BOSTON (Reuters) - A Kentucky teenager whose 2019 face-off with a Native American activist in Washington went viral has fired his lawyer, a man who played a key role in Donald Trump's attempts to overturn his election defeat, according to court notices filed on Monday.

 

The teen, Nicholas Sandmann, terminated lawyer L. Lin Wood from the team representing him in a series of lawsuits that accuse media companies like The New York Times Inc and CBS News Inc of inaccurately portraying the stand-off at the Lincoln Memorial on the day of a large anti-abortion protest.

 

"I have ended my lawyer-client relationship with Mr. Wood and no longer wish to be represented by him," Sandmann said in an affidavit included in the court filings.

 

Sandmann continues to be represented by Kentucky-based lawyer Todd McMurtry.

 

Wood did not immediately respond to a request for comment. In a statement shared on the Telegram app on Sunday,Wood said he expected Sandmann would "abandon" him because of earlier social media posts in which Wood suggested former Vice President Mike Pence engaged in "treason" and could "face execution by firing squad" for formally recognizing the election victory of President Joe Biden.

 

Wood said in the Telegram post that his comments about Pence were "rhetorical hyperbole."

 

Sandmann, 18, expressed alarm at Wood's comments earlier this month. On Twitter, the teen shared one of Wood's social media posts about Pence and wrote: "I'm sorry but what the hell."

 

The move is the latest indication that those who supported former President Donald Trump's baseless claim that his loss to Biden was the result of mass fraud could face longer term professional consequences.

 

A Delaware state judge this month blocked Wood from representing former Trump adviser Carter Page in a defamation lawsuit, saying that his conduct in election-related lawsuits "exhibited a toxic stew of mendacity, prevarication and surprising incompetence."

 

Sandmann's face-off with Native American activist Nathan Phillips in January 2019 was captured on video and shared on social media, generating widespread media coverage.

 

Sandmann's family has lawsuits pending against the New York Times, CBS, ABC News Inc, Rolling Stone LLC, and others. Reuters is not a defendant in the litigation.

 

The lawsuits alleged that because Sandmann wore a hat emblazoned with Trump's 'Make American Great Again' slogan, media outlets inaccurately suggested he was the face of an unruly mob.

 

In court filings, the media outlets have denied defaming Sandmann in their coverage.

 

Sandmann settled similar lawsuits against CNN and the Washington Post last year for undisclosed amounts.

 

Sandmann spoke at the Republican National Convention in August, endorsing Trump and accusing the media of advancing an "anti-Christian, anti-conservative, anti-Donald Trump narrative."

 

The teen's relationship with Wood appeared to sour as the attorney filed unsuccessful lawsuits seeking to overturn Biden's victory and baselessly accused Pence and Supreme Court Justice John Roberts of treason and corruption.

 

Separately on Monday, a U.S. voting machine company filed a $1.3 billion lawsuit against Trump's lawyer Rudy Giuliani, accusing him of defamation in what it called his "big lie" campaign about widespread fraud in the presidential election.

When presiding over an impeachment trial, the president pro tempore takes an additional special oath to do impartial justice according to the Constitution and its laws. It is an oath that I take extraordinarily seriously," Leahy said.

 

"I consider holding the office of the president pro tempore and the responsibilities that come with it to be one of the highest honors and most serious responsibilities of my career. When I preside over the impeachment trial of former President Donald Trump, I will not waver from my constitutional and sworn obligations to administer the trial with fairness, in accordance with the Constitution and the laws."

The Hill reports that the procedures for the trial are currently being negotiated by Senate Majority Leader Chuck Schumer (D-N.Y.) and Minority Leader Mitch McConnell (R-Ky.).

 

"Leaders have been negotiating all process issues about the trial, and all along we have deferred to them for any announcements about this and all other process matters," a spokesman for Leahy told The Hill.

 

Several Republican senators have spoken out against the decision to have Leahy preside, given that he's previously voted to convict Trump the first time the Senate impeached the former president. Some have raised constitutional objections.

 

"There's only one constitutional process for impeachment and it is of the president, not a president," said Sen. Josh Hawley (R-Mo.). "It requires the chief justice to preside."

 

Article I, Section 3, Clause 6 of the U.S. Constitution states:

 

The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

 

Leahy's statement explains there is historical precedent for having the Senate president pro tempore preside over impeachment trials as a "neutral arbiter" for impeachment cases that do not involve a U.S. president. Because Trump is no longer the president, the logic goes that Chief Justice Roberts is not lawfully obligated to preside over the trial. And because what the Senate is doing is unprecedented, there's plenty of room for the Senate to interpret its own rules.

 

However, that does not preclude Republicans from complaining. Sen. John Cornyn (R-Texas) told The Hill that having Leahy preside over the trial "really undermines the legitimacy."

'Attempted sedition': Justice Department launches investigation into alleged Trump plot

 

Donald Trump is being investigated by the Justice Department watchdog over a purported scheme to install officials to overturn the election result.

Department of Justice (DOJ) Inspector General Michael Horowitz announced the investigation today.

"The DOJ Office of the Inspector General (OIG) is initiating an investigation into whether any former or current DOJ official engaged in an improper attempt to have DOJ seek to alter the outcome of the 2020 Presidential Election," a statement from Mr Horowitz read.

 

"The investigation will encompass all relevant allegations that may arise that are within the scope of the OIG's jurisdiction.

"The OIG has jurisdiction to investigate allegations concerning the conduct of former and current DOJ employees."

 

Mr Horowitz was appointed as Inspector-General of the Justice Department by Barack Obama in 2012, but was kept on throughout the Trump Administration.

The investigation follows a report from the New York Times detailing an alleged plot by Mr Trump to replace the acting attorney-general.

Jeffrey Rosen became acting attorney-general a few days earlier following the resignation of Bill Barr.

The supposed plot would install Trump loyalist Jeffrey Clark as attorney-general, who would then use the power of the Justice Department to pressure states to overturn the election.

Trump nominated Jackson to be Secretary of Veterans Affairs to succeed David Shulkin. The long knives came out for a man who was highly respected by White House employees in three administrations because of this nomination, led by Democrat Senator Jon Tester. Suddenly Dr. Jackson became Dr. Feel-Good, a man inclined to over-generously hand out pills. It was a disgraceful partisan attack on Jackson. Jackson is now a member of the House, representing his home district in Texas.

 

Doctor Jackson was removed in part due to remarks made by VP Pence’s doctor, Dr. Jennifer Pena, who raised questions about Jackson in the White House:

 

 

Pena had raised concerns about Jackson, who had been tapped by President Donald Trump to lead the Department of Veterans Affairs, involving his medical treatment of Pence’s wife, Karen, last fall, officials told NBC News. Pena had reported the concerns to Pence’s chief of staff who took the issues to Trump chief of staff John Kelly.

 

Dr. Pena was apparently not Biden’s White House doctor.

Goya Foods has voted to silence its pro-Trump CEO Robert Unanue following his recent television appearances questioning the results of the presidential election, The Post has learned.

 

The Hispanic foods giant on Friday agreed to censure Unanue, 67, for controversial remarks in the wake of the deadly Jan. 6 invasion of the US Capitol building, including on Jan. 20 when he called Biden’s election β€œunverified” during an appearance on Fox Business.

 

The vote by a majority of Goya’s nine-member board means Unanue must now obtain board permission before making any more media appearances, sources close to the situation said.

 

β€œBob does not speak for Goya Foods when he speaks on TV,” Goya board member and third-generation owner Andy Unanue told The Post last week leading up to the vote. β€œThe family has diverse views on politics, but politics is not part of our business. Our political point of views are irrelevant.”

Signature Bank in New York also closed Trump’s account.

 

As did Germany’s Deutsche Bank.

 

New York mayor Bill de Blasio, who permitted Antifa and BLM to loot and burn Manhattan, has terminated the city’s contracts with Trump businesses that run ice skating rinks and a carousel in Central Park and a golf course in the Bronx.

Biden’s 100-Day Plan Includes Attack On Gun Industry

 

We’re still waiting on Joe Biden’s first round of executive actions dealing with gun control, but the new administration is signaling that it will work with Democrats in Congress to target the firearms industry with legislation as well as using the power of the executive branch to restrict the Second Amendment rights of Americans.

 

According to Biden’s plan for his first 100 days in office, the president plans on introducing a bill to repeal the Protection of Lawful Commerce in Arms Act. The law, signed by President George W. Bush in 2005, curtails the filing of lawsuits seeking to hold the firearms industry responsible for the third-party acts of criminals and was approved by a bipartisan majority of Congress when it became clear that the gun control movement was using a strategy of trying to bankrupt the industry through litigation.

 

Even if none of the cases filed against gun manufacturers went to trial, the companies still were on the hook for legal fees, while the cities and individuals who’d filed suit often relied on pro-bono representation by anti-gun litigators. It was a β€œdeath by a thousand cuts” strategy, but the Protection of Lawful Commerce in Arms Act put a stop to the vast majority of the lawsuits that had been filed.

 

As NRA’s Institute for Legislative action explains in a new alert to members:

 

While portrayed by opponents as providing β€œextraordinary” immunity to the firearms industry, the essence of the PLCAA is simply that the gun industry would be subject to the same rules of third party liability that apply to other businesses. Thus, the PLCAA prohibits, in state or federal court, a civil action or administrative proceeding by any person against a manufacturer or seller of a firearm, ammunition, or β€œcomponent part” thereof, or a trade association, for harms resulting from the criminal/unlawful misuse of the product by the person or a third party.

 

Contrary to the way the PLCAA is portrayed by the antigun media and other opponents, it does not provide β€œabsolute immunity” to unscrupulous gun companies. I had not been able to catch a good look at the clothes yesterday. I started my .05 speed review at Beyonce/Gaga. The edits were very clever, rapid…but holy shit the Arlington pics were just shameful. They managed to get the Biden girls dressed nicely on both occasions which is an outlier.
