Let me suggest that just as punishment is the failure of discipline, crises management is the failure of proper managementwith families, finances, relationships, and politics. It is regarding the latter that I offer these thoughts.

 

Proper management utilizes thisprinciple, “A prudent person sees evil and hides himself, but the naive proceed, and pay the penalty” (The Bible, Proverbs 22:3). The results of “crises management” is the consequence of those in charge—they will bring chaos or calm.

 

Chaotic crisis management arises because the governing structure has failed. This failure fuels insecurity and instability.A republican governing, founded upon human values and mutual respect, encourages the citizens’ productivity and leads to success and citizens’ strong self-esteem. These components build a strong nation. (Allow an aside: “Republicanism” is a political ideology that emphasizes the principles of representative government, individual rights, and the rule of law. “Republicans” believe in a system of government where power is vested in elected representatives who are accountable to the people who voted for them.)

 

When a nation’s stability is attacked, there is an unraveling of the social and civic order. Inept, “naïve” elected officialsinvite chaos and anarchy to result. The governing authority is scorned. In such events violations to the Rule of Law are allowed with impunity for some.Consequently, the innocent is victimized and the guilty are absolved.

 

This pattern is historically validated. Past world powers are forever gone; erased from the present; confined to the dustbins of “has-beens.” A common factor in these failed nations is that national pride blinded the citizens to the fragility of the nation’s permanence. An example is the Third Reich which was to last 1,000 years but only lasted 13 years!

 

A nation’s failure results from catastrophic choices made during crises.

 

An intriguing aspect of the national crisis management is seen inhow crises are utilized in restructuring the Rule of Law in the national body politic. The crises can be manipulated to serve an ungodly agenda that undermines the established Rule of Law.Think about this observation.

 

Never waste a serious crisis!

 

Rahm Emanuel, chief of staff to BHO, “You never want a serious crisis to go to waste,” he told a Wall Street Journal forum in 2008.

 

This seems to be the mantra of the Democrat Party Brand…the DEMS enjoy utilizing crises for their manipulative gaming of the nation. This is validated by a number of situations but look at the wildfires on the west coast.The DEMS are gaming “global warming” that currently is changed to “climate change.” The idiocy of this position has been rebuffed, but the DEM political Brand will not let it go. Here is a quick list of DEMS using the recent wildfires to game their positions (many more can be added):

• Hollywood director Jim Jarmusch blame the raging fires on “climate deniers,” demanding that people stop viewing “woke” as “a negative thing.” Note: Is it not interesting that PC “woke” requires DEMS to follow their handlers regarding the imagined “climate change?”

• Democrat Pramila Jayapal Blames Fires on Corporations Ignoring ‘Reality of Climate Change’

The REAL TRUTH regarding crises

 

Those wearing the Democrat Party Brand refuse to confess their foolish positions. It is easier to play the blame game than to admit wrong and change choice directions.

 

The CA fires bring this into a sharp focus. Some are now voicing discontent with the Democrat leadership, Mayor Bass and Governor Newson, over perceived failures in crisis management. It is too late for any redeeming action but at least some are admitting the real reason for the failed State.

 

The Democrat Party’s response to crisis management is illustrated by CA’s horror—Bass cut the Fire Department budget, rebuked the Fire Chief for criticizing management, shuttered SIXTEEN Fire Stations, placed DEI incompetence in charge of a critical water storage reservoir that has been offline for over a year, and the reader can add to this list.

The unspoken ideology

 

The unspoken fact is the Democrat Party has surrendered to the Engles/Marx “dialectic.” You will remember from Ninth Grade civics the theory that societal perfection comes only as the “old” is replaced with the “new.” There is the “thesis” (old) the “antithesis” (chaos that disrupts the old) and the “synthesis” (the resulting new and supreme order). According to the Marxist DEMS, chaos must be initiated, encouraged and supported so the old is violently removed. Then from the ashes of anti-social and uncivil destructive horrors, a “new” supreme order arises.

 

“Community organizer” (euphemistically one occupying a Socialist Marxist position seeking to bring chaos to the USA) Saul Alinsky, author of Rules for Radicals, put it this way (page 89): “In the arena of action, a threat or crisis becomes almost a precondition to communication.”

 

The DEMS action of taking advantage of any crisis whether real or manufactured is used by those waging war in “antithesis.” When used in this way, it is no longer a tactic of protest but a tactic of ideological subversion used to bring about totalitarian government control (Think of BLM, the hysteria of C-19, the J6 persecuted, the endless witch hunts of the DEMS against President Trump, etc).

 

The lead is formed along the lines of a crisis subject and then plays that crisis to force the need for control. If the crisis is allowed to continue (consider the unending attacks on President Trump or the never-ending COVID hysteria) people will cry out to the government for relief. It is assumed the government has the answer to the crisis. But the result of the Nanny State’s actions leads to property destruction, and even loss of life and limb.

 

The crisis response is designed to manipulate the people into accepting the lie that the Federal Governing Nanny State provides better than the individual. This is the “collective” rather than the individual!

 

The final point of Alinsky’s rules is illustrated by Bass. Number 13 states, “Pick the target, freeze it, personalize it, and polarize it.”  “(T)he opposition must be singled out as the target and frozen… There is a constant…passing of the buck.” The responsibility for the crisis must never be accepted by the Marxist. The blame must focus on the targeted change. The crisis will change but the target remains the same! (Recall how regardless of the crisis President Trump is to blame.)

 

To avoid culpability the Marxist “passes the buck” on responsibility. Listen to Bass, “‘Let me finish. Rest assured, when that is done, when we are safe, when lives have been saved and homes have been saved, we will absolutely do an evaluation to look at what worked, what didn’t work, and to correct or to hold accountable anybody, department, individual, etc. But my focus right now is on the lives and on the homes.” Where is mention of budget cuts, the empty reservoir, shuttering 16 fire stations, DEI ineptness, etc?

 

The Inexplicable Is Explained

 

Many are perplexed about the illogic of crisis management in our nation. After all, how can such egregious incompetence be employed, excused, and even awarded? As Conan Doyle would say, the explanation is “elementary.” Just pull back the curtain and all is exposed. Those elected to the Democrat Party and positioned to manage crises are wedded to a philosophy that urges chaos instead of calm; insecurity rather than safety. Why? Because the Democrat Party has metastasized Engles/Marx/Lenin ideology.

But the Scriptures are “profitable.” Although written millennia ago and addressed to specific nations, the inspired principles of governing apply today (The Bible, Romans 15:4).

 

The Scriptures emphasize the Almighty’s sovereignty. This reign ultimately brings human governing into the judgement dock. Among the many somber principles addressing this point here are two applying to the political crisis mismanagement:

 

Isaiah 28:15, “(Y)ou have said…we have made falsehood our refuge and we have concealed ourselves with deception.”

 

Jeremiah 49:16,“As for the horror you cause, the arrogance of your heart has deceived you, you who occupy the height of the hill. Though you make your nest as high as an eagle’s, I will bring you down from there, declares the Lord.”

 

Let those positioned in “high places” to govern our nation realize they are not positioned for arrogance but for assuring the continued greatness of our nation. They are not positioned to play the population to fuel chaos but to assure civility.

A: The DNI can assemble material from any silo. Meaning the DNI can reach into any IC silo and extract anything they want.

 

Under the original authorities given to the DNI, this authority exists. So, let’s spread the wings on this office and do exactly what it is permitted to do, only this time extract for the purpose of showing the President what is happening in every silo.

 

Almost every day an intelligence community overview assessment is compiled, it’s called the Presidential Daily Briefing or PDB.

 

The PDB contains content primarily produced by the CIA. However, in the modern era, the PDB is assembled and enhanced by adding information from other intelligence agencies (silos). The Director of National Intelligence assembles it; the position Tulsi Gabbard has recently been nominated for.

 

The DNI (now Tulsi) compiles the information, then delivers the PDB to the President, the National Security Advisor (now Mike Waltz) and the list of people assigned by the President to review it.

 

The PDB is the Intelligence Community (IC) telling the Office of the President, this is what’s going on. The PDB frames the worldview of the CIA and other agencies.

 

However, if the CIA/IC wants to frame policy and action to their agenda – and not to the agenda of the president/administration per se’ – the CIA/IC can shape the PDB information toward their own individual objectives. In the past several decades the CIA manipulation of the PDB became obvious.

 

Because the PDB was no longer considered to be an “independent” finding of fact, and was/is, instead, more of a CIA tool to shape and control the president, it became increasingly useless.

 

President Obama saw the traps within the CIA/IC use of the PDB and started to ignore it. Obama gave the PDB to almost two-dozen administration officials daily, essentially saying, “here this is what the CIA say is going on – check it out.” Meanwhile Obama did what he wanted to do in shaping policy, often regardless of the PDB content.

 

With an incoming President Trump administration, the CIA/IC use of the PDB to manipulate outcomes will be even more on display. With that in mind, here’s one approach that might be worth considering.

 

Make the CIA/IC (now Ratcliffe/Tulsi) provide a footnote for every assertion of fact within the PDB.

 

Put the footnotes into a classified appendix that includes sources and methods and give the appendix only to the National Security Advisor, now Mike Waltz. [ie. ‘Review and return’]

 

Let NSA Mike Waltz then review the attributions of source material in the White House SCIF. Then, if any concerns are noted, Waltz can turn to the National Security Council with a generalized statement describing the concern saying, “check this out.”

 

The NSC can then dig into the granular details and return with their own independent assessment about the validity of the information.

 

The National Security Advisor, Mike Waltz, can then go question the specific CIA/IC silo about any contradiction that might be at issue.

 

Do this enough times, and I predict the PDB will quickly change in both tone and content. The originators of the intelligence assessment, the CIA and other agencies, will be on notice that their homework is being checked by the National Security Council.

 

In essence, the DNI CAN BE deployed like a super strong cross-silo inspector general’s office. Force the other IC silos to comply with the demands of the DNI. This has never been done. But the DNI has this unique power.

 

The DNI can make the FBI, DOJ, DOJ-NSD, DoD, DoS and CIA provide anything and everything they demand. Instead of the other silos using blocks and threats against the office of the President, use the authority of the DNI to get them without confrontation. Then use the DNI to declassify the documents (if requested by potus), instead of the originating silo.

 

Can you see how the DNI office can be repurposed to be a seriously strong weapon in the toolbox of the President, against the schemes of those inside the various IC silos. The DNI becomes much more important than the CIA Director, NSA Director, FBI Director, Attorney General, etc, because the DNI can just show up and say, “give me this.” That’s the whole functional purpose of the DNI office that has never been exerted; let’s flippin’ use it.

 

Let’s use the office of the DNI as the central information hub that takes information from inside the corrupt silos, then provides that information to the President who puts sunlight upon it. Each corrupt silo penetrated with disinfectant. This could begin a process to pull down the shadow operations and let the American public see what has been happening inside our IC apparatus.

 

To accomplish this approach the National Security Advisor to the President (NSA), would be the person who tells the DNI exactly what they are looking for.

How does the NSA know what to look for? Because the National Security Advisor is the head of the National Security Council (NSC).

 

Now you see why I say put the strategic scruffy people like in a stripped down NSC.

 

Let the NSC monitor the silos with specific intent, then provide Trump’s NatSec Advisor with details on what appears to be happening and where.

 

With the approval of the President, the NSA then turns to the DNI and says, “POTUS wants this, go get this.”

 

Raw, unfiltered, unredacted information. The silo administrators end up in a fight with the ODNI, not the office of President Trump. President Trump then uses the power of his office to support the demands of the DNI.

 

Under this approach the DNI has a lot more power; yet funnily, it’s power they already have – yet have never utilized.

 

♦ Q: “Could Tulsi Gabbard actually enforce the rules for FISA? That would reduce spying by 95%.”

 

A: No. The DNI does not have any authority over how FISA is used. That is exclusively a DOJ-National Security Division (DOJ-NSD) decision.

 

♦ Q: “Has FISA ever been brought to the Supreme Court?”

 

A: No. You cannot bring FISA to the Supreme Court. It is not permitted because SCOTUS has ruled the judicial branch must defer all national security definitions to the executive branch. Period. End of Story. Understand this conundrum and you understand why this insufferable system continues without restriction.

 

♦ Q: “There are some voices here suggesting Gabbard lie her way into confirmation; agree with it all and fight it later. In your opinion, is this realistic, possible, sane, moral etc.?”

 

A: “In my opinion it is an unrealistic expectation. Whatever Tulsi Gabbard says to the SSCI during confirmation, is what she will be held accountable for. If she later deviates, specifically because of the interests we are discussing here, the Senate (both parties) will impeach her.

 

Chairman Tom Cotton and Vice-Chair Mark Warner will work together to remove her, if Gabbard flinches or moves one inch outside her senatorial permissions.

 

♦ Q: “Can Trump, on his own, end this FISA-702 thing? Can anyone answer this question for me please? Thanking you in advance…God bless America.”

 

A: Eh, sort of. As a confirmed Attorney General Pam Bondi can suspend the FISA process simply by not using the FISA Court. It would be a highly controversial thing to do, but President Trump is well within his “plenary” power to not use the FISA Court, and to use a standard Federal Court for Title-1 surveillance warrants; that can, if needed, be filed under seal. However, stopping the fraud and abuse via searches of the NSA database is another matter entirely.

A: I absolutely agree with a version of this. I have said so before. Any non-compliant access to the NSA database should immediately result in revocation of any/all classified security clearances, and immediate criminal prosecution should take place. Unfortunately, it will be challenging to do; because as IG Horowitz attested, over 10,000 users currently have access to this database across 1,500 workstations. {GO DEEP}

 

Office of Inspector General Michael Horowitz testified April 27, 2023, that more than 3.4 million search queries into the NSA database took place between Dec. 1st, 2020 and Nov. 30th, 2021, by government officials and/or contractors working on behalf of the federal government. These search queries were based on authorizations related to the Foreign Intelligence Surveillance Act (FISA).

 

Approximately 30% of those 3.4 million search queries were outside the rules and regulations that govern warrantless searches, what the politically correct government calls “non-compliant searches.” That means more than 1 million searches of private documents and communication of Americans were illegal and outside the rules.

 

Additionally, IG Horowitz also admitted that somewhere north of 10,000 federal employees have access to conduct these searches of the NSA database; a database which contains the electronic data of every single American, including emails, text messages, social media posts, instant messages, direct messages, phone calls, geolocation identifiers, purchases by electronic funds, banking records and any keystroke any American person puts into any electronic device for any reason. {READ MORE}

Crazy Like A Fox: Trump's Greenland Pitch

It was back in August 2019, just about the time Democrats were wasting everyone’s time with the first fake impeachment scandal, when Donald Trump originally introduced the idea of buying Greenland from Denmark.

 

At the time, the notion was dismissed by the pointy-headed arbiters of right and wrong known as the mainstream media, who concluded that Trump must see his presidency as an extended season of “The Apprentice.” In this episode, the modern-day land baron outsmarts the Scandihoovian rubes who didn’t know the “green” in Greenland was cold hard cash.

 

Like almost every other preconception of Trump in his first term, that take was nonsensical. There was considerable historical and geo-political justification for Trump’s proposal to rescue Greenland from European colonialism, and perhaps if his enemies had not sprung the Ukraine phone call impeachment hoax shortly after the Greenland gambit was proposed, it might have become a major accomplishment of Trump’s first term.

 

I wrote about the original proposal on Aug. 26, 2019, for RealClearPolitics in an article that declared “Trump’s No Safe Bet; He’s a Leader.” The premise was that unlike the feckless, washed-out, safety-in-numbers politicians who lead by following polls, Trump used common sense and intuition to find solutions to problems no one else even liked to think about. Building a wall to keep out illegal immigrants might seem like an obvious idea now, but before Trump, no one would have dared to say it.

 

The same is true of his wish to reclaim Greenland as North American territory. Few if any of Trump’s contemporaries had considered the idea, but it was not without precedent. Lincoln’s Secretary of State William Seward had sought to purchase Greenland for the United States in 1867, the same year he famously acquired Alaska from Russia.

 

These days, it may seem jarring to talk about buying large chunks of real estate for the purpose of national aggrandizement, but it wasn’t always so. In addition to Seward’s purchase of Alaska, the United States also can be grateful for Jefferson’s Louisiana Purchase, which nearly doubled the size of the country, as well as for the largely free acquisition of Florida from Spain. Land deals are not just in Trump’s blood; they are part of our national heritage.

 

They can also be vital to national security. Certainly everyone can agree we were infinitely better off during the era of the Soviet Union because Alaska was no longer in the hands of the Russian oligarchs. And President-elect Trump alluded to a similar benefit on Truth Social when he appointed his ambassador to Denmark in December:

 

“For purposes of National Security and Freedom throughout the World, the United States of America feels that the ownership and control of Greenland is an absolute necessity.”

 

Trump elaborated on that sentiment last week during his impromptu press conference at Mar-a-Lago.

 

“We need Greenland for national security purposes. … People really don’t even know if Denmark has any legal right to it, but if they do, they should give it up because we need it for national security. That’s for the free world. I’m talking about protecting the free world. You don’t even need binoculars. You look outside, you have China ships all over the place. You have Russian ships all over the place. We’re not letting that happen. We’re not letting it happen.”

 

So again, we have the Russian threat, but this time added on top of the perhaps even greater Chinese threat. As I pointed out five years ago, China has its own eyes on Greenland, not just for the strategic importance but because it is a repository of rare earth minerals and other resources:

 

“President Trump was well aware that the Chinese had already expressed their own interest in Greenland, offering to fund millions of dollars of infrastructure improvements on the island as part of the plan for global economic domination known as the ‘Belt and Road Initiative.’”

 

Fortunately, pressure on Denmark largely thwarted China’s Greenland ambitions, but meanwhile Trump’s appetite for American expansionism was whetted.

 

It is perhaps significant that the play for Greenland has been paired with Trump’s threat to take back the Panama Canal, which was turned over to the nation of Panama by Jimmy Carter in the late 1970s. The canal zone, after all, has proven to be a lucrative foothold for China in the New World, and provides a chilling warning of what might happen if someone of Trump’s stature did not step forward to hold the communist state out of Greenland.

 

And one thing is certain. No one is laughing at Trump this time around for his pitch to Denmark. Far-fetched? Maybe, but no one dares to underestimate Trump any longer. His willpower is a force of nature, and if he says he wants Greenland, don’t count him out.

The suspects face varying charges including second-degree kidnapping, first-degree assault, aggravated robbery, second-degree burglary, extortion and menacing. In addition to the above charges, the Aurora Police Department has also obtained arrest warrants for three additional suspects. Those suspects are not yet in custody.

 

The charges and the warrants stem from about 2:30 a.m., Tuesday, Dec. 17, 2024, when Aurora police patrol officers responded to a report of a kidnapping at The Edge at Lowry Apartments, located in the 1200 block of Dallas Street. The investigation to date has determined two victims were confronted by approximately a dozen armed suspects and taken to a vacant apartment against their will where they were bound, threatened and assaulted.

 

A total of 19 people were detained during the preliminary investigation. Three people were subsequently released after being interviewed by investigators and it was determined they were not involved in the crime.

 

The remaining 16 suspects are being held by U.S. Immigration and Customs Enforcement, which includes the nine suspects charged last week in Arapahoe District Court. The additional seven suspects in ICE custody remain under investigation for the Dec. 17, 2024, kidnapping.

 

In addition to the cases and charges noted above, Niefred Jose Serpa-Acosta was previously wanted on an active felony warrant for first-degree burglary and menacing with a deadly weapon. The warrant stemmed from Aug. 18, 2024, when a security camera captured Serpa-Acosta and five other armed men knocking on apartment doors at The Edge at Lowry about 10 minutes before a fatal shooting in the 1200 block of Dallas Street.

 

By Oct. 2, 2024, Operation Safe Haven investigators positively identified and obtained arrest warrants for all six suspects. With Serpa-Acosta’s capture last month, four of the six suspects from the Aug. 18, 2024, crime are now in custody.

 

Operation Safe Haven is a special Aurora Police Department task force activated last August to investigate crimes involving the city’s migrant population.

 

The investigation into the Dec. 17, 2024, kidnapping is active and ongoing. Anyone with any information is asked to contact Metro Denver Crime Stoppers at 720.913.STOP (7867). Tipsters can remain anonymous and could be eligible for a reward of up to $2,000.

India’s fencing along border ‘unauthorised’

 

Dhaka has told New Delhi that the construction of barbed wire fences by the Indian Border Security Force along the Bangladesh-India border "without proper authorisation" undermines the spirit of cooperation and friendly relations between the two nations.

 

Foreign Secretary Md Jashim Uddin has made this communication to Indian High Commissioner to Bangladesh Pranay Verma, who was summoned to the foreign ministry yesterday amid tensions touched off by the recent BSF activities along the border.

 

"Such activities, particularly the unauthorised attempts to construct barbed wire fencing and the related operational actions by BSF, have caused tensions and disturbances along the border," Jashim Uddin said in a media statement yesterday.

 

Also, Dhaka will push for the cancellation of any "unequal agreements" related to Bangladesh-India borders at a director general-level meeting of the border forces of the two countries scheduled for February.

 

Speaking at a press conference at the Secretariat yesterday, Home Affairs Adviser Lt Gen (retired) Jahangir Alam Chowdhury said that due to the BSF's recent fencing activities, tensions arose in five border areas, including Chapainawabganj, Naogaon, Lalmonirhat, and the Tin Bigha Corridor.

 

"Thanks to the strong position of the BGB and locals, India has been forced to halt its activities. I extend my gratitude to them for their role in this matter."

 

He added that various issues have risen along the border due to some "unequal agreements" signed during the previous government's tenure.

 

Jahangir Alam said four border-related Memorandums of Understanding have been signed between the two countries since Bangladesh's independence.

 

Asked at a separate press briefing in the foreign service academy, Chief Adviser's Press Secretary Shafiqul Alam said those four agreements are the 1974 Land Boundary Agreement for the disposal of enclaves and disputed lands; the Joint Indo-Bangladesh Guidelines for Border Authorities 1975; the Land Boundary Agreement Protocol 2011; and the Coordinated Border Management Plan 2011.

 

The home adviser said that, of those agreements, the 1975 MoU specifies that no defence development activities can take place within 150 yards of the zero line.

 

"Another MoU states that any development activities cannot occur within the 150 yards of the zero line without mutual consent. Any such work will require prior agreement between the two nations."

 

He said India has already fenced 3,271km of the 4,156km-long border with Bangladesh, leaving approximately 885km unfenced.

 

Jahangir Alam accused the previous Awami League government, which was in power between 2009 and 2024, of granting India unequal opportunities through MoUs, which have now led to the disputes over barbed wire fencing at 160 locations.

 

He stressed that these challenges stemmed from written permissions granted by the previous government. "These permissions should not have been issued."

 

He also said, "A major problem arises from the written assurances that allowed India to carry out certain activities. One of the significant issues pertains to the Tin Bigha Corridor."

 

Under the 1974 agreement, he said, Bangladesh handed over Berubari to India after parliamentary ratification. In return, India was supposed to provide Bangladesh with access to the Tin Bigha Corridor, but it failed to fulfil this commitment.

 

"They would open the corridor for an hour and then close it for another hour. Later, in 2010, a new agreement was signed to keep the corridor open for 24 hours. However, this [2010] agreement also allowed India to construct a border fence on the zero line at Angarpota.

 

"Now we face challenges in opposing this construction as Bangladesh signed this agreement."

 

At the meeting with Indian High Commissioner Pranay Verma, Foreign Secretary Jashim Uddin expressed serious concerns over BSF's recent activities along the border.

 

He called upon the Indian government to advise all authorities concerned there to refrain from any provocative activities that could stoke tensions along the shared border.

 

He hoped the matter would be discussed at length in the upcoming BGB-BSF DG-level talks.

 

After the meeting, Pranay Verma told journalists they discussed New Delhi's commitment to ensuring a crime-free border, effectively addressing the challenges of smuggling, movements of criminals and trafficking.

 

"We have an understanding with regard to fencing the border for security, the two border forces BSF and BGB have been in communication.

 

"We expect that the understanding will be implemented and there would be a cooperative approach to combatting crimes along the border."

 

At the meeting, Jashim Uddin also referred to the recent killing of a Bangladesh citizen by BSF in Sunamganj and expressed concern and disappointment over such persistent border killings despite repeated commitments from the Indian authorities to pursue a non-lethal strategy to stop killings.

 

He strongly called for urgent action by India to stop recurrence of such incidents; conduct enquiries into all the border killings; and take action against those responsible.

 

Jashim Uddin added that Bangladesh believes such issues should be resolved through constructive dialogues, in accordance with existing bilateral agreements, and in a way that upholds peace and tranquility along the border.

China Discusses Sale of TikTok US to Musk as One Possible Option

 

(Bloomberg) – Chinese officials are evaluating a potential option that involves Elon Musk acquiring the US operations of TikTok if the company fails to fend off a controversial ban on the short-video app, according to people familiar with the matter.

 

Beijing officials strongly prefer that TikTok remains under the ownership of parent ByteDance Ltd., the people say, and the company is contesting the impending ban with an appeal to the US Supreme Court. But the justices signaled during arguments on Jan. 10 that they are likely to uphold the law. Senior Chinese officials had already begun to debate contingency plans for TikTok as part of an expansive discussion on how to work with Donald Trump’s administration, one of which involves Musk, said the people, asking not to be identified revealing confidential discussions.

 

A potential high-profile deal with one of Trump’s closest allies holds some appeal for the Chinese government, which is expected to have some say over whether TikTok is ultimately sold, said the people. Musk spent more than $250 million supporting Trump’s re-election, and has been tapped for a prominent role in improving government efficiency after the Republican takes office.

 

Under one scenario that’s been discussed by the Chinese government, Musk’s X — the former Twitter — would take control of TikTok US and run the businesses together, the people said. With more than 170 million users in the US, TikTok could bolster X’s efforts to attract advertisers. Musk also founded a separate artificial intelligence company, xAI, that could benefit from the huge amounts of data generated from TikTok.

 

Chinese officials have yet to reach any firm consensus about how to proceed and their deliberations are still preliminary, the people said. It’s not clear how much ByteDance knows about the Chinese government discussions or whether TikTok and Musk have been involved. It’s also unclear whether Musk, TikTok and ByteDance have held any talks about the terms of any possible deal.

 

Musk and his representatives did not respond to a request for comment. Musk posted in April that he thinks TikTok should remain available in the US. “In my opinion, TikTok should not be banned in the USA, even though such a ban may benefit the X platform,” he wrote on X. “Doing so would be contrary to freedom of speech and expression. It is not what America stands for.”

 

ByteDance and TikTok representatives didn’t respond to messages seeking comment. The Cyberspace Administration of China and China’s Ministry of Commerce, government agencies that could be involved in decisions about TikTok’s future, also didn’t respond to requests for comment.

 

The talks in Beijing suggest that TikTok’s fate may no longer be in ByteDance’s sole control, said the people. Chinese officials recognize they will face tough negotiations with the Trump administration over tariffs, export controls and other issues, and they see the TikTok negotiations as a potential area for reconciliation, they said.

 

The Chinese government holds a so-called golden share in a ByteDance affiliate that gives it influence over the company’s strategy and operations. TikTok maintains that the control only applies to the China-based subsidiary Douyin Information Service Co., and has no bearing on ByteDance operations outside China. Still, Beijing’s export rules prevent Chinese companies from selling their software algorithms, like the one integral to TikTok. Because the Chinese government would have to approve of a sale that includes TikTok’s valuable recommendation engine, it has a significant voice in any possible deal.

 

TikTok’s US operations could be valued at around $40 billion to $50 billion, Bloomberg Intelligence analysts Mandeep Singh and Damian Reimertz estimated last year. That’s a substantial sum even for the world’s richest person. It’s not clear how Musk could pull off such a transaction, whether it would require the sale of other holdings, or whether the US government would approve. He paid $44 billion for Twitter in 2022, and is still paying off sizable loans.

 

Musk has a positive reputation among many ByteDance employees in China, according to a person familiar with the matter. He is seen as a very successful entrepreneur, who has experience engaging with the Chinese government through his Tesla Inc. business, the person added.

 

ByteDance’s leaders have repeatedly said their priority is to fight US legislation that requires the Beijing-based company sell or shut down the US operations because of national security concerns. TikTok’s lawyers have argued the legislation violates free speech laws under the Constitution’s First Amendment.

 

A majority of the Supreme Court justices suggested the security concerns take priority over free speech, although they have yet to issue a formal decision. President-elect Trump, who takes office Jan. 20, has sought to delay the TikTok ban — which takes effect Jan. 19 — so he can work on the negotiations. He has said he wants to “save” the app and there’s been speculation he could take last-minute action to sidestep the ban.

 

On a practical level, spinning off TikTok’s US business would be highly complex, affecting shareholders in China as well as the US. Lawyers for TikTok argued before the Supreme Court that separating the US portions of the product would be “extraordinarily difficult.”

 

It’s unclear if US TikTok would be sold off in a competitive process, or if a sale would be arranged by the government. Billionaire Frank McCourt and “Shark Tank” investor Kevin O’Leary are part of a bid through Project Liberty to acquire TikTok, which O’Leary has said he discussed with Trump. In the past, Microsoft Corp. had sought to acquire the business, and Oracle Corp. has a deep technology partnership with the company.

 

One alternative for TikTok would be to move its existing US customers over to a similar app — with different branding — to potentially sidestep the ban, one of the people said. It’s not clear how effective such a move would be.

 

One person close to the company, who spoke on the condition of anonymity because of the sensitivity of the strategy, said before the Supreme Court hearing that the legal battle is still the focus of top executives and they would prefer to keep fighting in the US rather than sell TikTok US and cede control for good.

 

Musk is in a position to influence the China-US relationship as the world’s richest person with businesses that straddle the world’s two largest economies. Tesla, where Musk is chief executive officer, erected a sprawling factory in Shanghai in 2019 and has since expanded the facility into the company’s largest production base. The effort helped Tesla expand its market share in China despite tough local competition, and build goodwill with government officials.

 

While Trump is staffing his incoming administration with China hawks like Secretary of State nominee Marco Rubio, Musk has spoken out against some recent China trade policies, including the Biden administration’s tariffs on Chinese electric vehicles.

Newsom Suspends State Environmental Rules for Rebuilding After Fires

 

California is one of America’s most difficult and costly places to build — a driving factor behind the state’s longstanding affordable housing shortage.

 

Governor Gavin Newsom has signed a broad executive order that aims to make it easier to rebuild after the fires by suspending California’s costly and time-consuming environmental review process for homeowners and businesses whose property was damaged or destroyed.

The order is likely to be the first of several permit streamlining measures issued by state, county and city agencies in the wake of the devastating fires across greater Los Angeles.

Mr. Newsom's three-page order, signed Sunday, covers all of Los Angeles and Ventura Counties and directs state agencies to coordinate with local governments to remove or expedite permitting and approval processes during rebuilding. The most significant piece is a waiver on permitting requirements under the California Environmental Quality Act — a landmark environmental law known colloquially as C.E.Q.A. or “See Qua.”

The governor also announced that he had suspended all permitting requirements under the California State Coastal Act for properties rebuilding after the fires.

California is one of America’s most difficult and costly places to build — a driving factor behind the state’s longstanding affordable housing shortage. Between state agencies and local land use commissions, the process of developing buildings, from office complexes to subsidized rental complexes, is longer and more expensive than in almost every other state.

Of all the hurdles a project can be subjected to, few are more difficult and time-consuming than C.E.Q.A. The law often requires developers to fund in-depth environmental studies on a project’s potential impact on everything from local wildlife to noise, views and traffic. Groups who oppose a particular development often use C.E.Q.A. lawsuits to try to stop them. This can add years even to small projects.

While the state’s powerful environmental groups are fiercely protective of any attempts to amend C.E.Q.A. or the Coastal Act, the laws are routinely suspended in emergencies and for large projects such as sports stadiums.

Still, Mr. Newsom’s order was unusually extensive. For instance, after other disasters C.E.Q.A. suspensions have typically required rebuilding property owners to show they tried to comply with the law, even if they weren’t subjected to it. The order announced Sunday is a full waiver: For anyone rebuilding after the fires, C.E.Q.A. is effectively gone.

AfD endorses controversial ‘remigration’ as German election race tightens

 

The co-leader of Germany’s AfD has endorsed the policy of “remigration”, pledging to carry out mass deportations of immigrants if it enters government next month.

 

Announcing her party’s election manifesto, Alice Weidel said Germany would witness “repatriations on a large scale” and a “total closing of Germany’s borders” in the party’s first 100 days in power if elected.

 

The AfD’s candidate for chancellor used the controversial term “remigration” to describe the policy during a speech to supporters in Riesa, a small town in eastern Germany that has seen a series of anti-AfD protests in recent days.

 

The phrase refers to the return of migrants to their place of origin – regardless of their citizenship status.

 

“If this must be called ‘remigration’, then let it be called ‘remigration’,” she said as the crowd cheered in response, while protesters jeered outside the town hall.

 

“Remigration” has been a controversial and much-debated term in German politics over the past year, with critics saying the policy is akin to ethnic cleansing.

 

Last week, investigative journalists published allegations of a secret meeting near Potsdam involving far-Right groups, including senior AfD figures, to discuss the “remigration” of millions of people – including “non-assimilated” people with German citizenship.

 

The commitment to “remigration” has put the AfD at odds even with other European far-Right groups, including France’s National Rally, headed by Marine Le Pen, which expelled AfD from its European Parliament group in May.

 

However, the AfD – which has been labelled a suspected extremist group by Germany’s domestic intelligence agency – has been climbing in the polls ahead of the vote, which Chancellor Olaf Scholz is expected to lose, on Feb 23.

 

Recent polls show the party in second place, with an average of 20 per cent. One poll showed only an eight-point difference between the AfD and the front-running centre-Right Christian Democrats (CDU) on just over 30 per cent.

 

However, a long-standing arrangement among Germany’s other parties against working with the AfD means it is unlikely to enter government.

 

That realistically leaves the CDU to work with one of the country’s two main Left-wing parties to form a government, at a time when many Germans want a tougher line on immigration and asylum.

 

The two parties are Mr Scholz’s Social Democrats and the Greens, which are fighting it out for third place. Polls put support for the parties at 15 and 14 per cent respectively.
