The White House on Monday signaled its approval of an intelligence community effort to perform a "damage assessment" on former President Donald Trump's storage of classified documents at his Florida estate, but stressed that President Joe Biden was "not involved" in the task.

"It is an appropriate action for the director in the intelligence community to undertake, but, again, I'll let them speak to the details of this," National Security Council (NSC) spokesman John Kirby told reporters, according to the Washington Examiner. He previously insisted that the NSC was not prepared to perform the assessment itself.

Kirby's comments follow the public release of a heavily-redacted affidavit that accompanied the search warrant the FBI used to conduct its raid on Mar-a-Lago. The warrant application relied heavily on media reports, including a CBS Miami article about moving trucks at the estate and a Breitbart News article in which former Trump adviser Kash Patel discussed the FBI's previous removal of classified documents from the estate on behalf of the National Archives.

Earlier this year, the Bureau secured 184 boxes of classified material from Trump's home. Despite the president's extensive cooperation and voluntary surrender of the documents, the FBI nonetheless cited this incident in the affidavit as establishing "probable cause" to conduct the raid.

After the raid, Trump filed a motion for the court to appoint a "special master" to review the documents the Bureau took from his home in August and to halt the federal government from further examining them, pending litigation. U.S. District Judge Aileen Cannon has signaled her "preliminary intent to appoint a special master" in accordance with Trump's request, potentially upending the intelligence committee's damage assessment effort.

Reform isn’t enough; get rid of the FBI

Its culture is too deeply embedded for effective reform. The best solution is to abolish the FBI and start anew. We need to rethink the kind of agency needed to investigate federal crimes.

Historically, the problem with the Federal Bureau of Investigation has not been one of leadership but of culture. Directors come and go; the culture remains. That culture is one of “us versus them,” very insular, functioning under its own unwritten rules. There are periodic calls for reform, but these are Band-Aids covering a serious gunshot wound. As an experienced criminal defense lawyer, I’ve concluded that the FBI must be abolished and its duties assigned to a new agency.

Consider an example from my own law practice.

Some years ago, I represented a client who the Boston FBI office believed had information about a federal crime. The FBI asked if I would make my client available for an interview. Fed’s instant payment service ‘FedNow’ set to launch by July 2023

The Federal Reserve is on track to deliver an instant payment service called FedNow between May and July 2023, the central bank's clearest timeline yet for a new system enabling settlement of U.S. payments in seconds.

The FedNow service also potentially negates the need for the creation of a central bank digital currency, or CBDC.

“The FedNow Service will transform the way everyday payments are made throughout the economy, bringing substantial gains to households and businesses through the ability to send instant payments at any time on any day, and the funds being immediately available to recipients to make other payments or manage cash flow efficiently,” Fed Vice Chair, Lael Brainard, said in a speech Monday.

The Fed has been testing the system with a limited number of banks and institutions, but Brainard called on financial institutions, service providers, and software companies to adopt the FedNow Service now to ensure the system will work smoothly come next spring.

"The time is now for all key stakeholders…to devote the resources necessary to support instant payments," said Brainard.

FedNow, which will enable consumers and businesses to send payments instantly, could offer some of the same benefits as a central bank digital currency.

Fed Governor Michelle Bowman has said that FedNow may deliver many of the same benefits as a Federal Reserve-issued digital dollar, while senior administration officials have also pointed to the FedNow service as an alternative to a CBDC. The Fed has released a study on a CBDC, but has made no decision on whether the U.S. should adopt one.

Officials are thinking through what needs a CBDC would fulfill after the release of the FedNow system.

Cowen analyst Jaret Seiberg said he thinks FedNow eliminates the business case for a stablecoin-based consumer payment system.

“FedNow provides the cost-reduction and settlement speed of stable coin payments without the need to convert into and out of tokens,” said Seiburg. “FedNow could then slow the growth of these tokens, which may help address policy concerns regarding stablecoins.”

Rolling out the FedNow system would involve upgrading back-office processes, evaluating accounting procedures to accommodate a seven-business-day week, arranging liquidity providers, and putting in place new technology to interface with customers.

The Fed maintains making funds immediately available will help Americans living paycheck to paycheck, or small businesses with cash flow constraints, by avoiding late payment fees or freeing up working capital for small businesses to finance growth.

Analysts say FedNow could also cut demand for payday loans as consumers won't have to wait for a check to clear. For businesses, there could also be upside for better paying suppliers on time, and businesses could embrace it as a less costly and more certain way to accept consumer payments.

The FedNow system would help the government transmit emergency relief payments to Americans faster, avoiding making citizens wait for checks as during the pandemic.

Financial regulators also want faster payments because it reduces systemic risk. During the financial crisis, the fear was that the financial system would shut down because banks would not trust that other banks would make good on intraday credit.

Overview

The Counter-Rocket, Artillery, Mortar (C-RAM) / Indirect Fire Protection Capability (IFPC) system was developed early during Operation Iraqi Freedom/Enduring Freedom in order to protect ground forces and forward operating bases from the threat of rockets, artillery, and mortars. C-RAM is made up of a variety of systems which provide the ability to sense, warn, respond, intercept, command and control, shape, and protect deployed forces.

C-RAM components include the Forward Area Air Defense Command and Control (FAAD C2), Land-based Phalanx Weapon Systems (LPWS), Lightweight Counter Mortar Radars (LCMR), Firefinder radars, Ka-band Multi-Function Radio Frequency Systems (MFRFS), Air and Missile Defense Workstation (AMDWS), and several other components that contribute to system intercept and communications.[i]

A main component of the C-RAM system is the LPWS, which is modified from the U.S. Navy MK-15 MOD 29 Block IB, Baseline 2 Close-In Weapon System, and mounted on a commercial 35-ton semi-trailer for land-based operations. The M61A1 20mm Gatling gun is capable of acquiring its target and firing at a rate of 4,500 rounds per minute. The Forward Area Air Defense Command and Control (FAAD C2) system integrates the sensors, weapons, and warning systems for C-RAM Intercept.[ii]

C-RAM was operationally deployed in Iraq and Afghanistan, where its sense and warn capabilities provided timely warning of more than 2,500 rocket and mortar attacks against C-RAM equipped forward operating bases. C-RAM was also purchased by Australia and the United Kingdom.

Strategic Implications

The C-RAM system was originally designed to fill operational needs in Iraq to counteract the increasing number of casualties caused by attacks using rockets, artillery, and mortars It was deployed by the United States in Iraq to protect the Green Zone and Camp Victory in Baghdad, Joint Base Balad near Balad, Iraq, and was deployed by the British Army for ground protection in southern Iraq. C-RAM can be used for defense and destruction against incoming weapons or can simply provide early warning.

More recently, the Army and Northrop Grumman are exploring new sensors and interceptor weapons able to destroy enemy drones using ground-based systems designed to track and knock out approaching enemy fire from Forward Operating Bases. C-RAM is deployed at numerous Forward Operating Bases throughout Iraq and Afghanistan and is now being analyzed for these upgrades and improvements.[iii]

The Justice Department said Monday that agents discovered a "limited" number of potentially privileged documents during the FBI's raid of former President Donald Trump's Mar-a-Lago estate.

The department made the statement in a court filing in which the agency also said the some of the materials taken in the Aug. 8 raid potentially contain material covered by attorney-client privilege.

The department also pledged to provide more detail in a supplemental filing but stated that its Privilege Review Team "identified a limited set of materials that potentially contain attorney-client privileged information," according to the court document.

The review team is currently in the process of addressing potential privilege disputes, officials said.

Unvaccinated West Point Cadets Ordered to Vacate Campus Within 24 Hours

After receiving notification of the final military adjudication of their cases, Coast Guard Academy cadets who sought a religious exemption from the military’s COVID-19 vaccine mandate were ordered to leave campus within 24 hours.

“Failure to obey this order may result in punitive or adverse administrative action,” according to a Developmental Counseling Form that was given to cadets telling them that they have until 4 p.m. on Saturday, August 13 to make a plan to receive the vaccine.

“I am deeply troubled that they would hold these documents for two days and serve them on a Friday afternoon,” attorney R. Davis Younts said. “Feels like another attempt to isolate and pressure cadets into getting the vaccine over a weekend where they will be limited in their ability to consult with attorneys or medical professionals.”

The cadets’ RAR appeals were denied in May. In June, the Coast Guard Academy notified the unvaccinated cadets that they would be disenrolled. The cadets appealed the disenrollment, but the academy didn’t reject the appeals until Aug. 15. The academy didn’t notify the cadets of its decision until Aug. 18, three days later, when it ordered them to leave by Aug. 19, the following afternoon.

When military members are denied their RARs for vaccine mandates, they’re allowed to appeal the denials. If their appeals are denied, then the military begins the process of separating them from the service.

After being ordered to leave within 24 hours of being notified that their disenrollment appeals were denied, the seven unvaccinated Coast Guard cadets had to pack up everything and figure out how to get themselves and all their belongings home before the deadline, one cadet told Just the News on Monday.

Because the cadets haven’t been disenrolled yet, they can’t leave the Coast Guard to look somewhere else for a job or education. The cadet said that it’s too late to transfer to another college at this point in the semester and that not all military academy credits transfer over, anyway.

The academy hasn’t told the cadets what the next steps are for disenrollment or when they will occur. Even if the academy lets them back, they have already fallen behind in their classes, according to the cadet.

Two of the unvaccinated cadets being forced to leave the academy’s campus are seniors, one is a junior, and four are sophomores. All of the freshman cadets were required to be vaccinated, as those who were unvaccinated were weeded out during bootcamp this summer, the cadet told Just the News.

Heavy clashes erupted in Baghdad, killing at least 10 people on Monday (local time), after powerful Shi'ite cleric Moqtada al-Sadr said he would quit politics, prompting his loyalists to storm a government palace and fight with rival groups.

As night fell, machine-gun fire and explosions rang out, with tracer fire rising into the sky above the Green Zone that houses government headquarters and foreign embassies, in the worst fighting the Iraqi capital has seen in years.

It followed a day of violence prompted by Sadr's announcement that he would withdraw from all political activity - a decision he said was in response to the failure of other Shi'ite leaders and parties to reform a corrupt and decaying governing system.

Sadr later said he was staging a hunger strike in protest against the use of weapons by all sides.

A political standoff between Sadr and Shi'ite Muslim rivals who are mostly backed by Iran has sent Iraq spiralling into yet another round of violence as it struggles to recover from decades of war, sanctions, civil strife and endemic corruption.

Since 2003, Iraqi groups have engaged in sectarian conflict and, more recently, intra-sectarian, intra-ethnic political competition.

The latest round of violence pits Sadr's supporters, which include a heavily armed militia, against Iran-aligned rival paramilitaries and the security forces.

Sadr's win in an October election, his attempts to form a government free of Iran-backed groups, and his eventual withdrawal from parliament in favour of street protests and occupying government buildings to block political activity have all featured in the build-up of tensions that finally erupted into new violence on Monday.

Security officials said some of the clashes were between Sadr's Peace Brigades fighters and members of the Iraqi security forces tasked with protecting the Green Zone, but that Iran-aligned militias were also likely to have been involved.

Reuters could not independently verify who was shooting at who on Monday night.

Sadr announced earlier in the day he was quitting politics. "I hereby announce my final withdrawal," he said on Twitter, criticising fellow Shi'ite political leaders for failing to heed his calls for reform.

Sadr loyalists who had been occupying the parliament building for weeks then charged a government headquarters in the Green Zone, once a palace of dictator Saddam Hussein, where some jumped into a swimming pool at the palace, cheering and waving flags.

Clashes then took place between young men loyal to Sadr and supporters of the pro-Iran militias, who threw stones at each other near the Green Zone, before the nighttime armed fighting.

In addition to the 10 people killed, several dozen were injured, police and medical workers said.

Iraq's military declared an open-ended nationwide curfew and urged the protesters to leave the Green Zone.

Sadr, who has drawn broad support by opposing both US and Iranian influence on Iraqi politics, was the biggest winner from an October election but withdrew all his lawmakers from parliament in June after he failed to form a government that excluded his rivals, mostly Tehran-backed Shi'ite parties.

Sadr has insisted on early elections and the dissolution of parliament. He says no politician who has been in power since the US invasion in 2003 should hold office.

"The (Iran) loyalists came and burned the tents of Sadrists, and attacked protesters," said Kadhim Haitham, a supporter of Sadr.

Pro-Iran groups blamed the Sadrists for the clashes and denied having shot at anyone. "It's not true - if our people had guns why would they need to throw rocks?" said one militia member, who declined to be identified by name.

Sadr has withdrawn from politics and the government in the past and has also disbanded militias loyal to him. But he retains widespread influence over state institutions and controls a paramilitary group with thousands of members.

He has often returned to political activity after similar announcements, although the current deadlock appears harder to resolve than previous periods of dysfunction and has given Iraq its longest run without a government.

Supporters of the mercurial cleric first stormed the Green Zone in July. Since then, they have occupied parliament, halting the process to choose a new president and prime minister.

Sadr's ally Mustafa al-Kadhimi, who remains caretaker prime minister, suspended cabinet meetings until further notice after protesters stormed government buildings and has publicly pleaded with Sadr to intervene to stop the violence.

Iraq, OPEC's second-largest producer, has struggled to recover since the defeat of Islamic State in 2017 because political parties have squabbled over power and its vast oil wealth.

Ukrainian strike on Russian-held city cuts water and power supply – official

Residents of Novaya Kakhovka are left without basic necessities, the local administration has said

An intense Ukrainian artillery strike hit the Russian-controlled city of Novaya Kakhovka in Ukraine’s Kherson Region, cutting off the city’s power and water supply, local authorities reported on Monday evening.

“We’re likely in for some gruesome consequences,” the Kakhovka district’s head Vladimir Leontyev told reporters. “Responding to the scene is currently impossible. There were a lot of strikes, something exploded.”

According to Leontyev, there were hits reported both within the city limits and at the nearby hydroelectric power plant. While the exact extent of the damage had not been established yet, the attack has crippled the city’s water and power supply.

“The fires are still burning and we are still hearing explosions,” Leontyev said around 10:45pm local time. The city’s hospitals had all been issued emergency generators and the authorities plan to start water deliveries in the morning, he added.

Novaya Kakhovka had been on the receiving end of Ukrainian shelling all day. Earlier, Leontyev told the media that about ten salvos, each including at least six rockets, damaged many civilian structures, including a market. The official said Ukrainian forces were using US-supplied HIMARS systems to harass the city.

Kiev claimed on Monday to have launched a counter-offensive in the Kherson Region, where Novaya Kakhovka is located. Natalia Humeniuk, Ukraine’s southern command spokeswoman, told state media that Kiev’s troops had breached the “first line of defense” of the Russian forces, but declined to give any details of the operation.

By Monday evening, however, the Russian Defense Ministry said the Kherson offensive had “failed miserably,” with Ukrainian forces routed after suffering heavy losses. According to the ministry’s report, Kiev lost over 560 troops, dozens of armored vehicles and tanks, and two Su-25 ground-attack planes.
