not thrown out. looks like the writ of certiorari was granted. this little out to keep the SCOTUS case alive was granted when the case was "rejected" but over looked by a lot of people. the wheels of justice turn slow but they're still turning. the case will now go to an appeals court to decide if the case has enough bearing to be heard by SCOTUS
