The U.S. Supreme Court announced that it will take up arguably one of the most abortion cases in at least three decades.

 

The nationโ€™s highest court will hear a direct challenge out of Mississippi to Roe v. Wadeโ€™s landmark holding that the Constitution provides a right of access to abortion.

 

โ€œItโ€™s the case opponents of abortion have long sought and advocates of abortion rights have dreaded, coming before a strongly conservative lineup of justices. Three were appointed by then-President Donald Trump, who said he would choose nominees willing to overturn Roe,โ€ NBC News reported.

 

โ€œThe issue of whether the Constitution provides a right to seek an abortion is not before the court in the Texas challenges, but it is squarely presented in Wednesdayโ€™s case. At the heart of it is a Mississippi law โ€” passed in 2018 but blocked by the lower courts โ€” that would ban most abortions after 15 weeks of pregnancy, allowing them only in medical emergencies or cases of severe fetal abnormality. Supporters say the law is intended to regulate โ€˜inhumane proceduresโ€™ and argue that a fetus is capable of detecting and responding to pain by that point,โ€ the report added.

The case presents an attack on the courtโ€™s landmark Roe v. Wade ruling in 1973 and a follow-on decision in Planned Parenthood v. Casey about two decades later. The court held that a state can impose some restrictions on abortion provided they do not present an โ€œundue burden,โ€ but cannot ban the procedure before fetal viability, generally considered to be 23 to 24 weeks into the pregnancy.

 

Mississippi said it must be free to take account of advancements in medical knowledge that would shift the point of viability earlier in the pregnancy. But abortion-rights advocates said viability, defined as the time at which a life could be sustained outside the womb, has remained the same since Roe was decided.

 

In its submissions, Mississippi said the Supreme Court made a fundamental error in its landmark abortion rulings, arguing, โ€œNothing in constitutional text, structure, history, or tradition supports a right to abortion.โ€ The state also said the court was wrong to rule that state laws outlawing abortion violated a womanโ€™s right to privacy. โ€œNowhere else in the law does a right of privacy or a right to make personal decisions provide a right to destroy a human life,โ€ it said in its brief to the court.

 

In a separate case regarding abortion, liberals were angry that the Supreme Court did not issue an opinion last week regarding Texasโ€™ abortion law Monday morning.

 

Several prominent Democrats attacked the justices for failing to take action in the case and used the opportunity to call for packing the court with liberal justices.

 

โ€œThe Supreme Court has allowed Texasโ€™s abhorrent anti-abortion law to remain in effect for 83 days,โ€ Demand Justice, a pro-court-packing organization run by former Obama administration staffers, tweeted. โ€œWe cannot keep waiting for this Court to act in the interests of the American people โ€“ itโ€™s time to #ExpandTheCourt.โ€

 

โ€œMany guessed the Supreme Court would weigh in on the Texas law today but it turned out to be a giant head fake. It is insane we let the third branch of government conduct itself with so little transparency when it comes to rights this fundamental,โ€ wrote Demand Justice Executive Director Brian Fallon, the former press secretary for Hillary Clintonโ€™s 2016 presidential campaign.

 

Liberals did not contain their outrage:

โ€œSERIOUSLY. AN ORIGINAL JURISDICTION CASE,โ€ Vox senior correspondent Ian Millhiser tweeted, using the legal term for disputes between states that go directly to the Supreme Court.

 

โ€œLOLZ at all of us for thinking that the Supreme Court might do something sensible in an abortion case today,โ€ he added. โ€œThe Supreme Court is bad, yโ€™all.โ€

 

Last month, Supreme Court Justice Sonia Sotomayor complained not happy about the court refusing to block Texasโ€™ six-week abortion law.

 

Sotomayor called it โ€œcatastrophicโ€ that Texasโ€™ abortion ban law was been stopped.

 

In a seven-page written rant, Sotomayor not only attacked her conservative colleagues, she sensationally claimed that the court โ€œcannot capture the totality of this harm in these pages.โ€

 

In September, abortion advocates and providers in the Lone Star State appealed to the high court to hear their arguments against the Texas law, SB 8, before there was a final judgment in a lower federal court โ€œbecause of the urgency of the harmโ€ the law allegedly causes.

 

Senate Bill 8, signed into law in May, bars abortions in the state after fetal heart tones are detected, generally around six weeks. It empowers private citizens to sue anyone involved in providing an abortion after the establishment of heart tones.

Researchers have discovered the worldโ€™s first living robot that can uniquely replicate itself. Scientists have dubbed them Xenobots, robots made from the stem cells of the Xenopus laevis, an African clawed frog.

 

The stem cells have tiny little hairs called cilia that help them move around a petri dish. The Xenobot project was first unveiled in 2020. Thanks to a group of scientists who found that they could move, work together in groups and self-heal.

The Department of Justice announced this week that it would crack down on airline passengers who throw tantrums. Now, if Attorney General Merrick Garland would only get around to doing something about people who plot the overthrow of our government and a former president whoโ€™s serially obstructed justice and abused power we might be getting someplace.

 

Not that in-flight safety isnโ€™t important. It is. Just like itโ€™s important to arrest and prosecute the moron Trumpist foot soldiers who stormed the Capitol on Jan. 6. All that is important. But it is not enough.

 

President Joe Biden may get everything else right but if his administrationโ€”starting with the Department of Justiceโ€”gets wrong its response to the threats to our democracy posed by Trump and the GOP, nothing else they do may matter.

 

A widely respected jurist, Garland was picked by Biden to depoliticize the DOJ and end the abuses of its power we saw under Trump appointees Jeff Sessions and Bill Barr. Certainly, he has made some strides in that direction. But if the result of his de-politicization is tiptoeing around the egregious serial wrongdoing of the leaders of the Republican Party, then his efforts will have exactly the opposite of the intended effect. By failing to hold Trump and Co. accountable, Garland will set the stage for them to continue unabated their efforts to turn the U.S. into a one-party state in which only Republicans can win elections and any tactics they may use to hold on to power will have been effectively validated by the inaction of Garland and his DOJ.

 

Garland has, on more than one occasion, already taken steps that have actually empowered or emboldened those who currently pose a threat to our system. A particularly egregious example of this was Garlandโ€™s decision to take the side of Trump by arguing that the former president was acting in his official capacity when he lied and defamed journalist E. Jean Carroll following her accusation that Trump had raped her long before he was elected president.

 

Garlandโ€™s position was defended by allies who argued that he was an โ€œinstitutionalistโ€ who felt it was his duty to defend presidential prerogatives. But what he was actually doing was defending the abuse of power and, however inadvertently, demonstrating that our institutions may face no threat quite so grave as that posed by self-anointed โ€œinstitutionalists.โ€

 

Recently, Garland has won praise for having had the Justice Department enforce contempt of Congress charges against disheveled Trump crony Stephen Bannon. However, the DOJ decision to bring charges against Bannon took weeks when it should have taken minutes. The case was clear-cut. Bannon ignored a legitimate Congressional subpoena, claiming rights he did not have.

 

I have been counseled by wise and respected friends, like former U.S. Attorney and Deputy Assistant Attorney General Harry Litman, that we should be grateful for the Bannon decision because it will empower the Congress to do its job. I understand the view. But this Congressional investigation has a clock running on it. If the GOP retakes the House next November, as many are currently predicting, the investigation into the Jan. 6 coup attempt will be instantly ended by the Republicans. So for all those called by the committee, it may appear that all they have to do to avoid suffering any consequences for their action is to stall just as Bannon is doing. In this case, justice delayed will most certainly be justice denied.

 

More troubling to me though is that the only reason we are hearing of any case being brought against Bannon as a senior coup plotter (or upper middle management in any case) is because Congress is investigating the events of Jan. 6. We have not heard a peep out of the Department of Justice about prosecuting those responsible for inciting, planning or funding the effort to undo the lawful transfer of presidential power to the man the American people elected, Joe Biden.

 

We also have not heard a peep out of them in terms of prosecuting the dozen instances of clear obstruction of justice that Special Counsel Robert Muellerโ€™s report cited against Trump. We have seen that Garland is letting the highly politicized investigation of special prosecutor John Durham into the conduct of the Trump-Russia investigation continue (by continuing its funding). We therefore have the real prospect that those who sought to look into the Trump-Russia ties that both Mueller and Congressional investigations have demonstrated were real, unprecedented and dangerous might be prosecuted while those who actively sought the help of a foreign enemy to win an election will not be.

 

Other wise and experienced legal observers for whom I have massive respect argue that further patience is in order, that we donโ€™t know what Garland is doing behind the scenes and we should give him more time. One such person is former U.S. attorney Barbara McQuade. She said to me, โ€œWhile I understand the frustration that DOJ has not yet charged higher-level defendants in the Jan. 6 attack, I think that it is not yet time to be angry with AG Garland for inaction. We donโ€™t know what investigative steps may be occurring because of the grand jury secrecy requirement. Robert Mueller spent almost two years on his investigation. I would expect this investigation to take at least that long.โ€

 

A.G. Gill, another analyst of these matters for whom I have great respect, creator and host of the Daily Beans and Mueller She Wrote podcasts, argues caution for another reason. She feels there are efforts afoot to turn public opinion against Garland and DOJ as a way of weakening and discrediting these institutions.

 

And yet Garlandโ€™s behavior to date has left me apprehensive. Conversations I have had with folks inside DOJ have not eased those concerns. There, frustration with Garland begins with his management style (which insiders liken to that of a judge running his chambers in which his office is a kind of bubble apart from the department and staffed by a small team akin to the clerks he had when he was in the judiciary).

 

It extends to concerns that he will err too far in the name of caution and a desire not to be perceived as political. This too is a hold-over from his court days and ignores that A) he is a political appointee, B) the issues he is dealing with are hyper-politicized and c) there is no way to prosecute politicians for crimes committed in the name of partisanship without appearing political.

 

But, still, Iโ€™ll admit it. I hear our judicial clock ticking as loudly as Mona Lisa Vitoโ€™s biological clock. Given that the stakes are so high and seeing some of the decisions Garland has made, I am wondering when it is ok to become alarmed, when it is ok to become angry.

 

I asked Slate senior editor and host of the โ€œAmicusโ€ podcast, Dahlia Lithwick whether my burgeoning anger was acceptable, and she responded: โ€œI was already pretty OK about getting mad at this last summer. Itโ€™s possible to admire and honor all the good and vitally necessary initiatives undertaken by Garlandโ€™s DOJ, to rejoice in his principled efforts to reinstate the wall between the Justice Department and the White House that Bill Barr and Donald Trump had reduced to a picket fence, and still to be maddened by the DOJโ€™s evident hope that a reckoning over Trumpโ€™s lawlessness can be left to prosecutors in New York and the Congress.โ€

 

She continued, making an important historical point: โ€œWhen the Obama Administration opted to draw a line under the Bush era torture and rendition programs, it didnโ€™t disappear the past, it just buried it. And given that Trumpโ€™s election denialism is emphatically not in the pastโ€”according to a November poll from the Public Religion Research Institute, 68 percent of Republicans believe the 2020 election was โ€˜stolenโ€™ from Donald Trump. That growing number doesnโ€™t just foment doubt in election integrity and the rule of law, itโ€™s being used to pass election suppression and democracy subversion measures in states around the country. The โ€˜big lieโ€™ that seeded Jan. 6 has become the litmus test for GOP loyalty. I understand that the optics of prosecuting oneโ€™s political enemies and criminalizing fiery speech and politics is a chilling callback to the McCarthy era. But the lies and violence and white supremacy and misogyny of Jan. 6 isnโ€™t buried in the past, itโ€™s metastasizing and spreading in ways that threaten the future as well.โ€

 

Revered legal scholar, Laurence Tribe, who taught Garland when the attorney general was a student at Harvard Law School, suggests we give his former student a little more time, but not an unlimited amount. He hears the clock ticking too. Tribe told me, โ€œIf Merrick Garland hadnโ€™t authorized the Bannon indictment when he did, Iโ€™d certainly have gotten mad long since. At least with respect to someone like me, he bought a few weeks with that indictmentโ€”but not a few months.โ€

 

โ€œAll things considered,โ€ he continued, โ€œIโ€™ll be both disappointed and angry if we find ourselves going into January 2022 without strong evidenceโ€”in a town that leaks like a sieveโ€”that DOJ is moving full speed ahead on holding Trump and his enablers, facilitators, funders and co-conspirators criminally accountable for the coup dโ€™รฉtat they tried to pull off and the violent insurrection they mounted against the Capitol to delay, obstruct and, if possible, subvert the solemn electoral proceeding there underway.โ€

 

That too, makes sense to me. What is certain is this: Time is running out. There is every reason to fear that Trump and the coup plotters will not be held accountable in any meaningful way. If they are not, they will see the inaction of our justice system as a license to continue their attacks on our system of government. What is more, absent an effective Department of Justice effort, those attacks are that much more likely to succeed and to be compounded by even greater abuses. And at that point, all the institutionalists in the world will not be able to put our Humpty Dumpty of a democracy back together again.

Trump Never Got Another Classified Intelligence Briefing After Jan. 6

He skipped his classified intelligence briefings for the holidays. And then, after his Jan. 6 briefing didnโ€™t happen, he never got another one, a new CIA book reveals.

 

After a holiday break where he didnโ€™t receive a classified intelligence briefing, President Donald Trump was supposed to get one on Jan. 6, 2021โ€”the day he incited a violent attack on the U.S. Capitol. It didnโ€™t happen. And then he didnโ€™t get one for the rest of his presidency.

 

That unusual stretch where the president didnโ€™t receive a regular classified briefing is recounted in the latest version of a book published and regularly revised by the Central Intelligence Agency, which describes how spies update presidents on national security matters.

 

The situation in the waning days of Trumpโ€™s presidency was so uncommon that it actually caused concern among some administration officials that Trump was losing touch with reality, as he was getting unhinged advice on domestic issues from Justice Department attorneys and outside counsel that openly advocated rejecting election results.

 

"There was no certainty that he was getting objective, unbiased information in any other way,โ€ one source familiar with the matter told The Daily Beast. โ€œYou couldnโ€™t trust that anybody around him was able to get that information to him in that period of time."

 

Unlike past presidentsโ€”who would read their daily intelligence report and occasionally get briefed by a CIA officerโ€”Trump regularly refused to read the text, demanded โ€œkillerโ€ pictures, and preferred to get updated in person by his daily briefer.

 

While past presidents took great interest in having the most up-to-date information on security challenges and foreign intelligence, the CIA book that was updated last month revealed that Trump spent two days a week receiving the latest sensitive information coming in from American spies all over the globe, in sessions running 45 minutes on average.

 

That came to a halt in late 2020, however, according to the CIAโ€™s โ€œGetting to Know the Presidentโ€ book, written by a revered former inspector general at the agency, John Helgerson.

 

Trump took a vacation break over the holidays when he traveled to Mar-a-Lago and told his briefer โ€œhe would see her later,โ€ Helgerson wrote. The president then went two weeks without that pivotal one-on-one update, unlike his predecessor, former President Barack Obama, who was known to read the daily report even while vacationing in Hawaii.

 

During that break, Trump and his closest advisers kept busy trying to overturn election results in Arizona, Georgia, Pennsylvania, and Wisconsin by peddling disinformation and supporting conspiracy-laden legal challenges that eventually went bust. There was his infamous phone call demanding that Georgiaโ€™s top elections official โ€œfind 11,780 votes,โ€ not to mention his despotic attempt to get the U.S. Supreme Court to declare Wisconsinโ€™s election โ€œunconstitutional.โ€

 

The White House finally scheduled a briefing when heโ€™d be back in the nationโ€™s capital. Trump was apparently too busy that dayโ€”spending Jan. 6 inciting a riot by delivering a speech and calling on his acolytes to โ€œfight like hellโ€ and march on the Capitol building just as Congress was certifying the 2020 election results.

 

The CIA book says, โ€œthe briefings were to resume on 6 January but none were scheduled after the attack on the Capitol.โ€

 

The break for the holidays and the two-week stretch after the insurrection meant that Trump went without the briefings for nearly his entire final month in office, a pause that experts found unprecedented.

 

โ€œItโ€™s not unusual to miss one here or there. But itโ€™s unusual to go several weeks without a briefing,โ€ said Matthew Kroenig, a former intelligence official who developed strategies to counter China, Iran, North Korea, Russia, and terrorist networks.

 

โ€œWhether you like him or not, he was the commander in chief. As a nation, we would have been safer if he would have been getting those briefings,โ€ said Kroenig, who is now the deputy director of the nonprofit Atlantic Councilโ€™s Scowcroft Center for Strategy and Security.

 

When asked by The Daily Beast, the CIA wouldnโ€™t answer why Trump stopped receiving briefings during that time. Three former intelligence officials said that scheduling the briefings would have been up to the White House, which was busy during the last two weeks fighting off accusations of an attempted coup and preparing for an impeachment fight.

 

The CIA also would not say if Trump has received them since he left office, although President Joe Biden went on record in February saying that his predecessor should no longer receive them.

 

Trumpโ€™s post-presidential office did not respond to questions Monday evening.

 

Helgerson, a career spy who has since retired and was contracted to write the book, declined to provide additional details on the sudden halt in briefings to The Daily Beast on Monday, citing strict limitations imposed by the agency.

 

The CIA bookโ€™s new chapter also described at length how Trump himself posed a challenge for the nationโ€™s intelligence officials, especially at the beginning of his presidency, when he was mired in accusations of suspicious ties to Russia and lashed out against the nationโ€™s surveillance networks.

 

โ€œโ€‹โ€‹For the Intelligence Community, the Trump transition was far and away the most difficult in its historical experience with briefing new presidents,โ€ the book states. โ€œRather than shut the IC out, Trump engaged with it, but attacked it publicly.โ€

 

A subsequent portion quotes Obamaโ€™s outgoing director of national intelligence, James Clapper, saying that Trump was โ€œfact-freeโ€ and prone to โ€œfly off on tangents; there might be eight or nine minutes of real intelligence in an hourโ€™s discussion.โ€

 

Some national security experts have pointed out that, while Trump stopped receiving the classified updates, many of those surrounding him still did. As Helgerson noted in his revised edition to the book, then-Vice President Mike Pence โ€œwas an assiduous, six-day-a-week Readerโ€ who would often join the president in his brief and spark a thoughtful discussion about pressing matters. Then again, by the end of his presidency Trump had turned on Pence and was notorious for relying on Fox News and Newsmax hosts for a steady stream of unverified information.

 

Larry Pfeiffer, a former CIA chief of staff who also ran the White Houseโ€™s Situation Room during the Obama administration, stressed that keeping the president informed during his final weeks in office would have been pivotal. He said the month-long stretch without a briefing was the most alarming detail in the bookโ€™s latest update.

 

โ€œGiven how complicated the world is today, and given the kinds of decisions the president should be involved in in the national security arena, Iโ€™d be concerned that the president could find himself behind the curve,โ€ he said.

 

โ€œIran could have planned some foolish attack, or you could have intel members of the incoming administration acting against current U.S. foreign policy,โ€ he said, making a joking reference to the problems that plagued Trumpโ€™s own transition team in 2016.

At the very least, filing a criminal compliant at the local level educates law enforcement on the crimes being committed by the federal government and serves as a disincentive to enforce federal mandates or directives with no legal nor constitutional basis.
