Virginia upholds election integrity for FUTURE elections as state judge outlaws counting late mail-in ballots without postmarks

 

Virginia Circuit Court Judge William Eldridge has ruled that election officials in Virginia were forbidden from counting unstamped mail-in ballots that arrived three days after the November election. In a consent decree signed Jan. 13, Eldridge determined that counting late ballots with missing postmarks violates existing state law.

 

Existing Virginia law states that β€œany absentee ballot returned to the general registrar after the closing of the polls on election day but before noon on the third day after the election and postmarked on or before the date of the election shall be counted.”

 

The decree settles a legal challenge that the Public Interest Legal Foundation (PILF), a public interest law firm dedicated to election integrity, filed in October against election guidance issued by the Virginia Board of Elections. Issued last August, the guidance would have allowed counting late mail-in ballots without legible postmarks.

 

The PILF sued on behalf of Thomas Reed, an election official in Frederick County. A week after the case was brought to court, Eldridge blocked the guidance in time for the November 2020 general elections, preventing late and unstamped ballots from getting counted.

 

The latest ruling permanently bans the guidance and will affect the forthcoming November 2021 Virginia gubernatorial and house of delegates elections.

 

β€œThis is a big win for the Rule of Law,” PILF President and General Counsel J. Christian Adams said. β€œThis consent decree gives Mr. Reed everything he requested – a permanent ban on accepting ballots without postmarks after Election Day and is a loss for the Virginia bureaucrats who said ballots could come in without these protections.”

However, many experts said that Virginia’s court victory was an outlier. J. Christian Adams, an election lawyer who served in the Voting Rights Section at the Department of Justice, wrote in an article for PJ Media: β€œBy and large, the Democrats succeeded in tossing out state laws related to absentee ballot verification, deadlines and a whole range of laws all in the name of COVID. By and large, GOP efforts in court failed.”

 

Last December, Texas led a multistate election lawsuit against Georgia, Michigan, Pennsylvania and Wisconsin. Texas and other states that joined it alleged that those four battleground states exploited the COVID-19 pandemic to justify enacting last-minute changes and ignoring both federal and state election laws, skewing election results. But the Supreme Court junked the lawsuit because it deemed that Texas lacked the legal right to litigate over how other states conduct their elections.

 

Many election lawsuits were also dismissed based on those grounds, according to David Clements, a business law professor at New Mexico State University.

An East Coast snowstorm is scrambling the start of the Senate’s week.

 

A final vote to confirm Alejandro Mayorkas, President Biden’s pick to lead the Department of Homeland Security, is being pushed from Monday at 5:30 p.m. to Tuesday due to inclement weather, a leadership aide confirmed.

 

The East Coast is currently getting walloped by a snowstorm, with snow potentially lingering until Tuesday.

 

While Washington, D.C., received only a few inches of snow on Sunday, according to The Washington Post, parts of the northeast are expected to get more than a foot of snow. The National Weather Service is predicting that New York City could get up to 22 inches by Tuesday morning.

 

The Senate held an initial vote for Mayorkas on Thursday, where he defeated a GOP filibuster. But the Senate struck a deal to hold his final confirmation vote on Monday, allowing senators to travel back to their home states for the weekend.

 

The delay comes amid what is shaping up to be a hectic week in Washington as Democrats prepare to pave the way for coronavirus legislation.

 

The House will vote this week on a budget resolution, the first step to bypassing the Senate’s 60-vote filibuster by using reconciliation.

 

Senate Democrats are also hoping to pass the budget resolution this week, though it was already shaping up to be an aggressive timeline even before the snow delay.

 

Passing a budget in the Senate includes holding a vote-a-rama, a marathon session where any senator who wants to force a vote on an amendment can do so.

 

Senate Majority Leader Charles Schumer (D-N.Y.) hasn’t yet publicly locked his caucus in to using reconciliation to pass coronavirus relief.

 

But he’s warned Democrats will go that route if they aren’t able to get buy in for 10 Senate Republicans on a deal that would closely resemble Biden’s $1.9 trillion proposal.

 

β€œOur preference is to make this important work bipartisanβ€”to include input, ideas, and revisions from our Republican colleagues, or bipartisan efforts to do the same. But if our Republican colleagues decide to oppose this urgent and necessary legislation, we will have to move forward without them,” Schumer said from the Senate floor late last week.

They took almost no time to pounce.

 

Within hours of the riots, corporate media reporters and pundits pointed to the presence of Proud Boys at the Capitol riots and organizing on social media. They implied or outright called for more censorship and encouraged the White House to enact new domestic surveillance powers. Naturally, deplatforming media companies that do not adhere to the dominant liberal orthodoxy became a subject of serious discussion.

 

Facebook’s former chief security officer Alex Stamos alleged during a Jan. 17 segment of CNN’s β€œReliable Sources” that conservative influencers and media outlets have β€œabused” press freedom, and advocated deplatforming conservatives from both traditional and social media.

 

β€œWe have given a lot of leeway β€” both in the traditional media and on social media β€” to people who have a very broad range of political views,” Stamos told CNN host Brian Stelter. β€œWe have to turn down the capability of these conservative influencers to reach these huge audiences.”

 

Stamos singled out One America News Network (OANN) and Newsmax in particular and accused those outlets of promoting β€œviolent extremism” in the same vein as the Islamic terrorist group ISIS.

 

β€œWe are going to have to figure out the OANN and Newsmax problem. These companies have freedom of speech, but I’m not sure we need Verizon, AT&T, Comcast and such bringing them into tens of millions of homes,” he told Stelter.

A coronavirus stimulus package proposed by a group of Senate Republicans as an alternative to President Biden's would cost $600 billion and include direct payments "targeted" to families in need, Sen. Bill Cassidy, R-La., said Sunday.

 

Biden unveiled his proposed $1.9 trillion coronavirus stimulus package earlier in January. Cassidy claimed that Biden did not even try to work with his bipartisan group of senators, colloquially known as the "sweet 16."

 

"The President's team did not reach out to anybody in our group, either Democrat or Republican when they fashioned their proposal," Cassidy told "Fox News Sunday." "So if you want unity, if you want bipartisanship, you ought to start with a group that's shown it's willing to work together for a common solution. They did not."

 

Cassidy and nine other Senate Republicans – Susan Collins of Maine, Lisa Murkowski of Alaska, Mitt Romney of Utah, Rob Portman of Ohio, Shelley Moore Capito of West Virginia, Todd Young of Indiana, Jerry Moran of Kansas, Mike Rounds of South Dakota and Thom Tillis of North Carolina – sent Biden a letter on Sunday with some information about their $600 billion plan.

 

Per the senators' letter and Cassidy's appearance on "Fox News Sunday," their proposal includes:

 

$160 billion toward public health (vaccines, personal protective equipment, support for health care providers)

$4 billion for behavioral health and substance abuse services

$20 billion for schools

 

The senators said they, like Biden, propose extending enhanced federal unemployment benefits and matching Biden's funding request for nutritional assistance for families. Biden's American Rescue Plan calls for continuing the 15% Supplemental Nutrition Assistance Program (SNAP) benefit increase, according to the White House. The senators said they would also include "additional resources" for the Paycheck Protection Program and the Economic Injury Disaster Loan Program to help small businesses and their employees.

 

The senators said they would release more details on Monday.

 

"In the spirit of bipartisanship and unity, we have developed a COVID-19 relief framework that builds on prior COVID assistance laws, all of which passed with bipartisan support," they wrote. "Our proposal reflects many of your stated priorities, and with your support, we believe that this plan could be approved quickly by Congress with bipartisan support."

 

"Just last month, Congress provided $900 billion in additional resources, and communities are only now receiving much of that assistance. Some of the spending appropriated through the CARES Act, passed last March, also has yet to be exhausted," they continued.

 

Cassidy said direct coronavirus relief payments need to be more targeted than previous direct payments.

 

"Above a certain income level, that money's not spent … doesn't stimulate the economy," he said.

 

The Republicans' proposal, however, may be in vain.

 

House Speaker Nancy Pelosi, D-Calif., announced Thursday that the House will bring a budget resolution to the floor next week for Biden’s $1.9 trillion relief package – the first step in advancing a bill through the reconciliation process.

 

The Senate will then vote to adopt the resolution. Budget reconciliations require only a simple majority to pass, as opposed to the 60 votes needed for most legislation. Democrats hold a majority in the House. The Senate is even, but Democrats have an effective majority because Vice President Kamala Harris has the tie-breaking vote.

The federal government has stood firm in its push to force social media giants to pay for news content, despite an angry backlash from Facebook and Google.

 

Google threatened to remove its search engine from Australia users at the inquiry last month, and has launched a massive public relations campaign to criticise the proposal.

 

β€˜MAO WOULD HAVE APPROVED’: WARNING OVER BIG TECH’S INFLUENCE

 

Peter Lewis, Director of The Australian Institute’s Centre for Responsible Technology, said the threat should β€œsend a chill to all those who value democracy”.

 

β€œRight now Australia is being confronted with big tech’s big stick: the threat to kill one in order to warn a hundred. Chairman Mao would have approved,” he said.

 

But he warned Australian governments and businesses had exposed themselves by relying heavily on apps such as Gmail and Google Maps.

 

β€œJust as we’ve determined a partnership with Huawei is not in our national interest, maybe it’s not in our national interest to be so reliant on Google moving forward,” he said.

 

Facebook reiterated a threat to prevent Australians from posting and accessing news content at the inquiry last month.

 

But Mr Lewis said that without verified news, it would would become a platform solely for β€œcute cats and conspiracy theories”.

 

Chris Cooper from Reset Australia – an initiative designed to β€œcounter digital threats to democracy” – said the threats showed the β€œsobering power” wielded by tech giants.

 

β€œThey have actively used the monopoly control over information markets to try and influence Australian opinion,” he said.

 

β€œIt reveals an entrenched disregard for community welfare and threatens to undermine Australia’s public decision making processes.”

 

Australians would be forced to find an alternative for the 95 per cent of searches conducted via Google if the company carried out its threat.

 

But although Google’s the threat was a β€œdemonstration of a corporation that has too much power”, it would likely prove β€œempty” given the value of the Australian market, he said.

 

β€œThey know that when it comes to search, there’s plenty of other search engines,” he said.

 

β€œSo it’s not an ideal scenario, and we shouldn’t take it. But I do think that it’s largely an empty threat.”

 

β€˜MAKE OR BREAK’: TRADITIONAL MEDIA TOLD TO ADAPT

 

The bill would establish an independent umpire to choose determine how much would be paid for news content, if the parties could not strike a separate deal.

 

But Dr Bronwyn Kelly, founder of the Australian Future Planning, said the reforms marked a β€œturning point” for Australian democracy.

 

β€œWe can make it or break it with the legislative decisions made here,” she told the committee.
