One Key Argument For Michael Sussmann’s Defense Has Already Crumbled

Michael Sussmann’s text message dispatches one of the strongest defenses pushed by his cohorts in the court of public opinion.

Former Hillary Clinton campaign attorney Michael Sussmann’s defenders have already been proven wrong on their claim that prosecutors will have a hard time proving Sussmann told the FBI that he was sharing Alfa Bank “intel” on his own, and not on behalf of a client.

Shortly after Special Counsel John Durham charged Sussmann with making a false statement to former FBI General Counsel James Baker when he provided Baker with data and three “white papers” purporting to establish a secret communication channel between the Trump organization and the Russia-based Alfa Bank, Sussmann’s friends, former colleagues, and political bedfellows launched a defense of the former Clinton campaign attorney.

Predictably, The Brookings Institute, which served as ground zero for the Russia collusion hoax, provided cover to Sussmann on its Lawfare blog. Chief collusion conspiracy theorist Benjamin Wittes penned a veritable defense brief. Wittes, who acknowledged in his article that “Baker is a personal friend and former colleague at Brookings and Lawfare,” attacked both Durham and the indictment.

Durham’s 27-page speaking indictment is “one of the very weakest federal criminal indictments I have ever seen in more than 25 years covering federal investigations and prosecutions,” Wittes proclaimed, asserting “the evidence that Sussmann lied at all is weak.”

“As a preliminary matter, the indictment by its terms concedes that the entire case—notwithstanding its many pages of narrative of the conduct of the Clinton campaign and its agents—hinges on the testimony of a single witness: the former FBI general counsel, Jim Baker,” Witte wrote. “This concession appears on page 18 of the indictment, which describes the Sept. 19, 2016, meeting between Sussmann and Baker at FBI Headquarters where the supposed lie happened. The indictment notably includes the fact that ‘[n]o one else attended the meeting.’”

Wittes then ticks off the prosecution’s three pieces of evidence that Sussmann told Baker he was not acting on behalf of any client, calling it “thin gruel,” with the gruel getting “a lot thinner when one looks at each of these pieces of evidence in any detail.”

First, there will be Baker’s testimony that Sussmann told Baker he was not acting on behalf of any client, Wittes notes. But Wittes claims Baker will be an unconvincing witness, because in his congressional testimony in October 2018, “Baker repeatedly disclaims specific memory of whether Sussmann identified his clients.” “It is hard for me to understand how a criminal case against Sussmann can proceed in the face of this testimony,” Wittes wrote.

Sussmann’s friend then downplays the “contemporaneous notes of Bill Priestap,” a higher up at the time in the FBI. Those notes, which Priestap penned after Baker relayed his conversation with Sussmann to his colleague, read “said not doing this for any client.” The note seems to corroborate Baker’s memory, Wittes acknowledges, before discounting it as hearsay. (Hearsay or not, the note will likely be admissible.)

Durham’s third piece of evidence concerns Sussmann supposedly repeating the lie to the CIA in January, but that “doesn’t cleanly corroborate the allegation that Sussmann lied to Baker,” Wittes concludes.

While Wittes’ Lawfare piece presented the most comprehensive defense of Sussmann, his fellow Russia collusion hoaxers also pushed the “it will be impossible to prove Sussmann lied to Baker” theme. In an op-ed for MSNBC, “Russia, Russia, Russia” queen Barbara McQuade called the case “weak on the merits,” claiming the special counsel could not prove Sussmann made the false statement.

“Sussmann maintains that he did not make the statement,” McQuade wrote, before repeating Wittes’ point that “it appears that the whole case is built on the testimony of one witness, Baker.” Like Wittes, McQuade stressed Baker will be a weak witness given his prior testimony. She also discounted Priestap’s corroborating notes as hearsay.

The Washington Post likewise critiqued the special counsel’s case, arguing that “even if the charge is legally sound, proving it will be a huge challenge.” “The alleged false statement was not written down or recorded. There were no witnesses other than the FBI attorney,” the Post wrote. And “given the nature of human language and memory, it’s almost impossible to prove beyond a reasonable doubt precisely what was said during a portion of a single conversation five years ago,” the article announced.

The New York Times also worked to counter the special counsel’s criminal case by citing Sussmann’s defense lawyers, Sean Berkowitz and Michael Bosworth. According to the Times’ piece, Sussmann’s legal team “have denied the accusation, insisting that he did not say he had no client and maintaining that the evidence against him is weak.”

The Times’ Russian-hoaxer team of Savage and Goldman continued: “The case against Mr. Sussmann turns on Mr. Baker’s recollection that Mr. Sussmann told him he was not at the meeting on behalf of any client—which Mr. Sussmann denies saying. There were no witnesses to their conversation.”

Sussmann’s lawyers went further in a statement released after the indictment, with NPR and others reporting the Latham and Watkins attorneys’ claim that the special counsel “is bringing a false statement charge based on an oral statement allegedly made five years ago to a single witness that is unrecorded and unobserved by anyone else.”

For all the ink spilled over the “you can’t prove Sussmann said he was not representing a client” defense of the former Clinton campaign attorney, 42 words dissolve that narrative: “Jim—it’s Michael Sussmann. I have something time-sensitive (and sensitive) I need to discuss. Do you have availability for a short meeting tomorrow? I’m coming on my own—not on behalf of a client or company—want to help the Bureau. Thanks.”

Last week, the special counsel’s office revealed Sussmann sent that text to Baker at 7:24 p.m. on the night before the meeting at which Sussmann handed the Alfa Bank material to the then-FBI general counsel. Just like that, the thin gruel seems more like cement.

Of course, it will be for a jury to decide whether Sussmann lied to Baker and is guilty of the offense charged, but Sussmann’s text message dispatches one of the strongest defenses pushed by his cohorts in the court of public opinion, which raises an intriguing question: Why is this text only becoming known now?

It isn’t as if Durham’s team went light on the details, either in the indictment or follow-up legal filings. And from comments they made to the press, Sussmann’s attorneys seemed unaware that prosecutors possessed the text message—which would be bizarre if the special counsel’s office knew of the text before dropping the indictment. After all, the special counsel would want to show Sussmann the strongest evidence it had of the alleged crime, to push him to enter a plea deal and cooperate with prosecutors.

Together these facts suggest that neither the special counsel’s office nor Sussmann’s legal team knew this damning text existed prior to the indictment. How, then, was the text discovered?

One possible explanation is that the text was recovered from one of Baker’s two cellphones the DOJ’s Office of Inspector General had secreted from the special counsel’s office until January 2022. But those phones were “FBI cellphones,” and according to Durham’s filing, the text was sent to Baker’s personal cell phone.

So, maybe instead the special counsel’s office somehow just recently obtained access to Baker’s personal cell phone or texts sent to that phone. If so, why the delay? Was someone keeping this evidence on the sly? Or did Baker possibly forward the Sussmann text from his personal cell phone to one of his FBI cellphones, and thus the text was on the phones the OIG had long possessed? If so, that raises even more questions.

The mysterious case of the appearing text will have to wait for another day. For now, though, we know that, contrary to the Russia-collusion hoaxers’ claim, the special counsel has ample evidence that Sussmann told Baker he was not working on behalf of a client, striking down one of the two main defenses touted by Sussmann’s backers. With a decision by the court on Sussmann’s motion to dismiss imminent, the second attack of the indictment—that the lie was not material—will likely crumble soon too.

Democrat Candidate For Arizona Governor Katie Hobbs Supports Abortion Until Birth

Katie Hobbs has made it clear that unborn children will be the most at-risk Arizonians if she is elected governor. During an interview with a local CBS affiliate, the gubernatorial nominee refused to say where she draws the line on abortion. That’s because she doesn’t draw the line.

In February, Arizona lawmakers passed a ban on abortions after 15 weeks. But this will likely change if Hobbs becomes governor, as she indicated that there should be no legal limits on abortions in a recent interview.

“Abortion is health care,” she responded to a journalist’s question of at what gestational age it should be legal to dismember a live preborn human. Asked again after she failed to support a limit on this practice, Hobbs replied, “Abortion is a personal decision between a woman and her family and her doctor, and that’s something that needs to be discussed in the medical exam room, not by politicians.”

Hobbs is correct. These decisions should not be made by politicians like her, whose track record on abortion is nothing short of barbaric. Late-term abortions include abortions after 20 weeks –when the child is approximately five months of age, at which time the baby’s facial features are developing and unborn babies can hear their mother’s heartbeat.

In 2011, Hobbs voted against banning sex- and racially discriminatory abortions. Her vote condoned the murder of unborn girls and countless minority children, including black babies, who are the biggest victims of abortion.

In addition to supporting the murder of unborn daughters and minority children, Hobbs voted for forcing taxpayers to fund abortion, a position the majority of Americans oppose.

Perhaps the most appalling of Hobbs’ abortion advocacy was her vote against requiring doctors to try to revive babies who survive abortions.

Hobbs is not the only Democrat politician who feels free to publicly express abortion extremism out of step with the majority of voters. Former Virginia governor Ralph Northam sent shivers down America’s spine with his comments on post-birth “abortions” in 2019.

“The infant would be delivered,” said Northham. “The infant would be kept comfortable. The infant would be resuscitated if that’s what the mother and the family desired. And then a discussion would ensue between the physicians and the mother.”

Michael Sussmann’s text message dispatches one of the strongest defenses pushed by his cohorts in the court of public opinion.

ormer Hillary Clinton campaign attorney Michael Sussmann’s defenders have already been proven wrong on their claim that prosecutors will have a hard time proving Sussmann told the FBI that he was sharing Alfa Bank “intel” on his own, and not on behalf of a client.

Shortly after Special Counsel John Durham charged Sussmann with making a false statement to former FBI General Counsel James Baker when he provided Baker with data and three “white papers” purporting to establish a secret communication channel between the Trump organization and the Russia-based Alfa Bank, Sussmann’s friends, former colleagues, and political bedfellows launched a defense of the former Clinton campaign attorney.

Predictably, The Brookings Institute, which served as ground zero for the Russia collusion hoax, provided cover to Sussmann on its Lawfare blog. Chief collusion conspiracy theorist Benjamin Wittes penned a veritable defense brief. Wittes, who acknowledged in his article that “Baker is a personal friend and former colleague at Brookings and Lawfare,” attacked both Durham and the indictment.

Durham’s 27-page speaking indictment is “one of the very weakest federal criminal indictments I have ever seen in more than 25 years covering federal investigations and prosecutions,” Wittes proclaimed, asserting “the evidence that Sussmann lied at all is weak.”

“As a preliminary matter, the indictment by its terms concedes that the entire case—notwithstanding its many pages of narrative of the conduct of the Clinton campaign and its agents—hinges on the testimony of a single witness: the former FBI general counsel, Jim Baker,” Witte wrote. “This concession appears on page 18 of the indictment, which describes the Sept. 19, 2016, meeting between Sussmann and Baker at FBI Headquarters where the supposed lie happened. The indictment notably includes the fact that ‘[n]o one else attended the meeting.’”

Wittes then ticks off the prosecution’s three pieces of evidence that Sussmann told Baker he was not acting on behalf of any client, calling it “thin gruel,” with the gruel getting “a lot thinner when one looks at each of these pieces of evidence in any detail.”

First, there will be Baker’s testimony that Sussmann told Baker he was not acting on behalf of any client, Wittes notes. But Wittes claims Baker will be an unconvincing witness, because in his congressional testimony in October 2018, “Baker repeatedly disclaims specific memory of whether Sussmann identified his clients.” “It is hard for me to understand how a criminal case against Sussmann can proceed in the face of this testimony,” Wittes wrote.

Sussmann’s friend then downplays the “contemporaneous notes of Bill Priestap,” a higher up at the time in the FBI. Those notes, which Priestap penned after Baker relayed his conversation with Sussmann to his colleague, read “said not doing this for any client.” The note seems to corroborate Baker’s memory, Wittes acknowledges, before discounting it as hearsay. (Hearsay or not, the note will likely be admissible.)

Durham’s third piece of evidence concerns Sussmann supposedly repeating the lie to the CIA in January, but that “doesn’t cleanly corroborate the allegation that Sussmann lied to Baker,” Wittes concludes.

While Wittes’ Lawfare piece presented the most comprehensive defense of Sussmann, his fellow Russia collusion hoaxers also pushed the “it will be impossible to prove Sussmann lied to Baker” theme. In an op-ed for MSNBC, “Russia, Russia, Russia” queen Barbara McQuade called the case “weak on the merits,” claiming the special counsel could not prove Sussmann made the false statement.

“Sussmann maintains that he did not make the statement,” McQuade wrote, before repeating Wittes’ point that “it appears that the whole case is built on the testimony of one witness, Baker.” Like Wittes, McQuade stressed Baker will be a weak witness given his prior testimony. She also discounted Priestap’s corroborating notes as hearsay.

The Washington Post likewise critiqued the special counsel’s case, arguing that “even if the charge is legally sound, proving it will be a huge challenge.” “The alleged false statement was not written down or recorded. There were no witnesses other than the FBI attorney,” the Post wrote. And “given the nature of human language and memory, it’s almost impossible to prove beyond a reasonable doubt precisely what was said during a portion of a single conversation five years ago,” the article announced.

The New York Times also worked to counter the special counsel’s criminal case by citing Sussmann’s defense lawyers, Sean Berkowitz and Michael Bosworth. According to the Times’ piece, Sussmann’s legal team “have denied the accusation, insisting that he did not say he had no client and maintaining that the evidence against him is weak.”

The Times’ Russian-hoaxer team of Savage and Goldman continued: “The case against Mr. Sussmann turns on Mr. Baker’s recollection that Mr. Sussmann told him he was not at the meeting on behalf of any client—which Mr. Sussmann denies saying. There were no witnesses to their conversation.”

Sussmann’s lawyers went further in a statement released after the indictment, with NPR and others reporting the Latham and Watkins attorneys’ claim that the special counsel “is bringing a false statement charge based on an oral statement allegedly made five years ago to a single witness that is unrecorded and unobserved by anyone else.”

For all the ink spilled over the “you can’t prove Sussmann said he was not representing a client” defense of the former Clinton campaign attorney, 42 words dissolve that narrative: “Jim—it’s Michael Sussmann. I have something time-sensitive (and sensitive) I need to discuss. Do you have availability for a short meeting tomorrow? I’m coming on my own—not on behalf of a client or company—want to help the Bureau. Thanks.”

Last week, the special counsel’s office revealed Sussmann sent that text to Baker at 7:24 p.m. on the night before the meeting at which Sussmann handed the Alfa Bank material to the then-FBI general counsel. Just like that, the thin gruel seems more like cement.

Of course, it will be for a jury to decide whether Sussmann lied to Baker and is guilty of the offense charged, but Sussmann’s text message dispatches one of the strongest defenses pushed by his cohorts in the court of public opinion, which raises an intriguing question: Why is this text only becoming known now?

It isn’t as if Durham’s team went light on the details, either in the indictment or follow-up legal filings. And from comments they made to the press, Sussmann’s attorneys seemed unaware that prosecutors possessed the text message—which would be bizarre if the special counsel’s office knew of the text before dropping the indictment. After all, the special counsel would want to show Sussmann the strongest evidence it had of the alleged crime, to push him to enter a plea deal and cooperate with prosecutors.

Together these facts suggest that neither the special counsel’s office nor Sussmann’s legal team knew this damning text existed prior to the indictment. How, then, was the text discovered?

One possible explanation is that the text was recovered from one of Baker’s two cellphones the DOJ’s Office of Inspector General had secreted from the special counsel’s office until January 2022. But those phones were “FBI cellphones,” and according to Durham’s filing, the text was sent to Baker’s personal cell phone.

So, maybe instead the special counsel’s office somehow just recently obtained access to Baker’s personal cell phone or texts sent to that phone. If so, why the delay? Was someone keeping this evidence on the sly? Or did Baker possibly forward the Sussmann text from his personal cell phone to one of his FBI cellphones, and thus the text was on the phones the OIG had long possessed? If so, that raises even more questions.

The mysterious case of the appearing text will have to wait for another day. For now, though, we know that, contrary to the Russia-collusion hoaxers’ claim, the special counsel has ample evidence that Sussmann told Baker he was not working on behalf of a client, striking down one of the two main defenses touted by Sussmann’s backers. With a decision by the court on Sussmann’s motion to dismiss imminent, the second attack of the indictment—that the lie was not material—will likely crumble soon too.

Britons face biggest crisis in decades

Highest cost of living predicted in the UK in nearly 70 years

The UK is facing the biggest decline in living standards since comparable records began in the 1950s, according to an independent forecast.

The London-based Centre for Economics and Business Research (CEBR) released a report on Monday, saying that the "cost of living crisis" has "well and truly" arrived in the UK. CEBR cites the recent uprating of the energy price cap – reflecting the global rise in energy costs – as the reason, saying that average UK households will be paying a whopping 73% more for their energy bill than compared to a year ago. In addition, petrol prices are up by 30% on the year and diesel prices are 36% higher, the report says.

According to the consultancy, in the coming months the consumer price inflation will far outstrip wage growth, jumping by a further 2.5% from its February level of 6.2%, which was the highest in 30 years. While most forecasts expect the UK economy to grow in each quarter of 2022, the energy price crisis will still see the households notably worse off, CEBR notes.

The Bank of England warned in March that inflation in the country is set to hit a 40-year high of 8.7% at the end of the year due to a rise in global energy prices over the past few months. The governor of the Bank of England, Andrew Bailey, also said last month that Britain was heading for the biggest single shock from energy prices since the 1970s, with the economy set to suffer a growth slowdown.

Energy prices have been rising globally over the past six months but the West's economic war with Moscow has exacerbated the problem. The UK joined the US and the EU in imposing several rounds of sanctions against Russia, a major energy supplier to Europe. Western countries have pledged to end all imports of Russian coal by the end of this year, to be followed by a ban on imports of oil and natural gas in the coming years.

Russian diplomatic compound seized in Poland

The building will be used to accommodate “Ukrainian friends,” according to the mayor of Warsaw

A long-disused Russian diplomatic compound located in the capital city of Warsaw was seized by Polish authorities on Monday. The Russian mission objected to the move, sending a diplomatic note to the host country’s Foreign Ministry.

The breach of the facility by Polish bailiffs attracted a crowd of reporters and was attended by the city’s Mayor Rafal Trzaskowski, who pledged to use the building to accommodate Ukrainian refugees.

“As promised, we are taking over the so-called Spyville and we will try to hand it over to our Ukrainian guests,” Trzaskowski said in a video address from the scene shared on his Twitter feed, referring to the compound by its popular nickname.

“At the moment, we are checking the technical condition of the building. I am glad that we can show that Warsaw helps our Ukrainian friends in such a symbolic way.”

The building in question was built by the Soviet Union back in 1970 under an agreement with Poland to house Soviet diplomats and their families. Since the collapse of the Soviet Union, the status of the building has been contested, with Polish authorities arguing that the facility did not qualify as a diplomatic property, while Moscow insists it still enjoys such status.

The breach of the compound was confirmed by Russian Ambassador to Poland Sergey Andreev, who said the mission had raised the issue with the country’s Foreign Ministry.

“We immediately sent a note of protest to the Polish Foreign Ministry, in which we stated that the site where the facility is located was provided to us by the Polish authorities in the ’70s. The Polish side has not terminated this agreement and is a party to it, so this agreement is still binding,” the diplomat told reporters.

The compound has been vacant for decades and has fallen into disrepair, Andreev noted, expressing doubts over Warsaw’s plans to use it to house Ukrainian refugees.

“Due to the obstructionist position of the Polish authorities, which for many years prevented the registration of this building as Russian real estate, we were deprived of the opportunity to use it,” the diplomat said.

“It remained abandoned, degraded and desolate for many years and is currently in obvious disrepair. I do not know who is going to live there, but at the moment it is certainly unsuitable for accommodating anyone.”

The already-strained ties between Russia and Poland entered a downward spiral after Moscow launched its large-scale military operation in Ukraine late in February. Apart from seizing the contested diplomatic property – ‘Spyville’ and a Russian embassy school – Warsaw has also expelled a record number of Russian diplomatic workers. On March 23, Poland expelled 45 Russian diplomats, alleging they were involved in intelligence operations threatening the country and its allies.

Moscow responded in a tit-for-tat fashion, declaring 45 Polish diplomatic workers ‘personae non-gratae’ and ordering them to leave the country before April 13.

FAIRFAX, Va. (Court TV) — The trial is Johnny Depp v. Amber Heard. The once-married couple has been feuding since they split in 2016 and the drama has spilled into courts in the U.S. and overseas.

The two will square off at the Fairfax County Courthouse in Virginia. Depp is suing Heard for defamation. He claims she damaged his reputation when she wrote about domestic abuse in an op-ed that appeared in The Washington Post in December 2018. Depp wasn’t named in the article but he claims in his lawsuit that the article implied he abused her and, as a result, he has lost movie roles and faced public scorn.

“Any defamation case has a difficult road to hoe,” George Freeman told Court TV, “but in this one I think it has a particularly difficult chance of success.”

Freeman served as in-house counsel for The New York Times for more than 30 years and is now executive director of the Media Law Resource Center.

“The first defense, really, is the most basic defense in libel law, which is truth,” said Freeman.

In order for Depp to win, he not only has to prove that the allegations are false, but that Heard acted with malice or intentionally lied about the alleged abuse.

“He really has to prove that she made it up out of whole cloth,” continued Freeman, “and I think that’s a stretch to ask a jury with all the evidence that exists, to ask a jury to believe that she made it up and she wasn’t abused at all is a very, very hard burden to meet.”

Depp has already lost a similar libel case in London. He sued The Sun for calling him a “wife beater.” A judge there found that the newspaper had proved the article was substantially true.

Depp’s U.S. trial, however, will be different. A jury will decide the case, not a judge. And, Depp’s appeal among fans could be a factor.

“He knows that he has a large fanbase,” said Wagmeister, “even throughout this entire legal battle, so Johnny Depp could also feel empowered by knowing that he does still have a fanbase behind him.”

Depp’s case is unusual for another reason. According to Freeman, “Johnny Depp sued Amber Heard in this case but not The Washington Post. Generally speaking, in nine out of 10 cases, in a libel case you sue the media that publishes as well as the person who is making the accusation. Yet he never sued The Washington Post in this case, which leads to the conclusion that this is really, in the end, a marital fight that has now grown into the American court system.”
