Murphy was permanently banned from Twitter more than two years ago for the tweet, which Twitter alleged violated their policy against hateful conduct.

A California Court of Appeals has ruled against feminist activist Meghan Murphy, who launched a lawsuit against Twitter after she was permanently banned from their platform for declaring "women aren't men," Reclaim the Net reports.

Murphy was permanently banned from Twitter more than two years ago for the tweet, which Twitter alleged violated their policy against hateful conduct.

Murphy, who has long been a critic of transgender activists, has long been accused of being "transphobic" for asserting that gender aligns with biological sex.

The court cited Section 230 of the Communications Decency Act, which allows big tech companies to censor content on their sites without oversight or legal liability over the content they platform.

"In sum, the trial court properly sustained Twitter’s demurrer without leave to amend because each of Murphy’s claims is barred under section 230(c)(1)," the judge wrote.

Murphy had also argued that Twitter's policy allowing them to ban users "at any time, for any, or no reason" is unfair and that they had previously marketed themselves as a pro-free speech platform.

Landmark Proposals to Strengthen Free Speech at UK Universities

New Free Speech Champion and registration condition for higher education providers announced

Tougher legal measures to strengthen free speech and academic freedom at universities in England have been announced by the Education Secretary today (16 February), to stamp out unlawful ‘silencing’ on campuses.

Following an increasing number of cases of individuals being silenced, the Education Secretary has warned of a ‘chilling effect’ where students and staff feel they cannot express themselves freely.

The proposed measures deliver on a manifesto commitment, and include a new free speech condition placed on higher education providers in order to be registered in England and access public funding. The regulator, the Office for Students, would have the power to impose sanctions, including financial penalties, for breaches of the condition.

The strengthened legal duties would also extend to Students Unions, which for the first time would have to take steps to ensure that lawful free speech is secured for their members and others, including visiting speakers.

In addition, a new legal measure would enable individuals to seek compensation through the courts if they suffer loss as a result of breach of the free speech duties – such as being expelled, dismissed or demoted.

Education Secretary Gavin Williamson said:

Free speech underpins our democratic society and our universities have a long and proud history of being places where students and academics can express themselves freely, challenge views and cultivate an open mind.

But I am deeply worried about the chilling effect on campuses of unacceptable silencing and censoring. That is why we must strengthen free speech in higher education, by bolstering the existing legal duties and ensuring strong, robust action is taken if these are breached.

Under the plans, the Education Secretary would also appoint a new Free Speech and Academic Freedom Champion to investigate potential infringements, such as no-platforming speakers or dismissal of academics, and higher education providers would be legally required to actively promote free speech.

The new Champion would be appointed to the board of the Office for Students and would be able to investigate potential infringements of the new registration condition on freedom of speech and academic freedom in higher education. The registration condition would work alongside strengthened legal duties on free speech and academic freedom and the Champion would also be able to recommend that the Office for Students imposes fines.

The policy paper also includes Government expectations that go beyond the minimum legal duties, setting out what universities should aspire to.

The Government will continue to work alongside the sector on guidance and further research, and the next steps for legislation will be set out in due course.

Tom Simpson, Associate Fellow at Policy Exchange, and an Associate Professor of Philosophy and Public Policy, at the Blavatnik School of Government, University of Oxford, said:

This policy paper by the Department of Education is a very welcome step towards ensuring that viewpoint diversity is protected in British universities.

As Cambridge University’s recent Senate House vote shows, there is a substantial majority of academics who favour academic freedom. The problem, as Policy Exchange’s research has explored, is that a very online culture allows the views of a minority to exert disproportionate influence on administrators, and to exert a chilling effect on other academics. Promoting a norm of political non-discrimination, and incentivising administrators to do what they are already legally obliged to do, is a crucial step towards ensuring a culture of free discourse in our universities.

BREAKING: Impeachment Process Against Governor Cuomo Has Begun

On Thursday, New York Assembly Republicans officially began the impeachment process against Governor Andrew Cuomo for his potentially criminal activity relating to the nursing home scandal.

The Republican lawmakers officially announced a resolution to start an impeachment commission against Cuomo. This is the first step necessary to remove Cuomo as Governor.

On Thursday, Assembly Republicans announced a resolution to create an impeachment commission consisting of eight bipartisan members of the legislature. The panel would have 60 days to conduct its work and submit its findings and recommendations to the state legislature.

“The Cuomo Administration’s nursing home cover-up is one of the most alarming scandals we’ve seen in state government,” Assembly Minority Leader Will Barclay said in a statement. “It is incumbent upon the Legislature to undertake a comprehensive, bipartisan review of the Cuomo Administration’s policies, decisions and actions on this matter and render a decision on what steps must be taken to hold the governor accountable.”

Cuomo is under intense fire from both Republicans and Democrats in the state of New York. On Monday, the New York governor falsely claimed that legislators in the state Assembly and Senate were told that there was a “pause” in responding to lawmakers’ requests for data relating to the nursing home scandal. That claim by Cuomo was immediately denounced by New York state Democratic legislators.

Relating to the “pause,” Cuomo said:

This past year, there was a toxic political environment and everything gets politicized and there’s political spin and then there are facts — two very different things and I just want to be sure people have facts. Last August, Department of Justice sent a letter to Democratic governors, four of them: New York, New Jersey, Michigan and Pennsylvania asking for information on public nursing homes. New York State Legislature also sent a letter asking for information on nursing homes. We paused the State Legislators’ request while we were finishing the DOJ request.

We told both houses, the Assembly and the Senate, that we had DOJ request for information and we were prioritizing that. We did give the DOJ request precedence and we told both houses that. The August request, we replied to fully. Separately, DOH got a DOJ letter signed by Jeffrey Clark, the attorney, in October — which we learned about from the New York Post. We didn’t even get the letter. The Post called and told us about the letter and that requested information on private nursing homes and we have been voluntarily producing information on that on a rolling basis as recently as January 8 as offered by DOJ — the rolling basis production.

Second, we paused the State Legislature’s request. We paused the State Legislature’s request. We voluntarily complied with the DOJ request for information. Two very different things, The New York State DOH has always fully and publicly reported all COVID deaths in nursing homes and hospitals. They have always been fully reported.

Editor of the Albany Times-Union asked New York state senators if Cuomo’s claim was true, asking: “[Gov. Cuomo] now claims legislative STAFF was told about the DOJ ‘pause’ in responding to lawmakers’ requests for nursing home data,” Casey Seiler tweeted. “Does that square with your experiences, @NYSenatorRivera, @JamesSkoufis, @DickGottfriedet al?”

Sen. Gustavo Rivera replied, “Outside of what I read in the paper? Ahem, let me clear my throat here, ahem: IT. DOES. NOT.”

A Politico reporter commented, “I honestly don’t think I would’ve placed ‘Assembly staff’ high on my rankings of the people most likely to get thrown under the bus today.”

New York State Assembly member Yuh-Line Niou tweeted: “The legislature had no knowledge of a DOJ inquiry. The legislature at a public hearing asked questions of the executive and of the health commissioner and then was lied to. The things said in the last press conference were frightening because for their blatant goal to mislead.” She added, “Also I should mention, a DOJ inquiry shouldn’t matter. The governor should not lie or withhold or cover up information that we need to legislate in order to keep New Yorkers safe.”

State Assembly member Ron Kim unleashed, calling Cuomo’s actions “despicable,” tweeting, “Gov Cuomo tried to throw our Speaker and our central staff under the bus today when his top aide admitted to obstructing justice. That’s beyond despicable.”

Los Angeles Parents Organize Strike Against Teachers’ Unions

Frustrated parents of children in the Los Angeles Unified School District (LAUSD) public school system are organizing a strike to protest the teachers’ unions’ refusal to return to work.

Parents who join the strike say that they will refuse to allow children to participate in remote classes, starting Feb. 22, and will picket in front of schools instead.

Children across the district have been participating in classes via Zoom for a year.

The strike was reported by Bill Melugin of local Fox affiliate KTTV:

Earlier this week, Los Angeles County public health authorities announced that coronavirus cases had dropped enough to allow elementary schools to reopen. As KTLA 5 reported:

For five consecutive days, the county has seen an adjusted case rate of less than 25 new cases per 400,000 people — meeting California requirement to allow in-person classes for students in grades K-6 for the first time, officials said. Older students will be allowed to return to campus once the county reduces case rates even further.

Students in other nearby districts have already begun returning to school.

However, teachers’ unions in Los Angeles, as in some other big cities nationwide, remain opposed to returning to work.

In a statement Tuesday, the United Teachers Los Angeles (UTLA), the main union for local schools, cautioned that reopening “unsafely” would “create more instability for students.” It added:

Educators cannot support a broad physical reopening of schools until school staff required to work in person have access to vaccinations, LA County is out of the purple tier and reaches much lower community transmission rate along with strict multi-layered mitigation strategies in place — such as COVID testing, physical distancing, use of masks, hand hygiene, and isolation/quarantine procedures.

It’s disheartening that once again elected officials are discounting the families that LAUSD serves, who are overwhelmingly low-income families of color. Black, Latino, and Pacific Islander residents are dying at disproportionately higher rates and getting vaccinated at disproportionately lower rates. The COVID death rate among Latino residents in L.A. County remains triple the rate for white residents even as the recent surge recedes.

Critics of the unions counter that minority communities are suffering most from school closures, which have led to higher absenteeism and crime rates in those parts of L.A.

Moreover, school board officials insist that reopening is safe, as KTLA noted:

LAUSD has enhanced sanitization measures and followed other guidelines from the federal Centers for Disease Control & Prevention, and the district has even established a comprehensive school-based COVID-19 testing program, according to LAUSD Superintendent Austin Beutner.

“Los Angeles Unified has done more than any school district in the nation to prepare schools to welcome students back to in-person classes,” the superintendent said Feb. 8.

President Joe Biden promised to have schools open by the end of his first 100 days in office, a pledge that the White House has since downgraded to having schools open one day per week by that deadline. Unions have insisted on more vaccination for teachers, and more “resources” to help districts prevent the spread of coronavirus on school premises.

Randi Weingarten, president of the American Federation of Teachers, told NPR earlier this month that teachers feel safer at home.

Though Centers for Disease Control and Prevention (CDC) Dr. Rochelle Walensky had previously said that vaccination was not necessary for schools to reopen safely, the CDC’s new guidelines were allegedly made particularly stringent after consultation with the unions. Walensky said that the new guidelines had been “free from political meddling.”
