WASHINGTON - The Obama administration in its final year in office spent a record $36.2 million on legal costs defending its refusal to turn over federal records under the Freedom of Information Act, according to an Associated Press analysis of new U.S. data that also showed poor performance in other categories measuring transparency in government.

For a second consecutive year, the Obama administration set a record for times federal employees told citizens, journalists and others that despite searching they couldn’t find a single page of files that were requested.

And it set records for outright denial of access to files, refusing to quickly consider requests described as especially newsworthy, and forcing people to pay for records who had asked the government to waive search and copy fees.

The government acknowledged when challenged that it had been wrong to initially refuse to turn over all or parts of records in more than one-third of such cases, the highest rate in at least six years.

In courtrooms, the number of lawsuits filed by news organizations under the Freedom of Information Act surged during the past four years, led by the New York Times, Center for Public Integrity and The Associated Press, according to a litigation study by the Transactional Records Access Clearinghouse at Syracuse University. The AP on Monday settled its 2015 lawsuit against the State Department for files about Hillary Clinton’s time as secretary of state, at AP’s request, and received $150,546 from the department to cover part of its legal fees.

The AP has pending lawsuits against the FBI for records about its decision to impersonate an AP journalist during a criminal investigation and about who helped the FBI hack into a mass shooting suspect’s iPhone and how much the government paid to do it.

Of the $36.2 million in legal costs fighting such lawsuits last year, the Justice Department accounted for $12 million, the Homeland Security Department for $6.3 million and the Pentagon for $4.8 million. The three departments accounted for more than half the government’s total records requests last year.

The figures reflect the final struggles of the Obama administration during the 2016 election to meet President Barack Obama’s pledge that it was “the most transparent administration in history,” despite wide recognition of serious problems coping with requests under the information law. It received a record 788,769 requests for files last year and spent a record $478 million answering them and employed 4,263 full-time FOIA employees across more than 100 federal departments and agencies. That was higher by 142 such employees the previous year.

A spokesman for former President Obama did not immediately respond to an email request for comment late Monday. The White House under Obama routinely defended its efforts under the information law in recent years and said federal employees worked diligently on such requests for records.

It remains unclear how President Donald Trump’s administration will perform under the Freedom of Information Act or other measures of government transparency. Trump has not spoken extensively about transparency. In his private business and his presidential campaign, Trump required employees and advisers to sign non-disclosure agreements that barred them from discussing their work. His administration has barred some mainstream news organizations from campaign rallies and one White House press briefing. And Trump broke with tradition by refusing to disclose his tax returns.

Trump’s secretary of state, Rex Tillerson, is traveling to Asia this week on a small plane without a contingent of journalists or a designated pool reporter who would send reports to the broader diplomatic press corps, departing from 50 years of practice.

Overall, in the final year of Obama’s administration, people who asked for records last year under the law received censored files or nothing in 77 percent of requests, about the same as the previous year. In the first full year after Obama’s election, that figure was only 65 percent of cases. The government released the new figures in the days ahead of Sunshine Week, which ends Sunday, when news organizations promote open government and freedom of information.

Under the records law, citizens and foreigners can compel the U.S. government to turn over copies of federal records for zero or little cost. Anyone who seeks information through the law is generally supposed to get it unless disclosure would hurt national security, violate personal privacy or expose business secrets or confidential decision-making in certain areas.

Trump Sex Scandal Video Is a RAT

 

Cyber-attackers are disguising malware as a video file depicting a fake sex scandal involving United States President Donald Trump.

 

The email-based attack was discovered by cybersecurity researchers at Trustwave who were reviewing their spam traps.

 

Targets are sent an email with the attachment “TRUMP_SEX_SCANDAL_VIDEO.jar”. Those who click on the malicious Java Archive (JAR) file unwittingly install the Qnode Remote Access Trojan (RAT) onto their computer.

 

Unusually, the title of the malicious file bore no resemblance to the subject of the email to which it was attached.

 

When the researchers opened the email “GOOD LOAN OFFER!!,” they expected to discover nothing more than an investment scam. However, attached to the email was an archive containing the malicious JAR file.

 

"We suspect that the bad guys are attempting to ride the frenzy brought about by the recently concluded Presidential elections since the filename they used on the attachment is totally unrelated to the email’s theme," wrote researchers.

 

An investigation into the attack revealed that the JAR file is a variant of a QRAT downloader researchers brought to the public's attention in August. Compostable means that a product is capable of breaking down into natural elements in a compost environment. Because it’s broken down into its natural elements it causes no harm to the environment. The breakdown process usually takes about 90 days. The ASTM defines compostables as anything that undergoes degradation by biological processes during composting to yield CO2, water, inorganic compounds and biomass at a rate consistent with other compostable materials and leaves no visible, distinguishable or toxic residue.

 

 

SO WHAT’S THE DIFFERENCE?

Looking at the definitions of both terms it’s pretty understandable why they are so easily confused but there’s a difference. While all compostable material is biodegradable, not all biodegradable material is compostable. Although biodegradable materials return to nature and can disappear completely they sometimes leave behind metal residue, on the other hand, compostable materials create something called humus that is full of nutrients and great for plants. In summary, compostable products are biodegradable, but with an added benefit. That is, when they break down, they release valuable nutrients into the soil, aiding the growth of trees and plants.

 

 

WHY IS KNOWING THE DIFFERENCE SO IMPORTANT?

While biodegradable items refer to just any material which breaks down and decomposes in the environment, compostable goods are specifically organic matter which breaks down, the end product having many beneficial uses which include fertilizing and improving soil health. Most importantly compostable items don’t leave toxic residue behind because it’s already organic. Unlike compostable, certain biodegradable products can take several years to break down and in some cases even leave toxic waste behind.

 

Plant based plastics for instance are often labelled as biodegradable. While they are meant to break down more easily than regular plastic and be safer for the environment, if the right environmental factors are not present it might take just as long as regular plastics.

While biodegrading is totally dependent on the products being exposed to the right amount of moisture and temperature compostable products will break down easily despite external environmental factors.

 

When in comes to recycling, the terms biodegradable and compostable dominate in popularity and can cause confusion. Concern raised by the compost industry, which was faced with materials that claimed to be biodegradable or compostable, led to the development of the European Standard EN 13432 which lays down criteria for what can or cannot be described as compostable and what can be called biodegradable. The US Standard ASTM D6400-99 also sets out similar standards.

 

Many items that are labeled as “biodegradable” are not accepted by composting facilities because they take too long to break down and/or will not decompose entirely, disrupting the composting cycle. However, materials that meet either the European or US Standard will break down effectively in virtually all composting systems.

Parler claims that Amazon deliberately left a security hole open, giving hackers the ability to target the social media platform’s inner workings.

 

Parler said in a court filing on Monday that Amazon deliberately left open Amazon Route 53, a Domain Name System web service, which invited hackers, according to a report by Washington Times.

“And the hackers got the message, launching an extremely large attack — one 250 times larger and 12-24 times longer than the average [Distributed Denial-of-Service] attack,” Parler added.

 

The social media platform went on to say that AWS later eliminated the Route 53 link, but that the damage was already done, as the “AWS-facilitated attack” made it clear to others that if they hosted Parler, they would experience hacks as well.

 

“AWS didn’t just put Parler up a creek without a paddle — it banished it up the Columbia River without a boat and made sure no other boats would be willing to come to the rescue,” said Parler in the court filing.

 

Amazon had booted Parler off its web hosting service Amazon Web Services (AWS), claiming that users on the platform might “incite violence” — a new narrative pushed by several tech giants in order to justify censoring, banning, and ostracizing political dissenters and competition.

 

Parler responded by filing a lawsuit against Amazon alleging that the tech giant’s decision was “motivated by political animus,” rather than a concern for public safety.

 

The social media platform has since resurfaced online following the registration of its domain with the web-hosting company Epik.

 

Parler still appears to be under construction, however, as the website currently displays a message from the company’s CEO, as well as from other investors of the social media site.
