The national security advisers of the U.S., Japan and South Korea will meet in person in Washington next week, to discuss the way forward on North Korea, a senior U.S. official told reporters Tuesday. U.S. National Security Adviser Jake Sullivan is scheduled to have a trilateral session with Japan's Shigeru Kitamura and South Korea's Suh Hoon, as well as bilateral engagements with each. President Joe Biden's administration, which is in the final stages of a lengthy review on its North Korea policy, will share its central findings with its Asian allies and strategize how to coordinate going forward. But the U.S. side will also "do what we can, to be perfectly honest, to try to improve communications between Seoul and Tokyo because we believe a strong working relationship with Japan and South Korea is clear national security interests of the United States," said the official.

The Biden administration has been in close and frequent contact with Japan and South Korea through various channels from the outset, a sign of the alliances' importance to Washington. This includes a visit to the two countries by Secretary of State Antony Blinken and Secretary of Defense Lloyd Austin, the duo's first overseas trip since taking office. Sullivan, who will host next week's meetings, has recently come back from a meeting alongside Blinken with Chinese officials Yang Jiechi and Wang Yi in Anchorage, Alaska, where the two countries also discussed North Korea – one of the areas of cooperation between the otherwise bitter rivals. "The Chinese position is to support diplomacy," said the official on Tuesday's call. But for Washington, "the hope of diplomacy really rests on the reality of deterrence and our forward-deployed capabilities." That said, "we believe such diplomacy in close coordination with South Korea and Japan, and frankly with China is in the best interest of all those concerned," the official said. "We don't want a situation where it's perceived that our door is not open to talk." The U.S. has not been in active dialogue with North Korea despite multiple attempts to engage.

Back in Alaska, Beijing gauged where Washington's head is at on North Korea, but the U.S. side made clear that its first step will be to engage our allies and friends through the process, the official said.

Megaship Blocks All Traffic In Suez Canal After Running Aground In Bizarre Incident

In what appears to be a freak accident, a Panama-flagged container ship called the Ever Given, owned by Evergreen Marine Corp., has run aground inside the Suez Canal, the critical artificially made shipping lane connecting the Red Sea with the Mediterranean.

Known as a critical chokepoint for the global oil trade, the Suez has become blocked in both directions thanks to the peculiar angle of what's been described as a "megaship".

The ship was traveling from a port in Egypt to Rotterdam, in the Netherlands, one of the world's most active ports. It was due to arrive March 31.

The traffic jam has reportedly spread from the canal, back into the Red Sea and the Mediterannean.

At a time when shipping companies are already struggling to recover from the strains of the COVID pandemic, which required them to rejigger global shipping routes in fundamental ways. It's also presents risks to the inflation outlook, as the lingering containership shortage mentioned above is slowing down the pace of global trade at a time when Americans' demand for products foreign-made consumer products is surging.

Alleged Boulder Colorado Gunman ID’d as Ahmad Al Aliwi Alissa

''The gunman who allegedly opened fire in a Boulder, Colorado, grocery store on Monday has been identified as 21-year-old Ahmad Al Aliwi Alissa by the New York Times.''

The New York Post reports that Alissa was charged with “charged with 10 counts of first-degree murder” on Tuesday.

Boulder police chief Maris Harold noted that Alissa lived in Arvada, Colorado, and pointed out that his ten alleged victims were between the ages of 20 and 65 years of age.

NPR reports that the deceased included 51-year-old police officer Eric Talley, who had been with the Boulder Police Department since 2010.

The New York Daily News observed that police do not have a motive behind the Boulder attack. But Gov. Jarid Polis reacted by saying, “Today we saw the face of evil. I am grieving with my community and all Coloradans.”

There’s a contemporary political compulsion to immediately inject a horrific shooting into ongoing debates about types of weapons and the terms for acquiring them. But before legislating a response, lawmakers should spend some time trying to figure out why Ahmad Al Aliwi Alissa allegedly murdered 10 people on Monday at a Boulder, Colo. supermarket.

Alissa, whose family emigrated from Syria, may have been suffering from mental illness, according to his 34-year-old brother, Ali Aliwi Alissa.

The brother told CNN on Tuesday that in high school bullies made fun of Alissa’s name and for being Muslim and that may have contributed to him becoming “anti-social.”

Alissa had become increasingly “paranoid” around 2014, believing he was being followed and chased, according to his brother. At one point, the young man covered the camera on his computer with duct tape so he could not be seen, said the brother, who lives with Alissa…

“We kept a close eye on him when he was in high school. He would say, ‘Someone is chasing me, someone is investigating me.’ And we’re like, ‘Come on man. There’s nothing.’ … He was just closing into himself,” the brother added.

Shelly Bradbury, Conrad Swanson and John Meyer report in the Denver Post that Mr. Alissa was “violent, short-tempered and paranoid” according to his former classmates at Colorado’s Arvada West High School, from which he graduated in 2018. According to the Post account:

“He was kind of scary to be around,” said Dayton Marvel, a teammate on the wrestling team. Alissa once had an outburst and threatened to kill people during an intra-team match, Marvel said.

“His senior year, during the wrestle-offs to see who makes varsity, he actually lost his match and quit the team and yelled out in the wrestling room that he was like going to kill everybody,” Marvel said. “Nobody believed him. We were just all kind of freaked out by it, but nobody did anything about it.”…

“He would talk about him being Muslim and how if anybody tried anything, he would file a hate crime and say they were making it up,” Marvel said. “It was a crazy deal. I just know he was a pretty cool kid until something made him mad, and then whatever made him mad, he went over the edge — way too far.”

At least one event in high school led to a misdemeanor guilty plea for third-degree assault, but no jail time. Jesse Paul reports in the Colorado Sun:

Arrest documents from the encounter say Ahmad Al Aliwi Alissa stood up in a classroom, walked over to the victim and “cold cocked” him in the head.

When the victim fell to the floor, Alissa got on top of him and punched him in the head several more times.

“No witnesses could see or hear any reason for (Alissa) to hit (the victim),” the documents say. “(Alissa) said (the victim) had made fun of him and called him racial names weeks earlier.”

Arvada Police Detective Dave Snelling confirmed Tuesday the local department had at least two interactions with Alissa over the past several years, including a case of criminal mischief. The details of that case were not immediately available.

Snelling would not say whether local police had received any warnings or complaints about Alissa recently, however, and instead deferred the question to the FBI.

Alissa lived with his family in an Arvada subdivision on West 65th Place, a quiet neighborhood of single-family homes. Neighbors said the household appeared to be multi-generational with a large number of family members living there.

The home is owned by Ali Aliwi Alissa, who also owns a nearby restaurant. The eatery, in a strip mall that shares space with a coffee shop, UPS store, battery store and other restaurants, was closed Tuesday.

Jamie Poeling moved her business, Dream Dinners, a few doors down from the restaurant just over a year ago and said she ate there infrequently. Employees there gave Poeling a discount and she returned the favor.

Poeling said she doesn’t know everyone in the family by name, but that she never had a negative experience at the restaurant. Employees would go out of their way to offer food to a homeless woman living behind the restaurant, she said.

“I’ve been in the shop while they’ve given her food and they’re very kind,” Poeling said.

It was not immediately clear Tuesday whether any of Alissa’s family knew of his plan to attack King Soopers.

‘Nothing else explains it’: Norwegian scientists say AstraZeneca DID cause blood clots, as British & Dutch experts dismiss theory

Norwegian scientists have linked the AstraZeneca vaccine and blood clots – a condition seen in some people that led countries around the world to halt its use. But British and Dutch medics say there’s no evidence for such a link.

“The cause of our patients' condition has now been found,” Pal Andre Holme, the head of a research group at the Oslo University Hospital, told Norway’s VG media outlet. He was referring to the cases of three health workers under the age of 50 who suffered from severe blood clotting after receiving the AstraZeneca jab. One of the medics then died on Monday.

The clotting in those patients was triggered by a very specific “strong immune response” likely caused as a result of the AstraZeneca jab, Holme explained. In collaboration with the University Hospital of North Norway, Holme’s team detected specific antibodies that “activate” platelets and in some cases can lead to blood clots.

Asked by VG if the vaccine was the “most likely” cause of this specific immune response, Holme said he believes “there is no other thing” in the history of the three individual patients which would generate such a response. None of the three patients had a history of similar health issues before, he said.

I am pretty sure it is these antibodies that are the cause and I see no other reason than that it is the vaccine that triggers them.

The professor still admitted that such side effects are likely to be very rare since “we are talking about very specific antibodies.” Norway halted the use of the AstraZeneca jab in its vaccination campaign alongside many other European nations. Some 120,000 Norwegians already received the jabs produced by the British-Swedish company. According to Norwegian media, “very few” serious side effects were reported by those vaccinated to date.

Some Norwegians, however, were apparently ready to take their chances, deadly side-effects or not, in the name of saving humanity. Earlier this week, journalist Linn Wiik declared she would “love to die” from AstraZeneca's Covid-19 vaccine if her sacrifice would help humanity to win the war against the virus.

Norwegian scientists revealed the results of their analysis just as the British medical regulator, MHRA, said that it found no evidence that could prove the link between the Oxford-AstraZeneca vaccine and blood clotting.

“This type of blood clot can occur naturally in people who have not been vaccinated, as well as in those suffering from COVID-19,” the MHRA CEO, Dr. June Raine, said in a statement, adding that her agency’s “thorough and careful review” showed that blood clots in veins of affected persons are occurring just as often as they would “in the absence of vaccination.”

Separately, the Dutch Lareb Center tasked with studying the side effects of the AstraZeneca jab also reported that it “has no evidence” of a link between the vaccine and blood clotting. The center said it received “a few dozen reports” about thrombosis and pulmonary embolism associated with all vaccines, adding that “reports so far give no reason to think that thrombosis is a side effect of corona vaccines.”

Earlier, a group of nations in Europe and beyond, including Germany, France, Italy and Spain, among others, suspended the rollout of the AstraZeneca vaccine amid reports of the potentially fatal blood clotting. Most recently, the Swedish Medical Products Agency said that a previously healthy woman died due to blood clotting a week after taking AstraZeneca’s Covid-19 jab.

The news also triggered the European drug regulator, EMA, to start its own review of all relevant cases. On Thursday, the agency said it deemed the jab “safe and effective,” prompting several nations, including Italy, Cyprus and Ireland, to restart its use.

__Suez Traffic To Resume As Blocking Ship Partially Moved

Update (0739 ET): Bloomberg reports the massive containership blocking the Suez Canal has been dislodged from the bank of the canal and moved to the side, potentially easing disruption to one of the world's most vital shipping lanes

Ahmed Mekawy, the deputy manager for the Suez Canal for Gulf Agency Company, expects the canal could resume today or tomorrow.

Mekawy said the containership is "expected to be re-floated shortly, then the Suez Canal Authority will work on resuming transit for all waiting ships."

The Suez Canal Authority has yet to comment on whether the ship has been moved.

''Update (0706 ET):'' The Gulf Agency Company in Egypt reports Suez Canal traffic could "resume soon."

''Update (0704 ET):'' The blockage of the Suez Canal by a massive container ship called the Ever Given, owned by Evergreen Marine Corp., could last for at least another day and send ripples of disruption through global supply chain networks, according to Bloomberg.

Eight tug boats have been working through Wednesday to free the 400m long container ship that ran aground in the Suez Canal on Tuesday. The angle at which the Ever Given ran aground has completely blocked the canal. The canal is a chokepoint for the global oil trade as dozens of vessels are moored outside both entrances waiting for the container ship to get unstuck.

"The salvage operation with tugs is underway, and hopefully, the vessel will be freed soon, but it could last days," said Ralph Leszczynski, head of research at shipbroker Banchero Costa & Co.

An official with the Gulf Agency Company in Egypt told Bloomberg no progress had been made in clearing the canal. The mishap's cause is due to the vessel's loss of steering amid high winds and a dust storm, the Suez Canal Authority said in a statement.

Taiwan-based Evergreen Line told Bloomberg in an emailed statement that the vessel deviated"from its course due to suspected sudden strong wind."

Grounded Ever Given Chokes World's Most Vital Shipping Lane

The canal's blockage has led to a gridlock of vessels on either side of the canal's entrances.

After Tuesday's steep selloff, crude futures rebounded on Wednesday on the Suez Canal developments. Brent futures are up 2.48% to $62.30, and WTI trades around 59 handle, up more than 2%.

"It's all about the Suez, as well as people trying to get into oil again after the selloff," said Bjarne Schieldrop, chief commodities analyst at SEB AB. It appears lockdowns, mutations, and vaccination rollout delays are on the backburner for now.

In what appears to be a freak accident, a Panama-flagged container ship called the Ever Given, owned by Evergreen Marine Corp., has run aground inside the Suez Canal, the critical artificially made shipping lane connecting the Red Sea with the Mediterranean.

Known as a critical chokepoint for the global oil trade, the Suez has become blocked in both directions thanks to the peculiar angle of what's been described as a "megaship".

The ship was traveling from a port in Egypt to Rotterdam, in the Netherlands, one of the world's most active ports. It was due to arrive March 31.

The traffic jam has reportedly spread from the canal, back into the Red Sea and the Mediterannean.

At a time when shipping companies are already struggling to recover from the strains of the COVID pandemic, which required them to rejigger global shipping routes in fundamental ways. It's also presents risks to the inflation outlook, as the lingering containership shortage mentioned above is slowing down the pace of global trade at a time when Americans' demand for products foreign-made consumer products is surging.

It could take days for a major Dutch salvage company to ride to the rescue.

GameStop has surged nearly 900% so far this year and at the peak of the trading frenzy on Jan. 28 the shares had touched $483 a piece. The company said on Tuesday after reporting quarterly results that it has been considering since January whether to increase the size of the $100 million share sale that it originally announced in December. A short squeeze occurs when hedge funds that bet against a stock need to buy it at much higher levels to cover losing positions.

Short interest in GameStop has since fallen, standing at about 24.3% of the stock’s float as of March 9 compared with 32.6% in late February, according to data from financial analytics firm S3 Partners.

All 10 Boulder Colorado Victims Were White. It’s Time to End Anti-White Race Hate.

The following ten people perished in the recent shooting in Boulder, Colorado carried out by Ahmad Al-Issa. All of them appear to be white, but neither the media nor politicians have bothered to resurrect their anti-race-hate campaign that ensues when Black Lives Matter riot, or when Asians are murdered in Atlanta.

The victims include grocery store workers, local college graduates, medicare agents, a police officer, and an Orthodox Christian.

Leiker had worked at the store targetted in the attack for three decades, and her friends revealed working at the store was her “favorite thing to do.”

Kevin Mahoney, 61

Mahoney’s daughter revealed that her father had been killed in the shooting with a photo of him walking her down the aisle for her wedding with the caption “I am heartbroken to announce that my Dad, my hero, Kevin Mahoney, was killed in the King Soopers shooting in my hometown of Boulder, CO.”

Lynn Murray, 62

Murray had two children and was a retired New York City magazine photo director whose clients included Cosmopolitan, Marie Claire, and Glamour. She relocated to Colorado to raise her children.

Her family noted she was at the grocery store to fill an Instacart order at the time of the shooting.

“I just want her to be remembered as just as this amazing, amazing comet spending 62 years flying across the sky,” her husband John urged.

Jody Waters, 65

Waters was a mother, grandmother, and rescue dog owner. She describes herself as a hiker and creative entrepreneur.

Neven Stanisic, 23

A graduate of Alameda West High School, Stanisic and his family “fled Bosnia 20 years ago for a better life in America,” according to leaders at Saint John the Baptist Serbian Orthodox Church in Lakewood.

“He was an amazing child,” said Ivana Petrovic, who along with her husband, Rev. Radovan Petrovic, have close ties with the family. “We’ve known the family ever since we became their spiritual father and mother here. He was a very good, shy, hardworking boy and one of those kiddos who listened to his parents the best.”

Stanisic’s Facebook showed him smiling with classmates and contained images of hand-drawn anime characters and the Assassin’s Creed video game series.

Yellen open to U.S. banks paying dividends, repurchasing stock

Treasury Secretary Janet Yellen said on Wednesday that U.S. banks look healthy enough to be allowed to pay dividends and repurchase stock, an updated view that reflects top economic officials’ growing confidence in the recovery from the coronavirus pandemic.

Yellen made her comments in a second day of testimony in Congress alongside Federal Reserve Chair Jerome Powell. The hearings are part of a quarterly economic update they are required to make. Asked by Senate Banking Committee Chairman Sherrod Brown if she opposed banks paying dividends and buying back stock, Yellen said she was previously opposed to bank stock buybacks, but financial institutions look healthier now and “should have some ability to, abiding by the rules, to make returns to shareholders.”

Yellen and Powell, in prepared remarks that mirrored those delivered on Tuesday before the House of Representatives Financial Services Committee, offered an optimistic outlook for the economy, fueled by expectations for continued progress against the pandemic due to vaccine rollouts and another $1.9 trillion of federal relief spending just getting underway. “It is going to be a very, very strong year in the most likely case,” Powell said in response to a senator’s question on the economic outlook. The U.S. economic recovery is evolving faster than expected, but still faces risks from the pandemic on one side and potential inflation on the other as massive fiscal support rolls through the system. The federal response to the crisis, including spending of about $5 trillion and considerable support from the U.S. central bank, set the stage for a rebound now taking hold as the COVID-19 vaccination program gains momentum and pandemic restrictions are lifted.

However, it remains unclear how quickly millions of still-unemployed workers will find their way back to jobs, whether the Fed can keep markets on an even keel amid rising prices and bond yields, and if initial progress against the pandemic can be sustained.

Judicial Supremacy to Judicial Lunacy? A Judge Challenges the Supreme Court’s Supreme Folly

“Our judges are as honest as other men, and not more so,” wrote Thomas Jefferson in 1820. “They have, with others, the same passions for party, for power, and the privilege of their corps.” While this is true, one Judge Laurence Silberman may be an exception.

Silberman, of the United States Court of Appeals for the District of Columbia Circuit, emerged from relative obscurity recently when he penned a dissent in the case of Tah v. Global Witness Publishing, Inc. In this case, which involved defamation, Silberman went far beyond disagreeing with how the majority applied a 1964 “landmark” Supreme Court opinion, New York Times Co. v. Sullivan. He also challenged the very “notion of Supreme Court infallibility,” as one commentator put it.

In a nutshell, the ’64 opinion held that succeeding in a defamation claim required a plaintiff to prove not just that statements made publicly were false and damaging, but that they were motivated by malice (read more about the case here and here.) As a result, public officials basically stopped suing the media because, unlike in Britain, it’s now notoriously difficult to win a defamation case in the United States.

Silberman finds that troubling. But what bothers him even more is that, as he pointed out, “Justice Thomas has already persuasively demonstrated that New York Times was a policy-driven decision masquerading as constitutional law. As with the rest of the opinion, the actual malice requirement was simply cut from whole cloth.”

Unfortunately, this isn’t uncommon. For the SCOTUS has long been, it appears, buying cloth in bulk. Thus did Silberman not only complain that the ’64 opinion must be overturned as it’s “a threat to American Democracy,” but go further.

In fact, he “makes plain his disdain for Justice Kennedy’s contention that ‘criticism of the Court is tantamount to an attack on the Constitution,’” relates commentator Andrea Widburg. “Instead, ‘I readily admit that I have little regard for holdings of the Court that dress up policymaking in constitutional garb.’ It’s that kind of dissimulation that is ‘the real attack on the Constitution.’ Indeed, ‘[t]he notion that the Court should somehow act in a policy role as a Council of Revision is illegitimate.’”

Silberman is merely stating a simple fact: It isn’t the courts’ role to in essence “make law” by imposing their own extra- or un-constitutional biases from the bench. Yet generally ignored is that this problem of judicial adventurism cannot realistically be mitigated without first tackling judicial supremacy.

Judges’ “privilege of their corps,” which Jefferson warned about, was perfectly epitomized by Kennedy’s “criticism of the Court = an attack on the Constitution” line. We should just respond, “Nice try.”

It’s natural for individuals and institutions to want to place themselves beyond criticism, but this is worse than un-American (are the justices royalty?). It also smacks of self-deification. It has often been joked that the Supreme Court is not the Supreme Being, but only God is beyond criticism because only He is infallible in all facets. The rest of us require the iron that sharpens iron that is legitimate criticism.

Kennedy’s self-deification is also a quite bold attempt at flipping the script. The SCOTUS has essentially been attacking the Constitution for at least a century via its unconstitutional opinions. Now, to avoid being called out on this, Kennedy claims that criticizing this abuse (or any other SCOTUS trespass) is an attack on the Constitution! Talk about projection.

But let’s talk about protection — of the courts and from them. It’s no surprise that many justices may want to be beyond criticism, for they’ve long been beyond accountability and beyond control. Judicial supremacy will have this effect.

Long our status quo, judicial supremacy is the standard whereby court decisions will constrain not just the parties in a given case or even just (regarding SCOTUS decisions) the whole judicial branch, but the legislative and executive branches as well.

To fully grasp the problem with this, consider a warning from James Madison, the “Father of the Constitution.” He said that having the judicial, legislative, and executive powers all vested in one entity is the very definition of tyranny. Well, now consider what former ambassador and government affairs expert Alan Keyes once explained:

The courts obviously have their judicial power. Yet if they can strike down a law in contravention of lawmakers’ will — essentially making themselves a super-legislature of last resort — then they’ve arrogated to themselves the legislative power as well. Moreover, if they can tell the executive branch that it must or may not execute a given action, regardless of that branch’s convictions about the action’s constitutionality, they’ve also then arrogated to themselves the executive power.

Ergo, all three powers are then vested in one body, the courts. Goodbye, checks and balances.

Worse still, this tyrannical power (using Madison’s description) is wielded by the one governmental branch that’s beyond the people’s reach. The legislators are elected as is the president (the executive branch), so the people can hold them accountable at the ballot box. But federal judges are appointed — for life — meaning, they’re effectively shielded from accountability.

I wrote “effectively” because the Constitution does give Congress the power to impeach judges, eliminate rogue lower federal courts, and limit the appellate jurisdiction of the SCOTUS. Yet this power isn’t exercised, and it won’t be for a simple reason:

Legislators like it when the courts “settle” hot-button, controversial issues so they don’t actually have to take a stand. In other words, lawmakers are outsourcing decisions they should make — and be held accountable for — to the branch of government that cannot be held accountable. Nice con, huh?

Having unaccountable people make our laws is obviously dangerous, and this is why Jefferson warned that the judicial-supremacy standard would make our Constitution a felo de se, an “act of suicide.” But what can we do?

First realize that judicial supremacy is not “the law of the land.” It’s not in the Constitution. Rather, the courts granted their absolute power to themselves, most notably in the Marbury v. Madison decision (1803). It’s reminiscent of how San Franciscan Joshua Abraham Norton, disgusted with our political and legal systems (I can sympathize), declared himself “Emperor of these United States” in 1859. Only, nobody took him seriously.

So why do we take the judges who would be kings seriously? The Constitution does, of course, explicitly grant the SCOTUS (and lower courts created by Congress) the “judicial power.” But here’s the rub: It doesn’t specify precisely what this power is.

In fact, according to Alan Keyes, with whom I discussed this matter, the Founding Fathers didn’t elaborate on this anywhere. Thus does a simple conclusion suggest itself: They believed that what constituted the judicial power was self-explanatory. Yet it logically follows that if this is so, it’s only because that power already existed and was well understood.

What was the Founders’ understanding? They emerged from the British tradition, which had, of course, long included a legal system and judges. Here’s what it didn’t involve: ruling laws unconstitutional and then “striking them down.”

After all, Britain didn’t (and doesn’t) have a Constitution.

In other words, British judges could take issue with a law and free someone charged under it. But they could not eliminate the law itself. This was the default understanding of the judicial power.

Now, if the Founders meant to radically change this — if they’d intended to grant American judges the unprecedented power to strike down law — wouldn’t they have said so? Wouldn’t they have stated, “The courts have the ‘judicial power,’ and understand what this actually means now” and then elaborate? That they didn’t indicates that the “judicial power” was what it had always been.

That is, judges’ rulings constrain the plaintiff(s) and defendant(s) party to the case in question, but they constrain no one else and cannot alter law.

The bottom line is that judicial supremacy appears a fiction, an extra-constitutional power enjoyed by a governmental branch that has neither the police nor the military to enforce it — and at the pleasure of the other two branches.

Late Justice Antonin Scalia alluded to this reality when he warned his SCOTUS fellows in his Obergefell v. Hodges (2015) dissent, “With each decision of ours that takes from the People a question properly left to them — with each decision that is unabashedly based not on law, but on the ‘reasoned judgment’ of a bare majority of this Court — we move one step closer to being reminded of our impotence.”

It’s high time the Court was reminded of its impotence. If we’re unwilling to issue that reminder, then it signals that we suffer an impotence running far, far deeper than law.

U.S. SEC begins rollout of law aimed at delisting Chinese firms

The U.S. securities regulator on Wednesday said it has adopted regulations, drawn up by Congress, that would kick foreign companies off American stock exchanges if they do not comply with U.S. auditing standards. The Holding Foreign Companies Accountable Act, signed into law by then-President Donald Trump in December, aims to remove Chinese companies from U.S. exchanges if they fail to comply with U.S. auditing standards for three years in a row.

While it applies to companies from any country, the legislation’s sponsors intended it to target Chinese companies listed in the United States, such as Alibaba, tech firm Pinduoduo Inc and oil giant PetroChina Co Ltd. The legislation aimed to address long-held concerns over the SEC’s inability to properly vet Chinese companies listed in the United States. That is because the Chinese government, citing national security concerns, is reluctant to let overseas regulators inspect local accounting firms which audit those Chinese companies. Lawmakers said they were worried U.S. investors were being put at risk by exposure to Chinese companies that are not held to the same standard as domestic companies. Some investment experts have also raised concerns that U.S. investors may effectively be funding instruments of the Chinese government, a U.S. adversary.

The SEC Wednesday amendments will require companies to prove to the regulator that they are not owned or controlled by an entity of a foreign government, and also require disclosures on audit arrangements and government influence, the SEC said. The agency fast-tracked the rule through “interim final amendments,” but is seeking public comments on a process for identifying foreign companies to which the legislation should apply. Determining which entities the measure should apply to may prove challenging, given many companies have complex structures with subsidiaries or shell units registered in other jurisdictions. The legislation required the SEC to issue rules around how companies should submit documentation within 90 days of enactment.

It is still “actively assessing” how to roll out the rest of the law’s requirements, including the identification process and trading prohibition requirements, the statement said.

Senator John Kennedy (R-LA) questioned the wisdom of a push by congressional Democrats to enact legislation in the immediate aftermath of a tragic shooting in Boulder, CO earlier this week.

Kennedy suggested Democrats were using this moment to enact gun control because he did not think they believed in the Second Amendment as interpreted by the federal government.

“Look, these killings were terrible,” he said. “They were horrible. I’m reminded though that, you know, America is a big country. We’re free, and one of the prices we pay for that freedom is that you’re always going to have some people who abuse it. Freedom is risk. But we have got to concentrate on is how to control that risk. You’re not going to stop the killings until you stop the killers. But you don’t stop drunk drivers by getting rid of all sober drivers, which is what many of my Democratic friends want to do with respect to the Second Amendment.”

“In my judgment, we do not need more gun control,” Kennedy continued. “We need more idiot control. How do we do that? We have already tried, the Republicans have. Senator Grassley, Senator Cruz had a bill to strengthen our national database. We regulate gun ownership in America. If you are convicted of certain crimes, if you have a tendency to violence, if you are mentally ill, and you want to buy a gun, your name has to run through a database. The problem is that the database has huge holes in it. And many federal agencies and state agencies are very cavalier about sending in the names. Grassley and Cruz’s bill, which I support, would have tightened up the database, and it would have cracked down on people who have guns who shouldn’t have guns.”

“Do you know why the bill didn’t pass?” he added. “Many of my Democratic colleagues filibustered it. Now, if you drill down far enough, what you’re going to find — I don’t want to paint with too broad a brush — but many, not all, many of my Democratic colleagues — they just don’t believe in the Second Amendment. They just don’t. I mean, we have heard it in terms of police officers. I mean, basically, the Democratic position is that if a bad guy shoots a cop, it’s the gun’s problem. If a cop shoots a bad guy, it’s the cop’s fault. You know, if it weren’t for double standards here, we wouldn’t have any standards at all.”

Myanmar coup latest: Suu Kyi's court hearing postponed to April 1

7:50 p.m. Malaysia will postpone planned deportations to Myanmar until after a proposed Association of Southeast Asian Nations emergency regional summit to discuss the post-coup unrest, Reuters reports, citing sources familiar with the matter. Malaysia had faced international criticism for its earlier decision to send people back to Myanmar, where international rights groups say they face a risk of abuse. Last Friday, Malaysian Prime Minister Muhyiddin Yassin backed an Indonesian proposal for an emergency ASEAN summit on the Myanmar crisis.

Treasury Secretary Janet Yellen had a sharp exchange Wednesday during a Senate hearing with Sen. John Kennedy, Republican of Louisiana, over a renewed plan by the International Monetary Fund to issue $650 billion in new reserves, known as Special Drawing Rights, to member states. IMF Managing Director Kristalina Georgieva on Tuesday said she would present the plan to the IMF's executive board in June. The IMF first floated the plan last year as a way to help countries pay for the costs of battling the coronavirus. But it was blocked by the Trump administration and then-Treasury Secretary Steven Mnuchin. Republicans in Congress are unhappy the IMF plan has been resuscitated. They note that China, Russia and Venezuela will benefit from the new reserve allocation. Kennedy said the Biden administration was making an end-run around Congress and alleged the IMF plan would cost American taxpayers "$180 billion." Yellen grew frustrated as the exchange went on. She said the U.S. would earn interest on its new SDRs so that the cost of the program would be a "wash." "I don't know where you got a number like that from." Yellen said.
