ERBIL (Kurdistan 24) – Over the weekend, Turkey’s President Recep Tayyip Erdogan showed footage of a brutal mass killing on Friday of 50 Muslims in two New Zealand mosques during a political campaign rally ahead of nationwide local elections later this month.

“Let’s watch this. It is important,” Erdogan told his supporters as snippets of the live-streamed video by the cold-blooded shooter identified as the Australian national Brenton Harrison Tarrant played on during the rally televised by almost all major Turkish news TV channels.

Social media companies have come under fire for not being more effective in taking down the video of the brutal massacre of Muslims while worshipping in Christchurch.

Turkish media, too, by law, are barred from airing the violent footage, but the Turkish president’s use of the footage in front of thousands of voters in the city of Tekirdag on Saturday carried it to millions of households—and in a much-politicized manner.

Senator Renews Push to Distance Commanders from Military Prosecutions

Alarming data from the Pentagon on the prevalence and prosecution of sexual assaults continue to drive advocates' efforts to push for an overhaul of the military justice system and to remove commanders from the process of deciding whether to prosecute.

Testifying March 6 in support of a six-year mission by Sen. Kirsten Gillibrand, D-New York, to give military attorneys – not commanders – the say in prosecuting serious crimes such as sexual assault, murder and child pornography, victims and advocacy groups said that the current system continues to fail those who report incidents.

According to retired Col. Don Christensen, former Air Force chief prosecutor and president of the Support Our Defenders advocacy group, about 8 percent of the 5,111 reports of military sexual assault in 2017 were prosecuted, with just 3 percent resulting in a conviction.

"Right now, we have a system where people have no faith in the process. There's ample surveys that show … that people would have more faith if independent prosecutors have this," Christensen told the Senate Armed Services Committee.

Gillibrand has tried for years to pass the Military Justice Improvement Act, which is designed to place responsibility for prosecuting crimes in the hands of trained uniformed criminal lawyers.

She has argued that the current system doesn't work, resulting in criminals going free and retaliation against victims.

"Despite many good leaders, far too many commanders don't make it a priority to address the problem of sexual assault in the military in a meaningful way," she said.

In her efforts to overhaul the system, Gillibrand has called attention to the issue, and changes have happened. For example, trained criminal investigators are now involved in pursuing any allegations of rape or sexual assault.

But, she said, the changes aren't enough.

"All too often, we hear from survivors that they're the ones who are punished. … They're retaliated against sometimes by the chain of command, sometimes by their peers. And in too many cases, survivors are punished for collateral misconduct such as underage drinking or fraternization, while the assailant goes free," Gillibrand said.

Ohio Union Faces Class Action Suit

An Ohio woman is suing one of the state's most powerful unions for its continued collection of dues payments over her objections.

Connie Pennington has been forced to pay dues to the Communication Workers of America Local 4502 as part of her job with the city of Columbus, but attempted to sever ties after the Supreme Court declared mandatory dues payments unconstitutional in the 2018 Janus v. American Federation of State, County, and Municipal Employees ruling. The union has maintained that workers should not be allowed to leave the union until its contract with the city expires in 2020. The lawsuit filed by Pennington seeks to overturn that policy and allow the union's 1,400 government workers to exercise their rights immediately, rather than waiting for the 30-day withdrawal window specified in the city's union contract.

"It impinges upon employees' First Amendment rights by compelling employees, who do not or no longer want to subsidize CWA's speech, to subsidize that speech," the suit says. "Pennington and Class Members are suffering the irreparable harm and injury inherent in a violation of First Amendment rights, for which there is no adequate remedy at law."

The union did not return request for comment.

The union responded to Pennington's initial withdrawal request in an August 2018 letter. CWA warned her that "if you resign now the obligation to pay dues would remain in effect." After reiterating her wish to cut all membership and financial ties, the union honored her request in September, but noted that she "remains obligated to pay dues." It has maintained this position despite Pennington and her attorneys' repeated attempts to cease payments.

CWA is not the only labor organization that has been accused of refusing to honor resignations in the wake of the Janus decision. Class action suits have been filed in Oregon and California alleging that local unions continue to take money out of the paychecks of government workers who resigned their membership. Government workers in nearly a dozen other states are also suing labor representatives to recover back wages lost to forced dues and fee payments over the years.

The suit was filed with legal help from the National Right to Work Foundation, which argued the Janus case before the Supreme Court. The group's president, Mark Mix, said that vigilance is required to ensure that unions abide by the decision. The Foundation has filed hundreds of suit over the years to help workers in right to work states escape coercive dues schemes and arbitrary limits on ending dues payments, such as narrow withdrawal windows. He expects labor organizations to continue to push the limits on forced membership.

"Ms. Pennington joins many other public sector workers across the country in standing up to Big Labor's coercion," he said in a statement. "Union officials have a long history of creating obstacles such as ‘escape period' schemes, arbitrary union-enacted limitations trapping workers into forced dues."

The suit asks the union to reimburse all dues money to objectors and others who have attempted to resign, as well as pay for legal costs associated with the suit.

Carney: Durable Goods Manufacturing Job Openings Up 17% Despite Steel and Aluminum Tariffs

It has been one year since the Trump administration began to roll out tariffs on steel and aluminum. And the evidence is clear that the tariffs have not come at a cost of American jobs.

The new tariffs have made basic materials for the construction of goods in the United States more expensive. Steel and aluminum prices are up sharply compared with the pre-tariff era, but they have been coming down in recent months as U.S. factories have ramped up production.

When Trump announced the tariffs, critics immediately said that while they might help steel and aluminum producers, they would be a net loser for America because metals-using manufacturing employs far more Americans than metals-producing. The higher price would cause employment in metals-using manufacturing to contract, the critics charged.But that hasn’t happened. Over the past year, employment in metals-using manufacturing is up. The strongest indication of this came on Friday, when the government released the data on job openings for January. As the year opened, durable goods manufacturing–the category that is most metals focused–posted 305,000 job openings. That’s nearly a 17 percent gain from last year, before the tariffs.

For several months, as jobs data for metals-using industry continued to show strength, critics of the tariffs charged that the costs were only delayed. One day, real soon, the tariffs would kick in and start killing jobs.

We’re now far enough into the tariff-era to render a decisive judgment: the critics were wrong. The metals tariffs have not hurt American workers.

Catholic priest charged with drugging, raping woman

A Roman Catholic priest in Florida is facing charges that he drugged a female parishioner and raped her.

The Rev. Jean Claude Jean-Philippe was in a Miami-Dade County jail late Saturday charged with sexual battery on an incapacitated victim.

The Miami Herald reports that in October the 64-year-old priest invited the victim to his home at Sacred Heart Catholic Church in Homestead. The woman said she drank tea he gave her and passed out. She told investigators she woke up two hours later naked in Jean-Philippe's bed, believing she was raped.

She did not notify police until two weeks ago after telling another priest. The Miami Archdiocese says she was told to contact authorities. Officers say Jean-Philippe confessed when confronted.

Jail records do not show if Jean-Philippe has an attorney.

Italy Probes Death of Model Who Testified in Berlusconi Sex Trial - Reports

The model told the court in 2012 that young women stripped for Berlusconi at his plush villa near Milan while he was still Italy's prime minister. She claimed that she did not have sex with him, but that those who did received significant sums of cash.

Italian magistrates have launched an investigation into the possible murder of a showgirl who was one of the key witnesses in a prostitution case against former Italian prime minister Silvio Berlusconi.

Imane Fadil, 34, a Moroccan model who claimed to have attended eight of the notorious "bunga bunga" soirées, died in a Milan hospital on 1 March after a "month of agony".

Fadil was taken to hospital on 29 January with severe stomach pains that had caused her to vomit; she reportedly told her friends and lawyers that she had been poisoned.

However, according to Italian news agency Ansa, toxicological tests revealed that she had died of a "mix of radioactive substances".

Fadil testified at Berlusconi's 2012 trial, where he was accused of hosting 'prostitution parties' at his villa in Arcore near Milan. She said that young women dressed as nuns had performed stripteases for a fee and told that they would receive even more if they agreed to have sex with the prime minister.

Berlusconi was accused of having sex with a teenage night-club dancer known under the stage name Ruby Rubacuori. He was also charged with abusing his power in a bid to conceal his connection with Ruby.

The media mogul admitted that young women did attend his parties, but said they were nothing but "burlesque contests". He also insisted that Ruby, who was 17 when she attended his parties, told him she was 24 years old.

He was initially found guilty and sentenced to 7 years in prison, but eventually cleared of all charges by an appeal court which ruled that even if he did have sex with Ruby, he did not know she was under 18.

He has since faced charges of bribing witnesses to give false testimony in the underage prostitution trial.

AT LARGE The Court of appeals in Eastern Finland processed an appeal against a district court sentence against immigrant Ismael Kaba, who last year was found guilty of rape of a 15 year old girl in the city of Joensuu in Northern Karelia. He was also found guilty of gross sexual abuse of a child – an offence that is tacked onto all rape cases in Finland when the victim is a minor.

Contacted his victim on social media

According to the District attorney, Kaba contacted his victim through Facebook and Snapchat. They arranged for a date in the city and after that Kaba invited the girl to an apartment on the pretence of meeting a friend of his. Kaba and the girl didn’t know each other before the date. After arriving in the apartment, Kaba had forced the girl down on a couch and put himself over her. The girl had resisted and several times told him to stop. Kaba ignored the girls resistance and raped her by forcing his fingers inside her. After some time he had been struck by a nose bleed and therefore terminated the rape.

They had left the apartment together and the girl took a bus home and blocked him from social media and all communications.

According to the DA, Kaba knew very well that his victim – who was a virgin – didn’t consent to his actions. The DA told the court that the girl had been afraid during the crime, since she didn’t know what could happen to her.

Before the court the DA presented evidence in the form of a medical examination, copies of a conversation on WhatsApp, as well as interrogation protocols from both Kaba and the girl.

Denied all accusations

Kaba told the court he had never had his hand inside the girl’s pants or done anything but having mutual kisses with her. The defense also claimed that a hand inside somebody’s pants should count at most as an attempt only. The defense also claimed that the girl had never claimed to have been abused or threatened with violence. Kaba pleaded not guilty to the charges of rape and sexual abuse of a child. According to him he had never touched the girl further than on her lower back and they hadn’t spent more than a few seconds or minutes in the apartment. Kaba said he had been surprised when he discovered the girl had blocked him from chat programs, since he was interested in getting to know her.

Circumstantial evidence

In its ruling, the District court wrote that when it is one person’s word against another’s, it is not enough that one party is considered to be a more believable person than the other to make a ruling, when direct evidence or circumstantial evidence is missing. However, the court found it remarkable that the girl had given a much more detailed account of what have happened than Kaba, as well as the fact that he claimed they had only spent seconds or a few minutes in the apartment even though he said he wanted to get to know her.

The District court also found that testimony from a gynaecologist and a paediatrician supported the girl’s side of the story. Chat logs from WhatsApp between the girl and her friends from soon after the encounter also furthered the courts decision to believe the girl. The District court ruled that there was no reasonable doubt of Kaba’s guilt. Even though the violence he had used was considered to be mild it was still enough to overpower the girl and rape her.

No time served – 90 hours of community service instead

In June 27th of 2018, the District court sentenced Ismael Kaba, born 1998, to 2 years imprisonment on the grounds of rape and gross sexual abuse of a child. However, the District court ruled a normal prison sentence would be harmful to the development of Kabas and gave him a conditional prison term, which means he will serve no time unless convicted of another crime within the two years. Kabas was instead sentenced to 90 hours of community service, as well as reimbursing his victim €5000 for her suffering.

The Court of appeals found no reason to change the ruling of the District court.
