=NY Amish Children Face Forced Vaccinations After Court Ruling

In a crushing blow to religious liberty, a federal appeals court has upheld New York’s controversial vaccine mandate that forces Amish children to receive vaccinations despite sincere religious objections from their communities.

The U.S. Court of Appeals for the Second Circuit ruled on March 3 in the case of Miller v. McDonald that New York’s elimination of religious exemptions for vaccines does not violate First Amendment protections, according to a report.

The contentious policy, enacted in 2019 following a measles outbreak, requires all children to be vaccinated to attend any school–whether public, private, or religious–unless they qualify for a medical exemption.

This mandate has placed Amish communities in an impossible position: violate their deeply-held religious beliefs or forfeit their children’s education at their own private schools.

The legal challenge began after three Amish schools –Dygert Road School, Pleasant View School (also known as Twin Mountain School), and Shady Lane School–faced financial penalties for refusing to comply with the law by not requiring parents to provide proof of student vaccinations.

Catholic Vote reported that in June 2023, the schools, joined by two school board members (Jonas Smucker and Joe Miller) and an elected representative for Amish schools in New York (Ezra Wengerd), filed a lawsuit seeking an injunction.

They argued that the state’s vaccination requirement violated their constitutional rights under both the First and 14th Amendments.

The initial legal effort failed when U.S. District Court Chief Judge Elizabeth A. Wolford granted the state’s motion to dismiss the case, ruling that the plaintiffs had “failed to allege a constitutional violation.”

Undeterred, the Amish plaintiffs appealed to the federal court.

In their appeal, the Amish community pointed to the landmark 1972 Supreme Court case Wisconsin v. Yoder, which affirmed their right to pull children from formal schooling after eighth grade based on religious beliefs.

The federal court, however, rejected this comparison, determining that immunization requirements do not “fundamentally alter the Amish way of life” in the same way that extended compulsory education would.

The judges further ruled that since the removal of religious exemptions applies equally to all children in New York, it constitutes a “neutral law” that does not specifically target religious groups.

For the Amish, who have historically resisted government-mandated medical interventions as part of their faith tradition, this ruling creates an untenable situation.

Reports outlined by Catholic Vote indicate that Amish schools and families have already accumulated approximately $118,000 in fines for refusing to comply with the mandate.

The Amish community’s appeal had garnered significant support from officials across the nation.

Alabama Attorney General Steve Marshall, joined by 19 other states, filed a legal brief in May 2024 supporting the Amish position and arguing that New York’s actions amount to religious harassment.

“New York has so little regard for religion that it will seek out, harass, and threaten Amish communities that want only to live out their faith amongst themselves,” Marshall said.

“Parents should not be forced to choose between their children’s schooling and their fundamental rights.”

Two hotels used as migrant shelters in New York City are now under criminal investigation, the news coming after Mayor Eric Adams (D) said his city was overflowing with border crossers and illegal aliens.

The U.S. Department of Justice (DOJ) is now probing funding and operations at the locations that have also received subpoenas, Fox News reported Thursday.

The Roosevelt Hotel was being used as a migrant shelter and intake center, while the Stewart Hotel was being used as a migrant shelter. In addition, the Hotel Chandler also received a subpoena but the location is reportedly only a shelter for the homeless.

The Fox article said the subpoenas mention an alleged violation of federal immigration law. According to CBS New York, about 170,000 migrants have been processed via the Roosevelt Hotel since 2023.

The outlet said officials are reportedly asking for the names and birth dates of migrants connected to the locations:

The European Court of Human Rights (ECHR) has ruled that the Ukrainian authorities were responsible for the deaths of 42 anti-coup activists in the city of Odessa in 2014. They lost their lives when Ukrainian nationalists, who supported the armed takeover in Kiev weeks earlier, torched the port city’s Trade Unions House where the protesters had gathered.

“The Court concluded that the relevant authorities had not done everything they reasonably could to prevent the violence, to stop that violence after its outbreak, and to ensure timely rescue measures for those trapped in the fire in the Trade Union Building,” the ECHR said in its decision published on Thursday.

More than a decade later, Kiev has not named or prosecuted any of the perpetrators. Instead, it pinned the blame on Moscow, claiming that the events in Odessa were “a pre-planned and well-financed operation” by the Russian security services. Relatives of 25 victims, as well as three people who had survived the fire, filed complaints against Kiev with the ECHR. In the past 24 hours, an alarming series of incidents has shattered the illusion that American political discourse remains rooted in respect and civility. At least four prominent conservative voices—Nick Sortor and his family, Gunther Eagleman, Joe Pags, and Shawn Farash—were all targeted in a spree of “swatting” attacks. These are not harmless pranks; they are carefully crafted operations aimed at weaponizing law enforcement against private citizens. Under the cloak of anonymity, these perpetrators call police with false reports of emergencies—some involving dire threats, explosions, or violence—triggering a high-intensity police response and, in some cases, heavily armed SWAT teams.

Late last night, Nick Sortor reported that both his sister and his father were swatted. Officers reportedly arrived with weapons drawn, ready to face an imagined threat. As if that were not horrific enough, the same day, Gunther Eagleman was swatted in broad daylight, followed by pizza deliveries after the incident—an unsettling hallmark of a coordinated campaign. Similarly, Joe Pags and Shawn Farash, known for his spot-on Trump impersonations, fell victim to the same crime.

What is crystal clear is that these attacks are not random. Sending pizza to victims’ homes after the chaos is a brazen signature, indicating that the same group or network is behind these acts. It is also a smug way to signal their success and intimidate anyone else who dares to speak against them. Such cowardice and cruelty are intolerable in a nation predicated on the freedom of speech, especially when it is carried out against citizens who have committed no crime beyond expressing their conservative viewpoints.

It is important to note that this trend of political intimidation is not unprecedented. Last year, U.S. Capitol Police Chief Thomas Manger spoke about the “swatting crisis” affecting members of Congress. One of the more harrowing incidents involved Rep. Marjorie Taylor Greene, whose swatting call resulted in a tragic car accident that took the life of a responding officer. Manger’s testimony before the Senate underlined the severity of the issue: the Dignitary Protection division is overextended and understaffed, officers are working exhausting overtime hours, and the scale of these attacks is escalating at an alarming pace. If this can happen to sitting members of Congress, then what hope does an ordinary citizen have of protection?

Let’s not mince words: swatting is attempted murder by proxy. When you call the police and falsely report that someone has committed a violent act or is on the verge of inflicting harm, you are inviting a potentially lethal force response. Officers—believing they are walking into a life-threatening situation—must react accordingly. The tragedies that can unfold from such deception are not abstract possibilities; they are real. When the police arrive expecting a shootout, any sudden movement, any misunderstanding, can lead to a fatal outcome.

That is precisely why these incidents must be met with swift and unyielding justice. There is zero reason to believe the Federal Bureau of Investigation (FBI) and the Department of Justice (DOJ) cannot track down those orchestrating these calls. In our modern, hyper-connected world, digital footprints are everywhere. If law enforcement wants to catch these criminals, they have the tools and the know-how. Yet, here we stand, once again, witnessing a wave of dangerous harassment against conservatives with little to no visible response from our federal authorities. The silence is deafening—and, quite frankly, unacceptable.

Let us also be absolutely clear that these acts of political aggression will not deter conservative voices. If anything, they affirm our cause……

Call your local police department or sheriff‘s office. Let them know you could potentially be the target of a swatting. In certain counties in Florida, for example, they will put your address on a “red flag” list and they will call your cell phone first if they get a swatting call to your house. They have a procedure they will go through to vet and make sure it’s not a swatting call.

A federal appeals court has upheld a decision requiring Amish school children to be vaccinated in New York.

These are not Amish children who attend public schools. These are Amish children attending Amish-owned and operated schools.

Religious objections do not work here, according to the Second Circuit court ruling. From Courthouse News:

MANHATTAN (CN) — A New York State law requiring Amish students to receive vaccinations does not violate those students’ constitutional rights, a Second Circuit panel ruled Monday.

The case, which the panel heard this past November, had been brought by three Amish community schools that were fined in 2019 for failing to comply with state-mandated school vaccinations.

The schools and Amish parents argued their First and 14th Amendment rights had been violated, as many Amish seek to live separately from the modern world and abhor vaccines.

I think “abhor” might be a little strong, but the point stands. Here’s more on why some Amish don’t vaccinate. Their attorney had previously argued:

“The state has determined that it’s OK to spare a child vaccination for the sake of their immune system, but it’s not OK to spare a child vaccination for the sake of their soul,” the plaintiffs’ attorney Shannon Grammel told the panel Monday. “And that’s the kind of value judgment the First Amendment does not allow.”

New York Cancels Religious Objections, Fines Amish Schools $118,000

New York Amish who rejected vaccination were in a good position prior to 2019. The state had previously long allowed religious objections on this matter:

New York had since 1966 allowed exemptions from mandatory school immunization for medical reasons or sincerely held religious objections. However, following a nationwide measles outbreak in 2018 and 2019, the Legislature removed those exemptions, joining four other states to prohibit any kind of nonmedical exemption.

No longer permitted this exemption, three Amish schools found themselves being heavily fined:

Shortly after the new rule was passed, the Dygert Road School, Pleasant View school, and Shady Lane school were fined tens of thousands of dollars each for violating state law after they refused to comply with the law. The schools and several board members sued the state for an injunction.

How much exactly were they fined? I found this explanation in the court ruling document:

Each violation of § 2164 is subject to a fine of up to $2,000. The DOH considers each day that an unvaccinated student attends school to be a violation. The Commissioner of Health concluded the total fines were “principled and conservative under the circumstances.” J.A. 127.

More specifically, the Commissioner of Health’s order imposed a $52,000 fine against Dygert Road School, a $46,000 fine against Twin Mountains School, and a $20,000 fine against Shady Lane School.

To calculate the fines against Dygert Road and Twin Mountains, the DOH multiplied the number of out-of-compliance students in each school by the maximum penalty (under the modest assumption that each of those students was out of compliance for only one day).

Because Shady Lane provided no documentation for its students, the DOH assumed that one student was not compliant for at least ten days.

That adds up to a total of $118,000 in fines against the three Amish schools.

Apparently a judge recommended that the fines not be imposed “due to a lack of adequate notice”…but the NY State Department of Health rejected this recommendation.
