Wife of Maryland Nuclear Engineer Pleads Guilty to Espionage-Related Offense

 

A Maryland woman pleaded guilty today to conspiracy to communicate Restricted Data related to the design of nuclear-powered warships. Her husband pleaded guilty to the same offense on Monday, Feb. 14.

 

Diana Toebbe, 46, of Annapolis, was arrested on Oct. 9, 2021, for knowingly and voluntarily joining a conspiracy with her husband, Jonathan Toebbe, to communicate Restricted Data to a foreign nation. During the course of the conspiracy, Diana Toebbe served as a lookout while her husband serviced three “dead-drops.”

 

According to court documents, at the time of his arrest, Jonathan Toebbe was an employee of the Department of the Navy who served as a nuclear engineer and was assigned to the Naval Nuclear Propulsion Program, also known as Naval Reactors. He held an active national security clearance through the Department of Defense, giving him access to “Restricted Data” within the meaning of the Atomic Energy Act. Restricted Data concerns design, manufacture or utilization of atomic weapons, or production of Special Nuclear Material (SNM), or use of SNM in the production of energy – such as naval reactors. Jonathan Toebbe worked with and had access to information concerning naval nuclear propulsion including information related to military sensitive design elements, operating parameters and performance characteristics of the reactors for nuclear powered warships.

 

According to court documents, Jonathan Toebbe sent a package to a foreign government, listing a return address in Pittsburgh, Pennsylvania, containing a sample of Restricted Data and instructions for establishing a covert relationship to purchase additional Restricted Data. Jonathan Toebbe began corresponding via encrypted email with an individual whom he believed to be a representative of the foreign government. The individual was really an undercover FBI agent. Jonathan Toebbe continued this correspondence for several months, which led to an agreement to sell Restricted Data in exchange for thousands of dollars in cryptocurrency.

 

On June 8, 2021, the undercover agent sent $10,000 in cryptocurrency to Jonathan Toebbe as “good faith” payment. Shortly afterwards, on June 26, Dianna Toebbe acted as a lookout while Jonathan Toebbe serviced a dead drop by placing an SD card, which was concealed within half a peanut butter sandwich and contained military sensitive design elements relating to submarine nuclear reactors, at a pre-arranged location. After retrieving the SD card, the undercover agent sent Jonathan Toebbe a $20,000 cryptocurrency payment. In return, Jonathan Toebbe emailed the undercover agent a decryption key for the SD Card. A review of the SD card revealed that it contained Restricted Data related to submarine nuclear reactors. On Aug. 28, Jonathan Toebbe made another “dead drop” of an SD card in eastern Virginia, this time concealing the card in a chewing gum package. After making a payment to Jonathan Toebbe of $70,000 in cryptocurrency, the FBI received a decryption key for the card. It, too, contained Restricted Data related to submarine nuclear reactors. The FBI arrested Diana Toebbe and her husband on Oct. 9, after she acted as a lookout while Jonathan Toebbe placed yet another SD card at a pre-arranged “dead drop” at a second location in West Virginia.

 

Diana Toebbe pleaded guilty to count one of the indictment charging her with conspiracy to communicate Restricted Data which carries a maximum statutory penalty of up to life in prison, a fine up to $100,000, and term of supervised release not more than five years. Pursuant to her plea agreement, Diana Toebbe will serve a sentence of not more than 36 months of imprisonment in federal prison. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

 

The FBI and the Naval Criminal Investigative Service are investigating the case.

 

Trial Attorneys Matthew J. McKenzie and S. Derek Shugert of the National Security Division's Counterintelligence and Export Control Section, Assistant U.S. Attorneys Jarod J. Douglas and Lara Omps-Botteicher of the Northern District of West Virginia and Special Assistant U.S. Attorney Jessica Lieber Smolar for the Western District of Pennsylvania are prosecuting the case.

Massachusetts Man Arrested on Charges For Assault on Law Enforcement During Jan. 6 Capitol Breach

Defendant Accused of Using Police Shield to Ram Into Officers

 

WASHINGTON — A Massachusetts man was arrested today for assaulting law enforcement during the breach of the U.S. Capitol on Jan. 6, 2021, which disrupted a joint session of the U.S. Congress that was in the process of ascertaining and counting the electoral votes related to the presidential election.

 

Vincent J. Gillespie, 60, of Athol, Massachusetts, is charged in a criminal complaint filed in the District of Columbia with assaulting, resisting, or impeding officers, civil disorder, engaging in physical violence in a restricted building or grounds, and related offenses. He was arrested in Athol, Massachusetts, and will make his initial appearance today in the District of Massachusetts.

 

According to court documents, on Jan. 6, from at least 4:11 p.m. to at least 4:25 p.m., Gillespie was among rioters in the Lower West Terrance of the Capitol who engaged in pushing, shoving, yelling, and fighting with law enforcement officers. He struggled his way through the crowd, eventually maneuvering through the rioters to the line of police officers defending the Lower West Terrace’s exterior door. At one point, he gained control of a police shield as he approached the officers. Gillespie used the shield to ram the law enforcement officers, continuing to scream “traitor” and “treason” at the police. He also grabbed a law enforcement officer by the arm and attempted to pull him into the crowd.

 

This case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney’s Office for the District of Massachusetts.

 

The case is being investigated by the FBI Boston Division’s Western Massachusetts Joint Terrorism Task Force and the FBI’s Washington Field Office. Valuable assistance was provided by the Athol, Massachusetts Police Department. Gillespie was identified as #141 on the FBI Washington Field Office’s seeking information photos.

 

In the 13 months since Jan. 6, more than 750 individuals have been arrested in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including over 235 individuals charged with assaulting or impeding law enforcement. The investigation remains ongoing.

The AESC includes, in addition to the Executive Director, the Directors of OSTP, CEQ, DPC, and NSC; the deputy secretaries of the Departments of State, Defense, Justice, the Interior, Agriculture, Commerce, Labor, Health and Human Services, Transportation, Energy, and Homeland Security; equivalent officers from the Office of the Director of National Intelligence, EPA, NASA, NSF, and the Arctic Research Commission; and the Assistant to the President for Public Engagement and Intergovernmental Affairs. I serve as the Chair of the Committee in my capacity as Director of OSTP, and the Vice Chair is Deputy Homeland Security Advisor Amy Pope.

Police On Horseback Trample ‘Freedom Convoy’ Protesters In Canada

 

On horseback in downtown Ottawa Friday, Canadian law enforcement was recorded forcing their way through a crowd of protesters as part of the government’s response to ending the 22-day protest against Canada’s Covid-19 restrictions.

 

Protesters fled as police riding horses pushed over several members of the ‘Freedom Convoy’ as part of a crowd-dispersal unit, according to The New York Times. The captured video appears to show the mounted officers knocking members of the convoy as they make their way through the thick crowd.

 

“They just fully trampled that lady,” a man on the video is heard saying.

 

Law enforcement acting under new powers given to them by Canadian Prime Minister Justin Trudeau, after invoking the Emergencies Act, began clearing out downtown, according to The New York Times. The 1988 Emergencies Act replaced Canada’s War Measures Act after Justin Trudeau’s father, former Canadian Prime Minister Pierre Elliott Trudeau, used the war act against protesters in 1970, The New York Times reported.

 

The Ottawa Police Service announced they arrested 70 protesters and towed 21 vehicles during the round-up.

 

Ottawa police accused the demonstrators of using children as human shields to prevent arrests and escalating aggressive tactics against officers, which resulted in the increased crackdown. The police tweeted that children at the protest will be “brought to safety.”

An elderly disabled woman (identified by red jacket) was standing with her mobility walker as the mounted police charged. She was crushed by the horses and Fox News journalist Sara Carter {LINK} is reporting she died from her injuries.

 

Shortly after the police mounted the charge and trampled the crowd, the Ottawa Police claimed via Twitter someone threw a bicycle at one of the horses. Video of the incident shows it wasn’t a bicycle and it was not thrown, it was the mobility walker of the deceased victim as she was trampled by the horses.

 

 

Video of the events clearly shows the Police were the aggressors as they charged into the crowd. The victims can be seen getting pinned between the horses, falling to the ground and then being trampled by the horses. The elderly woman (red jacket) and her mobility walker are in the picture above.

The American Rescue Plan Act of 2021 (ARP), also known as the Covid-19 Stimulus Package to the tune of $1.9 trillion, went into effect on March 11, 2021 to allegedly speed up the recovery from economic and health effects from Covid. A lot of money was allocated toward the education system. This followed after the CARES Act of $2.2 trillion which went into effect on March 27, 2020, and the $2.3 trillion Consolidated Appropriations Act that allotted $900 billion in alleged stimulus relief, signed into law on December 27, 2020. Over $190 billion went toward the education system. They are now trying to figure out how to resurrect or rework the Build Back Better Bill that would include $400 billion in free preschool for all, which is precisely where they want to target children with SEL programs and have already setup the framework across the country, and are implementing it in some preschools. Keeping all of this in mind, lets see how much SEL based programs could potentially siphon off.

Tens of thousands of folks forked over the fees, only to discover the grandfather clock that arrived was nothing as advertised. It was really just a table-top version made of particle board and plastic and worth less than $10. Some assembly was required.

 

The scheme generated thousands of complaints, sparking federal and state investigations. Joffe and his then-California partner, Linda M. Carella, were eyed by federal postal authorities and several state attorneys general for allegedly operating a multi-state mail-order scheme. Joffe settled several state lawsuits by agreeing to refund hundreds of thousands of dollars mainly to elderly victims, according to several published reports at the time.

 

Joffe and his attorney did not respond to requests for comment. But in a phone interview, Carella told RealClearInvestigations that Joffe ran the operation. “I was just the secretary, the receptionist,” Carella, 76, said from her home in Florida, where she is now retired. She did say she picked up the returned postcards and checks from mailboxes.

 

Carella said she quit after the investigation: “I said I don’t want anything more to do with this … I have not seen Rodney since then.” But Joffe pressed on with his direct-mail marketing business before packing up for Arizona a few years later. Federal and state tax lien records reveal Joffe who also sent out mailers for skin care and other beauty products owed more than $110,000 in back taxes on his property in Los Angeles in 1995.

The horses should have never been sent in. These horses are at least part draft so bigger than normal, some riders are using two hands to try to control them, and unless a horse has gone through a lot of training and maybe a sedative, this is a scary situation for them.
