Operators of 7-Eleven stores have paid back more than $176 million to staff and made more than $10 million worth of improvements five years after an investigation began into wage theft at the company.

An inquiry by the Fair Work Ombudsman (FWO), which launched after media reports revealed the extent of underpayments made by franchisees, found several store owners had deliberately falsified records to disguise wage underpayments.

 

Between September 2015 and February 2020, 7-Eleven back-paid more than $176.3 million in wages, interest and superannuation to 4,043 current and former franchisee employees.

 

The FWO said 7-Eleven voluntarily entered into a Compliance Deed in December 2016 to improve compliance across its network.

 

The deed was a recommendation from the ombudsman's inquiry into the stores, which found significant underpayments to 7-Eleven staff.

 

The ombudsman's inquiry found several 7-Eleven franchisees had deliberately falsified records to disguise wage underpayments and that 7-Eleven's approach to workplace matters did not detect or address deliberate non-compliance.

 

The FWO brought 11 lawsuits against 7-Eleven franchisees resulting in courts awarding more than $1.8 million in penalties against them.

 

The penalties included franchisees operating unlawful cash-back schemes, paying unlawful flat rates to workers, and falsifying records.

JPMorgan Chase & Co and Goldman Sachs Group Inc will halt software updates to its retail and investment banking systems that customers use to manage accounts, around the Nov. 3 U.S. presidential election, the banks said on Thursday.

 

The Information had reported earlier on Thursday about the banks’ move. “We plan and implement code freezes periodically throughout the year to coincide with times of increased market activity,” Patrick Lenihan, a Goldman Sachs spokesperson said, adding that a code freeze is instituted around every election.

 

Meanwhile, a JPMorgan spokesperson confirmed the report by The Information, but did not elaborate further. The digital media firm’s report also said the move was a preventive measure intended to minimize the risk of outages of their services during a period of potential market volatility surrounding the election.

 

JPMorgan’s technology leadership team had recently told its technology staff that it will halt all software code changes for critical banking systems between Nov. 1 and Nov. 8, the report said. Those systems include Chase.com retail banking as well as trading, treasury, asset management and other services.

ICE assists in seizure of $248 million worth of cocaine hidden in banana pulp

 

Arrest, seizure of 117 kg of meth concealed in boxes of PPE on same weekend

 

SYNDEY – U.S. Immigration and Customs Enforcement (ICE) Homeland Security Investigations (HSI) Canberra provided the Australian Border Force (ABF) with information that resulted in the seizure of 552 kilograms of cocaine worth an estimated $248 million. The operation leading to the seizure began in September 2020 following information from HSI on a suspected shipment containing drugs destined for Australia.

 

HSI Canberra provided Australian authorities with details on the possibility of narcotics smuggled into Australia concealed as bananas from Brazil. The container was identified and inspected by the ABF on Sept. 21 and held for further investigation by the Australian Federal Police (AFP). ABF officers identified anomalies within the approximately 275 boxes in the shipment that contained banana pulp, and upon closer examination, ultimately discovered cocaine hidden within the banana pulp bags.

“This joint investigation demonstrates the importance of strong international partnerships when it comes to dismantling transnational criminal organizations,” said ICE Canberra Attaché Adam Parks. “By working together, we were able to swiftly gather crucial information on the smuggling of cocaine through a shipment of fruit to Australia. I commend HSI Brazil and our Australian partners their professionalism, devotion and unrelenting efforts on targeting organizations and individuals involved in these major transnational crimes.”

 

In the two weeks following the detection, HSI Canberra, the AFP, the ABF, and the New South Wales Police Force monitored the narcotics and conducted additional investigative steps in furtherance of the case. The joint investigation led to the execution of search warrants Oct. 16, when officers seized mobile phones, a laptop, a case of green stones suspected to be emeralds, and five one-kilogram silver ingots. The investigation also resulted in the arrest of a 68-year-old man from north Sydney.

 

The investigation leading to these enforcement actions was worked jointly between HSI, the AFP, and the ABF, with support from HSI Brasilia and the National Targeting Center – Investigations.

 

On Oct. 17, AFP also arrested a 43-year-old Carlingford woman for her alleged involvement in the importation of approximately 117 kilograms of methamphetamine hidden in a shipment of latex gloves. The information leading to this arrest was developed in July 2020, when HSI special agents and Border Enforcement Security Task Force officers in Los Angeles inspected a shipping container of latex gloves and concrete besser blocks bound for Sydney. During the search, agents and officers identified 12 cardboard boxes with 47 individually wrapped clear plastic bags of a crystalline substance that was determined to be 117 kilograms of methamphetamine. The methamphetamine was seized in the United States by HSI Los Angeles. The shipment continued its scheduled route to Sydney, where Australian authorities awaited its arrival, and subsequently launched the operation leading to the arrest. This was an HSI-led investigation with assistance from U.S. Customs and Border Protection and AFP.

 

The HSI International Operations Division is the Department of Homeland Security’s largest investigative presence overseas. Division personnel serve as liaisons to governments and law enforcement agencies across the globe and work side-by-side with foreign law enforcement on HSI investigations. HSI is the principal investigative arm of DHS and a vital U.S. asset in combatting

On October 29, the Ministry of Defense of Azerbaijan released videos of recent drone and rocket strikes on Armenian forces in the disputed region of Nagorno-Karabakh.

 

The strikes seen in the videos targeted more than 27 posts and gatherings of Armenian troops as well as the following equipment:

California Democrat touts a Republican’s support in ad. The man is registered Democrat

 

A recent advertisement by Democratic Rep. TJ Cox includes a man who says he’s a Republican supporting Cox in next week’s election. But the man is a registered Democrat, according to public records.

 

The man, identified in the advertisement as “Manny” from Laton, is Manuel Lopez. He has been a registered Democrat since at least November 2019, according to records with Political Data Inc.

 

Lopez has registered as a Republican in the past, according to records from the firm.

 

Lopez in a phone call confirmed he was the one who appeared in the Cox ad. He ended the conversation when asked about his Democratic voter registration.

 

Cox, D-Fresno, is defending his seat against former Rep. David Valadao, a Republican from Hanford. Cox narrowly defeated Valadao in 2018, and the district has been flooded with advertisements and millions of dollars in spending both by of the campaigns and outside political groups.

 

The advertisement, called “For Us,” highlights Cox’s work for farmers and on San Joaquin Valley water challenges. It aired on TV and online starting last week in the Fresno market.

 

The ad has two other people introduce themselves, one man who identifies himself as a farmer and a woman who says she’s from Hanford, before Lopez introduces himself as a Republican.

 

“We’re sick of politics as usual,” the three say in voiceovers. “But TJ Cox is different.”

 

Cox’s campaign declined to comment on the ad. Instead, the campaign passed along a statement from Lopez.

 

“I’m a lifelong Republican,” Lopez said, according to the Cox campaign.

 

The Cox campaign plans to leave the advertisement up, a spokesman said.

 

The rest of the ad touts Cox’s record with water and helping people impacted by the coronavirus pandemic.

 

“Water is a big problem here, so TJ went to bat for us, got our fair share of water projects for the Central Valley to help farmers and TJ helped workers hurt by the Coronavirus,” the three people continue in voiceovers, transitioning between each of them. “TJ’s for me, and me, and all of us.”

 

While Cox has secured funding for water projects in appropriations bills, much of his efforts to pass additional measures for clean drinking water, canal repairs and other infrastructure repairs related to water in the Valley have not become law.

 

Cox voted for some coronavirus stimulus packages, helping businesses pay workers. The major one, known as the CARES Act, passed in March and delivered $1,200 stimulus payments to most Americans and increased unemployment insurance. But subsequent attempts by both the House and Senate to provide additional help and payments for the past seven months have failed to become law.

Today, the Department of Justice announced a global resolution of its criminal and civil investigations into the opioid manufacturer Purdue Pharma LP (Purdue), and a civil resolution of its civil investigation into individual shareholders from the Sackler family. The resolutions with Purdue are subject to the approval of the bankruptcy court.

 

“The abuse and diversion of prescription opioids has contributed to a national tragedy of addiction and deaths, in addition to those caused by illicit street opioids,” said Deputy Attorney General Jeffrey A. Rosen. “With criminal guilty pleas, a federal settlement of more than $8 billion, and the dissolution of a company and repurposing its assets entirely for the public’s benefit, the resolution in today’s announcement re-affirms that the Department of Justice will not relent in its multi-pronged efforts to combat the opioids crisis.”

 

“Today’s resolution is the result of years of hard work by the FBI and its partners to combat the opioid crisis in the U.S.,” said Steven M. Lansing — Michigan restaurants will have to begin tracking the names and numbers of customers in case of COVID-19 outbreaks starting Monday under a policy announced Thursday as the state experiences surges in cases of the virus.

 

The Michigan Department of Health and Human Services unveiled orders that limit non-residential indoor gatherings without fixed seating to 50 people — the limit was 500 — and restrict individual table sizes at restaurants to six people.

 

The health department's order on Thursday came on a day when Michigan set a daily case record at 3,675, along with 41 more deaths. That's the most new confirmed cases in a single day during the seven-month pandemic for the state.

 

The coronavirus trends in Michigan are "incredibly concerning," said Dr. Joneigh Khaldun, the state's chief medical executive. As of Wednesday, the state reported 1,348 adults with COVID-19 in hospitals, three times the 405 adults with COVID-19 in hospitals one month ago.

 

"We are taking targeted actions via the order to address areas that are particularly severe sources of spread, and we are issuing guidance that is a very clear road map for what we need to do bring cases down," said Robert Gordon, the director of the Department of Health and Human Services.

Only 1 Seattle Public Schools student is receiving special-education services in person right now

 

Within Seattle Public Schools, only one student with disabilities is currently receiving services in person. Next week, that number will increase to two.

 

District officials say there are a few reasons why it’s taking a long time to get in-person services delivered to students while the school year proceeds online for most kids. A major reason for the delay: The district chose to set up services at students’ home schools — as opposed to at districtwide hubs — which meant making sure 104 school sites were safe for adult work, said Concie Pedroza, chief of student supports.

 

Other districts are using different models to get students what they need in person. In Bellevue, which this September enrolled fewer than half of Seattle’s 52,481 students, 150 students were receiving services in person as of Thursday, according to spokesperson Michael May. There, the district is concentrating services at four school sites — not all of which are students’ home schools.

 

In Lake Washington, 475 students with disabilities were getting assistance in person as of Thursday, said spokesperson Shannon Parthemer. Educators recommended in-person services for 580 students; 105 families declined them. Lake Washington provides these services across 34 school sites.

 

Focusing on home schools was “the most important thing,” Pedroza, the Seattle schools official, said in a briefing with journalists Thursday.

 

Late last week, Seattle announced that remote learning would continue at least through January — making any moves at improving its online-era work all the more long-lasting. Sixty-five students are “already in queue” to receive these services, Pedroza said; eight students have successfully gone through the health and safety review the district requires of staff and families before it firms up its decisions.

 

Many parents of students with disabilities have said that remote learning has been particularly tough on their kids. Students with ADHD, for example, have a harder time focusing on screens for longer, especially without the support they’d get in school. Under federal law, students with disabilities have a specific right to a “free appropriate public education.”

 

To determine what that is, school staff and families set individualized goals and mandate the type of services students need to get there, such as speech or occupational therapy. Already, Washington families have turned to courts, claiming that those needs have not been met amid the coronavirus pandemic.

 

One critic of that policy said she did not understand why the district thought it mattered to focus on offering services at a student’s home school.

 

“I really worry about what’s going on with kids at home — I just cannot imagine that’s the least restrictive environment for them,” said Robin Lake, director of the Center on Reinventing Public Education. “What matters is the student receiving appropriate services and hopefully from the teacher that they know. That can happen anywhere.”

 

Similarly, Janis White, president of the Seattle PTSA, an organization that supports the parents of children with disabilities, said she felt “incredible dismay that we are eight weeks into the school year, and there are many students with disabilities who we’ve known since the spring could not engage in online learning and would need in-person services in order to make progress.”

 

Seattle’s school-reopening plan, approved in August, prioritized getting some students with disabilities back into school buildings even as the rest of students continued to learn online. The August version of the plan stated that special-education services offered in person would occur in two buildings in each of the city’s regions.

 

According to the district’s website, members of students’ individualized learning teams were set to meet remotely to determine whether in-person services were necessary. Once the team determines a student needs in-person help, students will receive transportation to get them to their home school sites “in compliance with health guidelines.”

French President Emmanuel Macron called the Nice attacker an “Islamist terrorist,” and deployed troops to guard churches and schools. Macron’s army deployment may reassure the public in the short term, but Philipps said that it’s “pretty much impossible” to screen out potential future attackers, and harder again to deport or detain them, as in his experience in the UK, many suspects were British citizens.

 

“We’ve got 20 or 30 thousand people of concern in the UK. France probably has far more than that,” he explained. "If you go to Nice there’s a massive North African contingent there.”

 

French media outlets have reported that the Nice attacker – who was shot and arrested by police – was a 21-year-old Tunisian migrant. Four years earlier, a Tunisian was behind the wheel of a 19-ton truck that plowed through crowds of people on the city’s iconic waterfront, killing 84 and injuring more than 400. France’s population is nearly nine percent Muslim, the highest percentage in any Western country. Of these 5.7 million Muslims, the percentage who harbor extreme views is unknown, but in 2016, three quarters of all suspected radicals on a government watch list were radical Islamists.

 

Philipps said that in his experience, he was surprised how many moderate Muslims see cartoons of the Prophet Mohammed as “extremely offensive” and understand “the idea of taking revenge.”

 

The core of the problem, he said, is the incompatibility of Islam with the liberal West. “When the cultures clash so much, and it leads to this kind of violence,” he said, governments need to “make some decisions” regarding the future of multiculturalism and open society.

Businesses connected to California Democratic representative Harley Rouda were subject to nearly $230,000 in local, state, and federal tax liens, documents reviewed by the Washington Free Beacon show.

 

Rouda spent decades as a real estate executive prior to his successful congressional bid in 2018. The Democrat owned stakes in a multitude of companies in the industry through his investment firm, Trident Holdings, which he registered in 2001 under the name Real Living, Inc. In November 2011, the company received a Franklin County, Ohio, lien notice showing more than $117,000 in unpaid taxes from 2009 to 2011. Rouda served as the company's "Chief Executive Officer and Managing Partner" at the time, according to a 2009 Securities and Exchange Commission filing.

 

Rouda's firm was also subject to a roughly $52,000 federal tax lien between the 2012 and 2015 tax years. The Democrat remained the company's CEO at the time, having served in the role "since February 2002," according to a since-deleted 2018 Bloomberg executive profile. State filings show that Rouda was not removed as the firm's registered agent until August 2020—in total, businesses connected to Rouda faced 33 liens totaling $228,835.34 from 2003 to 2020.

MIAMI — Democrats are sounding the alarm about weak voter turnout rates in Florida’s biggest county, Miami-Dade, where a strong Republican showing is endangering Joe Biden’s chances in the nation’s biggest swing state.

 

No Democrat can win Florida without a huge turnout and big winning margins here to offset losses elsewhere in the state. But Democrats are turning out at lower rates than Republicans and at lower rates than at this point in 2016, when Hillary Clinton won by 29 percentage points here and still lost the state to Donald Trump.

 

One particular area of concern is the relative share of ballots cast by young voters of color and less-reliable Democratic voters. Part of the problem, according to interviews with a dozen Democratic elected officials and operatives, is the Biden campaign‘s decision to discourage field staff from knocking on doors during the pandemic and its subsequent delay in greenlighting — and funding — a return to door-to-door canvassing.

 

“We did not get the kind of funding for different vendors who would do that type of work until late in the campaign,” said Rep. Frederica Wilson, a party institution who represents Miami’s heavily Black congressional district.

 

Wilson said the good news is that Biden’s running mate, California Sen. Kamala Harris, is working with her on a turnout event for this weekend geared toward young Black men. But the veteran congresswoman said there are still skilled operatives in her district who excel at turnout work who have yet to get approved by the campaign, a puzzling delay for an operation that raised a record $363 million the month before.

Judicial Watch Sues for Unmasking Records: Biden, Top Obama Officials ‘Unmasked’ General Flynn

 

(Washington, DC) Judicial Watch announced today that it filed a Freedom of Information Act (FOIA) lawsuit against the National Security Agency (NSA) for records of requests by former Vice President Joe Biden and other top Obama administration officials, including President Obama’s chief of staff, to “unmask” Lieutenant General (Retired) Michael Flynn (Judicial Watch v. National Security Agency (No. 1:20-cv-03088)). The term “unmasking” refers to the practice of disclosing to political appointees the identities of U.S. citizens referenced in intelligence surveillance of foreign nationals. U.S. citizens’ names are typically redacted from such reports unless a specific request is made to “unmask” them.

 

Judicial Watch filed this lawsuit after the NSA failed to respond to two separate September 1, 2020 FOIA requests.

 

The first request seeks “records about a January 12, 2017, request to ‘unmask’ Lieutenant General Flynn submitted to NSA by or on behalf of then-Vice President Joe Biden.”

 

The second request asks for “records about requests to ‘unmask’ Lieutenant General Flynn submitted to NSA by or on behalf of the following officials on the dates or date ranges indicated:

On May 19, Senator Grassley responded and asked for “the declassification of additional information related to the unmasking of Americans around the time of the 2016 election, but also to expand the scope of our request to include information as early as January 2016. Based on our investigation and recent press reports, we are increasingly concerned that the surveillance of U.S. persons affiliated with the Trump campaign began earlier than the opening of the FBI’s Crossfire Hurricane investigation in late July 2016.”

 

“The requests by Joe Biden and President Obama’s chief of staff to unmask the identity of President Trump’s top national security adviser reek of corruption and abuse,” said Judicial Watch President Tom Fitton. “The documents about this illicit spy operation should be released immediately.”
