Kanye West Brings Legal Challenge to Ballot Ban in Ohio

 

Rapper, fashion mogul, and independent contender in the 2020 presidential election Kanye West on Wednesday afternoon sued Ohio's secretary of state for rejecting his application to be listed on the state's ballot for the November election.

 

In a suit brought before the Ohio Supreme Court, West and running mate and pastor Michelle Tidball ask the court to compel the secretary of state's office to accept their petitions, overturning its decision to deny them based on a claimed discrepancy in signatures on two official campaign filings.

 

The Ohio filing is just the latest blow in the rapper-turned-candidate's struggle to appear on the ballot in November, when he is slated to be officially recognized in only a handful of states. Several more have, like Ohio, denied West ballot access.

 

A source with knowledge of the situation told the Washington Free Beacon that there are going to be "very aggressive legal efforts in Ohio and in states across the country to get Kanye on the ballot where he was qualified to do so. Attempts to keep Kanye off the ballot will be dealt with vigorously in court, without exception."

 

Earlier this month, West and Tidball filed the paperwork to the secretary of state's office to get on the Ohio ballot. At the time, the campaign submitted nearly 15,000 signatures, almost three times the state's minimum requirement.

 

But two weeks later, West's filing claims, Ohio director of elections Amanda Grandjean informed the campaign that the application had been denied, because the statement of candidacy they submitted to the secretary's office did not correspond to a copy of the statement associated with the nominating petition circulated by the campaign. In particular, Tidball's signature did not match on the two documents, "calling into question which is genuine," Grandjean wrote.

 

The same day Ohio secretary of state Frank LaRose announced West and Tidball's denial, he simultaneously announced that Green Party candidates Howie Hawkins and Angela Walker had been granted ballot access.

 

"A signature is the most basic form of authentication and an important, time-honored, security measure to ensure that a candidate aspires to be on the ballot and that a voter is being asked to sign a legitimate petition," LaRose said at the time. "There is no doubt that the West nominating petition and declaration of candidacy failed to meet the necessary threshold for certification."

Casting doubts on suggestions by President Trump and Attorney General William Barr, the U.S. intelligence community said it is not aware of any evidence that a foreign adversary is trying to undermine the mail-in voting process. Less than 70 days before Election Day, a senior official with the FBI and another senior official with the Office of the Director of National Intelligence, which oversees the intelligence community’s 17 agencies, said during an election threat briefing call that there is not currently any evidence of a mail-in voter fraud effort being carried out by any foreign adversary. However, the two agencies warned that the broader threat of foreign election interference remains ever-present. “We have no information or intelligence that any nation-state actor is engaging in any sort of activity to undermine any part of the mail-in votes or ballots,” the senior ODNI official said Wednesday when asked about the concern. Barr told New York Times Magazine on June 1 that “in terms of foreign influence, there are a number of foreign countries that could easily make counterfeit ballots, put names on them, send them in — and it’d be very hard to sort out what’s happening.” He followed up on that by telling Fox News on June 21 that “right now, a foreign country could print up tens of thousands of counterfeit ballots, and be very hard for us to detect which was the right and which was the wrong ballot. The differing ballots often use different designs and paper and generally employ bar codes or other tracking that would be difficult to recreate. It would also likely be a challenge for a foreign adversary to match the unique ballot to the proper person in a voter database, although Russian hackers have shown interest in probing voter files.

Rights experts condemn use of force against journalists covering US protests

 

Journalists covering ongoing protests denouncing systemic racism and police brutality in the United States must be able to do their job in peace, two experts on the right to freedom of expression said on Wednesday.

 

UN Special Rapporteur David Kaye, and his counterpart from the Organization of American States, Edison Lanza, condemned the use of force against journalists reporting on demonstrations that have rocked cities across the US over the past two weeks following the death of George Floyd, an unarmed African American man, by police in Minneapolis.

 

“We have received numerous reports of journalists attacked, harassed, arrested and detained in the course of their work covering protests in the United States against systemic racism and police brutality in the United States”, they said in a joint statement.

 

“Law enforcement has the duty to ensure the safety of journalists who are covering protests and to guarantee the right of the public to seek and receive information about these social mobilisations.”

‘Essential watchdog’ in democracies

 

The statement underlined the “essential watchdog role”, of the press in democratic societies, and the experts reminded US authorities that reporters must be afforded “the highest degree of protection” in order to perform their work freely.

 

“This obligation includes both the duty to avoid the use or threat of force against journalists and to protect journalists against third party violence,” they said.

 

“The targeting of media workers with lethal or less-lethal force for doing their work is prohibited under international human rights law and contrary to best policing standards. Those violating such rules must be subject to accountability and disciplinary processes.”

Leaders also have a role

 

Similarly, “public authorities should condemn attacks against journalists and promote the role played by the press”, the statement continued.

 

The experts have previously addressed what they described as US President Donald Trump’s “years-long attack” on the media, which has fostered a climate of hostility and intolerance.

 

Nearly two years ago, they expressed concern over the President referring to the media as the “enemy of the American people”, “very dishonest” or “fake news”, and accusing the press of “distorting democracy”, among other charges.

 

“We are deeply concerned that the militarisation of policing in the United States not only interferes with the right to peacefully assemble but also limits the ability of the press to cover protests”, the experts added.

 

“It encourages law enforcement to see protesters and journalists as belligerents, and we strongly encourage demilitarisation and a reliance on international standards for the management of protests”.

Right to freedom of expression

 

Mr. Kaye, an American, was appointed by the UN Human Rights Council in August 2014 to monitor protection of the right to freedom of expression across the world.

 

As a Special Rapporteur, he is neither a UN staff member, nor is he paid by the Organization.

“We are all shocked by the brutality of the murder of George Floyd. … It’s important to recognize that at the center of [this crisis] there is a serious question of racism,” he said. But the decision faced pushback among U.N. staffers and independent U.N. human rights advocates, who claimed the restrictions abridged the rights of individuals to free speech and peaceful assembly, which are enshrined in the U.N. A Jewish pediatrician who was convicted of possessing and distributing some 190,000 child pornography videos and images can serve as a medical supervisor at the Health Ministry’s student health services department, an Israeli court ruled last week:

 

"Avraham Barkai will be able to pay visits to schools but not treat children in his new position, which a panel of judges at the Nazareth Regional Labor Court determined that he should be allowed to fill, going against the recommendation of the Civil Service Commission.

 

Barkai was convicted in 2011 of being part of an international child pornography distribution ring and later sentenced to 18 months behind bars. However, the punishment was reduced on appeal to six months of community service, a nine-month suspended sentence and a NIS 20,000 ($5,690) fine.

 

For over a year up to his conviction, but after he had already been charged, Barkai continued to practice at a Haifa clinic of the Meuhedet HMO after a Health Ministry disciplinary committee ruled that he could continue to see children as long as a parent or nurse was in the room.

 

The disciplinary committee went on to rule that despite the charges, Barkai did not pose a danger to children as he had not been accused of physical acts against minors. As a result, it ruled that the pediatrician’s license should only be stripped for two years, and by July 2013 Barkai got his license back….

 

However, senior officials in the Health Ministry have come to Barkai’s defense. In 2014, the Health Ministry’s senior vice president of Administration and Human Resources, Dov Passat, submitted a letter to the disciplinary committee asserting that there should be nothing preventing Barkai from applying for tenders for positions as a pediatrician. The letter was submitted by Barkai as an official position of the Health Ministry to the Petah Tivka Magistrate’s Court, which ruled in 2018 that he be granted an exemption from the ban on employing convicted sex offenders as he does not pose a risk to the public, even if he works as a pediatrician.

 

In late 2018, a medical board voted unanimously to award Barkai a position as medical supervisor at the Health Ministry’s student health services department in the northern district. The Civil Service Commission subsequently interfered and blocked the appointment, stating in a 2019 hearing that “while the job at hand does not require clinical care for children, its core is oversight of student services and some of its assignments take place on school grounds and during the school day… Taking into account the nature of the offenses of which Dr. Barkai was convicted, [granting him this position] can greatly damage the image of the Civil Service Commission and the public’s confidence in its institutions.” "

My state also uses "exemption forms". In late 2018 I had an extensive (half hour or more) phone conversation with a state official in my state about my concerns about the situation with vaccine safety and exemptions. I asked that the state inform parents that medical exemption was available and I also wanted the state to look at vaccine safety. Not sure what happened by the state (or else our local school district) doubled down on making it hard to "get" exemptions. The form such as you showed demands parents admit they are in some fashion putting their child at risk, though the opposite is demonstrably true (flu shots increase the risk of other respiratory illness, including coronavirus, for example) and also allows the school to "segregate" (exclude) children by vaccine status also requiring the public sharing of what should be, imo, HIPPA protected information.

 

Parents should not lose legally and constitutionally protected freedoms via a state bureaucracy demand for a form.

Appeals court grants transgender student access to men's restroom, citing Gorsuch decision

 

A United States appeals court on Wednesday cited June's landmark Supreme Court decision on gay and transgender issues in a decision finding that a transgender male student was discriminated against by not being allowed to use the men's restroom. In a 2-1 decision, the Richmond, Virginia, court stated that Gavin Grimm, a student who sued a Virginia school board in 2015, was the victim of "a special kind of discrimination against a child that he will no doubt carry with him for life." Judge Henry Floyd wrote in the court's majority opinion that in light of the June Supreme Court decision Bostock v. Clayton County, which found that gay and transgender people are protected by nondiscrimination employment laws, the court had "little difficulty in holding that a bathroom policy precluding Grimm from using the boys restrooms discriminated against him." Floyd added that although Bostock "expressly" excluded a discussion of how bathroom cases should be decided, the basic principles of nondiscrimination were the same. The landmark Supreme Court case, Floyd said, deals with Title VII employment laws in the Civil Rights Act, and he said that Justice Neil Gorsuch's reasoning in the majority opinion, that rules regarding gender identity is discrimination "on the basis sex," could easily be used to interpret Title IX, which prevents sexual discrimination in schools. "Grimm was treated worse than students with whom he was similarly situated because he alone could not use the restroom corresponding with his gender," Floyd wrote. In a dissent, Judge Paul Niemeyer said that the decision ran contrary to commonly held biological definitions of sex. The American Civil Liberties Union, the legal nonprofit organization representing Grimm, celebrated the decision as an expansion and affirmation of Bostock, a case in which the ACLU was also involved. "Transgender students belong in our schools," senior staff attorney Josh Block said. "The court once again ruled that school’s obligation to create an environment that is safe and welcoming for all students includes transgender students." Grimm's case has been the subject of a long legal battle. It was set to be heard before the Supreme Court in 2017 but was sent back to lower courts after President Trump rescinded Obama-era requirements on transgender bathroom access. The state is partnering with PerkinElmer to build out a new laboratory in California and "full supply chain" for COVID-19 testing. He said the partnership will help drive down testing costs and improve turnaround time for results.

 

California is averaging about 100,000 tests per day. The state pays about $100 per test and turnaround time for results is roughly five to seven days.

 

With the state's contract PerkinElmer, the new cost breakdown would be:

 

40,000 tests: $47.99 each

100,000 tests: $37.78 each

150,000 tests: $30.78 each

The contract will initially cost the state $100 million, with a maximum amount of $1.4 billion, according to the Newsom administration. The goal is to begin processing tens of thousands of new tests by November and reach full capacity by March.

 

"This is exactly what the federal government should be doing," Newsom said. "And had the federal government done this some time ago, you wouldn't see average costs of tests at $150 to $200."

 

California has had a relationship with Massachusetts-based PerkinElmer for 30 years. The company conducts newborn screening for the state and operates other genetic testing programs.

From The Federalist, "No California Shouldn't Decriminalize Adult Sex With 14-Year-Olds":

 

LGBT activists have pushed reasonable notions of equality to its limits with obscene perversions. State Sen. Scott Wiener, D-San Francisco the same lawmaker who co-sponsored a bill in 2017 to remove the felony penalty for knowingly exposing another person to HIV has introduced a bill, Senate Bill 145 to give judges more flexibility in sentencing gay men who abuse minors.

 

Under current law which Wiener, who is gay, describes as "horrific homophobia" a straight 24-year-old male who has sex with a 15-year-old girl can avoid being put on the sex-offender list if the judge feels the situation does not deserve it, but a gay man in the same scenario with a similar-aged boy would not be given the same option.

 

Wiener's argument is one of evolving social standards. In 2015, the California Supreme Court upheld the long-standing separation of vaginal sex from other forms of sex-based on the misguided idea that if pregnancy occurred, placing the father on the sex-offender list could ruin his chances of providing for his family. The extreme of the scenario would be an 18-year-old man with a 17-year-old girlfriend.

 

Wiener's bill, however, is not so straightforward. He argues all forms of sex should be treated equally under the law.

 

The Law Will Protect Exploitation of Minors

 

Moreover, while there is room for flexibility in a ruling in which a boy turns 18 while his girlfriend is still 17 and her father presses charges, the bill defines the age minimum at 14. Recognizing that minors cannot legally consent to sex, Wiener argues that if a minor age 14 to 17 voluntarily has sex with an adult who is less than 10 years older, the judge should decide based on the individual facts of the case whether the adult should be placed on the sex-offender registry. Data provided by Wiener's office states, "[A]t least 2,400 people on the [CA] sex-offender registry, and potentially hundreds more, have been convicted of non-vaginal sex with a minor age 14 or older."

Not disagreeing with you but going on an experience, at the time I didn't know this existed, the individual I was taking care of had theirs look just like the image..unbeknownst to me, the wound should not have had all of that blood..during this stage, a visiting nurse came out everyday until the problems were resolved which was for a period of by memory 2 wks in the end to get to the point you are speaking of. The nursing team had to find different equipment to heal the wound. In all this individual was on a wound vac for at least 2 months.
