Repeal the Seventeenth!

The U. S. Senate has never been the same since the Seventeenth Amendment to the U.S. Constitution was passed. Before we had this amendment, senators were appointed by the legislature of their state (see Article I, Section 3 of the Constitution). Now, we have the Seventeenth Amendment which says that senators are elected by the people of their state. This might not seem like a big change. However, our Founding Fathers never wanted meant it to be this way.

 

Beginning in 1893, the House of Representatives passed this amendment several times, but the Senate refused to approve it. However, when over thirty of the states demanded this change in the way senators were elected, the Seventeenth Amendment was passed by Congress in 1912 and ratified by the states the following year.

 

The initial purpose of the Senate was to focus on the interests of the states. Allowing our senators to be chosen by the state legislatures gave the states a part in the federal government. However, this check the states had on the federal government was struck down by the Seventeenth Amendment and tipped the balance of power in the wrong direction. The amendment was hailed by some as a “triumph for democracy,” but the weakness of the new system soon appeared. The states’ political power diminished and the states lost their veto power over laws which violate their states’ rights. After striking down the Seventeenth Amendment, America would have two houses of Congress representing the people, but there would be no one in Washington to represent state governments.

 

Originally, Senators were to be appointed by the state legislatures because those in the legislatures were expected to know the best-qualified individuals to represent their state in Washington D.C.. Additionally, the Senate would be held accountable to the state legislatures. James Madison discussed this topic:

 

The senators will be appointed by the legislatures; and, though elected for six years, I do not conceive they will so soon forget the source from whence they derive their political existence. This election of one branch of the federal by the state legislatures, secures an absolute dependence of the former [the federal] on the latter [the states].

 

Fisher Ames, a participant in his state ratifying convention following the 1787 Constitutional Convention, was apprehensive of senators being chosen directly by the people (as is the case today). He said:

 

This would totally obliterate the federal features of the Constitution. What would become of the state governments, and on whom would devolve the duty of defending them against the encroachments of the federal government? . . . The state governments represent the wishes, and feelings, and local interests of the people.

 

Though we may wish to keep our vote for our senator, to restore the states’ position, a new amendment needs to be passed, repealing the Seventeenth. This would let the states regain both their representation in the Senate and their veto power over laws which violate states’ rights.

WASHINGTON — In a demonstration earlier this month, Intelsat and OneWeb provided broadband internet service to U.S. Army users via satellites in low Earth orbit and in geostationary orbit.

 

The event at Aberdeen Proving Ground, Maryland, was an attempt to show Army buyers that satellite communications from LEO and GEO is not an either-or proposition, and both can be seamlessly integrated.

 

Intelsat is a global communications firm that operates 52 GEO satellites stationed 22,000 miles above the equator. OneWeb currently has 358 broadband LEO satellites in near polar orbit planes at an altitude of 750 miles.

More than 100,000 particles of metal are orbiting the Earth, posing an unexpected danger to spacecraft. The particles, which range in diameter from 5 millimetres to more than 50 millimetres, were ejected from Soviet-era satellites and are now concentrated in an orbit 900 kilometres above the Earth.

 

The orbit is only shared by remote-sensing and communications satellites. The space shuttle, which is far more vulnerable to fast-moving particles, flies at less than half that height. But over time the particles will lose height.

 

A 1997 report from the US National Research Council warned that stray particles just a few millimetres across could punch a hole in the leading edge of a shuttle wing, causing a disaster on re-entry similar to the Columbia accident last year.

 

“We still haven’t lost any spacecraft due to any orbital debris that we know of,” says Nicholas Johnson of the NASA Johnson Space Center in Houston, Texas, who is chief scientist of the orbital debris programme. “If you are operating at 900 kilometres, there is a substantial elevation of risk, but the total risk is still not unacceptable.”

 

Anti-satellite tests and exploding booster rockets are blamed for most of the orbital debris generated by human activity, but the metal spheres add significantly to that figure.

 

Nuclear contamination

 

US radars track some 11,000 objects larger than 10 centimetres across, but there are more than 100,000 pieces between 1 and 10 centimetres across. Now Paula Krisko of the aerospace company Lockheed Martin estimates that there are a further 60,000 metal particles at least 1 centimetre across orbiting at 900 kilometres (Orbital Debris Quarterly Newsletter, vol 8, p 6).

 

Ironically, it was efforts to prevent nuclear contamination on the ground after re-entry that led to the metal particles being dispersed in space. In the early years of the space race, both the US and the Soviet Union developed compact reactors to power satellites while in orbit.

 

The US launched its first in 1965, and between 1967 and 1988 the Soviet Union launched a series of 31 reactor-powered Radar Ocean Reconnaissance Satellites (RORSATs), which monitored naval movements from a 300-kilometre orbit.

 

At the end of their lives, these satellites were supposed to be boosted to a parking orbit at 900 kilometres, but in 1978 Cosmos 954 failed to boost, and scattered radioactive debris across Canada when it re-entered the atmosphere.

To prevent a repetition, Soviet engineers designed later satellites to allow the reactor to be ejected. The idea was that this would be done after the satellite reached the parking orbit, but in emergencies it could be done in low orbit.

 

In 16 cases, the ejection process ripped open pipes carrying the liquid sodium-potassium alloy that acted as the reactor’s coolant. The alloy freezes at -12 degrees Celsius.

 

The first hint of the problem came in 1990 when NASA’s LDEF craft came back to Earth with sodium-potassium contamination. Krisko’s model puts the total mass of the coolant at 164 kilograms distributed in 116,000 particles.

 

Even at 900 kilometres, air resistance takes its toll on small particles. Carsten Wiedemann of the Technical University in Braunschweig says most particles smaller than about 5 millimetres across have already fallen into the atmosphere. Larger particles will trickle into lower orbits, then burn up in the atmosphere over a longer time.

Elon Musk has responded to the accusation by Michael Burry that he “just wants to sell Tesla” to capitalise on its enormous value while the share price is still high. The founder of the electric vehicle company tweeted that the investor made famous by The Big Short is a “broken clock”. McCain and the RNC took on the comment in terms that will be very familiar to people who followed Clinton campaign statements last year:

 

“Barack Obama’s call for ‘new politics’ is officially over. In just 24 hours, Barack Obama attacked one of America’s pioneering women CEOs, rejected a series of joint bipartisan town halls, and said that if there’s a political knife fight, he’d bring a gun," McCain spokesman Tucker Bounds said, referring also to the Obama campaign's shot at Carly Fiorina's lavish pay package and role in layoffs at Hewlett-Packard.

 

“Why is Barack Obama so negative? In the last 24 hours, he’s completely abandoned his campaign’s call for ‘new politics,’ equating the election to a ‘brawl’ and promising to ‘bring a gun,' " said the RNC's Alex Conant.

 

Obama doesn't actually use the phrase "new politics" a lot, and this is a box that the Clinton campaign tried, and failed, to keep him in last year, when it emerged early that he was happy to throw punches, and even to start fistfights, sending, for instance, the first negative mail to hit in Iowa last fall.

Google executives told employees last week in a companywide meeting that it is interested in a Pentagon contract for cloud computing and that working for the military would not necessarily conflict with principles created by the company for how its artificial intelligence technology would be used. Google is pursuing the contract three years after an employee revolt forced the company to abandon work on a Pentagon program that used artificial intelligence and to establish new guidelines against using A.I. for weapons or surveillance.

 

The pursuit potentially sets up another clash between company leaders and employees. Google’s cloud unit prioritized preparation for a bid on a Pentagon contract, The New York Times revealed this month, pulling engineers off other projects to focus on creating a winning proposal. The rush to pursue the contract is a dramatic shift for Google, which said in 2018 that it would not bid on a major cloud computing contract with the Defense Department, known as the Joint Enterprise Defense Infrastructure, or JEDI, because the work would conflict with its A.I. principles. The JEDI cloud computing contract was estimated to be worth $10 billion over 10 years, and was awarded to Microsoft in 2019. But facing legal challenges from Amazon, the Pentagon scrapped the contract in July and announced a new plan to purchase cloud computing technology. The new version of the contract, known as the Joint Warfighting Cloud Capability, will split the work between multiple companies.

The Pentagon has warned the US National Guard that Covid-19 vaccination is mandatory and that members will face disciplinary action if they do not get the jab after a National Guard general openly defied a vaccine mandate.

 

Brigadier General Thomas Mancino – the 45th Infantry Brigade Commander of Oklahoma’s National Guard – told his soldiers last week that “no negative administrative or legal action” would be taken if they refused Covid-19 vaccination, despite President Joe Biden’s controversial military vaccine mandate.

“The Secretary of Defense has the authority to require these vaccines for all members of the force, including the National Guard, as I said, even in a Title 32 status,” Kirby said, arguing that even when the National Guard members are under the command of state governors, they must abide by the Pentagon’s vaccination mandate, since the force is federally-funded.

The article goes on to note the military's interest in alternative means of launching small satellites into orbit, and obviously, this method is completely impractical for launching a manned capsule; the G's alone of spinning up a projectile to literally throw it into space would kill a human long before it reached a sufficient velocity to be thrown into space.

 

And that's my problem here, because the word "projectile" isn't mine, it's the article's.

 

In short, we're looking at …well…artillery,though of a very unconventional sort. Unconventional artillery has been around for a long long time. The first electro-magnetic "rail guns" were actually conceived (and experimented with) prior to World War One. But this system intrigues: it's not a"rod of God"system except in its use of sheer kinetic energy. It's more like a"baseball of God"technology. It's that artillery aspect that disturbs here, because with a little adjustment of the release chamber - shown pointing straight up in the pictures in the article - one could launch the "projectile" on a standard ballistic trajectory or alternatively, with the right electronic packages inside of it, guide it to a remote target and destroy it through sheer kinetic energy. Indeed, I can't help but think that perhaps we're looking at one of the technologies that was behind the announcement of the US Army a couple of years ago that it is designinga super-long range "cannon".This would certainly fit the bill if the technology can be made to work reliably. Late on Monday, JPMorgan sued Tesla for $162.2 million, accusing Elon Musk's electric car company of "flagrantly" breaching a contract related to stock warrants after its share price soared. According to the complaint filed in Manhattan federal court and first reported by Reuters, Tesla in 2014 sold warrants to JPMorgan that would pay off if their "strike price" were below Tesla's share price upon the warrants' expiration in June and July 2021.

 

JPMorgan, which said it had authority to adjust the strike price, said it substantially reduced the strike price after Musk's Aug. 7, 2018 tweet that he might take Tesla private at $420 per share and had "funding secured," and reversed some of the reduction when Musk abandoned the idea 17 days later.

 

In either case, Tesla's share price rose approximately 10-fold by the time the warrants expired, and JPMorgan said this required Tesla under its contract to deliver shares of its stock or cash. The bank said Tesla's failure to do that amounted to a default.

 

"Though JPMorgan's adjustments were appropriate and contractually required," the complaint said, "Tesla has flagrantly ignored its clear contractual obligation to pay JPMorgan in full."

 

According to the complaint, Tesla sold the warrants to reduce potential stock dilution from a separate convertible bond sale and to lower its federal income taxes (we are confident Bernie Sanders will have something to say about this). JPMorgan said it had been contractually entitled to adjust the warrants' terms following "significant corporate transactions involving Tesla."

 

The automaker in February 2019 complained that the bank's adjustments were "an opportunistic attempt to take advantage of changes in volatility in Tesla's stock," but did not challenge the underlying calculations, JPMorgan said. Musk's August 2018 tweets led to U.S. Securities and Exchange Commission civil charges and $20 million fines against both him and Tesla.

 

Meanwhile, TSLA stock continued to slide on Monday, briefly entering a bear market before shooting higher as a result of what we said was a perfectly unmanipulated move in response to Musk selling billions more in TSLA stock.

Rantz: Here’s why WA officials don’t admit COVID death rate is lower than breakthrough case rate

Washington reported last week over 69,000 breakthrough cases where vaccinated people were infected with COVID. These cases represent about 1.33% of the COVID vaccinated Washingtonians over 12 years old in the state. Though the data is somewhat misleading, it’s objectively good news and makes a case to get vaccinated if you haven’t already recovered from the virus.

 

But nearly as low — arguably, the numbers are closer to identical than not — is the chance of death from COVID. In fact, for most Washingtonians, the chances of being a breakthrough case are almost as low as dying from COVID. So why the attempts to keep us in a constant state of fear?

They expect 1% breakthrough cases for a virus that has about a 1% death rate. That means it’s incredibly rare to become infected with COVID while vaccinated. Likewise, it’s incredibly rare to die from COVID (whether or not you’re vaccinated). So why don’t officials say that?

Public health officials and Democrat politicians are singularly focused on you getting vaccinated, regardless of the consequences. They view the unvaccinated as dirty — so much so that they’ll gut their own agencies and departments to weed out the people who don’t think like them.

Several outlets parroted claims by Seattle Children’s Hospital that its ICUs were overrun with child-COVID cases. The hospital provided no data publicly. It took a few leaks to the Jason Rantz Show on KTTH to figure out the data didn’t back the claims — not even close. So why were the claims broadcast unvetted? Because reporters approved of the messaging: They must protect the children!

 

Meanwhile, the Tacoma News Tribune amplifies a claim by Dino Johnson, the chief operating officer at St. Anthony Hospital. He says the hospital is “full” due to unvaccinated patients. What’s that number?

 

“Johnson declined to give a number,” reports the TNT.

 

They did not fully vet the claim. But the paper likes the message.

It’s weak by week for old Joe Biden: Goodwin

 

Another week, another series of fumbling, mumbling and disasters. How low can Joe Biden go?

 

Once again, the common theme was weakness. At home and abroad, he is shrinking the presidency before our eyes.

 

The diminished commander in chief visited his party members in Congress Thursday and was reduced to pleading for them to save his bacon.

 

“The House and Senate majorities and my presidency will be determined by what happens next week,” he confessed to Democrats.

 

It was an extraordinary moment for a president, the ostensible leader of his party, but in reality this one is a beggar-in-chief. His focus was on the fate of two massive pieces of legislation, worth $3 trillion combined, even though the larger of the two hadn’t been written and major issues, including whose taxes would be raised, were still hotly disputed.

 

Nonetheless, with his job approval tanking and needing anything he could call a victory, especially at the Scotland climate summit, the president was desperate for signs of progress. Even a mere promise that both bills would eventually be passed would have been something he could boast about.

 

Instead, he got the back of Sen. Bernie Sanders’ hand.

 

After Biden’s closed-door meeting and a public statement in which he tried to portray progress by citing a sketchy “framework” for the social spendathon, which includes $550 billion worth of climate projects, the real power emerged from the shadows. Sanders, the Vermont socialist, flatly rejected the president’s request to pass the separate infrastructure deal first and urged his fellow travelers in the House to say no, which they promptly did.

 

So the man who is supposed to be the leader of the free world cannot even lead his own party, meaning Biden headed for Europe bearing nothing except embarrassment.

 

On Friday in Rome, he was again the pleader-in-chief, this time seeking forgiveness from French President Emmanuel Macron after a rupture in relations over a nuclear submarine deal in which Australia backed out of a deal with France and switched to one with the US and Great Britain.

 

The deal enraged France and hurt Macron politically just months before an April election. Video showed Biden looking like a scolded, sheepish child as he called events around the Australian deal “clumsy” and confessed he was not up to speed when the deal was announced.

 

So if the president isn’t up to speed on major events involving key allies, who is up to speed and, most important, who is making the decisions?

 

Weakness here, weakness there, weakness everywhere. Even live coverage of Biden’s meeting with the pope was canceled by Vatican TV, with a few minutes airing later. Why not show the whole thing?

 

In both meetings, Biden was maskless, a rare sight when he is in the United States. Is the rule follow the science, or when in Rome . . . ?

 

If that were all, the week would have been trouble enough. But Friday brought a disaster of another sort in the form of a report on the administration’s plan to pay up to $1 billion to illegal migrant families separated at the border by the Trump administration. The Wall Street Journal scoop was so outlandish I first thought it had to be a mistake or a pre-Halloween prank because something so fundamentally stupid can’t possibly be true.

 

But of course the report is true and as such reveals two other disturbing aspects of the Biden presidency: arrogance and incompetence.

 

There is no rational way to explain the mere existence of settlement talks with lawyers from the American Civil Liberties Union, which is representing the migrants, and the fact the talks were held in secret, then leaked. Perhaps the aim was to complete the deal, then treat it as a fait accompli at an announcement.

 

Whatever the plan, the idea is nuts on so many levels, including that it offers yet another clear signal to the cartels and people smugglers to keep bringing their caravans north.

Sen. Tom Cotton got it right in a tweet: “It’s unthinkable to pay a burglar who broke into your home for the ‘psychological trauma’ they endured during the crime,” the Arkansas Republican wrote. “Yet the Biden admin wants to reward migrants who illegally entered our country with up to $450,000 each for just that reason. Insanity.”

 

Others, including Texas GOP Rep. Dan Crenshaw, who lost an eye in combat in Afghanistan, noted that the families of American service members killed in the line of duty receive an insurance payment of $400,000.

 

“Let that sink in,” Crenshaw tweeted.

US to Partner With Israel to Combat Ransomware Attacks

The U.S. Treasury Department said on Sunday it will partner with Israel to combat ransomware, with the two countries launching a joint task force to address cybersecurity.

The task force will develop a memorandum of understanding supporting information sharing related to the financial sector, including cybersecurity regulations and threat intelligence, the Treasury Department said.

The announcement follows a virtual meeting on ransomware that held at the White House in October with the European Union and more than 30 countries, including Israel.

Deputy Secretary of the Treasury Wally Adeyemo asked then for international cooperation to address the abuse of virtual currency and disrupt the ransomware business model.

The partnership follows measures taken to combat a surge in ransomware that has struck several big U.S. companies, including an attack on the largest fuel pipeline in the United States that crippled fuel delivery for several days.

A broader U.S.-Israeli task force was also launched on Sunday to address issues related to fintech and cybersecurity, the Treasury Department said.

Adeyemo met with Israeli Finance Minister Avigdor Lieberman and Director General of the National Cyber Directorate Yigal Unna in Israel on Sunday to establish a bilateral partnership, the department said in a statement.

Earlier this month, the U.S. Justice Department charged a Ukraine national and a Russian in one of the worst ransomware attacks against American targets.
