Providing for an election to be had, pending approval of the General Assembly of the Commonwealth of Virginia, and a majority of qualified citizens voting upon the proposition prior to August 1, 2020, for the admission of certain counties and independent cities of the Commonwealth of Virginia to be admitted to the State of West Virginia as constituent counties, under the provisions of Article VI, Section 11 of the Constitution of West Virginia

 

Whereas, The Legislature of West Virginia finds that in 1863, due to longstanding perceived attitudes of neglect for the interests of the citizens of Western Virginia, and a studied failure to address the differences which had grown between the counties of Western Virginia and the government at Richmond, the Commonwealth of Virginia was irretrievably divided, and the new State of West Virginia was formed; and

 

Whereas, Such division occurred as the Trans-Allegheny portions of Virginia perceived that they suffered under an inequitable measure of taxation by which they bore a disproportionate share of the tax burden; and

 

Whereas, That this perception was further compounded by the effects of a scheme of representation by which Trans-Allegheny Virginia was not allowed to have its proper and equitable share of representation in the government at Richmond; and

 

Whereas, That this arrangement arguably resulted in the tax dollars of Trans-Allegheny Virginia being used to enrich the Tidewater through internal improvements which did not benefit the people of Western Virginia, while the people of the Trans-Allegheny had little to no say in how their tax dollars were allocated; and

 

Whereas, Though this course led to an irreconcilable division, and the subsequent formation of West Virginia, yet, the longstanding peaceful cooperation between this State and the Commonwealth of Virginia is a sign that such separation, undertaken even under the most challenging and onerous of circumstances, can, with the passage of time, yield lasting results which are beneficial to both sides; and

 

Whereas, In the intervening years, the same neglect for the interests of many of the remaining counties of the Commonwealth of Virginia has allegedly been evidenced by the government at Richmond; and

 

Whereas, Particularly, many citizens of the Southside, the Shenandoah Valley, Southwestern Virginia, and the Piedmont contend that an inequitable measure of taxation exists by which they bear a disproportionate share of the present tax burden of the Commonwealth; and

 

Whereas, The people of the Southside, the Shenandoah Valley, Southwestern Virginia, and the Piedmont also believe that, currently, a scheme of representation exists by which the citizens of Southside, the Shenandoah Valley, Southwestern Virginia, and the Piedmont do not have a proper share of representation in the government at Richmond; and, consequently

 

Whereas, The people of the Southside, the Shenandoah Valley, Southwestern Virginia, and the Piedmont believe that their tax dollars are used to enrich the Tidewater and Northern Virginia through internal improvements which do not benefit the people of these other parts of Virginia, while the people of these other parts of Virginia have little to no say in how their tax dollars are allocated; and

 

Whereas, In recent days, these tensions have been compounded by a perception of contempt on the part of the government at Richmond for the differences in certain fundamental political and societal principles which prevail between the varied counties and cities of that Commonwealth; and

 

Whereas, In the latest, and most evident, in this string of grievances, the government at Richmond now seeks to place intolerable restraints upon the rights guaranteed under the Second Amendment of the United States Constitution to the citizens of that Commonwealth; and

 

Whereas, The Legislative body of West Virginia believes that this latest action defies the wise counsel which has come down to us in the august words of our common Virginia Founders: as the government at Richmond now repudiates the counsel of that tribune of liberty, Patrick Henry-who stated to the Virginia Ratifying Convention in 1788 that “The great object is that every man be armed. Everyone who is able might have a gun”; and

 

Whereas, The government at Richmond now repudiates the counsel of a Signer of the Declaration and premier advocate of American independence, Richard Henry Lee-who stated in The Federal Farmer that “To preserve liberty, it is essential that the whole body of the people always possess arms”; and

Whereas, The Boards of Supervisors of many Virginia counties and the Councils of many Virginia cities have recognized this dangerous departure from the doctrine of the Founders on the part of the government at Richmond; and

 

Whereas, These Boards of Supervisors and Councils have passed resolutions refusing to countenance what they affirm are unwarranted and unconstitutional measures by that government to infringe the firearm rights of Virginians; and

 

Whereas, The actions of the government at Richmond undertaken since the recent general election have, regrettably, resulted in unproductive contention and escalating a lamentable state of civic tension; and

 

Whereas, That, as has been proven in numerous instances, such as have been observed internationally in more recent times with the peaceful dissolutions of Czechoslovakia and the Soviet Union, and the creation of South Sudan, or, earlier in Virginia’s own history, with the formation of Kentucky, the peaceful partition of neighboring peoples can occur, and, is often very beneficial to both sides in reducing tensions and improving the tenor of discourse over ongoing political and societal differences; and

 

Whereas, Article VI, Section 11 of The Constitution of the State of West Virginia explicitly permits additional territory to be admitted into, and become part of this state, with the consent of the Legislature and of a majority of the qualified voters of the state; and

 

Whereas, In a spirit of conciliation, the Legislature of West Virginia hereby extends an invitation to our fellow Virginians who wish to do so, to join us in our noble experiment of 156 years of separation from the government at Richmond; and, we extend an invitation to any constituent county or city of the Commonwealth of Virginia to be admitted to the body politic of the State of West Virginia, under the conditions set forth in our state Constitution, specifically, with the consent of a majority of the voters of such county or city voting upon such proposition; and we hereby covenant that their many grievances shall be addressed, and, we further covenant with them that their firearms rights shall be protected to the fullest extent possible under our Federal and State Constitutions; and

 

Whereas, Providing that the General Assembly of the Commonwealth of Virginia shall give its assent to any county or independent city presently part of the Commonwealth of Virginia having the opportunity and ability to do so, therefore, be it

That the question of admission, or, the rejection of such admission, of any county or independent city of the Commonwealth of Virginia desiring admission to the State of West Virginia, and a majority of whose qualified voters, voting on the question, have approved such measure, prior to August 1, 2020, shall be submitted to the voters of the State of West Virginia at the next general election to be held in the year 2020.

 

Such proposal shall be placed upon the general election ballot in the following form: “Shall the following county (or independent city) ___(name), currently a constituent part of the Commonwealth of Virginia, be admitted to the State of West Virginia as a constituent county of the State of West Virginia.”

 

Should the General Assembly of the Commonwealth of Virginia give its assent to any county or independent city presently part of the Commonwealth of Virginia having the opportunity to do so, and such county or independent city desiring admission to the State of West Virginia, and a majority of whose qualified voters, voting on the question, not have approved such measure prior to August 1, 2020, but do approve such measure at a later date;

 

Then, this provision of this Act shall serve as an official request of the Legislature of West Virginia to the Governor of West Virginia to call a special session of this Legislature to provide for a special election to provide for the approval of the admission, or, the rejection of such admission, of such county or independent city; and, be it

 

Further Resolved, That the Legislature directs that the Clerk of the House forward copies of this resolution to the Board of Supervisors of each county in the Commonwealth of Virginia who have voted to become sanctuary counties for firearms rights, and to the Council of each independent city in the Commonwealth of Virginia who have voted to become sanctuary cities for firearms rights; and, be it

 

Further Resolved, That the Legislature directs that the Clerk of the House forward copies of this resolution to the Clerk of the House of Delegates and Clerk of the Senate of the General Assembly of the Commonwealth of Virginia and requests, in a spirit of peace and goodwill, that the General Assembly will allow this measure for the peaceful transfer of peoples and the restoration of harmony to the Virginias; and, further requests, in a continuance of such spirit, that any firearms legislation proposed by that body have an effective date far enough into the future so that this exchange of peoples and territory could be accomplished before the effective date of such legislation.

USC ATHLETICS

 

THREE OFFICIALS FIRED … Tied to Admissions Scandal

 

Heads are rolling in USC's athletic department over the college admissions scandal and university fundraising – a key part of Lori Loughlin and Mossimo Giannulli's defense. The university just fired 3 officials – CFO Steve Lopes, senior associate athletic director Ron Orr and associate athletic director Scott Jacobson. USC hasn't said why they were canned, but we've confirmed all 3 were heavily involved in fundraising efforts for Trojan athletics.

 

TMZ broke the story … Mossimo wrote a check for $50k, payable directly to USC. Sources connected to the case told us the check was sent to another athletics director, Donna Heinel, who USC already fired. We're told the check was sent at the direction of the scandal ringleader, Rick Singer.

 

Lori and Mossimo contend they were making a donation on the up and up – and for that reason, one of their key witnesses could be former Athletic Director Pat Haden. He talked about his fundraising mission back in 2011, saying the Trojans needed to keep donor checks coming in to "feed the beast." Our sources say USC has been handing over documents to prosecutors and defense attorneys in the case – so it's possible some of those docs turned up new incriminating info about the newly fired officials. We haven't been able to confirm that.

 

You'll recall, Singer requested photos of Loughlin and Giannulli's daughters, Olivia Jade and Isabella, on rowing machines. Prosecutors believe the intent was to make it seem they were avid rowers, eligible for admission as USC Crew team members.

 

We're told USC had its antennae up as much 9 months before the indictments of Singer, Loughlin, Giannulli and Felicity Huffman. In fact, Heinel was fired the same day the feds announced the indictments in March 2019.

 

Sounds like USC is cleaning house. The school's new Athletic Director, Mike Bohn, was announced in November … after Lynn Swann resigned from the position in September.

The Trump administration’s handling of the Ayatollah seemed the most effective since Ronald Reagan’s inauguration forced the first Ayatollah to release our hostages. The strategy was brilliant. It exposed for all the world to see Iran’s fear of America. It laid bare the Regime of Terror’s dread of an all-out confrontation with the United States. There is no greater blow you can deliver to a terrorist regime than to expose its weakness, and President Donald J. Trump did it with the world watching.

 

After the United States eliminated Iran’s four-decade-long architect of terror, Maj. Gen. Qassem Soleimani, and Iranians reacted like they lost their most inspiring leader, the world was ready for massive attacks on U.S. interests and Israel. Instead, a missile attack disrupting sand formations reaffirmed that the age-old wisdom of not appeasing, but standing up to, bullies is always the right approach. It avoids war. We have been coming to this point since Donald J. Trump, as a candidate, disavowed then-President Barack Obama’s agreement allowing Iran a path to becoming a nuclear power and giving it billions of dollars to help it.

Feed the people? Arm terrorists? Buy the missiles they used to attack us? Steal a lot for the billionaire Ayatollah and the millionaire mullahs? The answers, if they are not obvious, will be supplied at the end.

 

As soon as President Trump disavowed the agreement and ended the payoff, the Regime of Terror began testing us, slowly and carefully. Interfering with allied shipping, detaining allied seamen, firing on targets in Iraq and then taking out a U.S. drone. The latter presented a test. Although no one died, it was an attack on American military equipment and many wanted to respond militarily. But President Trump decided it would be disproportionate to react to an attack that cost no lives by launching one that was likely to kill innocent Iranians. It was, of course, criticized, but if you know him or the basics of negotiation, you could see it was a set-up for a later move if necessary. And so it was.

 

The Ayatollah still did not have his answer as to President Trump’s trigger point. He knew he had to take it up another level to see just how far he could go. So with his butcher Soleimani he created unrest in Iraq and then stormed the American embassy. They wanted to see just how far they could push us. By not taking over the embassy, as they did 40 years ago, they were calculating, trying to expose American weakness. However, they were playing right into President Trump’s hands. Iran had crossed a red line and a response was necessary, a very carefully chosen one with an objective. And in the response would be a clear sign of America’s strategy.

The Plot to Level the Administrative State

 

The Supreme Court's conservative majority could use an obscure legal doctrine to permanently kneecap the ability of progressives to govern.

 

The nondelegation doctrine, unlike most legal concepts, is less boring than it sounds. After the 1930s, it became constitutional esoterica, a relic of a bygone age in which the Supreme Court resisted efforts by Americans to regulate their own economic affairs. But it has the potential to overthrow most of the federal government if wielded in a certain way, and the Roberts court could soon give it startling new relevance. The doctrine’s puissance lies in the separation of powers. In the American constitutional order, it’s the role of Congress to write the laws and the role of the executive branch to carry them out. The doctrine bars any branch from handing its powers to another branch. Congress can’t pass a bill that gives the president the power to write his own legislation, for example. Nor can the president instruct the military to take orders from the House and Senate Armed Services Committee instead of himself. Sounds simple enough.

 

For more than a century, however, lawmakers have tackled complex issues of national governance by creating regulatory agencies within the executive branch to address them. Those agencies, empowered with a certain degree of discretion, relieve Congress of the burden of determining which drugs are safe for the marketplace and which pollutants can’t be released into the air or groundwater. This interplay between executive and legislative power might not be exactly what James Madison and Alexander Hamilton had in mind in 1789. But it has nonetheless formed the bedrock for modern American governance. Last year, all five members of the Supreme Court’s conservative majority expressed a willingness to revisit the doctrine. It’s tempting to think that the justices might be onto something here. I’ve written extensively in the Trump era about how lawmakers have sometimes given the executive branch too much latitude, particularly when it comes to national security and immigration. But the movement to expand the nondelegation doctrine doesn’t seek a healthier relationship between Congress and the administrative state. Instead, it hopes to roll back the administrative state itself.

 

The justices called up the nondelegation doctrine from the constitutional minor leagues in 2018, when they agreed to hear Gundy v. United States. At issue was the Sex Offender Registration and Notification Act, or Sorna, which requires people on sex-crime registries to keep their registration current and notify states when they move. Congress gave the attorney general the discretion to determine whether those requirements would apply to people convicted before the law went into effect, which he did. Herman Gundy, who was convicted of sexually assaulting a minor in Maryland, was later convicted of violating Sorna’s requirements because he failed to register in New York. Justice Brett Kavanaugh had not been sworn in by the time oral arguments took place and thus missed the opportunity to participate in the case. Four of the court’s members voted to uphold the law, with Justice Elena Kagan writing for the plurality. Justice Samuel Alito voted in favor of that plurality’s outcome, perhaps to avoid a 4-4 deadlock that would have left the case unresolved. He also drafted a short concurring opinion to keep himself at arm’s length from their reasoning, writing that he would be willing to revisit the nondelegation issue in a future case. (Kavanaugh later expressed a similar stance.)

Homeowners along the Oregon Coast are fighting the imminent arrival of a tech giant on their shores.

 

Facebook recently bought a parcel of beachfront property in Tierra Del Mar, an unincorporated community south of Tillamook, from former Oregon Ducks and NFL quarterback Joey Harrington, and hopes to gain approval to install a undersea fiberoptic cable there.

 

The proposal was approved after deliberation by the Tillamook County Planning Commission.

 

That decision was upheld last week by a 2-1 vote of the Tillamook County Board of Commissioners.

 

"The county is saying we think it’s more important for a corporate interest to be able to come onto this property and do this than to value that the entire community said no," said Lynnae Rutledge, one of several homeowners to appeal the decision to the board.

 

Rutledge said she and her neighbors are concerned about the heavy equipment and deep drilling required to bring the cable to shore.

 

"This is going to bring in huge pieces of industrial equipment," said Rutledge. "It’s going to have vibration, which could impact people’s property. Their foundations. Their septic systems. Our groundwater."

 

In its permit application, the company tasked with installing the cable, Edge Cable Holdings, doesn't address potential impacts to neighboring properties, but said there will be no permanent impacts to wetlands or waters of the United States.

 

The company does acknowledge there are several threatened or endangered species in the area that could be affected by construction.

 

Asked for comment on the board's decision, a county employee said there would be no public comment until after the appeals process has been completed.

 

Neighbors can still file an appeal with the state's Land Use Board of Appeals.

China must rethink its hardline stance towards Taiwan, President Tsai Ing-wen said on Wednesday, as she warned the island was already independent and that any invasion would be “very costly” for Beijing.

 

Tsai won a second term over the weekend with a record 8.2 million votes, an outcome that was seen as a forceful rebuke of China’s ongoing campaign to isolate the self-ruled island.

 

China’s leadership had made no secret of its desire to see Tsai turfed out because she and her party refuse to acknowledge their view that the island is part of a “one China”.

 

Beijing regards Taiwan as its territory and has vowed to one day seize it, by force if necessary – especially if it declares independence.

 

But in her first interview since Saturday’s re-election, Tsai told the BBC there was no need to formally announce independence because the island already runs itself.

 

“We don’t have a need to declare ourselves an independent state,” she said in the interview, which aired on Wednesday.

 

“We are an independent country already and we call ourselves the Republic of China, Taiwan.”

Plot

Trevor Garfield (Samuel L. Jackson) is an African American high school science teacher at Roosevelt Whitney High School, a high school in the Bedford-Stuyvesant neighborhood of Brooklyn. Dennis Broadway (Method Man), a gangster student to whom he had given a failing grade threatens to murder him, writing the number 187 (the California police code for homicide) on every page in a textbook. Garfield knows that this is a warning and tries to report the administration, Garfield knows that Dennis just wanted to transfer back to his old school and he needed to have good grades. The administration ignored this warning and Dennis ambushes Garfield in the hallway, stabbing him in the back and side abdominal area multiple times with a shiv.

 

Fifteen months after surviving, Garfield, now a substitute teacher, has relocated to John Quincy Adams High School in the San Fernando Valley area of Los Angeles, but trouble starts again when he substitutes an unruly class of rejects, including a Chicano tag crew by the name of "Kappin' Off Suckers" (K.O.S.). Their leader, Benito "Benny" Chacón (Lobo Sebastian), a felon attending high school as a condition of probation, makes it clear to Garfield that there will be no mutual respect.

 

The tension mounts when a fellow teacher, Ellen Henry (Kelly Rowan), confides that Benny has threatened her life, an action against which the administration of the school refuses to take action, fearing legal threats. After Benny murders a rival tagger in cold blood, he disappears, and Benny's unstable tag partner, César Sanchez (Clifton Collins Jr.), takes over as leader. When César steals Garfield's family heirloom watch, the principal is more concerned about a lawsuit and refuses to take action. Ellen and Garfield develop a close friendship that approaches the beginnings of a relationship, but is stymied by Garfield's destabilizing behavior and his confrontations with the K.O.S.. Garfield's past garners the unwanted admiration of Dave Childress (John Heard), an alcoholic history teacher who carries guns at the school.

 

The conflict between Garfield and the K.O.S. escalates with the killing of Jack, Ellen's dog. César, after spraying cartoon graffiti depicting a dead dog, is shot with a syringe filled with morphine attached to the end of an arrow. He passes out, and wakes up to find one of his fingers cut off. César recovers the finger and it is reattached, with the letters "R U DUN" ("are you done?") tattooed as a warning.

 

A student Garfield has tutored, Rita Martínez (Karina Arroyave), a Chicana, faces abuse from both the K.O.S. and Childress, and drops out. The school administration is mired in bureaucracy and unable to intervene. After Benny is found dead in the Los Angeles River, apparently of a drug overdose, it is revealed that Garfield took matters into his own hands, killing Benny and severing César's finger. Garfield lets Ellen leave as she disavows his actions.

 

The K.O.S. plan to murder Garfield. At Garfield's house, the gang forces Garfield into a contest of Russian roulette with César. The latter's resolve is shaken as Garfield talks about the lost-cause lifestyle he has led. Hesitating at his turn, César watches as Garfield, offering to take his turn for him, takes the revolver and shoots himself in the head. Driven by his sense of honor and ignoring the protests of his horrified friends, César insists on taking his rightful turn and ends up killing himself .

 

On graduation day, Rita, who completes her studies along with former K.O.S. member Stevie Littleton (Jonah Rooney), offers a tribute to Garfield by reading an essay about him. The essay incorporates the theme of the Pyrrhic victory and Ellen leaves the school.

An alleged leaker of information about Kim Jong Un’s visit to Samjiyon last October was executed in Pyongyang in late December, Daily NK has learned.

 

In mid-October, North Korean authorities conducted a massive operation to identify the leaker of Kim’s October visit to Samjiyon. North Korean security authorities viewed the leak as a major breach of the regime’s security network because news of Kim’s visit was reported in South Korean media before being published in state media.

 

The director of the Hyesan office of the Ministry of State Security (MSS), North Korea’s main security agency, reportedly planned to resign in the wake of the leak, but Daily NK sources report he is still in office.

 

The suspected leaker was arrested in November by MSS officials and sent to Pyongyang for interrogation.

 

Daily NK sources reported that the suspect was then quietly executed at an MSS detention center in Pyongyang a month later – right before the start of the 5th plenary session of the 7th Central Committee on Dec. 28.

 

Normally, an investigation into such a serious leak case would have taken six months; Daily NK sources speculated that North Korean prosecutors were keen to quickly carry out the execution given the important nature of the case.

 

The family of the executed suspected leaker was exiled to Kapsan, Ryanggang Province, one source added.

Explosive Parnas Docs Tie Trump to Ukraine Dirty Tricks

 

WASHINGTON (CN) – On the eve of transferring the articles of impeachment to the Senate, House Democrats have released a trove of explosive documents from Rudy Giuliani’s now-indicted associate Lev Parnas providing new evidence tied to the Ukraine scandal.

 

The batch of files expose covert surveillance of ousted U.S. Ambassador to Ukraine Marie Yovanovitch, ties to a Russian mafia-linked oligarch under federal indictment and intimate details of the pressure campaign on newly elected Ukrainian President Volodymyr Zelensky.

 

A week before two central figures in the plot – Parnas and his accused co-conspirator Igor Fruman – were arrested, President Donald Trump personally signed off on their criminal defense attorney.

 

“The president consents to allowing your representation of Mr. Parnas and Mr. Furman [sic],” Trump’s current attorney Jay Sekolow wrote to the president’s former attorney, John Dowd, on Oct. 2, 2019.

 

The 59-page trove begins with a note Parnas scrawled on a notepad from the Ritz Carlton hotel in Vienna, Austria.

 

The first line in Parnas’ notes lays bare the plan to have Ukraine’s president investigate Trump’s political rival: “Get Zalensky [sic] to announce that the Biden case will be investigated.”

 

Scanned copies of the handwritten notes released Tuesday – stamped on the bottom right by the U.S. Attorney’s office – repeatedly refer to attorneys for oligarch Dmytro Firtash, who is under federal indictment in the United States on bribery and racketeering charges.

 

Those Firtash attorneys include repeat Fox News commentators Victoria Toensing and Joseph DeGenova, as well as Michael Cohen’s counsel Lanny Davis.

 

After Zelensky won the election, Giuliani wrote him a letter requesting a meeting with him in mid-May 2018, bringing Toensing along with him as a guest.

 

“I will need no more than a half-hour of your time, and I will be accompanied by my colleague Victoria Toensing, a distinguished American attorney who is very familiar with this matter,” Giuliani wrote.

 

A week before Trump agreed to their legal counsel, Parnas and Fruman were detained at Washington’s Dulles Airport before they boarded a flight bound for Vienna. Firtash is currently living in Austria’s capital city.

 

The coordinated effort to oust Yovanovitch, meanwhile, comes into focus through text messages Parnas exchanged with Robert Hyde, a Republican congressional candidate.

 

“Wow. Can’t believe Trump hasn’t fired this bitch. I’ll get right in that,” Hyde texted Parnas in March 2019.

 

Routinely tracking Yovanovitch’s whereabouts through a contact with embassy access, Hyde passed the information along to Parnas.

 

“They know she’s a political puppet. They will let me know when she’s on the move,” Hyde texted Parnas, who responded: “Perfect.”

 

The next day Hyde alerted Parnas: “Update she will not be moved special security unit upgraded force on the compound people are already aware of the situation my contacts are asking what is the next step because they cannot keep going to check people will start asking questions.”
