Justice Wood: β€œThere is a substantial basis in law to proceed, to permit the plaintiff [Project Veritas], to conduct discovery, and to then attempt to meet its higher standard of proving liability through clear and convincing evidence of actual malice.”

 

The New York Times is β€œone of the largest newspapers in the world since Abraham Lincoln,” the ruling stated. And it’s β€œclaiming protections from an upstart competitor [Project Veritas] armed with a cell phone and a web site.”

 

Judicial order denying New York Times’ motion to dismiss: β€œThe [New York Times] Articles could be viewed as exposing Veritas to ridicule and harm… because the reader may read these news Articles… and conclude that Veritas is a partisan zealot group, deceptively editing video, and presenting it as news.”

 

The order continued: β€œUpon review of the total context and tone of the stories… the court concludes that a reasonable reader could very well believe that the challenged statements were conveying facts about Veritas.”

 

Constitutional Law Professor Jonathan Turley called the decision a β€œmajor victory” for Veritas: β€œI expect to be teaching this case next year in my torts class when we deal with defamation.”

 

[WESTCHESTER, N.Y. – Apr. 5, 2021] Project Veritas founder and CEO James O’Keefe gave an update on the organization’s defamation lawsuit against the New York Times today, explaining how a recent court ruling could potentially flip the script on the mainstream media.

 

Justice Charles D. Wood wrote there is β€œsubstantial basis in law” for the suit to proceed, despite The New York Times citing Wikipedia as a source (along with various mainstream media outlets), to claim Project Veritas was β€œlibel proof.”

Happy Wednesday, dear Kruiser Morning Briefing friends. I dream in oboe music.

 

Before we begin I just wanted to point out the fancy new bio boxes we now have at the end of our posts. I’ve never felt more popular in my life. Next up: high tea and an ascot.

 

It’s springtime, a season of hope, renewal, and generally good times. A time to be with friends, family, and a frosty alcoholic beverage or three.

 

Unless, of course, you worship at the altar of Dr. Anthony β€œShut It, Peasants” Fauci. The nation’s chief panic porn sourpuss has turned his fifteen minutes of fame into fourteen months of tyrannical infamy and it doesn’t look like he wants to let up anytime soon.

 

Frequent readers of the Morning Briefing are no doubt aware that I can’t stand Fauci. What began as mild annoyance with Fauci at the beginning of the pandemic has morphed into full-blown intense dislike. I don’t really hate people, that takes far too much energy. Intense dislike can be an invigorating writing prompt, however. I’m a big fan.

 

Fauci’s shaming shtick has been wearing thin for a while. He really likes doing his bureaucratic bully thing during holidays or big events, like the Super Bowl. As I noted in that post, it’s nigh on impossible to count how many times Fauci has been wrong about pandemic-related things. He is revered by most on the Left as being wisest voice of reason in government regarding this stupid plague. In reality, he shoots from the lip with personal opinions that aren’t grounded in SCIENCE, all the while insisting that they are.

 

What really makes me dislike the guy, however, is the fact that he obviously doesn’t want anybody to feel better, at least emotionally. I wrote in mid-February that Fauci and Co. were going to start using β€œvariants” as an excuse to keep us cowering and miserable, despite the fact that more and more of us are getting vaccinated.

 

Fauci is sticking with his heavy-handed scolding approach and oh, by the way, he’s still wrong about everything:

It’s not theoretical. It actually happens.”

 

But, there’s been no surge. In fact, cases have continued to decline.

 

And Fauci, proven wrong, struggled to explain how Texas has defied his own predictions during an appearance on MSNBC on Tuesday, and tried to suggest that there might be a β€œlag.”

 

Yeah, some states that just reopened after long lockdowns are having surges now but people aren’t dropping dead in the street. Like the states that reopened a long time ago and stayed open, that will go away. The COVID tyrants know that, so now they’re trying to scare the public with something called a β€œdouble mutant variant” of the virus:

 

DOUBLE. SECRET. PROBATION.

 

Reject the scare tactics. Mock those willing to give up freedoms because a whimsical bureaucrat likes making them dance for his amusement. Remember: none of this really has anything to do with public health at this point. Nobody needs one mask if they’ve had two vaccines, let alone two, as Dr, Mao Zefauci has suggested.

 

America wants to live again, and at least half of us aren’t going to let Anthony Fauci lie us into submission.

β€œIt could be because they’re doing things outdoors,” Fauci continued. β€œYou know it’s very difficult to just one-on-one compare that. We just have to see in the long-range. I hope they continue to tick down, if they do that would be great. But there’s always the concern when you pull back on methods, particularly things like indoor dining, or bars that are crowded, you could see a delay, then all of a sudden cases tick back up.”

 

β€œWe’ve been fooled before by situations where people begin to open up, nothing happens, and then all of a sudden a few weeks later things start exploding on you.”

 

Fauci warned that we don’t β€œprematurely judge” what’s going on in Texas.

 

I think the real issue is that Dr. Fauci doesn’t know what he’s talking about. Don’t forget, this is the same man who praised New York’s COVID response.

Derek Chauvin’s lead defense attorney Eric Nelson played a video for the court on Monday that appears to show his client was kneeling on George Floyd’s shoulder β€” not his neck.

 

Black Lives Matter, and the mainstream media journalists that support them, have long claimed that the officer was kneeling on the 46-year-old drug addict’s neck.

 

Nelson asked Minneapolis Police Chief Medaria Arradondo if he was familiar with the concept of β€œcamera perspective bias” before playing two different angles of footage from the scene.

 

The two videos he played were from teenager Darnella Frazier and the police bodycam footage from former Officer Alexander Kueng. In the video recorded by Frazier, the angle makes it appear that the officer’s knee is on Floyd’s neck, however, in the body camera footage from the same exact time, you can clearly see that his knee is on the criminal’s shoulder.

 

So, at least during some parts of the arrest, it is pretty clear that Chauvin had his knee on his shoulder.

Something's going on in the S. of France. Looks like training at first, as there's an uptick in training among combat air forces globally; but, I've noticed over the past 3 weeks or so (before the Ukraine heat up) that France was flying SIGINT collection birds almost daily gathering intelligence, domestically.

 

So this morning (midday France) I'm noticing an AWACS and THREE SIGINT birds…two on station and when one leaves, he gets relieved. That AWACS is there for a lot of a/c that are not squawking.

 

This may be presented as an exercise in the press, but to this ops guy, it looks like ops. Somebody(s) are having a bad day in the touristy area of the S. of France. Just a hunch.

Taiwan says may shoot down Chinese drones in South China Sea

 

TAIPEI (Reuters) - Taiwan has spotted Chinese drones circling the Taipei-controlled Pratas Islands in the South China Sea and may shoot them down if they stray too close, a government minister said on Wednesday, a move that could dramatically increase tensions with Beijing.

 

Speaking at parliament, Lee Chung-wei, who heads the Ocean Affairs Council under whose purview the Coast Guard falls, said that they had recently spotted Chinese drones circling the Pratas, though they have not flown over the islands.

 

"They have never entered our restricted waters and airspace, they've just flown around them at a certain distance," Lee said.

 

While China recognises no Taiwanese claims of sovereignty, its aircraft and ships generally stay outside Taiwan's restricted zone, which extends 6 km from its coast.

 

Asked how the Coast Guard would react if a Chinese drone entered that restricted zone, Lee said they had rules of engagement.

 

"After it enters it will be handled under the rules. If we need to open fire, we open fire."

 

The Pratas lie at the top end of the disputed waterway, and have become a relatively new source of intrigue between Chinese-claimed Taiwan and Beijing.

 

In recent months Taiwan has complained of repeated Chinese air force activity near the islands, which Taiwan's Coast Guard only lightly defends though there are periodic deployments of marines. There is no permanent civilian population, only occasional visiting scientists.

 

In October, Hong Kong air traffic controllers warned off a Taiwanese civilian flight flying to the Pratas on a routine weekly supply run, forcing it to turn back.

 

The Pratas, the closest Taiwan-controlled territory to Hong Kong, have also taken on extra significance since anti-government protests began in the Chinese-run city.

 

Taiwan has intercepted at least one boat close to the Pratas carrying people fleeing from Hong Kong trying to make their way to Taiwan.

 

Taiwan's other main South China Sea island is Itu Aba, also known as Taiping Island, which is part of the Spratly archipelago.

 

Lee said they have not spotted Chinese drones there.

 

Apart from China and Taiwan, Brunei, Malaysia, the Philippines and Vietnam also have competing claims for islands and features in the South China Sea.

Somehow it seems to me I am living in 2 worlds (timelines) at once.

Was at store earlier, got kicked out (3rd time, just for speaking truth).

I think there is a complete comms lockdown from military (not the Obama military) to the Bidan administration.

PLANO, Texas – Two men have been sentenced for crimes against children, including attempted coercion and enticement of a minor and distribution of child pornography, in the Eastern District of Texas, announced Acting U.S. Attorney Nicholas J. Ganjei today.

 

β€œThe Eastern District of Texas, along with its law enforcement partners, is committed to locating and stopping the most dangerous predators,” said Acting U.S. Attorney Nicholas J. Ganjei. β€œMany of the events of these cases occurred during the height of the pandemic; however, these agents never stopped working to ensure the safety of the children in our community.”

 

β€œCrimes against children are some of the most reprehensible acts that law enforcement is determined to prevent and punish once they occur,” said FBI Dallas Special Agent in Charge Matthew DeSarno. β€œWe are thankful for the collaboration of our partners in the Dallas Child Exploitation and Human Trafficking Task Force. It is because of this partnership that these two individuals are now facing lengthy sentences for their crimes.”

 

Christopher A. Sheffer, 58, of Media, Pennsylvania pleaded guilty to attempted coercion and enticement of a minor on Oct. 30, 2020 and was sentenced to 240 months in federal prison today by U.S. District Judge Sean D. Jordan. Judge Jordan also ordered Sheffer to pay a fine of $40,000 and a $5,000 assessment pursuant to the Justice for Victims of Trafficking Act of 2015.

 

According to information presented in court, in September 2019, Sheffer was the administrator of a group on a popular social media and communications application. As an administrator, he had the authority to determine who could join the group, which was devoted to incest and individuals who sexually abuse children. Participants in the group shared child pornography as well as their interest in molesting children. Sheffer privately communicated with an individual who he believed had access to a prepubescent child. Over the next few months, Sheffer expressed his interest in meeting the child for sex, mailed the child gifts, and sent the child private messages. On July 10, 2020, Sheffer flew from his home in Pennsylvania to Texas, where he then rented a car and drove to a specific location to meet the child and engage in sexual acts.

 

Judge Jordan also sentenced Thomas Earl Cardwell, Jr., 43, of Kemp, Texas, to 210 months in federal prison. Cardwell had previously pleaded guilty to distributing child pornography on Oct. 19, 2020.

 

According to information presented in court, Cardwell had been arrested for and convicted of online solicitation of a minor, sexual conduct in July 2019 in the 371st District Court of Tarrant County, Texas. He was released from the Texas Department of Criminal Justice in December 2019. Two months later, in February 2020, Cardwell began communicating with individuals on a social media application about his desire to perform oral sex on female children. As part of those communications, on March 6, 2020, Cardwell distributed four videos of child pornography, depicting prepubescent minors engaged in sexually explicit conduct.

 

This case is part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by U.S. Attorneys’ Offices and the Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. But if President Biden has his way, that threshold will be cut to $3.5 million, and the rate of tax increased to 45 percent (from 40 percent). Luzerne County Man Indicted For Drug Trafficking And Firearms Offenses

SCRANTON - The United States Attorney’s Office for the Middle District of Pennsylvania announced that William Heck, age 40, of Hazleton, Pennsylvania, was indicted on April 6, 2021, by a federal grand jury for drug trafficking and firearms offenses.

 

According to Acting United States Attorney Bruce D. Brandler, the indictment alleges that on October 2, 2020, Heck possessed a firearm in furtherance of drug trafficking, was a convicted felon in possession of firearms and ammunition, and possessed more than 40 grams of methamphetamine and an additional amount of fentanyl for distribution in Luzerne County.

 

The case was investigated by the FBI Safe Streets Task Force and the Pennsylvania State Police. Assistant United States Attorney Robert J. O’Hara is prosecuting the case.

 

This case is part of Project Safe Neighborhoods (PSN), a program that has been historically successful in bringing together all levels of law enforcement to reduce violent crime and make our neighborhoods safer for everyone. The Department of Justice reinvigorated PSN in 2017 as part of the Department’s renewed focus on targeting violent criminals, directing all U.S. Attorney’s Offices to work in partnership with federal, state, local and tribal enforcement and the local community to develop effective, locally-based strategies to reduce crime.

 

Indictments and Criminal Informations are only allegations. All persons charged are presumed to be innocent unless and until found guilty in court.

 

A sentence following a finding of guilt is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.

 

Under federal law, Heck faces a mandatory minimum sentence of ten years in prison for the drug trafficking charge, up to a maximum sentence of life in prison, a term of supervised release following imprisonment, and a fine. For the firearms charges, Heck faces an additional mandatory minimum sentence of five years in prison, which must run consecutive to any other sentence, a maximum sentence of life, a term of supervised release and a fine. Under the Federal Sentencing Guidelines, the Judge is also required to consider and weigh a number of factors, including the nature, circumstances and seriousness of the offense; the history and characteristics of the defendant; and the need to punish the defendant, protect the public and provide for the defendant's educational, vocational and medical needs. For these reasons, the statutory maximum penalty for the offense is not an accurate indicator of the potential sentence for a specific defendant.

I don't want to sound like an asshole, but this really has nothing to do with how much faith you have. This is an exercise in logic and problem solving. We're surrounded by deception, and even our most treasured institutions are programmed away from critical thinking to get through it. Had churches never been closed from the get-go, people might have had the opportunity to figure this out a little quicker, but again, that has nothing to do with faith. It had everything to do with keeping people from communicating in group settings, and coordinating responses to take back their lives.

Maryland U.S. Attorney’s Office Seizes Three Domain Names Purporting to be Websites of Biotechnology Companies with Treatments for Covid-19

At Least One Fraudulent Website Purported to Sell Counterfeit Vaccinations

Baltimore, Maryland – The U.S. Attorney’s Office for the District of Maryland has seized β€œhealthbridgescience.com,” β€œglobal-pandemic-vaccines.com,” and β€œgenobioscience.com” all of which purported to be the websites of actual biotechnology companies developing treatments for the COVID-19 virus but instead were allegedly used to collect the personal information of individuals visiting the sites, in order to use the information for nefarious purposes, including fraud, phishing attacks, and/or deployment of malware. Individuals visiting those sites now will see a message that the site has been seized by the federal government and be redirected to another site for additional information.

 

The seizure of the domain names was announced by Acting United States Attorney for the District of Maryland Jonathan F. Lenzner and Special Agent in Charge James R. Mancuso of Homeland Security Investigations - Baltimore.

 

According to the affidavits filed in support of these seizures, these investigations began in March 2021. Homeland Security Investigations and the National Intellectual Property Rights Center received notification of two fraudulent websites, β€œgenobioscience.com” and β€œhealthbridgescience.com.” The third site, β€œglobal-pandemic-vaccines.com,” was discovered by Homeland Security Investigations’ Cyber Crimes Center (C3) during ongoing investigations for malicious websites. The cases were referred to HSI Baltimore for investigation.

 

Specifically, HSI was notified of two fraudulent websites β€œhealthbridgescience.com” and β€œgenobioscience.com,” by a victim biotechnology company. The company, which was granted an FDA emergency use authorization for their COVID-19 antibody drug cocktail treatment, confirmed neither of the suspect domains were approved company websites. The fraudulent sites displayed a nearly identical theme and design as the legitimate biotechnology company except for the subsection tab information. According to the affidavit, β€œhealthbridgescience.com” was registered on February 21, 2021 and β€œgenobioscience.com” was registered on March 24, 2021, but no registrant or contact information is listed for either website. As stated in the affidavit, criminals who operate websites and use targeted domain names often conceal their identity when registering their domain names by redacting personal identifiers to avoid being tracked by victims or law enforcement. An HSI Cyber Operations Officer (COO) also noted the β€œgenobioscience.com” website did not use secure communication technology, making any sensitive information shared on this website potentially compromised.

 

The third domain name, β€œglobal-pandemic-vaccines.com,” offered COVID-19 vaccines for sale that it claimed were manufactured by pharmaceutical companies that had been granted FDA emergency use authorization for their COVID-19 vaccines. A COO indicated that the domain was created on February 26, 2021 and its registrar organization was listed as β€œWhoisProtection.cc,” located in Kuala Lumpur, Malaysia, which is a privacy service used to shield a domain registrant’s actual information from being see publicly. Additionally, under the bogus website’s β€œContact Us” page, the telephone number appears to be associated with a messaging application and the street address listed is the address of a restaurant and a postal shipping center located in Torrance, California. Under the spoof website’s β€œshop” tab, there were two counterfeit vaccinations offered for sale to the public. The fraudulent website claimed that their vaccines did not require sub-zero storage. On March 15, 2021, HSI Special Agents, acting in an undercover capacity, called the phone number listed on the fraudulent website. An unknown individual agreed to sell fifty vials of the counterfeit vaccines

Miller, the architect of the Trump White House’s immigration policies, launched America First Legal this week, which will work with Republican attorneys general around the country to push back against President Biden’s rollback of Trump’s policies.

 

Trump put out a statement Wednesday promoting the project, and urging his supporters to get behind it.

 

β€œStephen Miller is a fearless, principled fighter for the America First movement. He has backbone, integrity, and never gives up. As we know, the Radical Left has been relentless in waging their battles in court. Conservatives and America First supporters badly need to catch up and turn the tables, which is why I applaud Stephen and Mark Meadows for rushing to fill this critical void,” Trump said in a statement released Wednesday.

 

β€œThe era of unilateral legal surrender must endβ€”and I hope all America First patriots will get behind America First Legal,” it added.

 

Jason Miller, Trump’s senior adviser, tweeted about the organization Wednesday morning and linked to a report in the Wall Street Journal about it.

 

The report said Stephen Miller would enlist lawyers from the Trump administration, GOP attorneys general and other attorneys around the country to help them in their cases against Biden.

 

β€œAnything the president does that we believe to be illegal is fair game,” Stephen Miller told the newspaper.

 

He described the new organization as something of a conservative version of the ACLU, adding that the nonprofit group often targeted the Trump administration.

 

When the Trump White House rolled out a new initiative, β€œwe wouldn’t get just one lawsuit in one court, we’d get six lawsuits in six courts,” he said.

 

β€œIt was an extraordinarily effective tactic, and there’s no counterpoint to that on our side,” Stephen Miller said.

 

America Legal First counts former White House chief of staff Mark Meadows and former acting Attorney General Matthew Whitaker as supporters, and both sit on the organization’s board.
