First Circuit Court of Appeals Rules Voter Rolls are Public Records and Election Officials Cannot Hide Them from the Public

 

The Public Interest Legal Foundation secured a landmark case on Monday in the First Circuit Court of Appeals.

 

The Court ruled that under the National Voter Registration Act of 1993 (NVRA) Maine’s voter roll is a public record and election officials cannot hide the information from the public.

 

George Behizy posted this from the ruling,

 

“Whether voter registration rolls are accurate and current cannot be determined without inspecting the Voter File…In other words, the evaluation of voter registration rolls would be impossible if the results of Maine’s voter list registration and maintenance activities were not subject to public disclosure. For the above reasons, Maine’s Voter File is a record concerning the implementation of programs and activities conducted for the purpose of ensuring the accuracy and currency of official lists of eligible voters and is thus subject to disclosure under Section 8.”

 

The Public Interest Legal Foundation posted this following the ruling earlier today.

 

Maine’s restrictions on the use of the voter roll were enacted to keep election watchdogs, like PILF, from analyzing and speak about errors in the voter roll.

 

(Alexandria, VA) – February 5, 2024: The Public Interest Legal Foundation (PILF) secured a landmark ruling for transparency and clean elections. The First Circuit Court of Appeals ruled in PILF’s favor that under the National Voter Registration Act of 1993 (NVRA) Maine’s voter roll is a public record. The Court’s opinion states:

 

“Whether voter registration rolls are accurate and current cannot be determined without inspecting the Voter File…In other words, the evaluation of voter registration rolls would be impossible if the results of Maine’s voter list registration and maintenance activities were not subject to public disclosure. For the above reasons, Maine’s Voter File is a record concerning the implementation of programs and activities conducted for the purpose of ensuring the accuracy and currency of official lists of eligible voters and is thus subject to disclosure under Section 8.”

 

Additionally, the Court ruled that Maine’s fines and restrictions on the use of voter file data are illegal obstacles to achieving Congress’s intent for transparency and oversight under the NVRA. The Court’s opinion states:

 

“[T]he restrictions imposed by the Use Ban erect an impenetrable barrier for those seeking to use the Voter File to evaluate and enforce compliance with the NVRA nationwide.”

50 Lawmakers Demand AG Garland Explain Illegal CCP-Linked Marijuana Farms

 

A bipartisan group of 50 US lawmakers have requested that Attorney General Merrick Garland provide information on illegal marijuana grow operations in the US that are linked to the Chinese Communist Party (CCP).

 

Led by Rep. Pete Sessions (R-TX), Jared Golden (D-ME), David Valadao (R-CA), Sen. Joni Ernst (R-IA) and Sen. Angus King (I-ME), the lawmakers penned a Friday letter to Garland expressing their concerns.

 

"Chinese nationals—including those with potential ties to the Chinese Communist Party (CCP)—are reportedly operating thousands of illicit marijuana farms across the country," they wrote. "The thousands of illicit Chinese marijuana growing operations pose a direct threat to public safety, human rights, national security, and the addiction crisis gripping our nation."

 

According to the lawmakers, Chinese grow operations have been identified in California, Colorado, Massachusetts, Michigan, Nevada, Oklahoma, Oregon, and Washington.

 

"In some cases, the grow operators were also engaged in human trafficking, forced labor, drug trafficking, and violent crime," the letter continues. "These farms are most commonly in states with legal marijuana programs where illicit growers try to disguise their operations in communities where law-abiding Americans live and work."

 

The letter cites a 2023 DHS memo which said that 270 suspected China-linked illegal grow operations in Maine alone were generating more than $4.3 billion in revenue.

 

In Oklahoma, over 2,000 marijuana farmers "are linked to China," according to the letter. "Investigators in Oklahoma discovered illicit marijuana growers engaged in human trafficking, sex trafficking, ketamine trafficking, illegal gambling, and international money laundering."

 

"Experts believe there is substantial evidence implicating the CCP in directly supporting illicit marijuana grow operations across the United States," the lawmakers wrote. "Whether located in retrofitted residential homes or on farmland, state regulatory and law enforcement entities appear unable to address these potentially CCP supported grow operations despite their significant threat to local communities across the country."

 

As the Epoch Times notes further, in September last year, a group of Chinese immigrants filed a lawsuit alleging that they were lured to northern New Mexico under false pretenses and then forced to work 14 hours a day on an illegal marijuana farm.

Been tracking Slo Joe in AF1 for the last 40 or 45 minutes. He's in the Kansas City ARTCC high altitude sector. I just heard, plain as fucking day, AF1 check on at FL 350 with Kansas City. Verbatim: Kansas City, AF1 checking on at FL 350. Kansas City ARTCC: AF1, Roger.

 

So even though Flight Aware or the ADS-B Exchange does not show a callsign for AF1, the crew and ARTCC controllers are acknowledging AF1 as AF1. So the no callsign thing proves nothing as to whether or not Slo Joe is President.

Three migrants were arrested by the NYPD after they allegedly went on a crime spree that saw them stealing wallets and cellphones from at least 62 women across the city's seven boroughs.

 

Police say they arrested the migrants, all believed to be from Venezuela, in a safe house in the Bronx after executing a search warrant.

 

The suspects were allegedly stealing the iPhones to use the Apple Pay feature and use the owners' credit cards to buy items.

 

NYPD Assistant Commissioner Kaz Daughtry said: 'Most migrants come to NYC in search of a better life. Sadly, some come to commit crime. Today we made tremendous progress in the largest robbery pattern plaguing our city.

 

Monday's arrests come after another video showed about a dozen migrants assaulting two police officers in Times Square late last month.

 

A Manhattan judge let at least five asylum seekers go free without bail after they were charged with the assault. Only one of the suspects remains in jail.

 

Four of the suspects are believed to have fled the city after being charged and released after giving fake names to a charity that helps migrants get bus tickets.

 

According to the New York Post, the migrants charged in the assault are also part of a phone-snatching scheme.

 

'They’re buying cars back in Ecuador and Venezuela'a police source told the Post. 'They’re putting pools in their homes there. All this money is going back and forth. That’s why the larcenies are going out of control. It’s unbelievable what they’re doing.'

 

New York City is buckling under the weight of a massive influx of asylum seekers, with over 170,000 arriving since the spring of 2022.

Former US President Donald Trump could be sent to prison “for a long time” when a verdict is delivered in his upcoming trial over alleged mishandling of sensitive government documents, an attorney linked to the US Democrats has warned.

Prosecutors, led by Special Counsel Jack Smith, claim that Trump rejected requests by federal officials to return the documents – some of which were stored in publicly accessible locations in Mar-a-Lago, including in an unsecured bathroom. Trump has denied all allegations of wrongdoing and has pleaded not guilty to the charges.

 

“People forget how damaging the evidence is in that Florida case,” Marc Elias, who represented the Democratic National Committee (DNC) between 2009 and 2023, said on MSNBC’s The Weekend on Sunday.

 

It is literally about a former president of the United States stealing highly classified sensitive documents from the United States government, treating them cavalierly, showing them to people, storing them willy-nilly.”

 

Elias said that the evidence, when it is delivered in the trial in over three months’ time, could be “devastating to him politically, adding that “it puts him in real prospect of going to prison for a long time.”

Iraq BANS U.S. Dollar Transactions at Eight Banks!

 

The Central Bank of Iraq (CBI) banned eight local banks from making US dollar transactions on 4 February, in an attempt to avoid sanctions and US financial restrictions.

 

A CBI document lists the banned banks as Ahsur International Bank for Investment, Investment Bank of Iraq, Union Bank of Iraq, Kurdistan International Islamic Bank for Investment and Development, Al-Huda Bank, Al-Janoob Islamic Bank for Investment and Finance, Arabia Islamic Bank, and Hammurabi Commercial Bank.

 

"We commend the continued steps taken by the Central Bank of Iraq to protect the Iraqi financial system from abuse, which has led to legitimate Iraqi banks achieving international connectivity through correspondent banking relationships,” a US Treasury Department spokesman said on Sunday.

 

The measures come after Iraqi officials met with the US Treasury Department’s top sanctions official Brian Nelson last week.

 

The Finance Committee in the Iraqi parliament made a statement on 31 January calling for the sale of oil in currencies other than the US dollar, aiming to counter US sanctions on the Iraqi banking system.

Zelensky to fire more top military brass – media

Together with General Valery Zaluzhny, the Ukrainian leader allegedly plans to let go of Chief of the General Staff Sergey Shaptala

 

Ukrainian President Vladimir Zelensky is reportedly considering letting go not only of Armed Forces Commander-in-Chief Valery Zaluzhny, but also of theChief of the General Staff, according to the news outlet Ukrainskaya Pravda.

 

The report comes after Zelensky admitted last week that he intends to fire the top commander of the Ukrainian Armed Forces. The two have had a major falling out following Kiev’s failed summer counteroffensive. Zaluzhny has described the battlefield situation as a “stalemate,” while Zelensky has vehemently rejected this assessment, especially in light of waning support from Kiev’s Western backers.

 

In an interview with Italy’s RAI TG1 news channel on Sunday, Zelensky announced that he is planning a “serious” overhaul of the country’s leadership, noting that these changes will not be “about a single person.”He did not, however, list any specific names.

 

Citing sources within the Ukrainian government, Ukrainskaya Pravda reported on Monday that Zaluzhny may indeed not be the only one getting canned amid Zelensky’s purge and suggested that Sergey Shaptala, who currently serves as the Chief of the General Staff, will also be leaving his position as early as this week.

 

“[The fate of] everyone else has not yet been decided,” the source told the outlet.

 

Rumors of Shapatala’s resignation appear to be partially confirmed by a post from Zaluzhny, who posted a picture with his colleague on Monday, wishing him a happy birthday and writing: “It will still be difficult for us, but we will never be ashamed.”

 

As for Zaluzhny himself, it is currently unclear when he will leave his post and what position he may take in the future. According to multiple media reports, he was set to be dismissed last week. However, after the information about his firing was leaked to the press, Zelensky appeared to have postponed the decision.

 

According to Rada MP Evgeny Shevchenko, Zaluzhny could nevertheless potentially vacate his position within the next few days. That’s after hereportedly agreed to become the country’s ambassador to the UK. Shevchenko noted that such a position is essentially a “political pension.”

 

It is unclear who could potentially replace Ukraine’s top military commander, but, according to the Washington Post, Zaluzhny believesno change in leadership would result in any rapid improvements on the battlefield.

 

Meanwhile, Russia’s Defense Ministry has stated that its forces currently hold the “strategic initiative along the entire line of contact.” Defense Minister Sergey Shoigu says Kiev lost more than 23,000 troops last month. In December, the ministry estimated that since the start of the conflict, over 383,000 Ukrainian soldiers have been killed or wounded.

I tracked it out of Denver ARTCC but on the live atc site I could only here the crews, not ATC. As the aircraft got closer to Kansas City ARTCC I pulled up that freq not knowing whether AF1 had already checked on. Just a few minutes later AF1 checked on. Real estate brokerage to pay $70 MILLION to settle nationwide lawsuits over grossly inflated broker's fees - has the bubble burst for greedy realtors?

One of the nation's biggest real estate brokerages has agreed to pay $70 million to resolve a lawsuit over inflated agent commissions.

 

Keller Williams Realty will pay the sum and also take several steps to provide homebuyers and sellers with more transparency over real estate commissions.

 

The Austin-based agency will add the money to a settlement fund which will be distributed by the courts. Home sellers who sold a property from a Multiple Listing Service (MLS) between 2015 and 2019 may be eligible for a slice of the fund.

 

The bumper settlement resolves more than a dozen lawsuits across the country over commissions that US real estate agents charge.

 

In some cases, they can be as high as 6 percent - around double the global average.

 

Attorney Michael Ketchmark, who is representing the plaintiffs in the lawsuit, hailed the development as a 'tremendous victory for homeowners and homebuyers across the country.'

 

The central claim put forth in the litigation is that the country´s biggest real estate brokerages engage in practices that unfairly force homeowners to pay artificially inflated agent commissions when they sell their home.

 

In October, a federal jury in Missouri found that trade body National Association of Realtors and several large real estate brokerages, including Keller Williams, conspired to require that home sellers pay homebuyers' agent commission in violation of federal antitrust law.

 

The jury ordered the defendants to pay almost $1.8 billion in damages. If treble damages - which allows plaintiffs to potentially receive up to three times actual or compensatory damages - are awarded, then the defendants may have to pay more than $5 billion.

 

More than a dozen similar lawsuits are pending against the real estate brokerage industry.

 

The suit has provoked controversy from the industry, with one report estimating up to 80 percent of realtors would lose their jobs.

 

Real estate agent Desirae Wykoff, 36, told DailyMail.com last year: 'I feel like realtors are getting an unfair reputation from this.

 

'I could see a lot of these people hanging up their license.'

 

Keller Williams' executive chairman Gary Keller said the firm had 'full confidence in the strength of an appeal' but that a settlement would remove extended uncertainty for its agents and franchisees. The ruling also means the firm cannot be roped into copycat lawsuits.

 

'We came to the decision to settle with careful consideration for the immediate and long-term well-being of our agents, our franchisees and the business models they depend on,' Keller said in a company-wide email.

 

'It was a decision to bring stability, relief and the freedom for us all to focus on our mission without distractions.'

 

The company based operates more than 1,100 offices with some 180,000 agents.

 

Among the terms of its proposed settlement, Keller Williams agreed to make clear that its agents let clients know that commissions are negotiable, and that there isn´t a set minimum that clients are required to pay, nor one set by law.

 

The company also agreed to make certain that agents who work with prospective homebuyers disclose their compensation structure, including any "cooperative compensation,' which is when a seller´s agent offers to compensate the agent that represents a buyer for their services.

 

As part of the settlement, which must be approved by the court, Keller Williams agents will no longer be required to be members of the National Association of Realtors or follow the trade association´s guidelines.

 

Two other large real estate brokerages agreed to similar settlement terms last year. In their respective pacts, Anywhere Real Estate Inc. agreed to pay $83.5 million, while Re/Max agreed to pay $55 million.

 

In recent years, acquiring a real estate license has become a popular side hustle for Americans. In 2020 and 2021 - when the pandemic forced many out of work - a record 156,000 people became Realtors, according to the NAR.

Philly sheriff posts flattering but phony headlines to campaign site — then offers odd disclaimer when caught

The Philadelphia sheriff’s team posted a series of flattering but phony news headlines on her campaign website – then issued a nonchalant disclaimer when its fake-news scheme was exposed.

 

Democrat Rochelle Bilal’s first term was marred by accusations that her office lost scores of guns, tried to misuse funds to double her salary and hired a top deputy who moonlights as a defense lawyer — but visitors to her campaign website are met with glowing headlines about her accomplishments.

 

The only problem is: those articles don’t exist, according to The Philadelphia Inquirer.

 

The supposed headlines came from reputable local outlets like NBC10, CBS3, WHYY and the Inquirer, but they were removed from the site Friday after the newspaper reached out for comment because it was unable to verify any of the headlines as authentic, the report said.

 

By Monday afternoon, the campaign had reposted the supposed headlines to its website, accompanied by a disclaimer that said it makes “no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information provided.”

 

Only three of the items — all press releases from the sheriff’s office — had clickable links.

 

The fake article names combined with their supposed outlets of publication did not turn up any hits on Google News — as legitimate archived digital articles should — when searched by The Post.

 

An NBC10 spokesperson reportedly said that none of the 12 supposed articles credited to the outlet about “her November 2019 election, police reform initiatives, distribution of free gun locks, suspension of evictions during the COVID-19 pandemic, or tips for domestic abuse survivors,” could be located by digital editors.

 

Stories that did loosely match the content of articles the campaign site boosted about had different headlines and publication dates, according to the report.

 

Bilal did not respond to requests for comment from the paper, and her spokeswoman said the issue would have to be addressed by her campaign manager. But the spokeswoman was reportedly unable to identify the manager.

 

Neither Bilal’s office nor campaign immediately responded to a request for comment from The Post.

 

Watchdogs hypothesized that the campaign had used artificial intelligence to fabricate the headlines, which they said could lead the public to be more untrusting of both elected officials and the media.

 

Voters bombarded with fake news “just assume everything is a lie,” Peter Loge, who leads the Project on Ethics in Political Communication at George Washington University, told the outlet.

 

“That is dangerous.”

 

“You just keep spewing stuff out and it fatigues people and they don’t know what to believe,” Matthew Jordan, professor of media studies and director of Penn State’s News Literacy Initiative, told the Inquirer.

 

“This works in that kind of environment, where people are exhausted and nobody is going to check anymore,” Jordan said. “Most people are probably looking at this on their phones and just scrolling along.”

 

Most of the scrapped headlines had elements of truth and seemed believable, according to the paper.

 

A fake WHYY headline with a publication date of March 16, 2020 reportedly read, “Philly Sheriff’s Office Announces Temporary Halt to Evictions Amid Coronavirus Outbreak.”

 

A day earlier, the outlet had published a story entitled “Philadelphia halts evictions as coronavirus bears down,” but neither Bilal or her office was mentioned in it, according to the report.

 

“That is how misinformation works,” Kelly McBride, who chairs the Craig Newmark Center for Ethics and Leadership at the Poynter Institute, told the paper. “It has to be believable. It has to be plausible. That’s what’s so insidious about it.”

 

Other articles appeared to be complete works of fiction, including a supposed Jan. 29, 2020 Inquirer article headlined: “Philly sheriff’s office to digitize sheriff sale process, reduce confusion and fraud.”

 

The newspaper said it did not publish any pieces about about Bilal or her office on or around that date.

McDonald's Corp.'s sales missed investor expectations in the fourth quarter as growth decelerated, hurt in part by the conflict in the Middle East

Donald Trump is going to lose in South Carolina — to Nikki Haley.

 

I say that as someone who lost in South Carolina — to Nikki Haley.

 

The year was 2010. I’d thrown my hat into the ring for governor. It was a big field with several well-known Republicans running, but Nikki Haley — then a state representative from Lexington — wasn’t on anyone’s likely winner list.

 

We were wrong. We underestimated Nikki Haley — just like people did when she ran against a 30-year Republican incumbent for the state Legislature, and just like her opponents have been underestimating her in the current presidential campaign. She didn’t let the naysayers get to her. She put her head down and went to work. She is one of the hardest working candidates I have ever met.

 

Haley is principled, persuasive and plain-spoken. She tells hard truths, answers hard questions and takes on the hardest fights — the fights that matter most to the people of South Carolina. In our race, it was transparency, accountability and fiscal responsibility. Haley owned those issues, and she broke down complicated spending topics in simple, everyday terms.

 

In the end, Nikki Haley was both the immovable object and an unstoppable force. She came from way behind, and in the final months leading up to the primary, her momentum grew — and grew some more, just like it’s doing now. She ended up winning the runoff with 65% of the vote, and a few months later, the people of South Carolina elected her governor.

 

Although it stung at the time, I can now say I’m glad Nikki Haley won. She was the right leader for our state, transforming our economy and uniting us in difficult times. Now she’s the right person for America.

 

First, she has to get through the candidate many people assume is going to win the S.C. primary: Donald Trump.

 

Trump should be afraid. History is repeating itself.

 

Haley is doing the same thing she did in 2010. She’s showing up and proving she’s the hardest worker of the bunch. She jumped into the race early because she didn’t need to wait and see what the other candidates decided, and right after she announced, she hit the campaign trail in New Hampshire and Iowa, holding town halls and answering voters’ questions. She didn’t get distracted by the media’s narrative or the latest fights on social media.

 

Her message is principled and strong. She hasn’t wavered in her support of our allies or backed away from criticizing Republicans — including Donald Trump — for adding $8 trillion to the national debt in just four years: nearly as much as Barack Obama added in eight years. The irresponsible spending played a role in the runaway inflation that’s still crippling families, and it’s holding us back at the exact time we need to move forward to hold China accountable.

 

Trump is taking South Carolina for granted, and Nikki Haley is taking South Carolina seriously, like she always has. She led our state in a better direction for six years. She stood with South Carolinians during our best and worst moments, and now she will lead our country toward a brighter future. I couldn’t be more honored to support her for president.

 

All she has to do is beat Trump in the primaries, especially South Carolina’s on Feb. 24. After that, she’s a shoo-in against the failed Joe Biden in November, while Donald Trump is not.

 

Can she get that far? Of course she can. Take it from someone who learned the lesson the hard way: Never underestimate Nikki Haley — even against Donald Trump.

King Charles III Diagnosed With Cancer, Postpones Public Duties

 

King Charles has cancer, Buckingham Palace has said in a statement, and he will postpone his public duties while undergoing a programme of treatment that began today.

 

Just days after being discharged from hospital for treatment of a non-cancerous enlarged prostate, it has been revealed King Charles III also has cancer. The cancer was discovered during tests the monarch underwent during his hospital stay, which identified a “separate issue of concern”.

 

Subsequent testing confirmed the King does have a non-specified “form of cancer”, Buckingham Palace said, and that he had already started a regime of treatment today.

 

The BBC reports the King has received treatment in London as an outpatient.

 

While the King is unable to perform public duties, the Palace made clear his constitutional role is unaffected as he would be able to continue to undertake “State business and official paperwork as usual”.

As a Constitutional monarch, his assent is required for the passing of laws but in practice this is now a mere formality, and he acts on the advice of his Prime Minister and Parliament. The Palace said this afternoon: “His Majesty has chosen to share his diagnosis to prevent speculation and in the hope it may assist public understanding for all those around the world who are affected by cancer.”

 

Both the King and Princess Catherine receiving treatment or recovering at the same time puts two of the Royal Family’s most effective and best-known faces out of the public eye for possibly months. Prince William has also taken time to help care for his wife and their children, and Princess Anne, the King’s sister, has stepped up to take on more duties.

 

The Prime Minister and leader of the Opposition have both expressed their best wishes for the king. Rishi Sunak’s statement said: “Wishing His Majesty a full and speedy recovery. I have no doubt he’ll be back to full strength in no time and I know the whole country will be wishing him well.”

 

Keir Starmer said: “On behalf of the Labour Party, I wish His Majesty all the very best for his recovery. We look forward to seeing him back to swift full health.”

During The King’s recent hospital procedure for benign prostate enlargement, a separate issue of concern was noted. Subsequent diagnostic tests have identified a form of cancer.

 

His Majesty has today commenced a schedule of regular treatments, during which time he has been advised by doctors to postpone public-facing duties. Throughout this period, His Majesty will continue to undertake State business and official paperwork as usual.

 

The King is grateful to his medical team for their swift intervention, which was made possible thanks to his recent hospital procedure. He remains wholly positive about his treatment and looks forward to returning to full public duty as soon as possible.

Leading sexual health experts have blamed record-high cases of sexually transmitted infections on the 'explosion' in popularity of dating apps like Hinge and Bumble.

 

Last week, officials deemed the spiralling cases of conditions like chlamydia and syphillis striking the US an 'out of control' epidemic.

 

The warning followed the release of the latest CDC data that showed 2.5 million cases of STIs were detected in 2022, marking a rise in chlamydia and, most worryingly, potentially deadly syphilis.

 

Prevalence of the infection, which can damage the brain and heart, has shot up almost 80 percent in five years.

 

The shocking figures have led to fierce debate among the medical community as to what is causing the alarming situation.

 

Some, for instance, have pointed to the staggering drop in condom use among American men - almost 30 percent since 2011, according to some studies.

 

Syphilis Used to Affect Mostly Gay Men, Then Came Dating Apps

In 2000, syphilis was on the verge of eradication with a record-low of 5,979 cases per year in the US.

 

In 2022, there were 207,000 diagnoses, according to official data.

 

A decade ago, experts say infections - which spread via contact with a syphilitic sore, which usually forms on the genitals - were almost all among gay or bisexual men.

 

But there was a sudden 'shift' in 2013, when cases began to rise among women and straight men.

 

Experts say much of this can be explained by the increasingly popularity of dating apps among heterosexual people, like Tinder, which launched in 2012.

 

Grindr - a dating app used by gay men - launched in 2009, when syphilis cases among men who have sex with men began to gradually rise.

 

Experts suggest the apps expanded access to sexual partners, as Americans no longer had to rely on meeting potential suitors in person.

Following the kiss, the pair allegedly drove to a “parking lot behind the neighborhood center at Emily Douglas Park, where [they] parked for approximately 45 minutes. There we slid back the seats of her Cadillac SUV so that Rep. Haley could climb on top of me.”

Every time I watch Nebraska they lose. Osborne only won those Championships. Because I went to bed early because they were losing. The other one I didn't watch at all. kek
