— – President Trump tweeted Tuesday morning that he had the "absolute right" to share information about national security with Russian officials in the White House last week after The Washington Post reported that the information was highly sensitive and classified.

The White House called the report "false" and denied that he revealed specific information about sources, methods and military operations to Russia.

Despite the massive blowback from the intelligence community and Democratic and Republican members of Congress, Trump is right.

Executive Order 13526

As president, Trump has the legal power to declassify information. He also has the authority to share information with whomever he wants, including foreign adversaries.

At the White House today, Trump's national security adviser, H.R. McMaster, defended Trump's disclosure and said it "is wholly appropriate for the president to share whatever information he thinks is necessary to advance the security of the American people."

Trump is protected under an executive order that was signed by Barack Obama in 2009 establishing a uniform system for "classifying, safeguarding and declassifying national security information."

The order allows the president to determine the system of designating classified information, and he is the ultimate authority over U.S. intelligence agencies, which gather and classify the information.

The Supreme Court confirmed as much in its 1988 ruling in Department of Navy v. Egan.

"[The president's] authority to classify and control access to information bearing on national security … flows primarily from this constitutional investment of power in the president and exists quite apart from any explicit congressional grant," the court said.

'This is unprecedented'

The intelligence community has been left spinning in the light of the revelations that Trump allegedly disclosed classified information.

But the problem isn't legal

— it's political, said Joseph Nye, a professor at Harvard University.

"It is a matter of policy and prudence," he explained. "Careless disclosure can dry up sources, whether it be the identities and lives of those in the field or the cooperation we get from liaison with other services, who have to protect their sources and methods."

While experts said that presidents may disclose classified information, it is rare for them to do so.

"This is unprecedented," said Kate Martin, a senior fellow with the Center for American Progress who has more than 30 years of intelligence and national security expertise.

As the head of the executive branch, Trump has the legal authority to disclose intelligence information, she said, but "the system assumes that a president acts in the interest of U.S. national security and that a president would not disclose intelligence information in a way that could be harmful simply in order to boast about his own access."

"Apparently, [McMaster] said Trump made the decision at the spur of the moment to share the information, without having gone through the process, which means he did not consider the harm that would follow the disclosure," she added.

The basic rule for confidentiality in the intelligence world, Martin said, is that officials share classified intelligence only with people who have a need to know it; otherwise, "you don't share it."

She added, "We've never had a president who defended himself by saying, 'Oh, it's lawful,' even though it's harmful to national security."

(4)   for documents in the physical and legal custody of the National Archives and Records Administration (National Archives) that have been available for public use, the agency head has, after making the determinations required by this paragraph, notify the Archivist of the United States (Archivist), who shall suspend public access pending approval of the reclassification action by the Director of the Information Security Oversight Office. Any such decision by the Director may be appealed by the agency head to the President through the National Security Advisor. Public access shall remain suspended pending a prompt decision on the appeal.

The non-binary former Energy Department official who was caught on video stealing luggage was ordered to pay $3,670 to the victim and given a suspended sentence of 180 days in prison after pleading 'no contest' to theft.

Samuel Brinton, 35, who uses they/them pronouns was issued their sentence Wednesday in Las Vegas, Nevada, eight months after they grabbed a passenger's bags inside Harry Reid International Airport.

Brinton was facing misdemeanor theft charges, which amount to less than $1,200 in stolen items. They had originally faced a felony theft charge since police said the amount stolen was $3,670.

Brinton - who was responsible for nuclear fuel and radioactive waste - was also told by a judge to stay out of trouble, according to Las Vegas court records.

A suspended sentence means the former Energy Department employee will not be forced immediately to serve a jail or prison term and may be required to complete probation.

Here's how a 21-year-old National Guardsman could possibly get sensitive Ukraine docs

WASHINGTON – Before the FBI announced it had arrested the suspected leaker of dozens of highly sensitive Ukraine war documents – some of which were created to brief the highest levels of the Pentagon – few would have suspected a 21-year-old National Guardsman as the potential culprit.

The FBI nabbed Massachusetts Air National Guardsman Jack Teixeira at his mother’s home Thursday after he was implicated in the biggest national security breach in at least 10 years.

The junior airman is accused of uploading troves of secret and top secret documents to Discord, a social messaging platform for gamers, from which they were spread across several websites.

An airman 1st class, Teixeira held the lowest petty officer rank the Air Force grants enlisted troops.

His job – a cyber transport systems journeyman – would have had him working not in intelligence analysis, but with IT infrastructure.

So how could such a young, low-ranking troop have gotten access to so many critical secrets?

There are several possible explanations:

The Pentagon regularly issues security clearances to troops as young as 18.

Some service members require security clearances as soon as they join the military, Pentagon spokesman Air Force Brig. Gen. Pat Ryder said Thursday.

“Depending on your position, you may require a security clearance,” Ryder said. “If you are working in the intelligence community and you require a security clearance, you’re going to go through the proper vetting,”

Even in his low position – just two ranks above newly enlisted airmen – Teixeira’s job specialty may have required a clearance.

Cyber transport systems journeymen can require higher clearance levels

Though officials have not said whether Teixeira had a security clearance, his job as a cyber transport systems journeymen (CTSJ) may have required him to work with and protect sensitive communication channels.

That’s because CTSJs are the Air Force’s “frontline technicians and trainers,” keeping up the infrastructure of the military’s most advanced cyber networks, which are used to securely send and receive highly sensitive information.

“[CTSJs] enhance our capabilities and provide us with the best and most secure systems so we can stay ahead of the curve in everything we do,” the Air Force says in its online description of the occupation.

His unit may have required access to foreign intelligence

Though it’s unclear why a cyber transport systems journeymen would have the need to know highly sensitive intelligence, it’s possible Teixeira’s work with the Air National Guard’s 102nd Intelligence Wing required him to have access to the sensitive channels, if not to the actual intelligence shared within.

Though Ryder declined to say Thursday whether Teixeira’s unit was assigned to support US efforts to help Ukraine, the 102nd provides intelligence for airmen assigned to both domestic and foreign US military efforts.

“Our mission is to provide worldwide precision intelligence and command and control along with trained and experienced Airmen for expeditionary combat support and homeland security,” the 102nd states on its website.

With that mission set, it is possible the 102nd could have been tasked with providing Ukraine-related intelligence.

The military runs on the backs of young people

About two-thirds of US service members are under the age of 30, and most of that group is under 25 – meaning the Pentagon is simply more likely to grant security clearances to personnel barely old enough to legally drink.

The Pentagon has previously activated National Guard units to support Ukraine war efforts.

For example, one of the leaked documents The Post reviewed Thursday suggests that a North Dakota Air National Guard reconnaissance squadron has been involved in analysis of Ukrainian drone strikes on targets in Bakhmut, where the most intense recent fighting has been focused.

However, the Pentagon to date has not publicly announced activations of National Guard units to support Ukraine’s war efforts from the US homeland.
