BEIJING/TAIPEI (Reuters) - China will strike back against any moves that undermine its core interests, its foreign ministry said on Friday, after U.S. Secretary of State Mike Pompeo said that Taiwan “has not been a part of China”. China calls Taiwan the most sensitive and important issue in its ties with the United States, and has been angered by the Trump administration’s stepped up support for the Chinese-claimed yet democratically ruled island, such as arms sales. Speaking in a U.S. radio interview on Thursday, Pompeo said: “Taiwan has not been a part of China”. “That was recognised with the work that the Reagan administration did to lay out the policies that the United States has adhered to now for three-and-a-half decades,” he said. The United States is bound by law to provide Taiwan with the means to defend itself, and officially only acknowledges the Chinese position that Taiwan is part of it, rather than explicitly recognising China’s claims.

Speaking in Beijing, Chinese foreign ministry spokesman Wang Wenbin said Taiwan was an inalienable part of China and that Pompeo was further damaging Sino-U.S. ties. “We solemnly tell Pompeo and his ilk, that any behaviour that undermines China’s core interests and interferes with China’s domestic affairs will be met with a resolute counterattack by China,” he said, without elaborating. China has put sanctions on U.S. companies selling weapons to Taiwan, and flew fighter jets near the island when senior U.S. officials visited Taipei this year. The defeated Republic of China government fled to Taiwan in 1949 after loosing a civil war to the communists, who founded the People’s Republic of China. Taiwan foreign ministry spokeswoman, Joanne Ou, thanked Pompeo for his support. “The Republic of China on Taiwan is a sovereign, independent country, and not part of the People’s Republic of China. This is a fact and the current situation,” she said. Taiwan officials will travel to Washington next week for economic talks, which have also annoyed Beijing.

Many of the digs until now have focused mainly on Dominion Election Systems - one of the companies that supplies voting machines. But Dominion also plays another role now: as the current owner of GEMS (see how this happened below).

From what I can tell, the real 'villain' in the piece is the software that runs on these machines: the GEMS software.

California judge rules Gov. Gavin Newsom overstepped authority with mail ballot order

The ruling prevents Newsom from changing existing law under any circumstance

A California judge has ruled that Gov. Gavin Newsom overstepped his authority when he issued an executive order requiring vote-by-mail ballots sent to all registered voters, according to reports.

Sutter County Superior Court Judge Sarah Heckman ruled Friday that Newsom did not have the authority to amend or change existing election law – even during a pandemic.

The ruling put a permanent injunction on Newsom, prohibiting him from changing existing law under the California Emergency Services Act (CESA), according to KCRA.

The ruling does not affect the results of the 2020 general election.

Newsom issued the order on June 3, just before the state Legislature passed a similar law. Two assemblymen, James Gallagher, R-Yuba City, and Kevin Kiley, R-Rocklin, sued Newsom, arguing that it was the Legislature’s role – not the governor’s – to change law.

"I think that is a very dangerous thing,” Kiley said in his October testimony, according to Newsweek. “And he's made good on his word, and he's been issuing order after order after order.”

The governor’s lawyer unsuccessfully argued that the June order was rendered moot by the Legislature's passage of a similar bill.

"Executive Order N-67-20 issued by the Governor on June 3, 2020 is void as an unconstitutional exercise of legislative power and shall be of no further force or effect," Heckman's ruling said.

"The California Emergency Services Act (CA Government Code §8550 et seq.) does not authorize or empower the Governor of the State of California to amend statutory law or make new statutory law, which is exclusively a legislative function not delegated to the Governor under the CESA.”

Heckman worried that Newsom's action could set a precedent that would allow governors to abuse the CESA to “amend statutory law or create new statutory law even during a state of emergency.”

Asian Borrowers Close In on Record for Dollar Bond Issuance

Borrowers from Asia are ramping up dollar debt sales again and are on the cusp of exceeding the full-year record for issuance.

Issuers from Asia ex-Japan have sold over $323 billion of notes in the U.S. currency so far this year, compared with $326 billion for all of 2019 – the current all-time high, according to data compiled by Bloomberg. Chinese borrowers led the charge last week following an initial lull after the U.S. election. Borrowers globally have sold unprecedented amounts of debt this year as they gird against the economic impact of the pandemic and take advantage of ultra-low borrowing costs. Credit markets have largely rallied since the end of March on the back of central bank stimulus. But the recent surge in coronavirus cases in many nations is keeping investors on edge, even as they weigh coronavirus vaccine results.

Dollar notes from Asia continue to offer higher premiums than their U.S. peers because Asian borrowers don’t directly benefit from Federal Reserve bond purchases. Junk bonds from the region pay spreads about 300 basis points more than their U.S. counterparts on average, near the highest since 2011. Investors should focus on the historically-elevated premiums on both Asian investment-grade and high-yield dollar bonds over peers elsewhere, according to Owen Gallimore, head of credit strategy at Australia & New Zealand Banking Group Ltd.

The Fed’s commitment to a loose monetary policy will likely continue to drive corporate bond issuance globally. The central bank signaled in September that rates would stay near zero for at least three years, after the pandemic sparked the worst economic slump since the Great Depression.

In Asia, analysts and bankers say that they expect debt sales to remain elevated going in to 2021. More bonds mature next year and borrowing costs are well below their five-year average. Goldman Sachs Group Inc. forecast earlier this month that sales by Asian issuers across dollars, euros and yen would hit a record again next year.

Lou Gohmer, who was asked for info to assist the raid before it happened; this happened over the weekend in Frankfurt, Germany. This was done after obtaining the permission and cooperation of the German govt. The servers were seized and are in the possession of the administration and GOP.

The federal government is investigating the takeover last year of a leading American manufacturer of electronic voting systems by a small software company that has been linked to the leftist Venezuelan government of President Hugo Chávez.

The inquiry is focusing on the Venezuelan owners of the software company, the Smartmatic Corporation, and is trying to determine whether the government in Caracas has any control or influence over the firm’s operations, government officials and others familiar with the investigation said.

The inquiry on the eve of the midterm elections is being conducted by the Committee on Foreign Investment in the United States, or Cfius, the same panel of 12 government agencies that reviewed the abortive attempt by a company in Dubai to take over operations at six American ports earlier this year.

The committee’s formal inquiry into Smartmatic and its subsidiary, Sequoia Voting Systems of Oakland, Calif., was first reported Saturday in The Miami Herald.

Officials of both Smartmatic and the Venezuelan government strongly denied yesterday that President Chávez’s administration, which has been bitterly at odds with Washington, has any role in Smartmatic.

“The government of Venezuela doesn’t have anything to do with the company aside from contracting it for our electoral process,” the Venezuelan ambassador in Washington, Bernardo Alvarez, said last night.

Smartmatic was a little-known firm with no experience in voting technology before it was chosen by the Venezuelan authorities to replace the country’s elections machinery ahead of a contentious referendum that confirmed Mr. Chávez as president in August 2004.

Seven months before that voting contract was awarded, a Venezuelan government financing agency invested more than $200,000 into a smaller technology company, owned by some of the same people as Smartmatic, that joined with Smartmatic as a minor partner in the bid.

In return, the government agency was given a 28 percent stake in the smaller company and a seat on its board, which was occupied by a senior government official who had previously advised Mr. Chávez on elections technology. But Venezuelan officials later insisted that the money was merely a small-business loan and that it was repaid before the referendum.

With a windfall of some $120 million from its first three contracts with Venezuela, Smartmatic then bought the much larger and more established Sequoia Voting Systems, which now has voting equipment installed in 17 states and the District of Columbia.

Since its takeover by Smartmatic in March 2005, Sequoia has worked aggressively to market its voting machines in Latin America and other developing countries. “The goal is to create the world’s leader in electronic voting solutions,” said Mitch Stoller, a company spokesman.

But the role of the young Venezuelan engineers who founded Smartmatic has become less visible in public documents as the company has been restructured into an elaborate web of offshore companies and foreign trusts.

“The government should know who owns our voting machines; that is a national security concern,” said Representative Carolyn B. Maloney, Democrat of New York, who asked the Bush administration in May to review the Sequoia takeover.

“There seems to have been an obvious effort to obscure the ownership of the company,” Ms. Maloney said of Smartmatic in a telephone interview yesterday. “The Cfius process, if it is moving forward, can determine that.”

The concern over Smartmatic’s purchase of Sequoia comes amid rising unease about the security of touch-screen voting machines and other electronic elections systems.

Government officials familiar with the Smartmatic inquiry said they doubted that even if the Chávez government was some kind of secret partner in the company, it would try to influence elections in the United States. The inquiry is focusing on the Venezuelan owners of the software company, the Smartmatic Corporation, and is trying to determine whether the government in Caracas has any control or influence over the firm’s operations, government officials and others familiar with the investigation said.

The inquiry on the eve of the midterm elections is being conducted by the Committee on Foreign Investment in the United States, or Cfius, the same panel of 12 government agencies that reviewed the abortive attempt by a company in Dubai to take over operations at six American ports earlier this year.

The committee’s formal inquiry into Smartmatic and its subsidiary, Sequoia Voting Systems of Oakland, Calif., was first reported Saturday in The Miami Herald.

Officials of both Smartmatic and the Venezuelan government strongly denied yesterday that President Chávez’s administration, which has been bitterly at odds with Washington, has any role in Smartmatic.

“The government of Venezuela doesn’t have anything to do with the company aside from contracting it for our electoral process,” the Venezuelan ambassador in Washington, Bernardo Alvarez, said last night.

Smartmatic was a little-known firm with no experience in voting technology before it was chosen by the Venezuelan authorities to replace the country’s elections machinery ahead of a contentious referendum that confirmed Mr. Chávez as president in August 2004.

Seven months before that voting contract was awarded, a Venezuelan government financing agency invested more than $200,000 into a smaller technology company, owned by some of the same people as Smartmatic, that joined with Smartmatic as a minor partner in the bid.

In return, the government agency was given a 28 percent stake in the smaller company and a seat on its board, which was occupied by a senior government official who had previously advised Mr. Chávez on elections technology. But Venezuelan officials later insisted that the money was merely a small-business loan and that it was repaid before the referendum.

With a windfall of some $120 million from its first three contracts with Venezuela, Smartmatic then bought the much larger and more established Sequoia Voting Systems, which now has voting equipment installed in 17 states and the District of Columbia.

Since its takeover by Smartmatic in March 2005, Sequoia has worked aggressively to market its voting machines in Latin America and other developing countries. “The goal is to create the world’s leader in electronic voting solutions,” said Mitch Stoller, a company spokesman.

But the role of the young Venezuelan engineers who founded Smartmatic has become less visible in public documents as the company has been restructured into an elaborate web of offshore companies and foreign trusts.

“The government should know who owns our voting machines; that is a national security concern,” said Representative Carolyn B. Maloney, Democrat of New York, who asked the Bush administration in May to review the Sequoia takeover.

“There seems to have been an obvious effort to obscure the ownership of the company,” Ms. Maloney said of Smartmatic in a telephone interview yesterday. “The Cfius process, if it is moving forward, can determine that.”

The concern over Smartmatic’s purchase of Sequoia comes amid rising unease about the security of touch-screen voting machines and other electronic elections systems.

Government officials familiar with the Smartmatic inquiry said they doubted that even if the Chávez government was some kind of secret partner in the company, it would try to influence elections in the United States. But some of them speculated that the purchase of Sequoia could help Smartmatic sell its products in Latin America and other developing countries, where safeguards against fraud are weaker…..
