Beanz's Take on Kari Lake's case before AZ Supreme Court

๐ŸšจTHREAD: There have been new filings in the @KariLake case at the AZ Supreme Court.

 

REFRESH: If you remember, Hobbs and Fontes asked the SC for sanctions against Lake, and the court gave dates for briefing. When Lake briefed, not only did they dispute the sanctions, but they used the opportunity to request a motion for consideration on the CoC issues and the 35,563 vote discrepancy; votes that Runbeck said they had and Maricopa said they didnโ€™t.

 

First, I will share some of the response to the original Lake rebuttal brief, that I threaded above. Then, I will share the rebuttal to THAT made by @KariLake and her attorneys.

 

Elias, on behalf of Hobbs, uses the familiar buzzwords, like โ€œBaselessly,โ€ โ€œFrivolous,โ€ โ€œpeddle conspiracy theoriesโ€ and โ€œSow distrust.โ€ Hobbs argues that there is no factual basis for the claims Lake has made.

 

What I found interesting here is that they are not asserting in this first paragraph that Lake had never raised the claims before- the original reason for the sanctions. They have moved to attacking the CoC and injected ballots themselves- even though Lake used Hobbs own evidence to show that fact pattern.

 

He then goes on to impugn their own evidence, stating that she misrepresented two trial exhibits, and didnโ€™t โ€œdevelop or preserve this new argument by raising it in her first reply brief before the court of Appealsโ€

 

This just isnโ€™t true. But at least they talked about the initial reason they requested sanctions now.

 

I am saying this in all honesty, when you have a strong argument, you donโ€™t typically have to insult the other party in your pleading. Lake attorneys havenโ€™t done this other than in response to taunts.

 

Again, here, Hobbs et al admit that Maricopa did not follow CoC procedures, stating that the number of ballots on the form from Maricopa County was merely an โ€œestimateโ€ of ballots, and that is why it doesnโ€™t match the totals at Runbeck.

 

The problem is, they broke from CoC procedure, have admitted it over and over again, and if we had honest brokers, this WOULD be a โ€œnail in the coffin.โ€

THIS IS NOT PROPER PROCEDURE. If a ballot leaves Maricopa for Runbeck without being accounted for, we have completely lost Chain of Custody. There is no provision for laziness, or being โ€œtoo busyโ€ that allows Maricopa to IGNORE this.

 

They say that Lake has โ€œfailed to graspโ€ the fact that this was done. To the contrary, they have said this over, and over, and over again, from the very beginning. In court pleadings, the defense is brazenly and repeatedly arguing that Maricopa didnโ€™t follow procedure (and by default) law.

 

This is their argument, in totality. They also add that even if what she is saying is true, it isnโ€™t properly before the court and she is asking for a reconsideration improperly. They against state they are asking for sanctions. They say her claim has NO justification.

 

That is just blatant dishonesty.

 

Here is @KariLake response to what you just read. Importantly here, Hobbs had previously argued that the two exhibits Elias just said are not indicative of a problem, were actually very important. Hobbs argued that those exhibits PROVED that Maricopa โ€œwould be aware of any ballot inserted or rejected or lost in any part of the process.โ€

 

You canโ€™t have it both ways. You canโ€™t argue on the one hand that those forms are only estimates and so there is no good way to KNOW what was leaving Maricopa for Runbeck, and on the other hand, those forms are going to give Maricopa an accounting of EVERY SINGLE ballot and where it is along the way.

 

They then again ask the court to remand this issue back down to the trial court along with signature verification.

 

Lake argues that Hobbs and Fontes canโ€™t all of a sudden reverse course and say their trail exhibits are meaningless estimates, when they argued to the court of appeals that those same exhibits would make Maricopa โ€œaware of any ballot inserted or rejected or lost in any part of the processโ€

 

How would they know if all they had before they sent them off was an estimate? In reality, itโ€™s likely they didnโ€™t realize they were relying on inconsistent exhibits to make this argument when they made it at the appellate court.

 

Remember, Hobbs (joined by Fontes) argued that these two exhibits were meaningful in their defense. Now, they are walking that back because Lake is relying on them to PROVE HER CLAIMS.

 

I want to make sure the people in the back hear this- they contradicted themselves relying on THIS EVIDENCE to prove CoC, and THIS VERY EVIDENCE PROVES OTHERWISE.

 

Itโ€™s their evidence, people.

The footnote says a lot here; it isnโ€™t that Lake didnโ€™t argue this point, itโ€™s that the appellate court chose to focus on a tweet from Maricopa instead of this part of the record. However, the appellate court accepted the argument that those trial exhibits were indicative of true CoC, so the fact that they erred is important.

 

A little slight at Hobbs/Fontes here:

 

โ€œ..makes grand statements about the integrity of our electoral democracy, it is Respondents - not Lake - that defend unlawful election conduct by switching arguments when it suits themโ€

 

And again- I am REALLY glad they keep hammering this home. Even if the 35,563 figure results in part from an estimate, the only reason there IS an estimate, is that Maricopa BROKE THE LAW and failed to count the ballots when the containers were opened AS REQUIRED. And, that many ballots is too high given the margin between the two candidates of 17,117 votes.

 

BECAUSE THEY BROKE THE LAW.

 

Now we get into the procedural, but itโ€™s important so I am threading it here. The argument Elias has made is that this reconsideration seeks review of the entire case, flouts the courts order, was procedurally improper, and expands the proceedings.

 

If they would have made a separate motion for leave to file would have complied with the law.

 

โ€ฆBut, if they wouldโ€™ve done that - THAT actually wouldโ€™ve expanded the request. Lake didnโ€™t ask for a review of the entire election contest, as argued. The fact they represented it that way is just more evidence of their blatant dishonesty.

 

They CLEARLY didnโ€™t do that here, and if you are willing to be so dishonest as to write that in a brief before the highest court in AZ, what else are you dishonest about?

 

They donโ€™t provide any reason to deny the procedural motions, and are wrong that reconsideration requires โ€œnew evidence or intervening change in the lawโ€

 

Their VERY ARGUMENT in defense is that THEY BROKE THE LAW.

 

This isnโ€™t hard. They have literally filed over and over admitting that they BROKE THE LAW.

 

In a case, if you fail to respond to an issue raised, you concede the issue is true. If you donโ€™t argue back against it, it is a concession. Hobbs/Fontes failed to rebut two issues raised, hence, they are conceding those points to Lake.

 

First, The Court of Appeals recognized that 50 ballots might have been unlawfully injected at Runbeck, but found the number immaterial, given the vote margin and all other counts were dismissed. Now that the court remanded the signature verification, itโ€™s possible that the CoC violation could include unlawful votes from that verification issue to make a material difference, which is true wherever the actual number is between 50-35,563 ballots.

 

And here, again, the CoC issue has been raised the entire time. They raised this specific claim as ARGUMENTS in support of an issue, that can be raised.

 

And finally, Lake requests the court grant her leave to seek the reconsideration of the denial of the Petition for Review with respect to the chain-of-custody issues.

Twitter owner and Tesla CEO Elon Musk recently announced the creation of a new artificial intelligence company called X.AI, according to a Nevada business filing from March.

 

The filing occurred March 9 and lists Musk as the company's sole director, and Jared Birchall, his family office manager, as its secretary.

 

Musk has been very openly skeptical of AI, even to the point that he wrote an open letter to AI developers, asking them to pause it temporarily.

 

"Recent months have seen AI labs locked in an out-of-control race to develop and deploy ever more powerful digital minds that no one โ€“ not even their creators โ€“ can understand, predict, or reliably control," a group of tech experts including Musk said in the letter.

 

Musk has reportedly started his new AI company to combat OpenAI, one of the leading artificial intelligence firms. He was the co-founder of OpenAI, but left in 2018 over unresolved issues.

 

He has reportedly sought to create a rival to OpenAI and has been recruiting artificial intelligence engineers for months, The Hill reports.

What to know about 1st test flight of SpaceXโ€™s big Starship

 

Elon Muskโ€™s SpaceX is about to take its most daring leap yet with a round-the-world test flight of its mammoth Starship.

 

Itโ€™s the biggest and mightiest rocket ever built, with the lofty goals of ferrying people to the moon and Mars.

 

Jutting almost 400 feet (120 meters) into the South Texas sky, Starship could blast off as early as Monday, with no one aboard. Muskโ€™s company got the OK from the Federal Aviation Administration on Friday.

 

It will be the first launch with Starshipโ€™s two sections together. Early versions of the sci-fi-looking upper stage rocketed several miles into the stratosphere a few years back, crashing four times before finally landing upright in 2021. The towering first-stage rocket booster, dubbed Super Heavy, will soar for the first time.

 

For this demo, SpaceX wonโ€™t attempt any landings of the rocket or the spacecraft. Everything will fall into the sea.

 

โ€œIโ€™m not saying it will get to orbit, but I am guaranteeing excitement. It wonโ€™t be boring,โ€ Musk promised at a Morgan Stanley conference last month. โ€œI think itโ€™s got, I donโ€™t know, hopefully about a 50% chance of reaching orbit.โ€

SUPERSIZE ROCKET

 

The stainless steel Starship has 33 main engines and 16.7 million pounds of thrust. All but two of the methane-fueled, first-stage engines ignited during a launch pad test in January โ€” good enough to reach orbit, Musk noted. Given its muscle, Starship could lift as much as 250 tons and accommodate 100 people on a trip to Mars. The six-engine spacecraft accounts for 164 feet (50 meters) of its height. Musk anticipates using Starship to launch satellites into low-Earth orbit, including his own Starlinks for internet service, before strapping anyone in. Starship easily eclipses NASAโ€™s moon rockets โ€” the Saturn V from the bygone Apollo era and the Space Launch System from the Artemis program that logged its first lunar trip late last year. Archeologists in Italy unearth ancient dolphin statuette

 

ROME (AP) โ€” Excavations in southern Italy have unearthed terracotta bull heads and a figurine of the Greek god Eros riding a dolphin, shining new light on the religious life and rituals of an ancient city, culture ministry officials said Saturday.

 

Itโ€™s the first trove of artifacts identified from a sanctuary in the ancient Greek city of Paestum, which dates from the 5th century B.C. Paestum, famed for its three massive Doric-columned temples, is near the archaeological site of Pompeii, but farther down the Almalfi coast.

 

The small temple was first identified in 2019 along the ancient city walls but excavations were halted due to the COVID-19 pandemic, the Italian Culture Ministry said in a statement.

 

Excavations yielded several small terracotta figurines in the first months of resuming work, the Ministry said. Archeologists found seven bull heads found around a temple altar as if placed there on the ground in a form of devotion.

 

A dolphin statuette found in the first trove of artifacts appears to be from the Avili family of ceramists whose presence had never before been documented in Paestum, the statement said.

 

Limited excavations began at the temples in the 1950s, and the ministry believes more treasures can be found in the area.

 

Ancient Romans controlled the city by around 275 B.C., renaming it Paestum from the Greek โ€œPoseidonia,โ€ in what had before been Magna Graecia.

this article agrees that in very ancient times the women were shown doing the brewing but goes on to say that it became a state industry presided over by men.

and that would thousands of years before our statement about modern beer mostly being brewed by women until very recently.
