With New Jersey too close to call, here's how election recounts work in the Garden State

The New Jersey governor's race remained too close to call early Wednesday morning as Republican challenger Jack Ciattarelli held a narrow lead over incumbent Democratic Gov. Phil Murphy, meaning that no matter who ends up in front once all votes are counted, the other side will want to challenge the outcome.

 

So how do recounts work in New Jersey? While some states have automatic recounts that are triggered by slim margins between candidates, the Garden State does not – it does, however, allow candidates to challenge results on a county-by-county basis.

"When any candidate at any election shall have reason to believe that an error has been made in counting the votes of that election, the candidate may, within a period of 17 days following such election, apply to a judge of the Superior Court assigned to the county wherein such district or districts are located, for a recount of the votes cast at the election in any district or districts," New Jersey law says.

 

How does it work?

 

The recount itself would be conducted by a county board under the judge's direction. The county board has the power to subpoena district board members to provide any necessary documents or other materials, and to be present for the opening of the ballot boxes. The county board can also have the district board members testify, if needed. Should there be any disputes, the county board can vote on them, but if the issue cannot be settled with a majority vote, the judge overseeing the recount would decide the matter.

Who pays for it?

 

Should a judge grant an application for a recount, the candidate has to pay a deposit for each district being recounted. The deposit amounts are based on the number of votes, but capped at $25 per district.

 

Should the recount result in a different outcome, or if it results in a change of at least 10 votes or 10% of the votes cast (whichever is greater), the government will pay the costs and the deposits will be refunded. Otherwise, the recount costs will be deducted from the deposits.

In the event of a new winner, the judge would hand down another order for the chairman and clerk of the county board of canvassers to issue a new certification.

If the original winner then gains enough votes to retake the lead, the recount process will stop unless the original challenger pays another deposit.

COP26 coalition worth $130 trillion vows to put climate at heart of finance

 

Banks, insurers and investors with $130 trillion at their disposal pledged on Wednesday to put limiting climate change at the centre of their work, and got support in the form of efforts to put green investing on a firm footing.

An announcement made at the COP26 U.N. climate conference in Scotland commits its signatories, who account for around 40% of the world's capital, to assuming a "fair share" of the effort to wean the world off fossil fuels.

 

A main aim of the COP26 talks is to secure enough national promises to cut greenhouse gas emissions - mostly from burning coal, oil and gas - to keep the rise in the global temperature to 1.5 degrees Celsius. But how exactly to meet those pledges, particularly in the developing world -- is still being worked out. Above all, it will need a lot of money.

"These happy headlines conceal a wealth of loopholes and opportunities for backsliding that we cannot afford if we are to avoid climate breakdown," the Environmental Justice Foundation said in an emailed statement. "Net zero pledges mean nothing without fossil fuel divestment. Time for financial institutions to put their money where their mouth is and stop funding climate-destroying fossil fuels," the NGO's CEO Steve Trent added.

 

Carney has led an effort to ensure that financial institutions account for and disclose the full climate risks of their lending or investments, forcing the wider economy to price in costs that until now been largely concealed. These include not only the direct effects of more frequent extreme weather events, but also costs such as a loss of government subsidies for fossil fuels, or the knock-on health and environmental costs of greenhouse gas emissions.

 

Kristalina Georgieva, head of the International Monetary Fund, said it was crucial to incorporate climate data into everyday macroeconomic reporting. China's central bank governor, Yi Gang, said Beijing was working on a new monetary policy facility to provide cheap funds for financial institutions to support green projects, and that the People's Bank of China (PBOC) and the European Union would soon publish a shared definition of green investment. And the vice chair of the global Financial Stability Board, Dutch central banker Klaas Knot, said a mandatory global minimum standard for disclosure of climate risks was now needed for both financial stability and the provision of sustainable finance.

Royal Marines make mockery of US troops just DAYS into training exercise

The British commandos "dominated" US forces while trialling a new battle structure in California. They eliminated almost the entire unit of US troops during the five-day fighting exercise.

US forces asked for a "reset" halfway through due to heavy simulated casualties, the Telegraph reported.

And at one point the commandos had destroyed or rendered inoperable every American asset.

Lieutenant Colonel Andy Dow, commander of the British force, said: β€œThroughout this deployment our focus has been on integrating game-changing capabilities from across the commando force to deliver disproportionate effect in the face of a free-thinking peer adversary.”

Exercise Dagger Green is attended by military forces from a number of countries.

The exercise is used to test US Marine Corps units before they are deployed overseas.

The area used for the exercise is over 3500 square kilometres of mountainous and desert terrain.

There are also urban settings with actors, who do not have to follow a script, playing civilians.

The Royal Marines' victory saw them target the US headquarters and valuable equipment.

The commandos also repelled a last-minute assault by US counterparts.

They ended the exercise in control of over 65 percent of the area after starting with less than 20 percent

Following reforms directed by the First Sea Lord, Admiral Sir Tony Radakin, the UK will have two LRGs each based around an existing unit of Royal Marines.

The Royal Marines are an amphibious force of the Royal Navy.

The elite fighting force is held at high readiness for worldwide rapid response and is able to deal with a wide range of threats. (End of article)

Unacceptable conditions at D.C. jail lead to plan to transfer about 400 inmates, officials say

 

The U.S. Marshals Service plans to transfer about 400 inmates out of the D.C. jail to a federal prison nearly 200 miles from Washington after a recent surprise inspection found evidence of β€œsystemic” mistreatment of detainees, including unsanitary living conditions and the punitive denial of food and water, officials said.

 

While β€œa formal summary” of the inspection, conducted last month, is still being prepared, Lamont J. Ruffin, the acting marshal for U.S. District Court in Washington, told the D.C. Department of Corrections in a letter Monday that the findings β€œmay warrant further examination” by the Justice Department’s civil rights division.

 

The jail, formally known as the Central Detention Facility (CDF), houses about 1,500 detainees, of which roughly 400 are inmates awaiting court appearances in federal cases or post-sentencing assignment to federal prisons.

 

Many of those 400 inmates, if not most, are D.C.-area residents with family members in local communities. In light of the inspection’s findings, the Justice Department said Tuesday, the federal detainees in the CDF will be moved to the U.S. penitentiary in Lewisburg, Pa., a nearly four-hour drive north of the District.

 

The move will not involve about 120 federal detainees, including about 40 defendants who face federal charges in the Jan. 6 riot at the U.S. Capitol, who are being held in the corrections department’s Correctional Treatment Facility (CTF), the Marshals Service said. That facility is located with the jail in Southeast Washington.

 

Ruffin, who ordered the inspection, said that conditions at the CTF β€œwere observed to be largely appropriate and consistent with federal prisoner detention standards,” and that the problems were primarily in the main jail.

 

In the CDF, an eight-member team of deputy U.S. marshals found β€œlarge amounts of standing human sewage . . . in the toilets of multiple occupied cells” and many cells in which water β€œhad been shut off for days,” Ruffin wrote.” He said jail staff members β€œwere observed antagonizing detainees” and β€œdirecting detainees to not cooperate” with the review. One prisoner was warned by a staff member to β€œstop snitching.”

 

β€œSupervisors appeared unaware or uninterested in any of these issues” Ruffin wrote.

 

D.C. Mayor Muriel E. Bowser’s administration opposes the planned inmate transfers, said Christopher Geldart, the city’s deputy mayor for public safety.

 

β€œWe take seriously the responsibility of caring for justice-involved D.C. residents and believe they should remain in D.C.,” Geldart said in a statement Tuesday. He said the corrections department strives β€œto provide a safe, orderly and humane environment” while regularly working on structural repairs at β€œthe aging detention facility.”

 

However, Geldart called Ruffin’s letter β€œdeeply concerning” and said city officials β€œare working with our federal partners to get the complete report in order to work through the specific findings.” In his statement, he did not individually address any of the findings.

 

The inspection, and the planned removal of federal prisoners, raises questions about the treatment of nonfederal inmates, who make up a vast majority of the jail’s population. Most of them are being held on local charges adjudicated in D.C. Superior Court. They are officially in the custody of the D.C. corrections department, not the Marshals Service.

 

The transferred inmates will be farther from their families and defense lawyers and the federal courthouse in Washington. But in the Lewisburg penitentiary, they will have expanded access to visiting areas, medical care and video teleconferencing facilities, the Marshals Service said.

 

The service said it is β€œcommitted to ensuring that detainees have adequate access to defense counsel, family support, medical care, and [evidence] related to their cases.”

 

The unannounced inspection, from Oct. 18 to Oct. 23, began five days after a federal judge in Washington found the jail warden, Wanda Patten, and D.C. Corrections Director Quincy Booth in contempt of court in a case involving the alleged mistreatment of a detainee charged in the Capitol riot.

 

Judge Royce C. Lamberth said jail officials β€œabused” the civil rights of the defendant, Christopher Worrell, an accused member of the Proud Boys, a far-right group with a history of violence. The judge said the officials failed to turn over information needed to approve wrist surgery that had been recommended for Worrell months earlier.

 

Lamberth called for the Justice Department to investigate whether the jail had been violating the civil rights of the dozens of prisoners charged in the Jan. 6 mayhem. The civil rights division is examining the circumstances of the treatment of those defendants but has not opened a formal investigation, people familiar with the matter said.

 

Lawyers, judges, detainees and others have long criticized conditions at the 45-year-old jail. The complaints peaked earlier this year after the prolonged confinement of detainees β€” including 23-hour-a-day lockdowns β€” to curb the spread of the coronavirus.

 

Ruffin’s letter, addressed to Booth, said that β€œEvidence of drug use was pervasive” in the jail and that β€œthe facility had a strong smoke and odor of marijuana.” It said, β€œThe smell of urine and feces was overpowering in many locations” while β€œfood delivery and storage” were substandard. β€œHot meals were observed served cold and congealed,” the letter said.

 

Copies of the letter were sent to two judges in U.S. District Court in Washington, the acting U.S. attorney and chief federal public defender in D.C., other officials of the Marshals Service, and the deputy chief of the Justice Department’s civil rights division.

 

β€œDetainees had observable injuries with no corresponding medical or incident reports,” Ruffin wrote.

 

β€œWater and food appeared to be withheld from detainees for punitive reasons,” he added. Meanwhile, β€œJail entrance screening procedures were inconsistent and sloppy” and the staff was β€œobserved not following COVID-19 mitigation protocols.”

 

In a statement, D.C. Council member Charles Allen (D-Ward 6), who chairs the committee on the judiciary and public safety, said that β€œunequivocally, those held in our care and custody must be treated humanely and in accordance with correctional standards” and that the city β€œneeds to act with urgency and full transparency in response to today’s news.” He said he would schedule an oversight hearing to learn the mayor’s plan.

 

The Marshals Service declined to comment on the schedule for prisoner movements, which could begin as soon as this week and continue for weeks.

The β€œDark Side” Of Myrtle Beach City Government No Media Wants To Cover

 

This week, a jury in Conway, S.C. ruled against the City of Myrtle Beach. Jurors ruled that the city tortiously interfered with a small business owner harassing him to the point of closure. The city ultimately purchased the property the business occupied. This after using the full weight of government to shut the private business down on the basis of a bogus β€œnuisance” complaint.

 

We received a lot of inquiries from readers about the recent verdict against the City of Myrtle Beach wanting more information. I was present during much of the trial and can give my own interpretation of what the facts and arguments were that led the jury to rule against the City. I also reached out to Tucker Player, one of the attorneys for Henry Brewington, for a statement.

 

Full disclosure, Tucker is my personal lawyer as well.

 

Henry Brewington is the son of sharecroppers from Hemingway, South Carolina. By the age of seven, Henry was working in the fields with his parents and siblings. If Henry didn’t work, Henry didn’t eat. Henry didn’t even get to go to school unless it was raining, and that was only because he couldn’t be in the fields if it was raining. This led to a lack of any formal education for Henry, but he didn’t let that hold him back. Henry eventually travelled to New Jersey and began his own business, a night club. He met his wife Ginny while in New Jersey and eventually came home to Hemingway.

 

In Hemingway, Henry and his wife operated a beauty supply store (which they still operate to this day) and a night club. Henry eventually opened another night club in Hemingway and saved up a $300,000.00 nest egg for his family. Henry’s son convinced his parents to come to Myrtle Beach where they all thought they could make money and turn the nest egg into a legacy for Henry’s children and grandchildren.

 

It was the American Dream, and the Brewington’s were living it. Until they came to Myrtle Beach, South Carolina. Myrtle Beach is where the American Dream died for the Brewingtons.

 

Henry spent all of his savings, all $300,000.00, to renovate his leased space and opened Levelz Club in July 2014. In the span of just seven months, the City of Myrtle Beach regulated and harassed Henry Brewington out of business. On the first night Henry’s Club was open, the police were standing in his doorway at 1:59am. At 2:01am, they cited Henry because there were still a few people left in the Club. It was merely a harbinger of things to come.

 

In October, someone took a picture of a champagne bottle with a children’s sparkler attached. That picture was sent to the fire marshal, who promptly cited Henry for the Unlawful Sale of Fireworks. Henry pled guilty and banned sparklers from his Club.

 

In December, a SLED agent allegedly asked for a drink of Jim Beam and Coke shortly after 2:00am. The bartender served the officer and the Club was immediately cited for serving alcohol after 2:00am. I am not a lawyer, but that certainly sounds like entrapment. Tucker Player thought so too because he argued that point in his closing. More troubling is the fact that Ginny Brewington, Henry’s wife, testified that they never stocked Jim Beam in their clubs.

 

Henry paid the fine and made sure no alcohol was served after 2:00am again. On the same night, a police officer found a patron rolling a marijuana joint in the bathroom.

 

In January, Ginny Brewington called the police about a fight that started in the Club and moved to the parking lot outside. Club Security broke up the fight and expelled the participants, but they started fighting again in the Superblock shared parking lot.

 

Despite only being two blocks away. The police didn’t show up until much later after the Club was gone and the perpetrators long gone. What is important to note is that the City’s regulatory officer, Lisa Robertson, called Ginny Brewington a few days later to ask about the fight. According to Ms. Robertson’s own notes, she told Ginny Brewington that the call β€œwould not be held against” the Brewingtons since they called it in. This was a lie.

 

On the weekend of January 23, 2015, which Ginny Brewington called β€œArmageddon Weekend,” no less than 6 Myrtle Beach police cars were in front and back of the club with their blue lights on β€œall night,” according to Ginny Brewington. The same thing happened on the following night, with no explanation whatsoever. Shortly before midnight, an officer pulled up in a golf cart and told the Brewingtons that β€œword on the street” was that there was going to be a retaliatory shooting for something that happened in Conway.

 

They provided no name, no description or any other details about the potential shooter or shooting.

 

The following Monday, Ginny Brewington called the City of Myrtle Beach to complain about what she saw as heavy-handed police harassment. In that conversation, Ginny told Lisa Robertson that she believed they were being treated differently than other clubs in the area.

 

Ginny specifically complained about the Heat Lounge. She told Robertson that she thought the Heat Lounge was bribing police officers because the cops were always over there and Heat never got in trouble for anything. According to Ginny Brewington, Lisa Robertson said she needed to call her back. When Robertson called Ginny back, she set an appointment on February 2, 2015 to meet with herself, Police Chief Warren Gall, and City Attorney Tom Ellenburg. The Brewingtons believed this was to discuss the police harassment complaint. But the City had other plans.

 

Ginny made her complaint about the police and Club Heat on January 26, 2015. On January 27, 2015, the VERY NEXT DAY, Lisa Robertson drafted a memo to Chief Warren Gall citing nine incidents at the Brewington’s club and recommending the club be shut down as a nuisance. So when the Brewington’s walked into the meeting on February 2, 2015, they were walking into an

ambush. In the meeting, there was no discussion of the police.

 

Tom Ellenburg informed the Brewingtons that they were a nuisance and he was going to shut them down. If they didn’t turn in their business license to him on that day, they would lose everything the put in the club.

 

Henry Brewington testified that he felt like it was one of the β€œsundown” laws used to drive African Americans from southern towns during segregation. He immediately found a woman to

purchase his business for $150,000.00, less than half of what he put into it.

 

So what did the City claim justified the nuisance? According to Brewington’s lawyers, β€œfive joints and a sparkler.” Tucker Player had a timeline displayed during his closing argument and was kind enough to send me a copy. What is shows are the 9 incidents used to shut down

Levelz. Here is the summary from the actual trial:

 

THE NINE CALLS THAT ENDED LEVELZ

 

10/18/14 – Sparklers in Drinks

 

10/19/14 – Someone was smoking a joint on the dance floor

 

12/14/14 – SLED citation for serving after 2am

 

12/14/14 – One guy rolling a joint in the bathroom

 

1/18/15 – Owner and her security company self reports a fight that the police show up too late to observe. (this is the one Robertson said would NOT be used against the Brewingtons)

 

1/25/15 – Two people get into a fight, Levelz Security diffused the situation, but it started again in the parking lot. Police had to break up the fight.

 

1/25/15 – One guy with a 3 gram bag of MJ in the Levelz bathroom

 

1/25/15 – Cops find a guy smoking weed in his car in the parking lot

 

1/25/15 – There was a drunk in front of the club in the street

 

As you can see, the City of Myrtle Beach used the children’s sparkler and Ginny Brewington’s self-report of a fight to shut the club down. Brewington’s attorneys had a filed day with the absurdity of these calls. On cross examination, Robertson was asked how a single person rolling a joint in his car, in the parking lot, was a β€œsafety” issue. Robertson responded it was about the safety of those people around the smoker who didn’t want the breathe the smoke.

Now, my readers may recall that there was a shooting close to Levelz in February, 2015. The City tried to focus the jury on the shooting (which assistant solicitor James Battle called a (β€œprofessional hit”) as the reason they shut Levelz down. But the evidence was in Robertson’s own notes: The City made the decision to shut Levelz down three weeks BEFORE the shooting. In addition, the evidence at trial was that after the meeting with Ellenburg, when he told Henry and Ginny he was going to run them our of town, they hired new security and turned the nightclub into a smoke free environment to make sure there were no more marijuana issues. That rule is what led to the victim of the shooting being expelled from the Club immediately before his execution. That’s right. The Brewingtons were enforcing the rules imposed by the City to kick the young man out of the club. He then walked away from the club and was shot NEXT DOOR, not in or around the Club. In fact, it was the armed security at Levelz that shot the assassin as he fled the scene.

 

In his closing argument, the Lion of Horry County, Tommy Brittain, railed against the City and government overreach. He demanded to know why Gall and Ellenburg were not there to testify. The entire courtroom was enraptured. What I witnessed in those 6 minutes of fire and fury were more powerful than anything any television show about lawyers could make up.

 

In the end, it was a good result for a good man. But more than that, it was a message to the City of Myrtle Beach. The citizens of Horry County will not tolerate this type of government interference and overreach. They will not tolerate bullies in public office. Most importantly, they have no problem handing big verdicts to the victims of the City’s transgressions.

 

Tucker was reluctant to say much about the pending cases, but he did explain the difference between the Brewington’s case and the other cases he and Tommy Brittain have against the City. He explained that the Brewingtons started in federal court with claims that their Constitutional rights were violated. The federal judge dismissed the Constitutional claims based on a Consent Order in which the Brewington’s agreed they were a nuisance. We told you earlier this month that the other Superblock cases survived their legal challenges. Tucker explained that even though the Brewingtons got a verdict of $500,000.00, they are limited to recover only $300,000.00 under the South Carolina Tort Claims Act. β€œThere are no caps on Constitutional claims.” He said with a wry smile. β€œIn fact, not only are there no caps, we can recover punitive damages and attorney fees.” When I asked him that that means for the City, he just smiled even wider.

 

One last thing. Twelve Horry County citizens found that the City of Myrtle Beach intentionally interfered with the Brewington’s business contract and awarded more than the maximum amount allowed by law. Yet, this is the only news outlet that reported on the verdict. The only one. What does that say about the new media in Myrtle Beach? Better yet, what does that say about the City’s grip on the media in Myrtle Beach. Even FitsNews is silent. This story is everything Will Folks preaches about on a daily basis: government overreach, to much regulation, and corruption in state government. Yet, he hasn’t even sent out a tweet. I can’t tell you what it means. Perhaps he is too wrapped up in the Murdaugh Murders to care about the small businesses any more. Such is not the case here. We will continue to expose the wrongdoings of the City of Myrtle Beach and any other government entity that preys on the pubic and stifles the free flow of capitalism and entrepreneurial spirit in American business. You can count on us. We aren’t going anywhere.

Election Day 2021: 56 districts in Essex County did not count votes last night. Here’s why.

 

Essex County Clerk Christopher Durkin has a lot of work ahead of him after 56 districts were not counted Tuesday night in the county.

 

β€œIt’s a mix but they are mostly in Newark, in East Orange, Irvington, Maplewood, Montclair, the majority of those 56 districts,” says Durkin.

 

Durkin says you can call it poll worker error. There will be an investigation as to why it happened. He asks New Jersey residents not to jump to conclusions as to why the 56 voting machines were shut down last night without being counted first.

 

β€œThose machines are at the polling places right now,” says Durkin. β€œThose machines have to be brought back to the warehouse and the judge will issue an order for us to open those machines, retrieve the results and post those results.”

 

But it doesn’t look like that will happen today.

 

β€œNo,” says Durkin. β€œWe need to compile a list of the results that are missing then need to schedule a hearing in front of a judge and then the judge issued the order and then were able to go and retrieve those results.”

 

Durkin says issues like this happen in every election in every county. The fact that it’s 56 voting machines in such a close race has obviously magnified this situation.

 

Meanwhile, five districts in Paterson are in a similar situation with their voting machines, according to Mayor Andre Seigh.

While all eyes were on Virginia last night, where Republican Glenn Youngkin pulled a massive upset, other elections were going on across the country. Candidates for local offices and state districts along with referendums on things like defunding the police occurred in places like Texas, Wisconsin, and Minnesota, and there’s a big upset in Texas that suggests doom is coming for Democrats in 2022.

 

That occurred in San Antonio where the race of HD118 took place. Republican John Lujan came out victorious in the majority-Hispanic district that Democrats carried by double-digits the last time around.

Here’s a report on the results from the San Antonio Report.

 

Republican John Lujan defeated Democrat Frank Ramirez in a special election runoff for Texas House District 118 on Tuesday, reclaiming the seat he held in 2016.

 

The business owner and former firefighter ended the night with 286 more votes than Ramirez, a first-time candidate. The runoff was expected to be a tight race. At the beginning of the evening, Ramirez held a narrow lead in early voting and absentee ballots. Lujan won 51.2% of the vote.

 

That’s a 15% shift toward the GOP since 2020. This was a district that Donald Trump lost in 2016 and appeared to be trending heavily blue like other areas around Austin and San Antonio. Yet, Lujan was able to turn the conventional wisdom on his head, carrying a majority of the Hispanic vote along the way.

 

Along with the recent Republican victories in the Rio Grande Valley, what this tells us is that assumptions about certain demographics favoring Democrats are outdated. For example, some are speculating that Youngkin won the Hispanic vote outright in Virginia last night. We are seeing a sea change on the issue of minorities voting for the GOP, not necessarily from black voters, but certainly from other sectors of the voting public.

 

I think the lesson here is two-fold. One, Republicans can demand action on illegal immigration and still do well with Hispanics. That counters the conventional wisdom of many establishment figures. On the other hand, Republicans who have reflexively assumed that a growing Hispanic population is somehow bad for the GOP are also wrong. At the end of the day, people are people and issues matter more than racial politics.

 

To wrap all this up, the results in Texas last night are just horrific news for Democrats going into next year’s election. Their entire schtick is one of identity and pushing divisions among minority groups, and they are simply doubling down on that effort. If anything close to a majority of Hispanic voters continue to reject that message, we aren’t just looking at a red wave next year but a red tsunami.

 

As for Republicans, they should continue to fight on issues that galvanize support. After many years of false hope, the Hispanic vote is there for the taking and it could solidify GOP majorities for years to come.

the difference is that i reduced the file size of the 'bad' image from over 3megs to less than 2megs. 8kun can supposedly handle up to 15megs of graphics (16 in fact) but that's for videos. When u try to post a large still image, there are problems. (Before image server change, the image simply wouldn't post - you got a file too big message (which you'll still get if the file is enormous). Now there's no message - just a distortion.

 

But i think there's more to the problem than that. if you haven't refreshed lately, you'll see that the first version i posted had the Camille Paglia image distorted - why, i dunno.
