Self-Defense will defeat the intent necessary to commit intentional murder and attempt..

 

Recklessness charges will similarly be defeated, but likely be a triable issue.

 

The misdemeanor charge is not even applicable because it only applies short barrel rifles and shotguns and noncompliance with hunting licenses.

The outcome of Kyle Rittenhouse's trial will depend on the first shooting and what cirucmstances led up to it.

 

There is a significant possibility that, given the current political climate, he will catch convictions on the lesser charges, or plead down, and do a few months of time.

However, the idea that Rittenhouse didn't have just cause to to be there, the fact that he traveled across state lines, the fact that he was too young to be open carrying a firearm, etc…

none of these things would serve as significant justification for Rosenbaum (red shirt guy) to attack him, nor would Rosenbaum have known any of these facts in the first place.

 

In order to secure a 1st degree intentional homicide conviction, the court would have to PROVE that Rittenhouse:

1) Engaged in language and behavior that was provocative or threatening to Rosenbaum (just having a weapon slung is not significant)

AND

2) Did not immediately retreat if/when Rosenbaum began threatening or chasing him

AND

3) Did not fully exhaust all viable options in retreating

AND

4) Maliciously intended to kill or grievously injure Rosenbaum before fleeing

 

The court's judgement of the second shooting hinges entirely upon how the first is judged:

If Rittenhouse is determined to have acted maliciously or even in bad faith, then the crowd would have been justified in chasing him down and attempting to subdue him.

If not, then Rittenhouse was being pursued by an unruly mob and was in the right to defend himself as long as he reasonably perceived a credible threat of death or grievous bodily injury.

Some say that Countess Elizabeth BΓ‘thory, considered by many to be the world’s worst female serial killer, was the true inspiration for Bram Stoker’s Dracula. After all, legend has it that she bathed in the blood of at least 650 servant girls she had tortured and killed. She was said to be so evil that villagers kept their daughters in hiding for fear that Elizabeth would take them. Her gruesome activities even earned her such names as β€œthe Infamous Lady” and β€œthe Blood Countess.” This is her story.

ErzsΓ©bet BΓ‘thory, more commonly known in the Western world as Elizabeth, was born in 1560 to one of the most powerful Protestant families in Hungary at the time. She was the daughter of Baron George BΓ‘thory and Baroness Anna BΓ‘thory, who were both BΓ‘thorys by birth. Possibly stemming from inbreeding within her family, it is said that from an early age Elizabeth suffered from seizures, loss of control, and fits of rage. As a child, she witnessed the brutal punishments handed out by her family’s officers on their estates; one anecdote describes a gypsy accused of theft who was sewn up in the belly of a dying horse and left to die. Her family tree certainly included some disturbed kin as well. One of her uncles taught herSatanism, and she learned aboutsadomasochismfrom her aunt.

Elizabeth was married by the time she was 15 years old to Count Ferenc NΓ‘dasdy, a soldier who would go on to lead the armies of Hungary against Ottoman forces threatening Central Europe. After her marriage, the countess became the mistress of the NΓ‘dasdy estate, where the couple earned a reputation as harsh masters. Building upon her own cruelty, it is believed that Ferenc showed her some of his own ways of punishing his servants. After 10 years, Elizabeth gave birth to 3 daughters and a son.

Although the count participated in his wife’s torture activities, it wasn’t until the death of her husband in the early 1600s that Elizabeth’s true evil came to fruition. She eventually moved to one of her castles at Čachtice in northwest Hungary (now Slovakia) and began surrounding herself with a cohort of servants to help her with her torture practices. Legend has it that one day an attendant girl was brushing Elizabeth’s hair when she accidentally pulled too hard and it tugged on a snag in her hair. The countess erupted in anger, jumping up and striking the girl with the back of her hand. The strike was so hard that it made the girl bleed and some of that blood was left on Elizabeth’s hand. Later that night, Elizabeth noticed that the skin on her hand where the blood had been looked more youthful than she had seen it in many years. This gave her the idea that if such a small amount of blood could make her hand look so young, then more could restore youthfulness to her whole body. It’s said that this is when the madness began andElizabeth started to bathe in the blood of virgin girls.

Young women began to disappear from villages near and far, as well as children. Unhappy girls were lured to the castle with the prospect that they would find work there but were never seen again. During a night raid, officials searched the castle and discovered the dead bodies of young girls everywhere they looked. Some were missing arms and eyes. One body was in the fireplace, not yet fully burned. Elizabeth was taken to trial and many testified against her, including her servants as well as survivors. One of the servants said that girls were tied up and beaten to death until their whole body was black as charcoal and their skin battered and torn. One girl suffered from 200 blows before dying. Another servant admitted that she had taken red-hot fire pokers and shoved them into the mouth of one girl. She said she placed her fingers in the mouth of another and pulled until the sides split open.

Finally, after hearing countless testimonies of the appalling activities that went on behind the castle’s walls, Elizabeth and her servants were convicted on 80 counts of murder, although evidence showed that as many as 650 females may have been killed in total. Her servants were sentenced to death, but Elizabeth was imprisoned for life in a room in her own castle that was boarded up with tiny slits for food and air. Elizabeth lived for 3 and a half years before she was found dead lying face down on the floor. After her death, Countess Elizabeth BΓ‘thory went down in history asone ofthe most evil women to ever have walked the planet.

Philippines warns Beijing it will enlist US help if China attacks

 

A violent encounter between China and the Philippines would trigger a confrontation with the United States, according to an unusual warning from Philippine President Rodrigo Duterte’s administration. ESPN host Max Kellerman suggested Thursday that Southeastern Conference football fans are dumb and incapable of discernment, declaring on his show, "First Take," that they seem "easy to propagandize and almost immune to facts."

 

During a discussion with co-host Stephen A. Smith over sports players taking a stand against racial injustices through protest, Kellerman took a turn to discuss the general election and his view of southerners.

 

Kellerman said:

 

Stephen A., you made the argument a couple weeks ago that you thought that if SEC football wasn't played, that could swing the general election because people in the baseβ€”in Trump's baseβ€”would be very upset that they didn't have football which is practically a religion down there.

 

And I disagreed because [Trump] would simply shift blame, and you know because the pandemic is raging and they seem to be very low, susceptible to very low quality information and easy to propagandize and almost immune to facts.

 

Because as Kellyanne Conway, adviser to Trump, said, you know, she may have alternative facts. And if they stand their kind of propaganda silos, like the Fox News propaganda silo, it wouldn't matter what happened because they would say 'Oh no, the handling of the pandemic has been great.'

Reactions to Kellerman's comments were mixed on social media, with many people praising him for his branding of the folks who live in the southeast as ignorant. Another wrote, "You sir are one of the reasons ESPN is losing so many viewers… You and [the] network have destroyed professional sports in the USA."

 

The Daily Caller's David Hookstead even penned an op-ed over Kellerman's insults, calling them " an absolutely pathetic and disgraceful thing to say."

 

"What the hell did we all just watch?" he wrote. "I understand that it might be hard for Max Kellerman to understand from his ivory tower and big salary, but people in SEC country aren't stupid."

Army Paratrooper Shot in the Foot During Live-Fire Exercise at Fort Bragg

 

A paratrooper in the 82nd Airborne Division at Fort Bragg, North Carolina was wounded in the left foot today during a live-fire exercise, and is now recovering at the base hospital.

 

Army officials from Bragg would not identify the 1st Brigade Combat Team soldier, but said he suffered non life-threatening injuries, according to a news release from the 82nd Airborne.

 

The incident occurred while soldiers were moving through a shoot-house, clearing rooms and firing live ammunition, according to a Fort Bragg official.

 

"Someone engaged a target and a bullet ricocheted and it basically struck the soldier in the foot," the official said.

 

Army officials did not say what weapon was involved in the incident.

 

The soldier was taken to Womack Army Medical Center on base, where he remains and is recovering from the injury, the official said.

 

The incident is currently under investigation, according to the release.

 

"We take the safety and well-being of our paratroopers very seriously and will ensure both the recovery of this paratrooper and the investigation of the incident are handled with the utmost care," Col. Andrew Saslav, 1 BCT commander, said in the release.

Twitter took down two fake accounts that were spreading information about black voters abandoning the Democratic Party amid months of unrest. The removed accounts were perceived to have been run by black voters, with tweets that often went viral. One of the accounts, @WentDemToRep, got 11,000 retweets on a tweet that said they were a lifelong Democrat who was pushed to vote Republican by the Black Lives Matter movement, according to NBC News. The U.S. Department of Justice wants Michigan Gov. Gretchen Whitmer and three other states governed by Democrats to turn over data related to nursing homes and COVID-19 deaths.

 

The governor agreed to provide the data, but blasted the request, labeling it a partisan stump aimed at helping President Donald Trump's re-election bid.

 

In a news release Wednesday, the department said the requests were sent to states "that issued orders which may have resulted in the deaths of thousands of elderly nursing home residents."

 

Whitmer defended her actions, arguing the letter relies more on politics than health policy.

 

"The fact that this letter was sent during the middle of the Republican National Convention week to four Democratic governors should make it crystal clear that this is nothing more than election year politics by an administration that is more concerned with the president's re-election campaign than protecting Michigan seniors," Whitmer said in a statement late Wednesday.

 

"We will review this letter and respond as appropriate. However, Americans would all be better served if the Trump administration stopped the partisan games and focused on delivering a real plan to defeat COVID-19."

Nursing homes and other long-term care facilities in Michigan and throughout the country have been particularly hard hit by COVID-19, the disease caused by the coronavirus. As of Tuesday, the state reported 8,146 residents infected with coronavirus and 2,083 who died of COVID-19. There also have been 4,301 confirmed cases among staff, with 21 staff members dying because of COVID-19.

 

But the DOJ news release goes a step further, accusing Michigan and the other states of requiring nursing homes to accept patients who have COVID-19. An executive order from Whitmer allowed for people infected with the coronavirus to be transferred and isolated at nursing homes that also house people who are not infected. There is no direct evidence the policy led to illness or death, as reported by the Associated Press in June.

Amazon's New Fitness Tracker Sounds Like a Body-Shaming, Tone-Policing Disaster

There are bad ideas, and then there is Amazon’s attempt to get into the health tracker market with a new health subscription service and accompanying tracker, Amazon Halo and Amazon Halo Band.

 

The pitch here is that Halo Band is a more holistic health tracker. In its press release announcing the device and service, Amazon says that the Halo Band is β€œpurpose-built to focus on your health and wellnessβ€”unlike smartwatches and fitness trackers, it doesn’t have a screen or constant notifications.” In that sense, it’s like the Whoop trackerβ€”and frankly, it looks a whole lot like it too. The sensor array itself contains an accelerometer, temperature sensor, heart rate monitor, two microphones, LED indicator light, and a button you can use to turn microphones on or off. Amazon claims the Halo Band will last about a week on a charge. There’s also a companion app that measures things like activity and sleep, and like Fitbit, offers β€œLabs” for experimental apps with partners. Oh, and also the ability to scan your body fat percentage using your phone, as well as analyze the tone you’re speaking in.

 

When this news broke, I had to blink at my screen a few times because I could not believe this launch was real after the Amazon Echo Look went to the big tech graveyard in the sky earlier this year. But no, this is a $65 device and $4 monthly subscription platform that encourages you to scan a 3D image of yourself in your undies with your phone so it can create a render of your body. Some β€œnew innovations in computer vision and machine learning” then allow Amazon Halo to calculate your body fat percentage. Per the Verge, once the calculating is done, β€œthe app will give you a little slider you can drag your finger on to have it show what you would look like with more or less body fat.”

 

There are obvious concerns right off the bat with body dysmorphia and eating disorders. In an article describing the body scan feature, Amazon states it doesn’t recommend people to scan their bodies more than once every two weeks, as it takes a long time to reduce body fat. In an email, a spokesperson also told Gizmodo that there is β€œeducation throughout the feature in the app that helps customers understand the context of their body fat percentage range, what body fat percentage means and more.” They also said that the slider tool would not β€œgo below the healthy body fat percentage for the customer’s sex and age.” Amazon also told the Verge that the feature would only be accessible for people 18 or older.

 

It’s nice that Amazon has put safeguards in place, but body dysmorphia and eating disorders are not rational. Being 18 years old or older does not mean you’re less likely to develop body image issues or bulimia. Being educated about your health on multiple levels, knowing what is the healthy thing to doβ€”that doesn’t stop a person from engaging in unhealthy eating behaviors. A recommendation to only measure yourself once every two weeks doesn’t deter someone from obsessively tracking their data and re-scanning their body, or hyper-obsessively fixating on what a β€œthinner” version of themselves would look like. Body dysmorphic disorder affects somewhere between 5 to 10 million people in the U.S., and this NIH study says it’s not only relatively common but likely underreported. The National Association of Anorexia Nervosa and Associated Disorders also states that at least 30 million people of all ages and genders currently suffers from an eating disorder in the U.S. Even with safeguards, you’re putting a potentially dangerous and affordable tool in the hands of millions of vulnerable people…….

LANSING – The U.S. Department of Justice announced Wednesday it is seeking data from Michigan Gov. Gretchen Whitmer and three other Democratic governors who "issued orders which may have resulted in the deaths of thousands of elderly nursing home residents."

Much of the data is already publicly available, but the department is evaluating whether to investigate Michigan nursing homes for possible violations of a federal law protecting the rights of "institutionalized persons," Assistant Attorney General Eric Dreiband told Whitmer in a letter.

At least 2,083 nursing home residents have died from COVID-19 in Michigan, accounting for nearly 1 in 3 deaths attributed to the novel coronavirus here since March.
