49 U.S. States Now Supplying ILLEGALS with Voter Registration Forms

 

Illegal aliens and other "non-citizens" can receive voter registration forms without needing to show proof of citizenship in at least 49 states.

The National Voter Registration Act (NVRA) of 1993 mandates that states facilitate voter registration at their respective departments of motor vehicles (DMVs) and other welfare offices. These agencies must provide voter registration forms alongside application papers.

 

Illegals can then use these forms to access welfare benefits and obtain driver's licenses and mail-in ballots. At least 19 states and the District of Columbia also allow illegals to obtain driver's licenses, said the National Conference of State Legislatures

 

Without a federal law requiring proof of citizenship for voter registration forms, migrants can simply claim to be U.S. citizens to register to vote, easily bypassing the official ban on non-citizens voting. Only Arizona has passed a law preventing this practice, but it applies only to state forms and not federal ones.

 

Probes and audits at both the federal and state level have revealed numerous illegals being included in voter rolls. Even Hans von Spakovsky, a former member of the Federal Election Commission, has highlighted various instances of illegal immigrants voting unlawfully in elections at different levels. "It's a real problem, not an imaginary problem," he told the New York Post.

Now that the dust has settled, here’s what I believe happened with the debate:

 

The war between Biden machine & the Obama machine spilled into the open

 

Democrat leaders on both sides are truly panicking about Biden’s crashing poll numbers

 

Biden knows if he’s out of power, his crime family will be prosecuted and disgraced and Jill Biden has gotten way to used to the lifestyle - she won’t give it up

 

Obama team knows their mafia operation will be prosecuted under Trump as well

 

So both sides are desperate and fighting over whose strategy is best to beat Trump

 

Obama machine launched a final sneak attack to pressure Joe to drop out after the debate that they knew he would be awful in

 

It didn’t work

 

Biden met with Obama the next day, made clear he wasn’t quitting, and now Obama machine puppets are all backtracking, including Obama himself

 

It’s now clear that Biden controls the DNC machine while Obama controls the media machine

 

The Democrat machine as a whole is begrudgingly unifying behind Biden in hopes that he can pull it off

 

But make no mistake - these people are truly scared of what’s coming down the road for them under Trump

 

I’ve never seen them act this desperately

 

These are not the moves of a confident & powerful regime

 

They are divided and desperate

 

If Trump wins, we will truly destroy the Deep State and they know it

What is "Chevron deference" …???

 

Looks like it's all about what the manufacturing industry regulations consider to be a SAUCE of pollution, specifically air pollution. So, this goes to the core of the CO2 argument.

 

Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., 467 U.S. 837 (1984), was a landmark decision of the United States Supreme Court that set forth the legal test for when U.S. federal courts must defer to a government agency's interpretation of a law or statute.[1] The decision articulated a doctrine now known as "Chevron deference".[2] Chevron deference consists of a two-part test that is deferential to government agencies: first, whether Congress has spoken directly to the precise issue at question, and second, "whether the agency's answer is based on a permissible construction of the statute."

 

The decision involved a legal challenge to a change in the U.S. government's interpretation of the word "source" in the Clean Air Act of 1963. The Act did not precisely define what constituted a "source" of air pollution. The Environmental Protection Agency (EPA) initially defined "source" to cover essentially any significant change or addition to a plant or factory. In 1981, the EPA changed its definition to be mean only an entire plant or factory. This allowed companies to build new projects without going through the EPA's lengthy new review process if they simultaneously modified other parts of their plant to reduce emissions so that the overall change in the plant's emissions was zero. Natural Resources Defense Council, an environmentalist advocacy group, successfully challenged the legality of the EPA's new definition.[3]

 

Chevron is one of the most important decisions in U.S. administrative law. It has been cited in thousands of cases since its issuance in 1984.[4]

 

Thirty-nine years later, in May 2023, the Supreme Court granted certiorari to reevaluate Chevron. Loper Bright Enterprises v. Raimondo, No. 22-451. A decision is expected in the first half of 2024.[5]

Wildfire near Scottsdale forces evacuations as air tankers, 200 firefighters battle blaze

 

Nearly 200 firefighters battled a wildfire near Scottsdale on Friday as air tankers dropped retardant on the flames that forced dozens of people to flee their homes overnight.

 

Arizona fire officials said there have been no reports of any injuries or homes damaged by the human-caused fire that broke out at about 2:30 p.m. Thursday near the Boulder Heights subdivision.

 

An estimated 60 people had left their homes by Friday morning after Maricopa County emergency personnel ordered evacuations for the subdivision on the edge of the Tonto National Forest.

 

The Boulder View Fire had burned about 5 square miles with no containment, authorities said.

 

"The southeast side of the fire remained active throughout the night producing 20- 40-foot flame lengths in areas," Tiffany Davila, a spokesperson for the Arizona Department of Forestry and Fire Management, said Friday.

 

“Additional resources were redirected to that side of the fire last night to begin structure protection and help crews start firing operations to tie the fire into nearby roads," she said.

 

The Red Cross set up an evacuation center at a high school in Scottsdale and evacuation shelters for horses and other large animals were established at several locations, including the rodeo grounds at nearby Cave Creek.

 

The Red Cross Evacuation Center at Cactus Shadow High School closed at 8 p.m. Friday and was set to reopen at 7 a.m. Saturday, officials said.

 

Those in the evacuated area that may need services can call the Red Cross at 602-332-1051.

 

With the fire burning to the east, Scottsdale has closed the north portion of its McDowell Sonoran Preserve (north of Dynamite Boulevard) until further notice.

 

“This closure is enacted out of an abundance of caution for the public - while this fire does not presently pose an immediate threat, gusting winds can change that rapidly,” city officials stated in a release.

Over 500 Jewish Tanks and APC/Bulldozers Destroyed in Gaza

 

More than 500 armored vehicles of the Israeli Defense Forces (IDF) have been obliterated while operating in the Palestinian enclave of the Gaza Strip since the start of war last October, Israel’s Maariv reported on June 29.

 

According to the Hebrew-language newspaper, dozens of these vehicles had been completely decommissioned and removed from service.

 

To deal with the losses, the IDF established two logistics centers within Gaza to repair the vehicles damaged in fighting with the Hamas Movement and other Palestinian armed factions in the Strip.

 

Israeli troops responsible for transporting the vehicles are said to be physically and mentally fatigued, Maariv said in its report, adding: “If they are called upon to occupy southern Lebanon, they will be there, but not in their best condition.”

 

The Gaza war has reportedly consumed far more weapons and ammunition than the IDF had initially expected, and usage remains high.

 

The IDF material losses are not suprising considering that Hamas and other factions in Gaza are heavily-armed with anti-armor means, including the locally-made Al-Yassin 105 rocket-proppelled grenade and a wide range of anti-tank guided missiles, including Soviet-made Malyutka, Russian-made Kornet, North Korean-made Bulsae-2 and Chinese-made HJ-8L. Locally-made explosive devices also caused much damaged to Israeli armour in the Strip.

Supreme Court overturns Chevron decision, curtailing federal agencies' power in major shift

Washington — The Supreme Court on Friday overturned a landmark 40-year-old decision that gave federal agencies broad regulatory power, upending their authority to issue regulations unless Congress has spoken clearly.

 

The court split along ideological lines in the dispute, with Chief Justice John Roberts writing for the conservative majority.Justices Elena Kagan, Sonia Sotomayor and Ketanji Brown Jackson were in dissent. Kagan read portions of her dissent from the bench.

 

The court's ruling in a pair of related cases is a significant victory for the conservative legal movement, which has long aimed to unwind or weaken the 1984 decision in Chevron v. National Resources Defense Council. Critics of that landmark ruling, which involved a challenge to a regulation enacted by the Environmental Protection Agency under the Clean Air Act, have said the so-called Chevron doctrine gives unelected federal bureaucrats too much power in crafting regulations that touch on major areas of American life, such as the workplace, the environment and health care.

 

"Chevron is overruled. Courts must exercise their independent judgment in deciding whether an agency has acted within its statutory authority, as the [Administrative Procedure Act] requires," Roberts wrote for the court. The chief justice called the earlier decision a "judicial invention that required judges to disregard their statutory duties."

 

The framework required courts to defer to an agency's interpretation of laws passed by Congress if it is reasonable. Calls for it to be overturned came from not only conservative legal scholars, but some of the justices themselves who have said courts are abdicating their responsibility to interpret the law.

 

The Supreme Court's reversal of the Chevron decision also further demonstrates the willingness of its six-justice conservative majority to jettison decades of past rulings. In June 2022, the court overturned Roe v. Wade, dismantling the constitutional right to abortion, and in June 2023, it ended affirmative action in higher education.

 

"In one fell swoop, the majority today gives itself exclusive power over every open issue — no matter how expertise-driven or policy-laden — involving the meaning of regulatory law," Kagan wrote in a dissent joined by Sotomayor and Jackson. "As if it did not have enough on its plate, the majority turns itself into the country's administrative czar."

 

White House press secretary Karine Jean-Pierre criticized the Supreme Court's decision as "deeply troubling" and said in a statement that it undermines the ability of agencies to employ their expertise.

 

"Republican-backed special interests have repeatedly turned to the Supreme Court to block common-sense rules that keep us safe, protect our health and environment, safeguard our financial system, and support American consumers and workers," she said. "And once again, the Supreme Court has decided in the favor of special interests, just as it did when they sought to gut long-standing protections for clean water, thwart efforts to respond to a global pandemic, and block the cancelation of crippling student debt for tens of millions of Americans."

 

The challenge to Chevron deference

 

The dispute that led to the court's reevaluation of the Chevron doctrine stemmed from a 2020 federal regulation that required owners of vessels in the Atlantic herring fishery to pay for monitors while they're at sea.

 

These at-sea monitors, who collect data and oversee fishing operations, can cost more than $700 per day, according to court filings.

 

The National Marine Fisheries Service implemented the rule under a 1976 law, arguing that the measure allows it to require fishing vessels to cover the cost of the monitors. But companies that operate boats in New Jersey and Rhode Island challenged the regulation in two different federal courts, claiming the fisheries service lacked the authority to mandate industry-funded monitoring.

 

The federal government prevailed in both challenges, and the fishing companies asked the Supreme Court to step in and overrule Chevron.

 

The industry-monitored fishing program was suspended in April 2023 because of a lack of federal funding, and the fishermen were reimbursed for associated costs. Jackson recused herself from one of the two Chevron cases before the court.

Concerns about a ruling

 

While the conservative legal movement decried the growth of the so-called administrative state, the Supreme Court's decision to reconsider the Chevron ruling sparked concerns that unwinding or even limiting the framework would threaten the ability of federal agencies to craft regulations on issues like the environment, nuclear energy or health care.

 

Proponents of the doctrine have argued that agencies have the expertise and experience to address gaps in the laws enacted by Congress, especially when it comes to administering programs that serve broad swaths of the population. Overturning Chevron would make it more difficult for the federal government to implement the laws passed by Congress, its backers warned.

 

Kagan, in dissent, accused the conservative majority of usurping the power the legislative branch gave to agencies to make policy decisions and putting judges in the center of the administrative process on all manner of subjects.

 

"What actions can be taken to address climate change or other environmental challenges? What will the nation's health-care system look like in the coming decades? Or the financial or transportation systems? What rules are going to constrain the development of A.I.?" she wrote. "In every sphere of current or future federal regulation, expect courts from now on to play a commanding role."

 

The Biden administration urged the Supreme Court to leave Chevron deference intact, calling it a "bedrock principle of administrative law." Justice Department lawyers argued that the framework allows experts at federal agencies to interpret statutes, and have said they, not judges, are better suited to respond to ambiguities in a law.

 

Chevron doctrine has been applied by lower courts in thousands of cases. The Supreme Court itself has invoked the framework to uphold agencies' interpretations of statutes at least 70 times, but not since 2016.

 

Roberts wrote for the court that its decision reversing Chevron would not call those questions those prior cases. But with Chevron overruled, Kagan warned of new legal challenges to longstanding agency interpretations that had never previously been targeted.

 

The pair of disputes were among several others that the justices are deciding this term that involve the power of federal agencies. They also weighed the constitutionality of internal legal proceedings at the Securities and Exchange Commission, which threatened to upend the work of administrative law judges in various federal agencies, as well as whether the Bureau of Alcohol, Tobacco, Firearms and Explosives lacked the authority to outlaw bump stocks under a 1934 law that regulated machine guns.

 

The court ruled in a divided 6-3 decision that the ATF did go too far when it banned bump stocks, invalidating the rule put in place during the Trump administration.

The Supreme Court on Friday significantly weakened the power of federal agencies to approve regulations in a major decision that could have sweeping implications for the environment, public health and the workplace.

 

The 6-3 ruling, overturning a precedent from 1984, will shift the balance of power between the executive and judicial branches and hands an important victory to conservatives who have sought for years to rein in the regulatory authority of the “administrative state.”

 

The lawsuits were filed by two groups of herring fishermen challenging a Commerce Department regulation requiring them to pay the salaries of government observers who board their vessels to monitor the catch. But the decision will net a far wider swath of federal regulations affecting many facets of American life.

 

The decision overturns the Chevron v. Natural Resources Defense Council precedent that required courts to give deference to federal agencies when creating regulations based on an ambiguous law. Congress routinely enacts open-ended laws that give latitude to agencies to work out — and adjust — the details to new circumstances.

The majority, she added, “disdains restraint, and grasps for power.”

 

White House press secretary Karine Jean-Pierre described the outcome as “yet another deeply troubling decision that takes our country backwards.”

 

Jean-Pierre said that “Republican-backed special interests have repeatedly turned to the Supreme Court” and that “once again, the Supreme Court has decided in the favor of special interests.”

 

Conservatives have long sought to rein in regulatory authority, arguing that Washington has too much control over American industry and individual lives. The justices have been incrementally diminishing federal power for years, but the new case gave the court an opportunity to take a much broader stride.

 

In the case of the fishermen who brought the case, the law allowed the government to mandate the observers but was silent on the question of who had to pay their salaries, which the fisherman argue added roughly $700 a day to their costs. They encouraged the court to rule that agencies couldn’t enact such a requirement without explicit approval from Congress.

 

The Supreme Court had been trending in that direction for years, knocking back attempts by federal agencies in other contexts to approve regulations on their own. In 2021, for instance, the court’s conservatives struck down a Biden administration effort to extend an eviction moratorium first approved during the Trump administration. Last year, the court’s conservatives similarly invalidated a Biden plan to wipe out student loans of millions of Americans.

Everything You Always Wanted to Know About the Chevron Doctrine

 

This doctrine, formerly known only to specialists, will play a large role under Trump.

 

During the Gorsuch nomination, there was a lot of talk in the press about the Chevron doctrine. Most people have never heard of this doctrine, and only a few are aware of all the nuances. As the Trump Administration’s rulemaking efforts come before the courts, we’re going to be hearing a lot more about it. As the Court’s 2017 Term gets underway, I thought this would be a good time to give a roadmap to the doctrine.in fact, we’ve already seen a short opinion from Justice Gorsuch questioning the application of the doctrine.

 

The Chevron doctrine is a rule about court review of agency actions that many scholars consider central to modern administrative law. That doctrine calls for judges to accept reasonable interpretations of a statute by an administrative agency, even if the judges might have favored different interpretation themselves. The Supreme Court has cited two reasons to give agencies the power to interpret ambiguous statutes: (1) agencies are more democratically accountable than courts, and (2) Congress has given the agency the main responsibility for implementing the statute.

 

Even before Chevron, courts agreed that an agency’s statutory arguments were entitled to respectful consideration, given an agency’s expertise about the statute it administers and the practical and technical issues involved in implementing the law. (This is now known as Skidmore deference.) But Chevron upped the level of deference to agencies. It created a two-step test:

 

Step One. Is the statute’s meaning clear? If so, that meaning controls.

 

Step Two. If the statute is ambiguous, the agency’s interpretation will be upheld by the court provided it is reasonable, even if the court would have chosen an alternative interpretation.

Opposition to Judge Brett Kavanaugh’s appointment to the Supreme Court has almost nothing to do with the nominee himself, who is regarded by almost all serious observers as exceptionally accomplished, experienced, and judicious. He is opposed because his nominator is Donald Trump, and he is opposed because some Democrats feel cheated that President Obama’s 2016 nominee, Judge Merrick Garland, was never given a hearing or a vote. As a practical political matter, that is all that needs be said about the Kavanaugh appointment. Supreme Court move could spell doom for power of federal regulators

Conservatives get the chance to use a dispute over fisheries to deliver the final blow to Chevron deference.

 

A legal doctrine long despised by conservatives for giving federal regulators wide-ranging power is making yet another march to the gallows at the Supreme Court.

 

The high court announced Monday that it is taking up a case squarely aimed at killing off the nearly-four-decade-old precedent that has come to be known as Chevron deference: the principle that courts should defer to reasonable agency interpretations of ambiguous provisions in congressional statutes and judges should refrain from crafting their own reading of the laws.

 

Overturning the doctrine would have major implications for the Biden administration’s climate agenda. It would complicate the administration’s efforts to tackle major issues such as climate change via regulation, including possibly derailing the Environmental Protection Agency’s push to mitigate carbon emissions from the electricity and transportation sectors — the two highest polluting industries in the United States.

 

The Supreme Court’s move is another signal that the court’s conservatives have not tired in their efforts to weaken the administrative state. The top target is the case that played a pivotal role in expanding the powers of federal agencies after it was handed down in 1984: Chevron v. Natural Resources Defense Council.

 

The Chevron doctrine has “been in a coma for a while, so we’ll see whether they want to revive it or take it off life support,” said David Doniger, who in 1984 argued that case before the Supreme Court for the NRDC.

 

Just last fall, Justice Neil Gorsuch said the court had flinched too many times.

 

“At this late hour, the whole project deserves a tombstone no one can miss,” he wrote as the court passed up a Chevron-related case in November. “We should acknowledge forthrightly that Chevron did not undo, and could not have undone, the judicial duty to provide an independent judgment of the law’s meaning in the cases that come before the Nation’s courts.”

 

Justice Clarence Thomas wrote in 2020 that “Chevron is in serious tension with the Constitution,” repudiating one of his own majority opinions from 2005 concluding that the Federal Communications Commission could invoke Chevron deference to justify decisions regulating internet services.

CDC Recommends New COVID-19 Vaccines For Nearly All Americans

 

The U.S. Centers for Disease Control and Prevention (CDC) on June 27 recommended forthcoming COVID-19 vaccines for virtually all Americans.

 

“CDC recommends everyone ages 6 months and older receive an updated 2024-2025 COVID-19 vaccine to protect against the potentially serious outcomes of COVID-19 this fall and winter whether or not they have ever previously been vaccinated with a COVID-19 vaccine,” the agency said in a statement.

 

The COVID-19 vaccines now available, which are also broadly recommended, target the XBB.1.5 strain. But observational data indicate they provide short-lived protection against COVID-19 infection and hospitalization.

U.S. Food and Drug Administration officials, acting on advice from their advisers, recently directed vaccine manufacturers to produce COVID-19 vaccines with updated formulations.

 

Updated vaccines from Pfizer and Moderna will target the KP.2 variant, while an updated shot from Novavax will target the JN.1 variant.

 

The updated formulations are expected to be available in September.

 

CDC advisers earlier Thursday unanimously advised the CDC to recommend the forthcoming vaccines to virtually all Americans, even though no clinical efficacy or safety data are available for them.

 

Data from animal testing suggest that the vaccines trigger higher levels of antibodies than the shots currently available, manufacturers said previously.

 

CDC advisers considered a risk-based recommendation that would only say certain groups receive one of the vaccines but ultimately opted for what is known as a universal recommendation.

 

Dr. Jamie Loehr, one of the members, said before the vote that the cost-effectiveness of vaccinating young people, who are generally at little risk from COVID-19, had him leaning towards a risk-based approach. He changed his mind, though, after listening to a presentation from a CDC researcher.

 

Dr. Denise Jamieson, another member, said that members should not “get too caught up in cost-effectiveness currently.” She said, “If we compare it to other vaccine-preventable diseases it seems like a really good investment.”

 

Each dose of a new shot could cost up to $130, according to estimates presented during the meeting.

 

Pooled effectiveness estimates from studies of the currently available vaccines, which target the XBB strain, and the last slate of shots, which were bivalent, found that effectiveness against hospitalization due to COVID-19 was below 50 percent, the original threshold laid out by regulators.

 

Researchers with the CDC and other institutions have also found the protection wanes over time, one reason U.S. officials have turned the COVID-19 vaccine model into a once-a-year update similar to the influenza vaccination program.

 

Many Americans took the original COVID-19 vaccines but most have opted against receiving the newer shots. As of May 11, just 14.4 percent of children and 22.5 percent of adults have received one of the currently available COVID-19 vaccines, according to CDC surveys, which also found that many doctors have stopped recommending the shots because they’re focused on promoting other vaccines and worry recommending COVID-19 vaccination could increase hesitancy among patients to receiving the other vaccines.

 

Experts said in Thursday’s meeting that the message needs to be that people need another shot.

 

“We have to keep saying that over and over and over again—you need this year’s vaccine to be protected against this year’s strain of the virus,” Carol Hayes, who represents the American College of Nurse-Midwives as a liaison to the CDC panel, said during the session.

 

The CDC estimated that up to 116,000 hospitalizations from COVID-19 will be prevented over the next year with universal vaccine recommendations, assuming an initial 75 percent effectiveness against hospitalization.

 

The effectiveness was projected in certain scenarios to drop to 50 percent after three months, the CDC said.

 

The KP.2 strain is the dominant strain in the United States as of May 25, according to CDC data. The closely related KP.3 strain, and the JN.1 variant, are also causing a number of cases.

 

Modeling through June 22 projects the rise of a new strain called LB.1.

 

A spokesperson for the CDC told The Epoch Times recently that LB.1 “has the potential to infect some people more easily based on a single deletion in a spike protein“ but ”there is currently no evidence that LB.1 causes more severe disease.”

Signs of avian flu found in San Francisco wastewater

 

Signs of H5N1 bird flu virus have been detected at three wastewater sites in California's Bay Area, according to sampling data.

 

While positive wastewater samples have been found in seven other states, California is the only one that has yet to report a bird flu outbreak in a herd of dairy cows.

 

Genetic evidence of bird flu was detected in San Francisco wastewater on June 18 and June 26. Additional H5 "hits" were seen at a site in Palo Alto on June 19, and another on June 10 from the West County Wastewater facility in Richmond.

 

According to the San Francisco Department of Public Health, officials have been closely monitoring H5N1 along with federal, state and local partners, and are "aware of the recent detections of fragments of H5N1 in San Francisco's wastewater."

 

"As with the previous detections reported from before mid-May 2024, it is unclear what the source of H5N1 is, and an investigation is ongoing," wrote department officials in a statement. "It is possible that it originated from bird waste or waste from other animals due to San Francisco's sewer system that collects and treats both wastewater and stormwater in the same network of pipes."

As we've reported, a lot of people on the Left are very upset with CNN's handling of the presidential debate Thursday night, even though they catered to every one of the Biden campaign's demands: that it be on a Biden-friendly network, that there was no audience and even the White House press pool had to watch from across the street, and that microphones be turned off. But Keith Olbermann still wants to literally burn CNN to the ground because moderators Jake Tapper and Dana Bash went out of their way to hide their obvious bias.

 

Collin Rugg notes that the Hollywood elite were also furious at CNN for letting such a debacle take place. Why didn't the moderators push back on all of Donald Trump's lies?

The Reckoning of Joe Biden

For the President to insist on remaining the Democratic candidate would be an act not only of self-delusion but of national endangerment.

 

here is an immense bounty of bunk about the wisdom of age available to all of us who require it from time to time, but, as the pitiless Mark Twain put it in his autobiography, “It is sad to go to pieces like this, but we all have to do it.”

 

On Thursday night, it was Joe Biden’s turn. But, unlike the rest of us, he went to pieces on CNN, in front of tens of millions of his compatriots. At some level, Biden’s supporters were hoping that he would defy the realities of time, the better to puncture the vanities and malevolence of his felonious opponent. And so there was a distinct cruelty to it all, the spectacle of a man of eighty-one, struggling terribly with memory, syntax, nerves, and fragility, his visage slack with the dawning sense that his mind was letting him down and that, as a result, he was letting the country down. It must be said, with fellow-feeling, but it must be said: This was an event that, if unremedied, could bring the country closer to another Trump Presidency and with it a diminishment of liberal democracy.

 

The question is: What will Joe Biden do about it?

"US Citizen" musings 1/3

I came across some interesting court cases recently.

1787 – The Constitution for the United States of America is written.

1819 – Just 32 years later, while James Madision, John Adams, and Thomas Jefferson were all still alive, the Massachusetts Supreme Court said there were only citizens of the states:

The term, “citizens of the United States,” must be understood to intend those who were citizens of a state, as such, after the Union had commenced, and the several states had assumed their sovereignties. Before this period there were no citizens of the United States. Manchester v. Boston, Massachusetts Reports, Vol. 16, Page 235 (1819)

1821 – Two years later, a federal court said a citizen of one state is a citizen of the other states, as well:

“A citizen of one state is to be considered as a citizen of every other state in the union.” Butler v. Farnsworth, Federal Cases, Vol. 4, Page 902 (1821)

1855 – No such thing as “citizen of the United States”

“A citizen of any one of the States of the Union, is held to be, and called a citizen of the United States, although technically and abstractly there is no such thing. To conceive a citizen of the United States who is not a citizen of some one of the States, is totally foreign to the idea, and inconsistent with the proper construction and common understanding of the expression as used in the Constitution, which must be deduced from its various other provisions.” Ex parte Frank Knowles, California Reports, Vol. 5, Page 302 (1855)

1868 – 14th Amendment adopted. In the main body of the US Constitution, anyplace where “Citizen” was written, the word was capitalized. Starting with the 14th Amendment, and all amendments thereafter, the word “citizen” was lower-case. Interesting.

1873 – Just 5 years after the adoption of the 14th Amendment, federal courts said this:

The term resident and citizen of the United States is distinguished from a Citizen of one of the several states, in that the former is a special class of citizen created by Congress. U.S. v. Anthony 24 Fed. 829 (1873)

1875 – 2 years after that, we have the US Supreme Court stating:

We have in our political system a government of the United States and a government of each of the several States. Each one of these governments is distinct from the others, and each has citizens of its own. United States v. Cruikshank, 92 U.S. 542 (1875)

1883 – 8 years later, the Indiana Supreme Court said:

One may be a citizen of a State and yet not a citizen of the United States. McDonel v. The State, 90 Ind. 320 (1883)

1906 – US Supreme Court (this case has never been overturned, and has been cited by other courts over 1,600 times, making it one of the most authoritative court cases in American law):

The individual may stand upon his Constitutional Rights as a Citizen. He is entitled to carry on his private business in his own way. His power to contract is unlimited. He owes no duty to the State or to his neighbors to divulge his business, or to open his doors to an investigation, so far as it may tend to incriminate him. He owes no duty to the State, since he receives nothing there from, beyond the protection of his life and property. His rights are such as existed by the Law of the Land (Common Law) long antecedent to the organization of the State, and can only be taken from him by due process of law, and in accordance with the Constitution. He owes nothing to the public so long as he does not trespass upon their rights. Hale v. Henkel 201 U.S. 43 at 89 (1906)

there is a citizenship of the United States and citizenship of a state,” Tashiro v. Jordan, 201 Cal. 236 (1927)

1953 – Federal Court:

A citizen of the United States is a citizen of the federal government Kitchens v. Steele, 112 F.Supp 383 (1953)

1958 – US Supreme Court:

The constitutional theory is that we the people are the sovereigns, the state and federal officials only our agents. Cooper v. Aaron, 358 U.S. 1 (1958)

1968 – District Court in Puerto Rico, citing US Supreme Court (natural, fundamental rights do not belong to US citizens):

Defendants’ error lies in assuming that the right to vote is an essential right of citizenship. The only absolute and unqualified right of citizenship is to residence within the territorial boundaries of the United States. US vs. Valentine 288 F. Supp. 957 [see: Balzac v. People of Puerto Rico, 258 US 298]

1993 - District Court case:

The privileges and immunities clause of the 14th Amendment protects very few rights because it neither incorporates the Bill of Rights, nor protects all rights of individual citizens. Instead this provision protects only those rights peculiar to being a citizen of the federal government; it does not protect those rights which relate to state citizenship. Jones v. Temmer, 89 F. Supp 1226

How to make sense of it all?

1776:

When the Declaration of Independence was signed, the 13 British colonies in America became free and independent States, on equal footing with all other countries of the world.

The People in each of these 13 States/countries wrote their own constitution, identifying the powers of their State governments, and limiting the authority of their government, while also prohibiting their government from violating the fundamental rights of the People in the State.

1787:

The People, via their representatives in Congress, assembled, wrote a new constitution to create a 14th government (“federal government”) to grant certain powers to it for a more efficient overall government experience. This federal government was granted certain powers that would apply within the States, such as regulating foreign commerce, but only the powers enumerated. In addition, this document had a clause giving the federal government exclusive jurisdiction over the federal territories (powers beyond what was enumerated). So, the enumerated powers apply to the States, but all other powers ONLY apply to the federal territories and enclaves (military bases).

1819: The courts were already recognizing that there could be a confusion with the term “citizen of the United States.” They were clarifying that this term meant a “citizen of a particular State, and by means of that, also a citizen of THESE States, united.” But, there was NO SUCH THING as a “citizen of the United States, as in the federal government.”

1868:

The 14th Amendment had a tricky clause, which created (or became construed as creating) a new class of citizenship, which was federal and NOT state.

Early 20th Century:

The courts were still recognizing that We the People, as individuals, have natural rights that the government (state or federal) cannot violate. But there was also a movement hidden in the shadows trying to pervert this idea. This was the time of the income tax and Federal Reserve creation (unconstitutional, btw).

Mid-20th Century:

The courts were recognizing these two competing ideas. There were those who were trying to trick everyone into thinking they were “US citizens” and at the same time not revealing that to be one of these, one would give up their natural rights. At the same time, some courts were reasserting the original concept, so as to remind Americans who they are (members of the sovereign class, and not subjects of the government, ruled over by a higher class – which does not exist, in reality).

Current times:

Only people who have familiarized themselves with the REAL LAW of the United States of America (meaning, all the case law about this subject) understand that they are not citizens of an inferior class. However, the propaganda has been so strong, that these people are looked at by everyone else (myself included, until recently) … as crazy.

But really, who is crazy? Those who understand they are of the class of people who created the government, or those who believe they are inferior subjects who must do anything a government employee demands of them?

Holy Trinity Sunday

Mr. President,

 

In recent months we have been witnessing the formation of two opposing sides that I would call Biblical: the children of light and the children of darkness. The children of light constitute the most conspicuous part of humanity, while the children of darkness represent an absolute minority. And yet the former are the object of a sort of discrimination which places them in a situation of moral inferiority with respect to their adversaries, who often hold strategic positions in government, in politics, in the economy and in the media. In an apparently inexplicable way, the good are held hostage by the wicked and by those who help them either out of self-interest or fearfulness.

 

These two sides, which have a Biblical nature, follow the clear separation between the offspring of the Woman and the offspring of the Serpent. On the one hand, there are those who, although they have a thousand defects and weaknesses, are motivated by the desire to do good, to be honest, to raise a family, to engage in work, to give prosperity to their homeland, to help the needy, and, in obedience to the Law of God, to merit the Kingdom of Heaven. Why it matters: Biden's train wreck performance coupled with Trump's highly-anticipated return to the debate stage drew a sizable audience in an era when the value of political debates had been in question, but very few young people watched.
