Don't read too much into it - Apache are an open source company which means their code is community maintained and developed (and therefore community checked with all of it publicly checkable and multiple, traceable people responsible for signing it off into the final build.
Apache is a server, which essentially means that it sits underneath a website and handles traffic. If two companies get into a legal war over information that has leaked or been extracted or inserted via a website, and that website uses apache as it's server (and 45% of the internet does) then at some point Apache will have handled that data.
Apache has to have the fact that it is not legally responsible for incidents such as this written into it's terms otherwise people could attempt to come after them, say in an instance where they have lost money and they can't sue the other company, the real perp. Apache has to ensure that legal responsibility is fairly reflected or mirrored onto the two real participants in this instance and not the middleman.
This is standard in contracts of companies that handle other people's data in a 'passthrough' manner.
Furthermore, Apache is generally accepted as a responsible candidate for a central role in the support of the internet as it is open source software and therefore commercial interests cannot infiltrate the company / directives of the company. Even if the Clowns, say, put a couple of people into the architecture team, because the decision to go forward and the reasons for that are made publicly (inside the community) then without the core development community approving this wouldn't happen.
Compare this with a commercial company - I don't even want to say their name as they have good lawyers, but think database - if their server was used they could put any code in there that they wanted and not disclose. Apache is a trusted vendor of community maintained software, and even if it was subverted then it would be traceable and visible.
