A major Chicago fundraiser for United States President Barack Obama has been schmoozing senior Zanu-PF figures, including President Robert Mugabe, in the hope of winning business deals from the Zimbabwe government.

In return, amaBhungane understands, senior Zimbabwean security force members have been looking to the fundraiser,real-estate tycoon Elzie Higginbottom, to help the country to wriggle off the hook of targeted US sanctions.

Internal Zanu-PF documents seen by amaBhungane suggest that the Zimbabwean military was keen to enter into negotiations with Higginbottom to form a joint-venture diamond mining company in 2011.

Higginbottom’s vast property portfolio has been β€œconservatively” valued at $200-million by the Chicago Tribune. Campaign finance records indicate that he and his wife contributed $400 000 to Obama’s campaign war chest between 2008 and 2012 and donated generously to both Obama inaugurations.

Higginbottom’s largesse has catapulted him into a super-category of party political funders in the US popularly referred to as β€œbundlers” (see β€œSupport in bundles”).

Zimbabwe security forces apparently saw the participation of Americans in the Chiadzwa diamond fields near Marange as key to avoiding further action by a β€œhostile” US government to restrict the Zimbabwe diamond trade.

The security forces also hoped that a delegation of Chicago businessmen led by Higginbottom would lean on key members of the Obama administration to reverse, or ease, US sanctions against senior Zanu-PF figures.

The sanctions, administered by the US treasury’s Office of Foreign Asset Control (Ofac), prohibit US citizens from engaging in β€œany transactions with any person, entity or organisation” on a list of β€œspecially designated nationals”.

IL Says Casino Queen Can't Stay Open 24 Hours

Chicago, ILl. – The Illinois Gaming Board has rejected a request by the Casino Queen to stay open 24 hours.

Currently, the Casino Queen is open 22 hours. Illinois law allows 24-hour gambling, but the board must approve changes in hours.

Casino Queen director Michael Gaughan said the casino "is about two feet of water away from temporary closing" and wanted expanded gambling hours to compete with Missouri casinos, which are open all day.

"We are about two generations behind now," he said. "We are doing our best to stay proactive in this market today."

Jeannette Tamayo, interim board administrator, said the Gaming Board did not have enough staff members to supply agents at the casino if it were open 24 hours.

"We barely have enough staffing right now," she said.

Board Chairman Elzie Higginbottomtold Casino Queen officials that the board had received numerous letters and phone calls opposed to 24-hour gambling.

Four other casino owners have reduced hours of operation to cut costs after Gov. Rod Blagojevich got approval from lawmakers to take 70 percent of revenue over $250 million from the most profitable boats and smaller increases for less profitable boats.

And 50 to 85 times more people had been infected than originally thought in northern California (2.5%-4.2%), while in southern California – where most flights from Asia land into LAX – the infection rate was found to range from 2.8%-5.6% (which experts believe is due to earlier-than-thought exposure to COVID dating back to last Fall).

ZERO Children Dying

 

In addition to having a LESS THAN ONE PERCENT fatality rate overall, the fatality rate for children – who appear to be essentially immune (likely due to their contraction of endless common colds most of which are from Corona virus strains) – is ZERO.

 

You read that right: worldwide, ZERO children under 10 have died. And in the US? Zero individual under age 20 have died. [3]

 

Yet further, the number of deaths for all people in the US to date is proving this virus to be no more deadly than a bad flu.[4]

 

And that is even with the number of deaths being radically over-inflated due to the CDC’s order that all deaths be counted as COVID deaths – including e.g., a man who dies by crashing his motorcycle or heart attack, if he tests positive for COVID (even though he was not SICK from COVID at the time of his death, and the actual proximal cause of his fatal injury was vehicular fatality or heart attack).

 

Sweden is actually doing the math correctly: counting people who die with COVID separately from people who die from COVID.

 

But the U.S. to date is refusing to do correct math, and thus it must be noted that even the math showing COVID to be no worse than the flu is likely still artificially north of where it should be – COVID may well be far less fatal than the flu (and we know it is less fatal than SARS or MERS).[5]

 

Finally, it should be noted that countries and states who’ve gone into lockdown actually have no better outcomes, and in some cases, MORE fatalities than those who did not employ lockdown.[6]

 

Frankly, this is not shocking: in the 1918 flu pandemic, it was rapidly discovered that outdoor hospitals with no roofs – where patients were exposed to sunlight and fresh air – had lower death rates and better recovery rates (due to the incontrovertible science that shows better immune response with Vitamin D, and of course, the ability to breathe non-contaminated air that is not re-circulating with a heavy virus load).[7]

Governors are not Kings

 

Now that we have reviewed the math, I want to turn to a governmental analysis, followed by a review of legal points.

 

Governors are not kings. While they can issue orders, those orders are not always constitutional.

 

Courts – which are currently closed state-wide – are the final arbiter of whether any decree, order, or law is actually lawful.

 

As educators, I doubt I have to point out here the rather obvious fact that we have three branches of government, precisely to avoid the end that is occurring right now: the three branches are to act as a system of checks and balances on each other.

 

Currently, in California and most states, only one branch of government is in session. This is a set-up for abuse, and something our forefathers took great pains to avoid.

 

There is a name for countries whose countries function with only one branch in session: they are called dictatorships.

 

Put simply: due to the current closure of the courts, many executive branches are accomplishing by fiat what would never be allowed in any other setting, and which decrees are likely exceedingly unconstitutional.

Constitutional Rights

 

And turning to the legal analysis: governments may, in times of crises, curtail First Amendment rights, as well as other rights guaranteed by our Constitution. Phrased differently, our right to speech, to assemble, to pray, our freedom of movement (a derivative First Amendment right) may be encroached upon and are not absolute.

 

That said, any order that burdens a First Amendment right must pass strict scrutiny: it must be β€œnarrowly tailored” to achieving a β€œcompelling state interest.”

 

Applying this standard in reverse to the facts at hand, safeguarding public health is likely going to be considered a compelling state interest – although that prong is harder to meet with every passing day that yields a new study showing COVID to be no more fatal than the flu.

 

But more to the point, an order that indefinitely prevents normal assembly or speech – as many governors’ orders do – is never going to be able to be shown to be β€œnarrowly tailored” to addressing the problem of the virus.

 

An example of a β€œnarrowly tailored” solution designed to achieving virus containment and public health concerns would be confining sick people to home or hospital – which is a true quarantine – as opposed to locking down 95% of Americans who are neither sick nor carriers and putting us under house arrest for an indefinite period of time.

 

Moreover, what may – at one very discrete point in time – be a prudent action that errs on the side of caution (ordering people to stay home during the first 4-6 weeks of the virus) – and which many would concede appears narrowly enough tailored at the front side – will NOT continue to be deemed narrowly tailored if said solution is applied indefinitely.

 

Stated differently: house arrest to control a pandemic spread for one month seems narrowly tailored and justified, but house arrest forever – particularly when the facts show that the virus is NOT a pandemic and is no more fatal than the annual flu – cannot be justified in a free society, and would never meet the legal standard.[8]

 

California’s recent order has major other issues which I won’t belabor here, as they are not particularly relevant, other than to point out the rather obvious fact that if a person can be trusted to stand six feet apart from his neighbor while buying marijuana (pot stores are considered β€œessential” under California’s current order), then it begs the question of why Ma and Pa Smith cannot be trusted to remain six feet apart from their neighbors while praying in the pews of their local church this Sunday.

 

While the governor has to my knowledge issued no official guidance to educational institutions of which I’m aware (other than shutting everything down through the end of this particular school year), he has been loudly telegraphing in interviews that he believes there will be no mass gatherings and no sports for at least 18-24 months, and that schools should endeavor to engage in some costly and scientifically unsound re-arrangements prior to Fall 2020.

Lawsuits Coming and the State will Lose

 

On that front: the State is about to be hit with a deluge of lawsuits, as both the existing stay-at-home order is unconstitutional (not just from a First Amendment standpoint, but from a 13th Amendment/slavery standpoint, and from a Takings Clause standpoint re small businesses), as are the verbalized but not-yet-written statements about California’s future (should they be enacted).

 

These lawsuits the State will lose: it is not constitutional to continue house arrest indefinitely, nor to require masks on healthy people at all (let alone indefinitely), nor to prohibit adults or children from gathering normally at church, work, sports, or school for 1-2 years.

 

Moreover, the Department of Justice has clearly and correctly indicated it will be intervening as a party of interest in such federal court lawsuits, and siding with the people and against the State. To wit, as reported by both NPR and Bloomberg[9] yesterday:

 

Attorney General Barr called some current stay-at-home orders β€œburdens on civil liberties” and said that if they continued and lawsuits were brought, his department would side against the state.

Seattle Mayor Jenny Durkan issued a letter Tuesday calling on city councilmembers to open an investigation into Kshama Sawant, and possibly expel her from the dais.

Durkan points to what she labels β€œdisorderly or otherwise contemptuous behavior” from Councilmember Sawant. In the letter directly addressed to Council President Lorena Gonzalez, she cites a handful of specific incidents.

Allegations she led a march to Mayor Durkan’s home over the weekend; Durkan’s address is redacted in official documents over threats made against her during her time as a U.S. Attorney

The letter also alleges that Sawant’s followers vandalized Durkan’s home β€œby spray-painting obscenities,” while asking city council to β€œfully investigate” Sawant to β€œdetermine if action should be taken.”

Sawant and Durkan have clashed over several issues during their time in city government, most recently with Sawant calling on Durkan to resign in the wake of police violence at protests downtown and on Capitol Hill.

β€œDisagreements on policy contribute to a robust public debate. However, police disagreements do not justify a Councilmember who potentially uses their position in violation of law or who recklessly undermines the safety of others, all for political theatre,” Durkan states.

Neither Sawant nor the rest of the council have responded to the mayor’s letter yet.

Fauci also added that some of his past comments on the ability of sporting leagues and schools to reopen have been taken out of context.

 

β€œWhen things get in the press of what I supposedly said, I didn’t say,” Fauci added. β€œI never said we can’t play a certain sport.”

 

β€œThe only thing that I can do is, to the best of my ability, give you the facts and the evidence associated with what I know about this outbreak,” Fauci concluded.

 

Some parts of the U.S. have experienced a surge in coronavirus cases over the past few weeks, and recently recorded 37,000 new cases, breaking the country’s single-day record. States such as Arizona and Texas have reimposed some restrictions on businesses in the state to slow the spread, and aovid overwhelming their medical systems.

We must begin with understanding that Turkey is vital to U.S. interests. Turkey is really our strongest ally against the Islamic State in Iraq and Syria (ISIS), as well as a source of stability in the region. It provides badly needed cooperation with U.S. military operations. But the Obama administration is keeping Erdoğan’s government at arm’s length β€” an unwise policy that threatens our long-standing alliance.

 

The primary bone of contention between the U.S. and Turkey is Fethullah GΓΌlen, a shady Islamic mullah residing in Pennsylvania whom former President Clinton once called his β€œfriend” in a well circulated video.

 

GΓΌlen portrays himself as a moderate, but he is in fact a radical Islamist. He has publicly boasted about his β€œsoldiers” waiting for his orders to do whatever he directs them to do. If he were in reality a moderate, he would not be in exile, nor would he excite the animus of Recep Tayyip Erdoğan and his government.

For those of us who have closely studied the careers of Seyed Qutb and Hasan al Bana, the founders and followers of the Muslim Brotherhood, GΓΌlen’s words and activities are very familiar.

 

The late Seyed Qutb in particular was very much in the GΓΌlen mold. The author of 24 books on education and the arts, he assembled an inner circle of intellectuals and influential politicians. But contrary to this well-masked faΓ§ade, Qutb’s writings provided the inspiration for terrorist groups like Al-Qaeda. Qutb was hanged in 1966 in Egypt for instigating rebellion.

 

Likewise, Hasan al Bana, an Egyptian who died in 1949, defined the first phase of pre-emptive jihad as a long and quiet process that can take as long as a quarter of a century, to prepare the forces for a decisive strike. Al Bana famously declared that the only acceptable form of law is Sharia.

 

To professionals in the intelligence community, the stamp of terror is all over Mullah GΓΌlen’s statements in the tradition of Qutb and al Bana. GΓΌlen’s vast global network has all the right markings to fit the description of a dangerous sleeper terror network. From Turkey’s point of view, Washington is harboring Turkey’s Osama bin Laden.

 

Washington’s silence on this explosive topic speaks volumes when we hear the incredulous claim that the democratically elected president of Turkey staged a military coup, bombed his own parliament and undermined the confidence in Turkey’s strong economy, just so that he could purge his political opponents.

 

This baseless claim is a dark reminder of the vicious rumors spread by our enemies that 9/11 was an inside job by the American intelligence apparatus as an excuse to invade Muslim lands to grab their oil!

Butler man sentenced to 5 years probation for child pornography charges

Took plea deal, originally faced 252 years in prison

A 34-year-old Butler man was sentenced Wednesday to a total of five years probation along with fines for downloading child pornography.

 

Visiting Judge Timothy Creany sentenced John Paul Doerr for 35 counts of child pornography and one count of criminal use of a communication facility, which refers to the computer Doerr used to collect child pornography.

 

In total, Doerr was sentenced to five years probation with the first six months on a modified house arrest with electronic monitoring. The house arrest will be lifted if Doerr gets a job, Creany noted. Doerr must also pay $1,950 in fines and he must register as a sex offender for 15 years. His access to the internet will be monitored for two years.

 

Creany was brought in from Cambria County after all the Butler County judges recused themselves from the case, citing Doerr's connection to his father, President Judge Thomas Doerr. And the Butler County District Attorney made a similar decision, deferring prosecution in the case to Senior Deputy Attorney General Chuck Washburn with the Pennsylvania Attorney General's Office.

 

β€œIt's a standard sentence. This is typical in these types of cases,” Washburn said after sentencing. β€œIt's average.”

 

Doerr originally faced 42 felonies related to child pornography stemming from his January 2019 arrest. Doerr admitted to investigators he downloaded pornographic videos involving children onto his home computer, according to authorities. Charging documents reveal state police arrested him following an undercover investigation into the sharing of child pornography on the Internet.

 

As part of the plea deal, prosecutors agreed to drop six charges of disseminating photos or films depicting child sex acts. In exchange, Doerr pleaded guilty to 35 counts of child pornography and one count of criminal use of a communication facility, which refers to the computer Doerr used to collect child pornography.

 

After pleading guilty in November 2019 he faced up to 252 years of prison in accordance with sentencing guidelines.

Suit Filed Against Butler Co. President Judge

Butler County’s president judge is facing allegations of sexual misconduct.

 

A federal lawsuit was filed Wednesday against President Judge Thomas Doerr by an unidentified woman, referred in the suit as β€œJane Doe.” The suit was filed in the U.S. District Court for the Western District of Pennsylvania by attorney Edward Olds of Pittsburgh.

 

The suit alleges Doerr and the woman met back in 2004 and began a sexual relationship, which included having sexual relations at the Butler County Courthouse. Doerr then allegedly told the woman he would do what he could to help get her a job with the county probation office.

 

β€œThe prospect that Doe would be hired to serve as a probation officer in Butler County was implicit, and in fact, discussed that evening. Doerr suggested that he would do what he could to hlep Doe get a job with the probation office,” the lawsuit states.

 

The suit alleges Doerr did use his influence to get the woman hired in 2005. The relationship between the two allegedly continued for four years, with the woman alleging she felt she couldn’t resist Doerr’s requests for sex without her job being put in jeopardy.

 

β€œOnce she began her work for the Butler County Court of Common Pleas, Doerr began again, to summon her to his chambers for sexual relations. Doe felt that she had little choice and did not resist his command. She felt that she had no choice, given the power disparity; therefore, she succumbed,” the suit states.

 

The woman alleges she β€œeventually decided to terminate the affair, and the sexual encounters ceased. But the consequences of the affair have persisted to this day.”

 

The lawsuit claims Doe is the victim of workplace discrimination, including involuntary reassignments, harassment and mistreatment, because two of her superiors resented her for her access to and contact with the judge. Butler County Court Administrator Thomas Holman and Chief Probation Officer Douglas Ritson are also named in the suit.

 

In February 2016, Doe contacted the Equal Employment Opportunity Commission and indicated her intent to file a Charge of Discrimination. The lawsuit claims when Doe advised her supervisors of her intent to file the charge, she experienced retaliation in the form of a job performance review.

 

β€œShe has been treated in this fashion, an in essence punished, due to her ending the relationship with Doerr and filing a charge of discrimination,” according to the lawsuit.

 

In closing, the suit states, β€œThe conduct of the defendants has injured Doe in multiple ways. She has lost income and the opportunity to advance in her career and develop the full extent of her capacities and garner experience as a probation officer, she has suffered great emotional injury, loss of reputation and other personal injuries.”

 

Doe is seeking β€œall of the relief that is just and appropriate, including compensatory damages, injunctive relief, punitive damages, counsel fees and the costs of this action.”
