for the District of Columbiaโ€™s stay of proceedings are a lawless breach of trial ethics and lawyerly conduct. Jack Smithโ€™s actions brought disrepute to the Justice Department and the federal government as a whole, and he should face discipline appropriately.

 

ATTEMPTING TO EXPEDITE TRIAL IN VIOLATION OF DOJ POLICY

 

In June 2023, Biden special counsel Jack Smith obtained an indictment against President Donald J. Trump. The indictment charges President Trump with several offenses in relation to the Capitol riot of January 6, 2021. President Trump is now the presumptive Republican nominee for President, having won enough delegates to secure the nomination on March 12, 2024. As we will demonstrate, Biden special counsel Jack Smith is attempting to expedite the trial in order to influence the general election in November. This conduct violates Section 9-85.500 of DOJโ€™s Justice Manual to which Jack Smith is bound.1

 

Section 9-85.500 dictates that โ€œ[f]ederal prosecutors . . . may never select the timing of any action . . . for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party.โ€ Jack Smith first violated this rule whenโ€“in August 2023โ€“he petitioned the District Court for a January 2, 2024, trial date. There exist approximately thirteen million pages of discovery for President Trump to review, plus thousands of hours of camera footage. Prosecutors bringing a case of this complexityโ€“with so many consequential and novel legal issues to sort outโ€“would normally never seek to bring it to trial within five months. The only reason to push for such an early trial date was to work to get the case tried before the November election, and the Justice Department Manual clearly forbids Jack Smith from taking any action on that basis.

 

Biden special counsel Jack Smith next violated this Justice Department provision when he petitioned the Supreme Court of the United States for a writ of certiorari before judgment in December.2 This extraordinary petition sought to bypass the normal appellate process, which involves a decision by a Court of Appeals panel and, possibly, review by the en banc court. Jack Smith asserted that it was โ€œimperativeโ€ for the Supreme Court to grant his highly unusual request,3 but on December 22, 2023, the Supreme Court denied Jack Smithโ€™s petitionโ€ฆ.

Columbia University suspends press access on campus amid pro-Palestine protests

 

"Media access to campus is suspended. Campus is accessible only to CUID-holders and essential personnel as a safety measure and that includes media," the University announced.

 

The university also revealed that early Tuesday morning, "a group of protestors occupied Hamilton Hall on the Morningside campus of Columbia University."

 

To protect the safety of the community during the "protest activity," the university said it has asked students and faculty to "avoid coming to the Morningside campus to do so; essential personnel should report to work according to university policy."

 

The university also said that "access to campus has been limited to students residing in residential buildings on campus and employees who provide essential services to campus buildings, labs, and residential student life."

That Jack Smith was solely motivated by the desire to interfere in the November election was effectively proven two months later. In February, President Trump petitioned for certiorari on the issue of presidential criminal immunity for official acts.4 Biden special counsel Jack Smithโ€”having supported certiorari just two months earlierโ€”now opposed certiorari. Jack Smith effectively repudiated his own arguments from two months earlier, with little explanation for his about-face other than his naked assertion that โ€œ[t]he nation has a compelling interest in the prompt resolution of this case.โ€5 Opp. To Pet. For Cert. at 34-35. Aside from the upcoming election, what โ€œcompelling interestโ€ does the public have in the prompt resolution of this case? Why should this interestโ€”based on an unstated reasonโ€”override the due process rights of a criminal defendant?

 

Moreover, if the case were so important that Jack Smith believed the Supreme Court should take the extraordinary step of granting certiorari before the Court of Appeals could weigh in, how could he now argue that the case was not important enough for even a normal grant of certiorari? The only way to reconcile Jack Smithโ€™s filings is to recognize that his obvious goal was not to seek justice and the neutral application of the law, but rather to get President Trumpโ€“ and get him before November.

 

Smith and his team have claimed that they are not in violation of the Justice Manual because, he argues, the relevant provision applies only to the timing of the indictment itself, and not to cases that are already being litigated.6 This is an implausible reading; Justice Manual section 9-85.500 applies to โ€œany actionโ€ by โ€œfederal prosecutors and agents,โ€ โ€œincludingโ€ (but not limited to) โ€œinvestigative steps, criminal charges, or statements.โ€ On its face, section 9- 85.500 also applies to the โ€œactionsโ€ by the Special Counsel undertaken in the course of prosecuting this case against President Trump, including the attempt to obtain a preposterously early trial date, as well as the filing of an extraordinary request for certiorari for judgment.

 

Jack Smith has not talked about the election in his filings because it is an obviously improper reason to expedite President Trumpโ€™s trial. Biden special counsel Jack Smithโ€™s actions, however, leave no doubt that the election is driving his timing decisions. No other plausible reason exists for why he is rushing this case against a criminal defendant in a manner inconsistent with the Justice Departmentโ€™s usual practice.

 

VIOLATIONS OF COURT-ORDERED STAY

 

Biden special counsel Jack Smith also repeatedly and deliberately violated the District Courtโ€™s stay of proceedings, in violation of D.C. Rule of Professional Conduct 3.4(c). When President Trump appealed the District Courtโ€™s interlocutory order denying his motion to dismiss the case on presidential immunity grounds, theDistrict Court issued a stay of proceedings as required by unambiguous Supreme Court precedent.7 Thus, the District Court rightly stayed โ€œany further proceedings that would move this case towards trial or impose additional burdens of litigation on Defendant.โ€8 But Jack Smith repeatedly flouted the District Courtโ€™s order.

This conduct strongly supports the opening of an ethics investigation to hold Biden special counsel Jack Smith accountable for prosecutorial misconduct.

 

Jack Smith emphatically said that โ€œno one in this country . . . is above the law.โ€13If that is true, then he should be open to, and welcome, an ethics investigation into conduct that, on its face, implicates potential violations of DOJ policy and multiple rules of professional conduct.

WASHINGTON (AP) โ€” The U.S. Drug Enforcement Administration will move to reclassify marijuana as a less dangerous drug, The Associated Press has learned, a historic shift to generations of American drug policy that could have wide ripple effects across the country.

 

The proposal, which still must be reviewed by the White House Office of Management and Budget, would recognize the medical uses of cannabis and acknowledge it has less potential for abuse than some of the nationโ€™s most dangerous drugs. However, it would not legalize marijuana outright for recreational use.

 

The agencyโ€™s move, confirmed to the AP on Tuesday by five people familiar with the matter who spoke on the condition of anonymity to discuss the sensitive regulatory review, clears the last significant regulatory hurdle before the agencyโ€™s biggest policy change in more than 50 years can take effect.

 

Once OMB signs off, the DEA will take public comment on the plan to move marijuana from its current classification as a Schedule I drug, alongside heroin and LSD. It moves pot to Schedule III, alongside ketamine and some anabolic steroids, following a recommendation from the federal Health and Human Services Department. After the public comment period and a review by an administrative judge, the agency would eventually publish the final rule.

 

โ€œToday, the Attorney General circulated a proposal to reclassify marijuana from Schedule I to Schedule III,โ€ Justice Department director of public affairs Xochitl Hinojosa said in a statement. The DEA is a component of the Department of Justice. โ€œOnce published by the Federal Register, it will initiate a formal rulemaking process as prescribed by Congress in the Controlled Substances Act.โ€

 

Attorney General Merrick Garlandโ€™s signature throws the full weight of the Justice Department behind the move and appears to signal its importance to the Biden administration.
