Judge Sullivan's Appeal for 'En Banc' Hearing Has Good Chance at Success

Judge Emmet Sullivan's refusal to abide by the D.C. Circuit Court's decision to dismiss the Flynn case and subsequent appeal for an "en banc" decision is not without precedent.

Flying under the radar is the role that Judge Sullivan has played in simultaneously overseeing both the Michael Flynn case and a major lawsuit against Trump. In Blumenthal v. Trump, Jerry Nadler, who oversaw the House impeachment of Trump, and some 200 congressional Democrats sought to sue the president according to the obscure "Emoluments Clause." The basic contention is that Trump is in a compromising position because his business holdings occasionally receive funding or contracts from foreign entities, much like any other elected official with business interests in foreign countries.

As Matthew Walther noted in The Week, "The [Emoluments C]lause has never given rise to any legal cases of note, and it has never been defined or even meaningfully addressed by the Supreme Court." But Sullivan was willing to take the first shot at it by ultimately ruling the suit as constitutionally valid, while admitting that "there is only one other judicial opinion interpreting the Clause." Sullivan relied entirely upon the briefs and counsel provided him by Democrats, as he has also done in the Flynn case, especially by bringing in retired judge Gleeson and inviting briefs from activist lawyers and prosecutors.

As in the Flynn case, the D.C. Circuit Court intervened to dismiss the case because Sullivan "did not adequately address … the separation of powers issues present in a lawsuit brought by members of the Legislative Branch against the President of the United States." The Circuit Court also protested that Sullivan had "abused" his discretion in attempting to minimize and reject the validity of Trump's appeal. While Sullivan ultimately lost the battle on this case, the court documents demonstrate that he repeatedly attempted to push through what is otherwise a defunct and never-before-prosecuted Emoluments Clause.

The story doesn't end there. There are two other lawsuits invoking the Emoluments Clause that have been brought against Trump: CREW v. Trump, initiated by the hyper-partisan David Brock, and D.C. and Maryland v. Trump, filed by two progressive attorneys general who have attempted to sue the president in no fewer than a dozen cases

The opposition Labour Party was also displeased but for different reasons, criticizing Johnson for not mandating masks when it advised in favor of wearing them back in May, and “why it'll take another 11 days before these new guidelines come into force,” according to the party’s health spokesman Jonathan Ashworth.

Labour leader Keir Starmer has criticized Johnson’s coronavirus response as “slow,” saying that the PM is “good on the rhetoric but he is not good on governing.” Starmer said there will inevitably be an inquiry into Downing Street’s handling of the pandemic.

Both cases were originally dismissed by appeals courts on the grounds that Congress has no need of the Judicial Branch to enforce its own law. However, they were then later reinstated, even though it was conceded that there was "no history" of opinions to aid their decision.

In fact, the D.C. Circuit's decision to reverse the dismissal of D.C. and Maryland v. Trump was done by appealing to the rare "en banc" decision, the very same appeal Judge Sullivan has now sought in the Flynn trial.. An "en banc" appeal allows for a case to be reheard by the entire court's bench rather than only the three appointed judges. If the majority of the bench decides against the original ruling of the three-person panel, the decision is reversed.

It is worth noting that while the D.C. Circuit has averaged fewer than three en banc cases per year over the last 20 years, it has exercised this rule four separate times in cases related to President Trump. To put it more simply, out of the eleven cases that this court has heard en banc since Trump took office, four of them are cases against Trump's or his administration. The Flynn case would make the fifth. For comparison, during the entire tenure of Obama, there were no en banc hearings by the D.C. Circuit that involved Obama or his administration

But even if Sullivan's appeal did not eventually succeed in overturning the dismissal of the Flynn case, it is likely that he would count it a victory if he were simply able to convince the court to have an "en banc" hearing. This would further delay the end of the Flynn case by weeks, if not months. And considering that Trump is seriously considering inviting Flynn back into the Trump administration, this could spell imminent danger for many intelligence officials who have not done things "by the book."

In fact, before his arrest, Flynn had openly advocated for the replacement of the current intelligence software with the highly innovative program Palantir. This program is "capable of building comprehensive models of activity to detect suspicious anomalies" and is "the combination of every analytical tool you could ever dream of." Such a system could very likely uncover the myriad of anomalies committed under the Obama administration, including but not limited to the Russia collusion hoax, Spygate, unlawful/unauthorized unmasking requests, the IRS scandal, etc. If so, that's a serious "uh-oh" for the whole administration, which has regularly been accused of abusing intelligence data, among many other abuses

Thus, the goal for Judge Sullivan and his growing number of comrades is to delay the dismissal of the trial long enough to eventually see out a Biden presidency. If Flynn gets anywhere near the White House before the election, or if Trump gets re-elected and brings in Flynn, this most likely is a doom-and-gloom scenario for many big-time hitters in Washington

A federal judge on Monday permanently blocked Georgia's 2019 pro-life "heartbeat" law, which prohibits abortions after a fetal heartbeat is detected, ruling that it violates the Constitution.

U.S. District Judge Steven Jones, who also temporarily blocked the law in October of last year, ruled against the state in a lawsuit filed by abortion providers and advocates. The new ruling permanently bars the state from ever enforcing the law.

The legislation passed both chambers and was signed into law by Republican Gov. Brian Kemp last March despite a massive opposition effort by Hollywood liberals. It effectively declared abortion procedures illegal after a "detectable human heartbeat exists," with some exceptions. A heartbeat can be detected as early as six weeks into a pregnancy.

Under current Georgia law, abortions are prohibited after 20 weeks of gestation, or roughly 22 weeks of pregnancy, the Atlanta Journal-Constitution reported.

In agreement with Roe v. Wade, Jones ruled that the Georgia law would burden a woman's 14th Amendment "right to privacy" and agreed with the abortion advocates' argument that the law sought solely to ban abortions and not "promote fetal well-being."

"The court rejects the state defendants' argument that the statutory purpose solely concerns 'promoting fetal well-being,'" the judge wrote. "Instead, HB 481's specific references to Roe v. Wade and 'established abortion related precedents' … lends support to plaintiffs' argument that the purpose of H.B. 481 was to ban or de facto ban abortion."

FOX 35 INVESTIGATES: Florida Department of Health says some labs have not reported negative COVID-19 results

ORLANDO, Fla. - After FOX 35 News noticed errors in the state's report on positivity rates, the Florida Department of Health said that some laboratories have not been reporting negative test result data to the state.

Countless labs have reported a 100 percent positivity rate, which means every single person tested was positive. Other labs had very high positivity rates. FOX 35 News found that testing sites like one local Centra Care reported that 83 people were tested and all tested positive. Then, NCF Diagnostics in Alachua reported 88 percent of tests were positive.

Despite being tax exempt — meaning they are not required to pay the same taxes other businesses must — the Catholic church has received more than $1.4 billion in taxpayer-backed coronavirus aid. According to a scathing report out of the Associated Press, the total payout could be as high as $3.5 billion, making this tax exempt organization one of the largest recipients in the country of the taxpayer-funded pandemic bail out.

Adding to the already corrupt nature of a tax-exempt organization received billions in taxpayer funds is the fact that according to the analysis of federal data, hundreds of millions of dollars are “going to dioceses that have paid huge settlements or sought bankruptcy protection because of clergy sexual abuse cover-ups.”

Because they do not pay taxes, institutions of faith are not usually eligible for programs such as these. However, the Catholic Church’s lobbying efforts were unprecedented, according to the report. They lobbied for an exemption to federal rules and amassed what could amount to nearly 4 billion dollars.

Typically, because the church has over 500 employees, they are disqualified from applying for this SBA bailout. However, as small businesses failed to receive minuscule loans for tens of thousands of dollars to keep their doors open, one of the richest organizations in the world persuaded this administration to grant them a waiver for the 500 employee cap.

White House Leakers Beware; Mark Meadows Has Been Setting Traps

The Trump administration has been plagued with leaks from establishment loyalists - enemies of the administration who feel its their duty to undermine Trump's agenda. One swamp operative even penned a book, "A Warning" penned by "Anonymous," who claimed "many of the senior officials in [Trump's] own administration are working diligently from within to frustrate parts of his agenda and his worst inclinations."

Tracking down the leakers has been assigned to Trump's Chief of Staff, Mark Meadows, who joined the Trump administration on March 31, 2020 after serving as the ranking Republican on the House Oversight Committee.

FOX 35 Investigation Reveals Inflated Florida Coronavirus Numbers

A FOX 35 investigation released on Monday discovered an inflation of coronavirus cases by the Florida Department of Health. The Sunshine State’s health authorities misreported the number of persons testing positive for coronavirus in its aggregation and publication of test results from laboratories.

FOX 35 anchor Charles Billi explained the impetus for the investigation. He said, “We found numerous labs that are only reporting positive test results, so they show a 100-percent positivity rate. That got our attention.”

According to the latest publication of statewide test results from the Florida Department of Health, published on Friday, several testing facilities’ positivity rates for coronavirus tests were 27.66, 33.33, 37.10, 40, 43.13, 44.44, 50, 55, 57.14, 59.23, 60, 87.5, 91.18, and 100.

Twenty-two labs reported 100-percent positivity rates. Two labs reported 91.18-percent positivity rates.

The Florida Department of Health’s stated positivity rates and associated volume of coronavirus cases does not match claims made by the testing facilities, reported FOX 35:

Democrat Funded ‘News Outlet’ CourierNewsroom Floods Facebook with Election Ads

A purported news outlet funded by a Democrat-aligned nonprofit is flooding Facebook with millions of dollars in ad spending ahead of the 2020 election, without disclosing any of its political donors, according to a report in Politico.

In its report, even left-leaning Politico admits that the advertising blitz is “blurring the lines between campaign advocacy and a newsroom.”

The articles and Facebook ad dollars look like the efforts of a run-of-the-mill political group. But they are actually from a news outlet: CourierNewsroom.com, also known as Courier, which was created and funded by the Democratic-aligned digital organization Acronym. Courier has spent over $1.4 million on Facebook ads this election cycle, mostly to promote its flattering articles and videos about more than a dozen endangered House Democrats at the top of the Democratic Party’s priority list this November, according to Facebook’s political ad tracker.

But because Courier is organized as a media outlet, it does not have to disclose its donors or the total money it spends promoting Democratic politicians.

The effort is linked to Reid Hoffman, the Linkedin cofounder who infamously funded a social media misinformation campaign, complete with Twitter bots posing as Russian agents, during the 2017 Alabama runoff election.

After apologizing for that episode, saying he was “embarrassed” by it, it appears Hoffman is back in the business of social media manipulation.

And in setting up the enterprise, Acronym — which is financed by some of the deepest pockets in progressive politics, such as liberal billionaires Reid Hoffman, the co-founder of LinkedIn, and Laurene Powell Jobs, the majority owner of The Atlantic — has stirred outrage and provoked debate about the ethics of such political tactics and the future of the press.

Democrats and the Biden campaign are at the forefront of efforts to pressure Facebook into clamping down on “misinformation” which in their view includes banning Trump ads. The practice of using a “news organization” propped up by a Democrat nonprofit to flood the platform with ads in favor of Democrat political candidates creates a major conflict with this message.

The camera detected a 2000 Chevrolet extended cab pickup. The Trooper responded to the area and observed the same vehicle. The Trooper initiated a traffic stop and the vehicle fled east on Highway 83. The pursuit ended after the vehicle crashed at Papalote and El Campo Roads. The driver exited the vehicle and successfully fled the area on foot. The vehicle was found to be reportedly concealing approximately 453 pounds of cocaine valued at $14,496,000.

The drawbridge cameras possess enhanced motion detection and low light capabilities, which have been modified for law enforcement needs. Operation Drawbridge uses hundreds of cameras along the border.

Detection alerts are sent simultaneously to the Border Patrol, sheriffs, the Fusion Center, and other border law enforcement partners under the operation of Texas DPS Information Technology (IT) personnel.

Since the inception of the program through the end of January 2019, Operation Drawbridge reportedly detected more than 450,000 criminal exploitations of the Texas-Mexico border and has directly resulted in the apprehension of more than 250,000 individuals. It is also credited for the seizure of more than 248 tons of marijuana.

Narco-Terrorist on Most Wanted List Captured in Mexican Border State

PIEDRAS NEGRAS, Coahuila – State investigators arrested a cartel gunman officially identified as taking part in a terror attack that killed 23 as more than 150 shooters stormed a rural town and tried to burn city hall. The gunman was on an international wanted list targeting key cartel figures.

The arrest took place last week in Coahuila when Jorge Manuel “N” was charged for the kidnapping of a local police officer during a November 2019 terror attack in Villa Union. Authorities moved Jorge Manuel to a detention center in Saltillo where he will await trial. Coahuila Attorney General Gerardo Marquez Guevara in a prepared statement to Breitbart Texas confirms authorities arrested and charged 11 suspects for the attack.

On November 30, 2019, a group of approximately 150 gunmen from the Cartel Del Noreste faction of Los Zetas used dirt roads to move from Nuevo Laredo to Villa Union, where they fired at the city hall, torched police vehicles, and started a shootout that went on for hours that led to at least 17 dead gunmen, four dead police officers, two dead firefighters, and several other shooting victims. Coahuila Governor Miguel Angel Riquelme said captured gunmen explained their goal was to spread fear and intimidate the residents.

In the months after, authorities learned more about the role of Jorge Manuel and added him to a Most Wanted list between Coahuila state authorities and U.S. Customs and Border Protection called “Se Busca.” The suspect was added as the #5 fugitive. The list began in South Texas as a way to share information and has since been replicated in other border regions.
