OTTAWA: The Justice Centre today announced its opposition to any rumoured declaration of a national emergency under the federal Emergencies Act, which defines “national emergency” as follows:

 

For the purposes of this Act, a national emergency is an urgent and critical situation of a temporary nature that

 

(a) seriously endangers the lives, health or safety of Canadians and is of such proportions or nature as to exceed the capacity or authority of a province to deal with it, or

(b) seriously threatens the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada

 

and that cannot be effectively dealt with under any other law of Canada.

 

The Justice Centre announced that if a national emergency is declared over peacefully protesting truckers in Ottawa, it will immediately file a court application seeking to overturn such a declaration.

 

“Prime Minister Pierre Trudeau used the War Measures Act in 1970 to deal with violence, kidnapping and murder committed by terrorists in Quebec. Today, Prime Minister Justin Trudeau is considering using the Emergencies Act to deal with bouncy castles and ball hockey,” says lawyer Jay Cameron, Litigation Director at the Justice Centre.

 

“Peaceful protesters who feed the homeless, shovel snow, pick up garbage, dance in the streets, play street hockey, wave Canadian flags, sing the national anthem and set up bouncy castles for children do not ‘seriously endanger the lives, health or safety of Canadians,’ nor are these peaceful activities ‘of such proportions or nature as to exceed the capacity or authority of a province to deal with it’,” states Mr. Cameron.

 

Sworn affidavits about the situation in Ottawa, filed with the courts, indicate that the truckers are ‘friendly, courteous, humble, considerate and peaceful.’

 

The peaceful nature of the truckers’ protest has also been confirmed by numerous media sources and by hundreds if not thousands of videos taken by people on the ground in Ottawa.

 

“Truckers in Ottawa sitting in hot tubs by their trucks do not ‘seriously threaten the ability of the Government of Canada to preserve the sovereignty, security and territorial integrity of Canada.’ The only reason the truckers are still in Ottawa is because the arrogant political elite refuse to discuss the truckers’ concerns over the loss of their civil liberties, and authoritarian vaccination mandates”, stated Cameron.

 

If the Emergencies Act is invoked, the federal government will have to demonstrate to a court how existing powers, both municipal and provincial laws, such as bylaws, are insufficient to deal with any issues.”

On Monday, a North Carolina dad spoke at a local school board meeting urging parents to "take the wheel back" in their children education, and commended the school board for passing a resolution last summer that banned critical race theory teachings in the district.

 

Brian Echevarria is running for District 73 in the North Carolina House of Representatives, and one of the main tenets of his campaign is to stop critical race theory indoctrination in schools and the reinstitution of parental rights as regards the "upbringing and education of their children."

 

"One of the things I wanted to thank you for tonight was the resolution, the nondiscrimination resolution, the CRT deal, because it’s happening, and as a parent, I speak to other parents, there's a few things that we don't want," he said, noting a resolution that was passed by the board over the summer.

In July, the Cabarrus County Board of Education voted unanimously to approve a resolution that would ensure dignity and nondiscrimination in the district. That resolution in part encompassed the blocking of teaching of critical race theory in the district’s schools.

 

The resolution promoted not teaching that one race is or sex is inherently superior to another; "That an individual, solely by virtue of his or her race or sex, is not inherently racist, sexist, or oppressive"; and that "That no individual, solely by virtue of his or her race or sex, should feel discomfort, guilt, anguish, or any other form of psychological distress," among other topics.

 

"I’m biracial. I'm bilingual and multicultural. The fact is in America and North Carolina, I can do anything I want, and I teach that to my children. And the person who tells my little pecan colored kids that they're somehow oppressed based on the color of their skin would be absolutely wrong and absolutely at war with me," said Echevarria.

54 current, former CHP officer from East LA station charged in alleged overtime fraud scheme

EAST LOS ANGELES – Dozens of current and former Highway Patrol officers have been charged with racking up more than $226,000 in phony hours in an overtime fraud scheme, California's attorney general said.

 

The charges announced Thursday stem from a criminal investigation of officers in the East Los Angeles station.

 

Between 2016 and mid-2018, 54 officers recorded hours of phony overtime while patrolling high-occupancy traffic lanes or providing protection to state transportation workers in construction zones, prosecutors said.

 

"The alleged offenses were not discovered earlier because the supervisors who would have been the ones to report these activities were also committing the fraud," according to a felony complaint against two of the officers. "Moreover, the fraud typically took place during graveyard hours, which was outside of the normal working hours of office managers."

 

Of the 54 officers charged, 11 are still employed by the agency, the highway patrol said.

 

Officers who are still with the agency and under investigation by the Department of Justice have been placed on administrative time off and had their peace officer powers removed, said Officer Jose Barrios, a department spokesman.

 

"As a professional law enforcement agency which holds it employees to the highest of standards, the CHP takes all allegations of misconduct seriously," Barrios said in a statement. "The CHP uncovered the overtime fraud in the East Los Angeles area several years ago during an internal examination."

 

The highway patrol would have no further comment amid the investigation and pending litigation, Barrios said.

 

Charges were filed earlier this month and the officers were booked by the Los Angeles County Sheriff's Department this week, according to a statement from the attorney general's office.

 

"Trust is a critical part of successful law enforcement," Attorney General Rob Bonta said in the statement. "These defendants disregarded the law through their alleged actions and did so without thought of how their conduct would impact the California Highway Patrol or the community that trusted them to protect and serve."

 

The highway patrol said in early 2019 that it had temporarily relieved "dozens" of officers from duty while it investigated whether they had billed the state for hundreds of hours of suspected bogus overtime costing about $360,000, according to news accounts at the time. They said at the time that the abuse seemed to be isolated to officers covering the Los Angeles area and the agency had changed its overtime practices in response.

Valerio added that other officers who personally knew the lieutenant were "disgusted" at the allegations. California adopts nation’s 1st ‘endemic’ virus policy

The plan includes increased monitoring of virus remnants in wastewater to watch for the first signs of a surge. Masks won’t be required but will be encouraged in many settings.

 

If a higher level of the virus is detected, health officials will determine if it is a new variant. If so, state and federal officials have a goal to within 30 days determine if it responds to existing tests, treatments and immunities from vaccines or prior infections.

 

California’s health secretary, Dr. Mark Ghaly, said one of the goals is to avoid business closures and other far-reaching mandates. However, he said the state’s requirement that schoolchildren be vaccinated against coronavirus by fall remains in effect.

 

The plan includes new education, including “myth-buster videos” to fight misinformation and disinformation and help interpret ever-evolving precautions for a confused public whiplashed by safeguards that seemingly shift by the day and vary across county lines.

 

In coordination with the federal government, it calls for a first-in-the-nation study of the pandemic’s direct and indirect impacts long-term on both people and communities.

 

All this will cost billions, much of it already outlined in the pandemic response package Newsom sought as part of his budget last month. That includes $1.9 million that lawmakers already approved to boost staffing at hospitals and increase coronavirus testing and vaccine distribution, as well as existing money and anticipated federal funds.

 

His proposed budget also includes $1.7 billion to beef up the state’s health care workforce, with more investment in increased laboratory testing capacity, data collection and outbreak investigation.

 

Newsom, who has faced criticism for sometimes failing to follow his own rules, defended keeping in place some of his executive emergency orders, which he said most recently have allowed the state to quickly bring in temporary medical workers and to quickly distribute more than 13 million home test kits to schools.

Federal prosecutors can't show a clip from the film "The Godfather Part II" at a trial as they try to prove to a jury that Roger Stone threatened a witness, a federal judge said Monday.

It's unlikely Canberra protesters were injured by 'sonic weapons', but such a risk is real

 

As thousands of anti-vax protesters descended on Canberra last weekend, police were out in force in the nation's capital, with Australian Federal Police Commissioner Reece Kershaw noting that the lack of coordination among demonstrators provided a "challenge" for law enforcement.

 

The police, however, had an advantage: long-range acoustic devices (LRADs), which are used to transmit messages or alarms at high volumes and frequencies.

 

Photos and videos shared by protesters show the devices atop a police vehicle and in front of Parliament House. A spokesman for ACT Policing confirmed to Fact Check via email that LRADs were deployed during the protests.

 

But while the devices are known to cause harm (they are often referred to as non-lethal weapons), claims made by Canberra protesters that the use of the devices caused them to feel ill are likely incorrect.

 

In one video posted to YouTube, a high-profile anti-vaccine activist claims that police deployed "sonic low frequency weapons against peaceful protesters", and that demonstrators were "copping the effects" of such devices.

 

"They're deploying supersonic weapons," the activist was filmed declaring to a crowd gathered outside Parliament House.

 

"That's why you're feeling a bit nauseous and sick. It's a disgusting thing that the government is doing."

 

The video implies that the ill effects caused by the LRADs were being felt by the crowd despite the devices being inaudible.

 

But James Parker, an associate professor at Melbourne University who is the director of a research program titled "Law, Sound and the International", told Fact Check that's not how LRADs work.

 

Dr Parker explained that the devices could be used in two ways: to issue voice commands or to emit "an incredibly high pitched and painful" alert tone capable of causing ear damage.

 

Asked whether the devices could be used to "attack" the protesters without being audible, Dr Parker replied: "I don't think there's any evidence whatsoever of the LRAD being used for secret, stealth, sub-audible attacks."

 

He added that the most effective way to cause harm using sound was through high-pitched frequencies broadcast extremely loudly.

'Sonic weapons': Craig Kelly raises conspiracy theory about protesters in parliament

Independent MP Craig Kelly has brought a conspiracy into the House of Representatives, suggesting Australian Federal Police used "sonic weapons" on anti-vaccine mandate protesters in Canberra last Saturday.

 

He asked if the AFP had sought approval from the presiding officer to use "long range acoustic" devices on protesters.

 

The conspiracy has been circulating online this week after some of the protesters say they fell ill following Saturday's protest, which Mr Kelly claimed was the largest ever in Canberra - to the sound of jeering from some members.

 

"During that protest, can the Speaker confirm if the AFP positioned one or more long range acoustic devices in the parliamentary precincts with the intention that it be used as a sonic weapon against protesters," Mr Kelly said, to muffled laughter.

 

Before the Speaker can answer, an interjector calls out, "It's 5G!".

 

There is no evidence such weapons exist or are owned by the AFP.

 

"I'll report back to the house," a weary sounding Speaker Andrew Wallace replies, before adding a few seconds later "in due course".

Brazil: Death toll in Petropolis rises to 117 after heavy rains trigger landslides

 

The number of people who died due to heavy rains that recently hit Petropolis raised to 117 on Thursday as emergency services still try to rescue survivors from under the mud and debris.

Torrential rains caused severe landslides and flooding in the city located in the mountains north of Rio de Janeiro on Tuesday, destroying houses, overturning cars and washing away debris.

More than 370 people are homeless, according to the state government. 24 people were rescued alive so far and another 116 are still missing.

‘Red-Handed’: 20 Republicans Who Sold Out to China

 

A total of 20 former and current elected Republicans are named in Peter Schweizer’s new bestseller Red-Handed: How American Elites Get Rich Helping China Win as having business dealings and political ties to the United States’ largest adversary, China.

 

Senate Minority Leader Mitch McConnell (R-KY)

 

Sen. Mitch McConnell (R-KY) and his wife, former President Trump’s Department of Transportation Secretary Elaine Chao, “enjoy some of the deepest and most abiding ties to Beijing- linked entities of anyone in Washington, D.C.,” Schweizer writes.

 

Those ties mostly stem from Chao’s fathers’ massive shipping business, the Foremost Group, which has built the family’s fortune by sharing a close financial relationship with China-owned companies like the China State Shipbuilding Corporation (CSSC).

 

After McConnell visited Beijing, China in 1993, alongside Chao, the Foremost Group received 10 mammoth ships from China-owned companies between 2001 to 2011.

 

“There can be little doubt that the McConnell-Chao family business fortunes could be disrupted overnight if Beijing looked with too much disfavor at the policy positions he takes toward China,” Schweizer notes.

 

Former President George H.W. Bush and former Florida Gov. Jeb Bush

 

The Bush family’s ties to China began before former President George H.W. Bush became vice president to former President Ronald Reagan but flourished when he became Commander in Chief.

 

Prescott Bush, Bush Sr.’s brother, met with Chinese officials in Beijing in February 1989 just days before the president was set for an official visit. Prescott’s meeting helped close the deal to build a golf club in Shanghai, China for non-Chinese business executives when they were visiting the country.

 

Prescott also met with Chinese officials, on that same trip, to push for the creation of a communications network across China. Prescott was trying to secure the deal on behalf of New York-based Asset Management International Financing and Settlement Ltd. which had been paying him $250,000 a year.

 

Months later in 1989, Bush Sr. lifted U.S. restrictions on exporting satellite technologies to China — a boon for Prescott’s client, Asset Management. Prescott would later launch the U.S.-China Chamber of Commerce (USCCC) which exists to this day and has sought to further tether the U.S. economy to China.

 

When former President George W. Bush entered the Oval Office, Schweizer writes that “a new generation of Bushes began securing deals with Chinese officials” including Bush’s brothers, Neil Bush Jeb Bush.

 

Neil, for example, scored a $400,000 annual salary working for the Chinese company Grace Semiconductor Manufacturing which had deep political ties in China. Neil also a China-linked firm called the Interlink Management Corporation.

 

Jeb, in 2013 after leaving office, began meeting with a number of Chinese business executives. Later, he created Britton Hill Holdings and raised $26 million to invest in a liquid petroleum shipping company backed by the China-based HNA Group “with close ties to Beijing’s “red aristocracy,’” Schweizer writes.

 

Former Speaker of the House John Boehner (R-OH)

 

While Speaker of the House, former Rep. John Boehner (R-OH) “took positions and actions that were highly beneficial to Beijing,” Schweizer writes.

 

Particularly, in 2011, Boehner single-handedly blocked legislation that would have held China to account for its years of currency manipulation after the Chinese embassy in Washington, D.C. deployed the lobbying firm, Squire Patton Boggs, to lobby lawmakers against the bill. Boggs was paid $35,000 to block the legislation.

 

“It’s a pretty dangerous thing to be moving legislation through the U.S. Congress forcing someone to deal with the value of a currency,” Boehner said at the time.

 

After leaving office in 2015, Boehner became a “strategic advisor” for Boggs. The firm, Schweizer writes, is “one of the most powerful in the United States, has deep and abiding ties to the Chinese government.”

 

“Beyond representing the Chinese government, Boehner’s firm also has a wide array of Chinese government-linked corporate clients that it lobbies for in Washington,” Schweizer writes. “These include ChemChina, China Railway Rolling Stock Corporation, Huawei, and Wanhua Chemical Group.”

Covid: Australian vaccine abandoned over false HIV response

A promising Australian candidate for a coronavirus vaccine has been abandoned after trial participants returned false HIV positive results.

Australia had previously agreed to buy 51 million doses of the vaccine being developed by Australian firm CSL and the University of Queensland (UQ).

The government said orders of other vaccines would now fill the shortfall.

CSL and UQ stressed that the positive results were false - meaning trial participants' health was not at risk.

The Australian government said it had now entered an agreement for the Novavax vaccine, and upped its existing order of the Oxford/AstraZeneca vaccine.

The UK was the first to begin rolling out a vaccine from Pfizer this week.
