Trump plans to attend oral arguments in Supreme Court birthright citizenship case

Both the Supreme Court and the Supreme Court Historical Society have said there is no official record of any sitting president attending oral arguments.

President Donald Trump said he plans to take the extraordinary step of attending Supreme Court oral arguments Wednesday in a case that could end birthright citizenshipin the U.S.

"I'm going," Trump told reporters in the Oval Office on Tuesday. "Because I have listened to this argument for so long."

White House press secretary Karoline Leavitt later confirmed to NBC News that Trump plans to be there Wednesday morning when Supreme Court justices hear arguments on the constitutionalityof a January 2025 executive order he signed that seeks to limit birthright citizenship to people who have at least one parent who is a U.S. citizen or a legal permanent resident.

Both the court and the nonprofit Supreme Court Historical Society said in October that there is no official record of any sitting president having attended oral arguments at the high court.

Trump attended the formal ceremonies at the court confirming his Supreme Court appointees Neil Gorsuch and Brett Kavanaugh, but he has never been there before for arguments.

Trump would be present weeks after his attacks on justices following the court's ruling against his tariffs. At the time, he called justices "disloyal to the Constitution." In the days leading up to oral arguments in that case, Trump indicated he might attend them at the Supreme Courtbut ended up not going.

Richard Pildes, a professor of constitutional law at New York University, said Trump's presence during oral arguments "certainly raises the temperature of the argument, which might be the President’s intent."

"The case is about the powers of the presidency as an institution," Pildes said in an email to NBC News. "By showing up in person, the President would instead be personalizing the case, as if it’s a personal confrontation between him and the justices."

He added that presidents have avoided attending oral arguments because there is an understanding that the court's decisions apply to the presidency as an institution, not to just an individual president's time in office.

“They have understood it’s not good for the country to up the level of confrontation by representing the dispute as a more personalized one through showing up in person,” Pildes said.

While Trump's presence would be unorthodox, he is by no means the first president to publicly comment on a pending case tied closely to a White House agenda. President Barack Obama drew criticism in 2012 after he said the Supreme Court would be taking an “unprecedented, extraordinary step” if it struck down the 2010 Affordable Care Act.

Chief Justice John Roberts has worked hard to keep the Supreme Court independent from the two other branches of government, frequently speaking out against threats to and attacks on the judiciary. Many of those attacks have come from Trump, the head of the executive branch.

"The problem sometimes is that the criticism can move from a focus on legal analysis to personalities," Roberts said March 17. "And you see from all over, I mean, not just any one political perspective on it, that it's more directed in a personal way, and that, frankly, can be actually quite dangerous."

"Personally directed hostility is dangerous and has got to stop," he added.

The Supreme Court agreed in December to hear the case after lower courts ruled against Trump's plan to end automatic birthright citizenship for almost anyone born in the U.S.

The 14th Amendment has long been interpreted to protect birthright citizenship, as it states: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.”

The Trump administration is pushing back against the longtime interpretation of that clause.

Lawmakers are leaving Washington in record numbers.

On Friday, Republican Congressman Sam Graves of Missouri became the 36th Republican and 57th House member to announce plans not to seek re-election, saying it was time to "pass the torch" to a new generation. In fact, more Republicans are retiring ahead of the midterms than at any point in nearly a century, according to an ABC News tally of retirement announcements and a review of historical data since 1930 compiled by the Brookings Institution.

Heading for the exits

That's a larger cohort than the 34 Republicans who did not run to keep their seats in 2018, when Republicans lost the majority in a 40-seat wave election to Democrats during the first Trump administration.

It includes powerful committee chairs, including Graves and Rep. Jodey Arrington of Texas, the Republican leader of the House Budget Committee; veterans such as retired Navy SEAL Rep. Morgan Luttrell of Texas and retired Air Force brigadier general Rep. Don Bacon of Nebraska; and 20 Republicans running for Senate or governor of their home states.

Two other Republicans, Rep. Marjorie Taylor Greene of Georgia and Rep. Mark Green of Tennessee, retired before the end of the term. Rep. Dan Crenshaw lost his primary in Texas this month.

"Republicans are staring down the barrel of the minority party, which is not a fulfilling place to be in federal politics in 2026," said Casey Burgat, the director of the Legislative Affairs Program at George Washington University.

So far, 21 House Democrats have announced plans to retire, more than the total that left ahead of the 2018 midterms, but fewer than the 29 Democrats who did not run for office again before the party lost the House majority in 2021. Of that cohort, eight launched bids for Senate or governor of their home states. Another Democrat, former Rep. Mikie Sherrill of New Jersey, has already left Congress and won the New Jersey governor's race last fall.

Many reasons for leaving

Many of the lawmakers cited personal reasons, including long careers and their families, as shaping their decisions not to seek office again.

Others dropped re-election bids following redistricting fights that scrambled political maps and would have forced them to campaign in new districts.

The group of retiring members, particularly the Democrats, includes influential party leaders who have spent decades in Congress, including former House Speaker Nancy Pelosi of California, and former House Majority Leader Steny Hoyer of Maryland.

The 86-year-old Democrats began their political lives decades ago, as interns together in the 1960s for then-Maryland Sen. Daniel Brewster.

Still, some of the oldest members of Congress, such as 88-year-old Rep. Hal Rogers, R-Ky., and 87-year-old Rep. Maxine Waters, D-Calif., are running for re-election.

Rep. Jared Golden, 43, a moderate Democrat from Maine, surprised some colleagues when he announced plans to retire from his Trump-leaning district.

In his announcement, he pointed to the "increasing incivility and plain nastiness" of politics, and "recent incidents of political violence" that factored into his decision to leave public life.

"As a father, I have to consider whether the good I can achieve outweighs everything my family endures as a result," he wrote in the Bangor Daily News.

Golden also voiced frustration with the state of Congress and the longest shutdown in government history last fall, arguing that the dysfunction led him to reconsider his options.

With redistricting from both parties carving up the House map and leaving fewer truly competitive swing districts, politicians may be motivated by what helps them win primaries elections, over what can be done through legislative compromise across Capitol Hill, Burgat said.

"Compromise has become a dirty word," he told ABC News.

WSJ: Trump Is Right on Birthright Citizenship

The 14th Amendment’s authors would exclude illegal and visiting aliens from U.S. ‘jurisdiction.’

President Trump’s executive order denying birthright citizenship to U.S.-born children of nonresident aliens goes before the Supreme Court Wednesday, and conventional wisdom has it that the president will lose in Trump v. Barbara. If the court stays true to the original meaning of the 14th Amendment’s Citizenship Clause, however, the conventional wisdom will prove wrong.

The clause grants citizenship to persons who meet two conditions: birth in the U.S. and being “subject to the jurisdiction” of the U.S. The dispute is over the meaning of the latter term. Everyone agrees that it excludes at least three classes: children of diplomats, of soldiers from an invading army, and of American Indians maintaining tribal relations. In each of these categories, the status of the child depended on the status of the parent.

The constitutional debate is about the original concept embodied in the text that explains these exclusions and whether that concept embraces or excludes children born on U.S. soil to parents who are unlawfully or temporarily in the U.S. The court has never squarely addressed this question.

Before Mr. Trump’s executive order, what originalist scholarship existed on the original meaning of “subject to the jurisdiction” was sporadic and lightly tested if at all. The past year has produced an explosion of originalist scholarship on both sides. The justices are now in a good position to decide which side has presented the stronger originalist case.

Kurt Lash of the University of Richmond has examined the congressional debates over the 14th Amendment and the Civil Rights Act of 1866. That act declared that “all persons born in the United States and not subject to any foreign power” are citizens. The 14th Amendment was intended to constitutionalize, not alter, the Civil Rights Act. Congress re-enacted the same language after the 14th Amendment was adopted, suggesting an identical operation. But the drafters of the 14th Amendment saw a need for constitutional language that more clearly excluded the children of tribal Indians.

Sen. Lyman Trumbull (R., Ill.), who managed the Citizenship Clause in the upper chamber, explained that “subject to the jurisdiction” meant “not owing allegiance to anybody else,” whether to a tribe or a foreign power. Rep. Axios Supply Chain Attack Pushes Cross-Platform RAT via Compromised npm Account

The popular HTTP client known as Axios has suffered a supply chain attack after two newly published versions of the npm package introduced a malicious dependency that delivers a trojan capable of targeting Windows, macOS, and Linux systems.

Versions 1.14.1 and 0.30.4 of Axios have been found to inject "plain-crypto-js" version 4.2.1 as a fake dependency.

According to StepSecurity, the two versions were published using the compromised npm credentials of the primary Axios maintainer ("jasonsaayman"), allowing the attackers to bypass the project's GitHub Actions CI/CD pipeline.

"The dropper contacts a live command and control server and delivers platform-specific second-stage payloads. After execution, the malware deletes itself and replaces its own package.json with a clean version to evade forensic detection."

THE DISEASE

First, shingles is genuinely unpleasant

To fairly evaluate any vaccine, you have to start with the disease it prevents. Shingles is caused by the same virus that gave you chickenpox as a child — it never fully leaves your body. It retreats into your nervous system and can reactivate decades later, typically producing a painful, blistering rash that appears in a band on one side of your torso, face, or limbs.

For most people, the rash resolves in two to four weeks. But for a significant minority, roughly one in five people who get shingles, rising to nearly one in three among adults over 60, the pain doesn’t stop when the rash heals. This complication is called postherpetic neuralgia, or PHN. It’s a chronic nerve pain that can persist for months, years, or sometimes permanently, and is described by those who have it as burning, electric, and constant. It is associated with depression, sleep disruption, and social withdrawal.

Most cases of shingles are mild to moderate and resolve within a few weeks, with 10–20% becoming “severe” in a meaningful clinical sense.

I have personally had shingles fifteen plus years ago, an unusual and rather nasty variant called intra-abdominal shingles. Inside your abdomen. I did not have medical insurance, and so I delayed treatment until I could not stand the pain. As a consequence, I developed a particularly nasty postherpetic neuralgia- a paralytic polio-like syndrome that caused a partial paralysis of the left side of my abdomen. Suffice to say, this created problems as an advanced equestrian. I quite literally lost my core. That said, I personally consider that a “natural” booster, and have never accepted the shingles vaccine. My body, my choice.

About 10–18% of shingles cases progress to PHN, which is the main long-term issue. There is no “cure” for PHN, as no drug will cure it. The treatments available are nerve-calming drugs, like gabapentin, antidepressants used as pain medications, and lidocaine patches, which help some people, but roughly 40 to 50 percent of PHN patients never achieve adequate pain relief from any available therapy. BTW - stating that there is “no cure” is medically acceptable language, but it lacks nuance. Most people do improve and even achieve complete recovery, gradually over time. But there is no treatment that will “cure” PHN - drugs will only help with the symptoms, so this is a significant nuance.

This matters for understanding the vaccine because preventing shingles also means preventing any chance of developing PHN. But how effective is the vaccine at actually doing that for any individual?

One of the many secret societies who have been tabbed as the hidden puppet masters behind the New World Order, the Shickshinny Knights of Malta – also known as the American Grand Priory of the Sovereign Order of St John of Jerusalem, Knights of Malta – are headquartered in the modest town of Shickshinny, Pennsylvania, in Luzerne County, an area settled largely by German and Russian immigrants. When Napoleon seized the island of Malta and dispossessed the Knights of their last territorial base, a handful of knights took refuge at the court ofTsar Alexander I of Russia, where they became members of his personal honour guard but preserved a Priory of the Knights of Malta in secret. Some of their descendants emigrated from Russia to Pennsylvania and brought the knightly traditions of their forefathers with them; in 1908, the Order’s Grand Priory in America was founded. By this process, the heritage of the original Knights Hospitallers made its way to Luzerne County. Not least among the ironies of the Shickshinny Knights is the close parallel between these stories and the “family tradition” origin legends of many modern Wiccan groups. See Wicca.

Despite their lurid reputation in certain conspiracy theories dealing with the New World Order, the Shickshinny Knights are among the smaller conservative secret societies in twenty-first-century America. Its membership has included a number of retired generals from the Second World War era, including Charles Willoughby, former chief of intelligence for General Douglas MacArthur, but very few figures with significant power or wealth. It does apparently have significant connections with other extreme right-wing groups in America and Europe – one of its members, for example, was an editor for the John Birch Society magazine American Opinion.
