California court rules against Meghan Murphy who was banned from Twitter for saying 'women aren't men'

Murphy was permanently banned from Twitter more than two years ago for the tweet, which Twitter alleged violated their policy against hateful conduct.

A California Court of Appeals has ruled against feminist activist Meghan Murphy, who launched a lawsuit against Twitter after she was permanently banned from their platform for declaring "women aren't men," Reclaim the Net reports.

Murphy was permanently banned from Twitter more than two years ago for the tweet, which Twitter alleged violated their policy against hateful conduct.

Murphy, who has long been a critic of transgender activists, has long been accused of being "transphobic" for asserting that gender aligns with biological sex.

The court cited Section 230 of the Communications Decency Act, which allows big tech companies to censor content on their sites without oversight or legal liability over the content they platform.

"In sum, the trial court properly sustained Twitter’s demurrer without leave to amend because each of Murphy’s claims is barred under section 230(c)(1)," the judge wrote.

Murphy had also argued that Twitter's policy allowing them to ban users "at any time, for any, or no reason" is unfair and that they had previously marketed themselves as a pro-free speech platform.

Landmark Proposals to Strengthen Free Speech at UK Universities

New Free Speech Champion and registration condition for higher education providers announced

Tougher legal measures to strengthen free speech and academic freedom at universities in England have been announced by the Education Secretary today (16 February), to stamp out unlawful ‘silencing’ on campuses.

Following an increasing number of cases of individuals being silenced, the Education Secretary has warned of a ‘chilling effect’ where students and staff feel they cannot express themselves freely.

The proposed measures deliver on a manifesto commitment, and include a new free speech condition placed on higher education providers in order to be registered in England and access public funding. The regulator, the Office for Students, would have the power to impose sanctions, including financial penalties, for breaches of the condition.

The strengthened legal duties would also extend to Students Unions, which for the first time would have to take steps to ensure that lawful free speech is secured for their members and others, including visiting speakers.

In addition, a new legal measure would enable individuals to seek compensation through the courts if they suffer loss as a result of breach of the free speech duties – such as being expelled, dismissed or demoted.

Education Secretary Gavin Williamson said:

Free speech underpins our democratic society and our universities have a long and proud history of being places where students and academics can express themselves freely, challenge views and cultivate an open mind.

But I am deeply worried about the chilling effect on campuses of unacceptable silencing and censoring. That is why we must strengthen free speech in higher education, by bolstering the existing legal duties and ensuring strong, robust action is taken if these are breached.

Under the plans, the Education Secretary would also appoint a new Free Speech and Academic Freedom Champion to investigate potential infringements, such as no-platforming speakers or dismissal of academics, and higher education providers would be legally required to actively promote free speech.

The new Champion would be appointed to the board of the Office for Students and would be able to investigate potential infringements of the new registration condition on freedom of speech and academic freedom in higher education. The registration condition would work alongside strengthened legal duties on free speech and academic freedom and the Champion would also be able to recommend that the Office for Students imposes fines.

The policy paper also includes Government expectations that go beyond the minimum legal duties, setting out what universities should aspire to.

The Government will continue to work alongside the sector on guidance and further research, and the next steps for legislation will be set out in due course.

Tom Simpson, Associate Fellow at Policy Exchange, and an Associate Professor of Philosophy and Public Policy, at the Blavatnik School of Government, University of Oxford, said:

This policy paper by the Department of Education is a very welcome step towards ensuring that viewpoint diversity is protected in British universities.

As Cambridge University’s recent Senate House vote shows, there is a substantial majority of academics who favour academic freedom. The problem, as Policy Exchange’s research has explored, is that a very online culture allows the views of a minority to exert disproportionate influence on administrators, and to exert a chilling effect on other academics. Promoting a norm of political non-discrimination, and incentivising administrators to do what they are already legally obliged to do, is a crucial step towards ensuring a culture of free discourse in our universities.

BREAKING: Impeachment Process Against Governor Cuomo Has Begun

On Thursday, New York Assembly Republicans officially began the impeachment process against Governor Andrew Cuomo for his potentially criminal activity relating to the nursing home scandal.

The Republican lawmakers officially announced a resolution to start an impeachment commission against Cuomo. This is the first step necessary to remove Cuomo as Governor.

On Thursday, Assembly Republicans announced a resolution to create an impeachment commission consisting of eight bipartisan members of the legislature. The panel would have 60 days to conduct its work and submit its findings and recommendations to the state legislature.

“The Cuomo Administration’s nursing home cover-up is one of the most alarming scandals we’ve seen in state government,” Assembly Minority Leader Will Barclay said in a statement. “It is incumbent upon the Legislature to undertake a comprehensive, bipartisan review of the Cuomo Administration’s policies, decisions and actions on this matter and render a decision on what steps must be taken to hold the governor accountable.”

Cuomo is under intense fire from both Republicans and Democrats in the state of New York. On Monday, the New York governor falsely claimed that legislators in the state Assembly and Senate were told that there was a “pause” in responding to lawmakers’ requests for data relating to the nursing home scandal. That claim by Cuomo was immediately denounced by New York state Democratic legislators.

Relating to the “pause,” Cuomo said:

This past year, there was a toxic political environment and everything gets politicized and there’s political spin and then there are facts — two very different things and I just want to be sure people have facts. Last August, Department of Justice sent a letter to Democratic governors, four of them: New York, New Jersey, Michigan and Pennsylvania asking for information on public nursing homes. New York State Legislature also sent a letter asking for information on nursing homes. We paused the State Legislators’ request while we were finishing the DOJ request.

We told both houses, the Assembly and the Senate, that we had DOJ request for information and we were prioritizing that. We did give the DOJ request precedence and we told both houses that. The August request, we replied to fully. Separately, DOH got a DOJ letter signed by Jeffrey Clark, the attorney, in October — which we learned about from the New York Post. We didn’t even get the letter. The Post called and told us about the letter and that requested information on private nursing homes and we have been voluntarily producing information on that on a rolling basis as recently as January 8 as offered by DOJ — the rolling basis production.

Second, we paused the State Legislature’s request. We paused the State Legislature’s request. We voluntarily complied with the DOJ request for information. Two very different things, The New York State DOH has always fully and publicly reported all COVID deaths in nursing homes and hospitals. They have always been fully reported.

Editor of the Albany Times-Union asked New York state senators if Cuomo’s claim was true, asking: “[Gov. Cuomo] now claims legislative STAFF was told about the DOJ ‘pause’ in responding to lawmakers’ requests for nursing home data,” Casey Seiler tweeted. “Does that square with your experiences, @NYSenatorRivera, @JamesSkoufis, @DickGottfriedet al?”

Sen. Gustavo Rivera replied, “Outside of what I read in the paper? Ahem, let me clear my throat here, ahem: IT. DOES. NOT.”

A Politico reporter commented, “I honestly don’t think I would’ve placed ‘Assembly staff’ high on my rankings of the people most likely to get thrown under the bus today.”

New York State Assembly member Yuh-Line Niou tweeted: “The legislature had no knowledge of a DOJ inquiry. The legislature at a public hearing asked questions of the executive and of the health commissioner and then was lied to. The things said in the last press conference were frightening because for their blatant goal to mislead.” She added, “Also I should mention, a DOJ inquiry shouldn’t matter. The governor should not lie or withhold or cover up information that we need to legislate in order to keep New Yorkers safe.”

State Assembly member Ron Kim unleashed, calling Cuomo’s actions “despicable,” tweeting, “Gov Cuomo tried to throw our Speaker and our central staff under the bus today when his top aide admitted to obstructing justice. That’s beyond despicable.”

Los Angeles Parents Organize Strike Against Teachers’ Unions

Frustrated parents of children in the Los Angeles Unified School District (LAUSD) public school system are organizing a strike to protest the teachers’ unions’ refusal to return to work.

Parents who join the strike say that they will refuse to allow children to participate in remote classes, starting Feb. 22, and will picket in front of schools instead.

Children across the district have been participating in classes via Zoom for a year.

The strike was reported by Bill Melugin of local Fox affiliate KTTV:

Older students will be allowed to return to campus once the county reduces case rates even further.

Students in other nearby districts have already begun returning to school.

However, teachers’ unions in Los Angeles, as in some other big cities nationwide, remain opposed to returning to work.

In a statement Tuesday, the United Teachers Los Angeles (UTLA), the main union for local schools, cautioned that reopening “unsafely” would “create more instability for students.” It added:

Educators cannot support a broad physical reopening of schools until school staff required to work in person have access to vaccinations, LA County is out of the purple tier and reaches much lower community transmission rate along with strict multi-layered mitigation strategies in place — such as COVID testing, physical distancing, use of masks, hand hygiene, and isolation/quarantine procedures.

It’s disheartening that once again elected officials are discounting the families that LAUSD serves, who are overwhelmingly low-income families of color. Black, Latino, and Pacific Islander residents are dying at disproportionately higher rates and getting vaccinated at disproportionately lower rates. The COVID death rate among Latino residents in L.A. County remains triple the rate for white residents even as the recent surge recedes.

Critics of the unions counter that minority communities are suffering most from school closures, which have led to higher absenteeism and crime rates in those parts of L.A.

Moreover, school board officials insist that reopening is safe, as KTLA noted:

LAUSD has enhanced sanitization measures and followed other guidelines from the federal Centers for Disease Control & Prevention, and the district has even established a comprehensive school-based COVID-19 testing program, according to LAUSD Superintendent Austin Beutner.

“Los Angeles Unified has done more than any school district in the nation to prepare schools to welcome students back to in-person classes,” the superintendent said Feb. 8.

President Joe Biden promised to have schools open by the end of his first 100 days in office, a pledge that the White House has since downgraded to having schools open one day per week by that deadline. Unions have insisted on more vaccination for teachers, and more “resources” to help districts prevent the spread of coronavirus on school premises.

Randi Weingarten, president of the American Federation of Teachers, told NPR earlier this month that teachers feel safer at home.

Though Centers for Disease Control and Prevention (CDC) Dr. Rochelle Walensky had previously said that vaccination was not necessary for schools to reopen safely, the CDC’s new guidelines were allegedly made particularly stringent after consultation with the unions. Recommendations:

1. Limit the issuance of uniqueIDs to the thread level. Throttle to get a chance to capture traffic as it comes in.

2. Analyze sources and trace. You'll like run out of icmp responses, but if you gather enough, you might be able to conceivably geolocate.

NYC Waitress Fired For Waiting To Take COVID Vax Over Pregnancy Concerns

A waitress in New York City was fired after she told her employer that she wanted to wait and see if the COVID-19 vaccine - which has been in use for less than nine months - has any side affects on pregnancy.

34-year-old Bonnie Jacobson, who started working at the Red Hook Tavern in August, says she's not an 'anti-vaxxer,' but was uncomfortable taking the vaccine while she and her husband were trying to conceive, she told the Daily Mail.

On February 8, the restaurant sent an email to employees which said "If you choose to get vaccinated, here's what you need to know." The email made no mention of mandatory vaccinations - which, by the by, don't prevent people from catching or transmitting COVID-19 and instead helps protect against serious illness from the disease.

During a staff meeting, Jacobson says she told her manager that she wanted more time to research the vaccine, and was told that she wouldn't be required to get the shot.

"As a 34-year-old woman, why take the risk right now when I can just wait a little longer when there are people a lot older and more at risk who could use the vaccine more than I could right now?" she told the Mail. "My dad is 68 years old and lives in Pennsylvania and has diabetes, there’s no reason why I should be getting that before him."

Days later on February 12, the Brooklyn tavern changed its mind and sent an email telling employees that the vaccine was ''mandatory.''

"Please be advised that we will require that all employees receive the vaccination," reads the email.

"This will be mandatory for all existing employees and any new hires. The exception to this policy will be if your own personal health or disability prohibits you from obtaining this vaccination. We encourage you to consult your healthcare professional to determine if getting a vaccine is right for you."

Jacobson emailed her employers back, and said that while she 'fully supports' the vaccine, she doesn't want to get it yet.

"While I fully support the vaccine and understand its importance I do believe this is a very personal choice. I really hope this choice would not affect my employment at Red Hook Tavern," she wrote, adding that she takes COVID "very seriously" and will continue to practice safety guidelines.

"I just wanted more time they didn’t allow me that, I didn’t even have time to consult a physician. It was a week from being 'your choice,' to it's not going to be mandatory, to it us mandatory, to you’re fired," said Jacobson. "I had a very good working relationship there. I just had an employee review on February 6 and it was all positive, so it was truly shocking that it was so impersonal."

According to labor attorney Carolyn D. Richmond, it's too early for companies to mandate shots.

The media these days is saturated with tales of “evil conservatives” and our heinous plans for world domination through “insurrection”. In fact, most mainstream articles that cover recent events including the election and the protests at the capitol make a point to always mention “white supremacy” and “terrorism” in the same breath as the word “conservative”. This is an entirely deliberate propaganda tactic called “word association” or “word redefinition”; change the subtext of a word or group label in the minds of the masses and you can often change perception from positive to negative.

In other words, Conservative = Racist/Terrorist. It doesn’t matter if it’s not true, it just matters that people are conditioned to subconsciously make the connection.

How about an example:

I’ve offered numerous criticisms of Trump and his administration over the years, but none of those criticism had anything to do with what leftists have been regurgitating since 2016. To them, Trump’s “racism” was verified fact, yet when I ask any social justice warrior to produce an actual quote of Trump saying something racist, they can’t seem to dig anything up.

By extension, leftists have a bizarre obsession with Russia and the theory that Russia is an ever present hand of god in US politics, yet, none of them can produce any concrete proof that Russia has meaningful influence in American elections or affairs.

The political left has committed itself to a fantasy world; a parallel universe. They deeply believes in things that never happened, and treat those beliefs as sacrosanct. Why? Probably because their movement is infected with people that are easily manipulated by word redefinitions and false associations. Are they victims of propaganda? Sure. Are they innocent? No, not really.

Refusal to question the actions and motives of your chosen movement is willful ignorance, and leftists should be held accountable for that.

They are the ONLY group of people that has consistently supported mass surveillance, mass censorship and deplatforming, mass violence, property destruction and looting as well as violations of individual rights through medical mandates and lockdowns.

They call conservatives “insurrectionists” and “traitors”, but they are the only people openly trying to dismantle constitutional protections and the Bill of Rights.

So, who are the real villains of this story?

It’s one of the main reasons why we find it difficult to organize on the same scale that leftists often do. We might all agree on the source of the problems our country faces, but we rarely all agree on the details, or the solutions. This is a weakness, but it is also a strength.

I would much rather be a part of a movement that self reflects. I would much rather be a part of a movement that doesn’t operate as a hive mind. There needs to be LOGICAL dissenting voices in everything so that ideas are challenged. If the ideas are found wanting by reason and wisdom, then they need to be addressed or abandoned. The political left has no concept of this, though.

Leftists are afraid to question anything within their own circles. To dissent on the smallest detail is to be a heretic, a traitor to the cause. They use the word “diversity” all the time, like a battle cry, but when confronted with true diversity (diversity of thought), they panic and react violently.

Leftists don’t actually care about diversity; they only care that you have blind allegiance to the collective. Stray but a little, and the mob will come for your head. They LOVE plantations, they love slavery; as long as they own the plantations and they control the slaves.

A natural consequence of this Animal Farm mentality is that irony and hypocrisy is lost on the followers of such movements. They project all their shortcomings and crimes on others. The devils they see in conservatives are actually the devils they see in the mirror everyday. That said, the higher up you get in the leftist pyramid, the less it becomes hypocritical and the more it becomes malicious and deliberate.

The gaslighting, the word association propaganda, the selective memory hole they use to erase historical facts that contradict their ideology, the people at the top and their lackeys KNOW exactly what they are doing. They don’t care that their claims are hypocritical or outright fraudulent. They know they are lying, they know they are gaslighting. They’re not interested in being right, they are only interested in WINNING.

There is much more going on here than meets the eye. There is a great deal of power and money behind the rise of the hard left ideology and there are certain people that benefit from it’s expansion. Leftists like to view themselves as the “underdogs” or revolutionaries fighting against “the man”. However, every resource of global power brokers has been offered in support of the political left. The “Man” is the ally of the leftists; in some ways he is even the creator of the leftist movement.

They aren’t revolutionaries at all; they are the jackboots of the new world order.

It was globalist institutions like the Rockefeller Foundation and the Ford Foundation that funded different elements of the feminist movement and “gender studies” movements from the late 1960’s onward. This included the Rockefeller Foundation’s large donations to ‘The Feminist Press’ and the Ford Foundation’s programs to indoctrinate university professors into injecting social justice talking points into their curriculum.

I would say, actually, yes, that’s EXACTLY what freedom of speech means. Freedom of speech means that no single group of people is allowed to use fear, intimidation and punishment to compel silence in other groups or individuals that disagree with them. With corporate monopoly and government on their side, it is clear that leftists have appointed themselves the sole arbiters of “consequence”, and this violates the constitution in every conceivable way.

The collusion between government, corporations and extremist ideological movements is the classical definition of fascism. And, just as the Third Reich enjoyed immense funding, investment and industrial support from globalists and corporations in the decade leading up to WWII, the political left is enjoying immense support from the global corporate oligarchy today.
