5-4 Supreme Court Rules Pipeline Company Can Use Eminent Domain to Seize Land in NJ

 

The U.S. Supreme Court ruled in a 5-4 decision that federal eminent domain powers can be used to seize land to construct the PennEast Pipeline in New Jersey.

 

The ruling, announced Tuesday (pdf), did not fall along the typical ideological lines. Republican appointees Chief Justice John Roberts, Justice Samuel Alito, and Justice Brett Kavanaugh voted in the majority along with Democrat-appointed Justices Stephen Breyer and Sonia Sotomayor.

 

Justices Neil Gorsuch and Amy Coney Barrett, who were appointed by former President Donald Trump, dissented in the ruling. Justice Clarence Thomas, one of the most conservative justices, and Democrat appointee Elena Kagan joined them.

 

The majority ruled that PennEast has the power to seize state-owned and protected lands to construct its 120-mile-long natural gas pipeline between New Jersey and Pennsylvania. The decision upheld a precedent that energy firms have previously used to build pipelines around the United States.

 

Their ruling also reversed a September 2019 decision handed down by a federal appeals court that had blocked PennEast from seizing lands from New Jersey.

 

The pipeline would link Marcellus Shale dry gas production with markets in New Jersey, New York, and Pennsylvania. Some 1 billion cubic feet of natural gas will be transported per day from Pennsylvania to New Jersey, according to PennEast.

 

Paul Clement, an attorney for PennEast, argued in front of the Supreme Court that New Jersey’s claim of sovereign immunity doesn’t apply because the pipeline firm was acting on behalf of the federal government when the federal Federal Energy Regulatory Commission granted approval for the project.

 

β€œIf we lose this case, then this pipeline will not be built in anything like its current configuration,” Clement had said. β€œI don’t think there is a way to reroute this pipeline in a way that doesn’t in some way impact New Jersey land.”

 

New Jersey attorneys argued that a private entity like PennEast cannot file a lawsuit against a sovereign state to acquire the property, saying only the federal government has that ability. The Supreme Court’s majority rejected that argument.

I have often thought that cemeteries are a waste of good real estate. Probably because I am a practical person. I suppose we don't really need any more mini malls, but whenever I see a cemetery, I think a nice park would be a better use of the space. Maybe just have a wall with people's names instead of all of those tombstones.

 

But now, especially with the "conspiracy theory" about Arlington Cemetery possibly having tunnels, etc. under it, I wonder if other cemeteries have things built under them?

Identities of living and dead people were stolen in Harris County, Texas to fraudulently vote in the 2020 election, according to bombshell audio obtained by NATIONAL FILE. A convicted forger who mailed the fraudulent ballot applications in Democrat Congresswoman Sheila Jackson Lee’s district worked as a campaign assistant for Sheila Jackson Lee’s 2020 campaign, and has gotten paid by Jackson Lee’s campaign efforts in the past. The Joe Biden campaign’s 2020 Texas political director Dallas Jones oversaw this alleged voter fraud operation and he was interrogated by the FBI in the last weeks of the 2020 election according to insiders. The audio below includes phone calls in which people confirm that their identities or the identities of their dead relatives were stolen in Harris County. This information has been provided to the Texas Secretary of State for the purpose of aiding Texas Attorney General Ken Paxton’s office in formal investigations.

The woman does not recognize the name of Tomar Bishop, who obtained the absentee ballots associated with Thomas’ identity, or Gloria Palmer, the recent Sheila Jackson-Lee campaign PAC vendor who oversaw Tomar Bishop. Sylvia Thomas wonders β€œWhat else are they doing?” in addition to fraudulently voting on her behalf. Kyle Massey charged for allegedly sending pics to 13-year-old girl

 

Former Disney star Kyle Massey has been charged with a felony for allegedly sending pornographic photos to a 13-year-old girl.

 

The β€œThat’s So Raven” actor has been charged with one count of communication with a minor for immoral purposes, TMZ reported. Massey, who played Cory Baxter on the Disney series, is accused of electronically sending sexually explicit content to the girl during the months of December 2018 and January 2019.

 

The case is tied to a civil lawsuit filed against Massey in 2019, in which the girl β€” who was not named because of her age β€” sued him for $1.5 million for allegedly sending β€œnumerous sexually explicit text messages, images, and videos” via Snapchat.

 

The family decided to go to the Sheriff’s Office after their civil suit stalled β€” supposedly because lawyers didn’t think Massey had enough money to make the case worth it β€” TMZ reported, and authorities began their investigation in 2020.

 

Massey, 29, was scheduled to appear for his arraignment Monday in King County Criminal Court in Washington, but failed to show.

The lawsuit filed in 2019 claimed the girl met Massey when she was just 4 years old. The pair kept in touch and Massey became close with her family as she pursued a career in entertainment.

 

Massey allegedly even indicated the girl should come out from Seattle, Wash. and live with him and his girlfriend in Los Angeles.

 

The girl and her mother say Massey β€œheld himself out as a father figure” to her, and their contact ramped up in November 2018 when the girl indicated she was interested in a role in a proposed reboot of β€œRaven” spinoff β€œCory in the House.” (It’s unknown if the reboot ever actually existed.)

 

About a month later, Massey allegedly requested to be the girl’s friend on Snapchat, and shortly after sent her β€œnumerous sexually explicit text messages, images, and videos.”

Millions of counterfeit masks seized during operation in Maine

 

PORTLAND, Maine – More than two million counterfeit N95 masks purchased by the State of Maine were seized June 16, by Homeland Security Investigations (HSI) Special Agents. The seizure was the result of an ongoing investigation being conducted by multiple HSI Offices and United States Attorney’s Offices across the United States.

β€œThe sale of counterfeit masks and other personal-protective-equipment constitute a serious threat to anyone who relies on PPE to protect themselves during the COVID-19 Pandemic,” said Acting Special Agent in Charge William S. Walker, who oversees HSI operations in New England, including Portland, Maine. β€œThe seizure of counterfeit masks as well as the recovery of $3.6 million in funds used by the State of Maine to pay for this PPE material are steps that restore accountability in the supply chain. These efforts couldn’t be realized without the support of the U.S. Attorney’s Office for the District of Maine and the cooperation of the State of Maine.”

 

The counterfeit N95 masks were purchased by the State of Maine over a series of transactions occurring in late 2020 and early 2021. HSI worked with the State of Maine and 3M to verify the masks fraudulent origin. HSI and law enforcement partners work together regularly to prevent dangerous counterfeit products from reaching U.S. consumers.

National Effort

 

Since 2020, HSI has conducted enforcement actions across the country that have resulted in the seizure of almost 10 million counterfeit 3M N95 respirators.

 

Since many of the counterfeit masks are produced abroad, HSI is also working closely with its international law enforcement partners around the world to pursue leads into sources of supply and prevent shipments of counterfeit products from reaching U.S. shores.

 

Initial leads came to the HSI-led National Intellectual Property Rights Coordination Center through 3M, which shared reports of suspected counterfeits being purchased by hospitals and government organizations. HSI mobilized quickly, initiating multi-state investigations into the individuals and organizations looking to profit from the sale and distribution of counterfeit N95 respirators.

20 arrested in Marion County drug operation, 9 wanted

 

A Marion County drug operation on Saturday led to the arrest of 20 people with nine more wanted by the sheriff’s department.

 

The operation, dubbed β€œCracked Pipe,” was conducted by the Marion County Sheriff’s Office with assistance from the Drug Enforcement Administration, Marion County Constables and Mississippi Department of Corrections Probation and Parole.

 

The sheriff’s office said the operation began with a search warrant served at a home at 150 Lampton Hilltop Road in Columbia, where investigators seized 106.66 grams of methamphetamine, 36.86 grams of cocaine, 29.47 grams of crack cocaine, 28.27 grams of marijuana and multiple doses of ecstasy. A rifle and two handguns were also seized, in addition scales, bags and money.

 

Investigators arrested 34-year-old Evan Jawan Lampton, of Columbia, and 41-year-old Tawanda Serena Lampton, of Kokomo. Child Protective Services was called after a juvenile was found at the home.

 

Evan Lampton was charged with two counts of sale or transfer of a controlled substance, conspiracy to sell or transfer, two counts of trafficking while in possession of a firearm, three counts of possession with intent while in possession of a firearm and child endangerment.

 

Tawanda Lampton was charged with sale or transfer of a controlled substance, trafficking while in possession of a firearm, seven counts of possession with intent while in possession of a firearm and child endangerment.

 

Investigators next searched a home at 524 Highway 98 West in Kokomo. The sheriff’s office said investigators seized 94.37 grams of cocaine, 3.15 grams of methamphetamine, a plethora of prescription drugs and a firearm.

 

The sheriff’s department arrested 22-year-old Breanna Danielle McKenzie, 57-year-old Betty Quinn, 51-year-old Robert Earl Magee Jr., all of Kokomo.

 

Child protective services were called in reference to an infant in the home.

Pharma’s Statistical Trick to Coax Children Into Receiving Experimental Jabs

 

Many scientists and medical experts have warned that vaccinating children against COVID-19 is both unnecessary and risky in the extreme. The video above features comments by Peter Doshi, Ph.D., made during a June 10, 2021, public hearing by the U.S. Food and Drug Administration’s Vaccines and Related Biological Products Advisory Committee.

 

Doshi is an associate professor at the University of Maryland School of Pharmacy and the senior editor of The BMJ. He has previously pointed out that while Pfizer claims its vaccine is 95% effective, this is the relative risk reduction. The absolute risk reduction β€” which is far more relevant for public health measures β€” is actually less than 1%.1 As such, the COVID-19 vaccine is of dubious benefit, to say the least.

 

If you choose to watch the video above I must warn you to stop after Doshi finishes and not view the presentation by Dr. Jacqueline Miller. She’s a paid shill pediatrician and the head of development for infectious diseases at Moderna. The reason I advise this caution is because if you understand reality, you will be shocked at how easily a physician can sell out and sacrifice even her own children in the delusional belief that Moderna’s shot provides any benefit to children.

 

Meanwhile, largely because of irresponsible beliefs and comments like Miller’s, harms are rapidly mounting, which skews the risk-benefit ratio even further. Considering the potential for harm, children should not get the COVID-19 vaccine, Doshi says, citing trial evidence from Pfizer β€” the very same evidence used to support its emergency use authorization application for 12 to 15-year-olds. In this trial, harms clearly outweighed the benefits.

Risk-Benefit Analysis

 

While benefits were rare and short-lived, side effects were common and long-term effects are completely unknown. In the 12-to-15 age group, 75.5% experienced headache, along with a long list of other transient side effects. However, more serious systemic adverse events also occurred in 2.4% of the trial subjects receiving the actual mRNA shot

β€œPut another way, 2% of the fully vaccinated avoided COVID,” Doshi says, adding β€œ98% of the vaccinated wouldn’t have gotten COVID anyway … So, the benefit is small.”

 

One of the reasons for why children reap so little benefit from this jab is because a significant portion of American children are already immune and aren’t at risk of infection to begin with. Doshi cites Centers for Disease Control and Prevention [CDC] data showing an estimated 23% of children under the age of 4 and 42% of those age 5 through 17 have already had a SARS-CoV-2 infection and now have robust and long-lasting immunity.

 

While most side effects in children have been short-lived, at least seven deaths among 12- to 17-year-olds had been reported as of June 11, 2021, as well as 271 events rated β€œserious.”2 In the long term, there’s really no telling what might happen, and that’s a really important point.

 

As noted by Doshi, during the 2009 swine flu pandemic, narcolepsy didn’t become apparent until nine months after vaccination with the Pandemrix vaccine, and it wasn’t until four months into Israel’s COVID-19 vaccination campaign that heart damage was recognized as a side effect in young men and boys.

Attorneys general and secretaries of state are on the ballot in more than two dozen states next year.

State election chiefs from both parties have faced verbal abuse and threats, following the 2020 election – as former President Donald Trump spread falsehoods of a "rigged" election. Although there's no evidence of widespread wrongdoing that could have changed the election's results, Republicans lawmakers in key swing states have raced ahead with laws they say will shore up election integrity.

Democrats and voting rights groups say the measures are aimed at suppressing votes in 2022. Additionally, they argue that bills seeking to curb the power of secretaries of state and other election officials could lead to partisan meddling when it's time to count votes and certify results.

The States United Democracy Center, a bipartisan group founded to advance fair elections, has tallied at least 216 bills in 41 states that would criminalize the actions of election officials, give legislators more power over the running of elections or otherwise interfere. Two dozen have become law to date.

Last week, GOP lawmakers who control Arizona's Legislature voted to strip Democratic Secretary of State Katie Hobbs of her authority to oversee election-related lawsuits and gave that power to the state's Republican attorney general.

The ban would expire on January 2, 2023, when the offices of secretary of state and attorney general could switch party control after the 2022 election. Hobbs is running for governor; Attorney General Mark Brnovich is running for the US Senate.

Hobbs has sharply criticized a GOP-ordered and problem-ridden "audit" of the 2.1 million votes cast in Maricopa County, Arizona.

In Michigan, meanwhile, a Republican lawmaker has introduced a bill that calls for an audit of 2020 results in the state – despite the secretary of state concluding that no fraud or foul play occurred in last year's election. Indicted Israeli Traders Had Ties To Muddy Waters In 2014, Before Severing Ties

 

Two Israeli traders facing insider trading charges were once "close associates" of short seller Muddy Waters, before splitting due to a dispute in 2014, according to a new report by Bloomberg. The traders split from Block in 2014 after Block said he suspected that they were selling information from Muddy Waters reports prior to the firm publishing them.

 

Tomer Feingold and Dov Malnik were both said to have approached Muddy Waters founder Carson Block in 2010 after Block's firm published a report on Orient Paper Inc.

 

Block said that even though Feingold and Malnik were "close friends", they told him that they only had "passing familiarity" with each other at the time. Block told Bloomberg that the pair played "significant roles" in both field research and trading for some of Muddy Waters' earliest reports. They contributed to the firm's blockbuster report on Sino-Forest, which Muddy Waters exposed as "one of the biggest frauds in Canadian stock market history".

 

When he discovered the pair was selling the firm's reports, Block said it was a β€œmassive betrayal of my trust.”

 

β€œThrough significant deceit, they integrated themselves into my business and personal life,” Block told Bloomberg.

 

But the Israelis claim in a lawsuit against Block that they were denied a "rightful share of the Muddy Waters’ brand," which they helped build. Their 2014 lawsuit alleged Block β€œwrongfully alleged that plaintiffs β€˜have misappropriated information from [Mr. Block personally] and Muddy Waters LLC to engage in unauthorized trading on behalf of themselves and others.’”

 

Feingold and Malnik said they had agreed to publish under the Muddy Waters name, but Block then β€œwrongfully asserted control over the jointly-developed brand and have excluded plaintiffs” from working together.”

Russian Jets Flew by Dutch Ship at Safe Distance in Black Sea to Prevent Border Violation - Video

 

The incident apparently happened the day after a Russian warship and fighter jet were forced to fire warning shots in order to drive the Royal Navy's HMS Defender from Russia’s territorial waters near the Crimean Peninsula after the British vessel ignored calls to leave.

 

The Russian Air Force had to scramble Su-30 and Su-24 fighter jets in order to prevent a violation of the country's borders by Dutch frigate the Evertsen on 24 June, the Russian Defence Ministry has stated in an apparent response to earlier complaints by the Netherlands' military.

 

The ministry said the Evertsen was sailing in neutral waters on 24 June, but later changed its course and moved towards the Kerch Strait. The jets were sent in order to prevent the ship from violating the Russian border there. Soon after the jets flew by the Evertsen, the frigate changed course, the ministry stated.

 

The Russian Defence Ministry stressed that the jets acted in accordance with international law and that they kept a safe distance from the Dutch ship.

 

Netherlands Slams Russia for 'Harassments' of Its Ship

 

The Netherlands' Ministry of Defence previously accused Russian fighter jets of harassing Dutch frigate the Evertsen as it sailed through the Black Sea on 24 June. The ministry said that the actions of the jets contradicted "the right to free use of the sea".

 

The Ministry of Defence claimed that Russian fighter jets had carried out mock attacks on the warship and jammed its communication systems for five hours. The Dutch military further said that the jets had created a dangerous situation at sea by flying low and close to the vessel as it sailed southeast of the Crimean Peninsula.

President Joe Biden told outgoing Israeli President Reuven Rivlin on Monday that his commitment to Israel was "iron-clad" and vowed that Iran would never build a nuclear bomb during his administration.

The Biden administration is trying to revive the Obama-era Iran nuclear deal, which was designed to put limits on Tehran's ability to build a nuclear weapon but was abandoned by then-President Donald Trump in 2018.

Like Trump, Israel opposes the deal and sees it as too lax, even after Benjamin Netanyahu, a key Trump ally, was recently replaced as prime minister by a fragile coalition government.

In Iran, hard-liner Ebrahim Raisi has been elected president, replacing the more moderate Hassan Rouhani, which could have an impact on talks in Vienna aimed at reviving the nuclear deal.

"Iran will never get a nuclear weapon on my watch," Biden told reporters at the White House before going into the meeting with his Israeli counterpart Monday. He said Washington's "commitment to Israel" is "iron-clad."

He spoke alongside Rivlin, who is at the end of his seven-year term and will be succeeded as president July 7 by Isaac Herzog, currently chairman of the Jewish Agency, a nongovernmental organization that links Israel with the Jewish diaspora around the world.

At the White House, Rivlin stressed that the U.S. and Israel are "best friends" and that their relationship would always be founded on "the values of democracy and values of liberalism." But he also hinted at recent tensions: "We may, from time to time, hold discussions on issues on which we do not agree."

The U.S. and Israel say they want the same thing: to stop Iran from obtaining nuclear weapons. But they disagree on how to get there. Iran has always denied it wants such an arsenal.

In an attempt to revive the 2015 deal, its parties β€” the U.S., United Kingdom, France, Germany, China and Russia β€” have been meeting in Vienna since April.

During indirect talks, U.S. and Iranian negotiators have discussed the lifting of sanctions on Iran's supreme leader, Ayatollah Ali Khamenei, a former U.S. official and two people familiar with the matter told NBC News last week.

Now that Trump and Netanyahu are out of the picture, the Biden administration and the new Israeli coalition government have been focused on a far quieter type of diplomatic negotiations. But core differences remain.

"Israel has some serious reservations about the Iran nuclear deal that is being put together in Vienna," Israeli Foreign Minister Yair Lapid said in Rome on Sunday during a first meeting with Secretary of State Antony Blinken. But he added that "we believe the way to discuss those disagreements is through direct and professional conversation, not a press conference."

It's not just the nuclear deal. Last month, Israel's recent conflict with Hamas, the Palestinian militant group that governs the Gaza Strip, caused dismay internationally including among congressional Democrats.

The 11-day fighting killed more than 250 Palestinians, including dozens of children, and 12 Israelis, including two children. The U.S. provides $3.8 billion in military aid to Israel annually.

At the White House, Biden "emphasized the importance of Israel taking steps to ensure calm, stability, and to support greater economic opportunities for the Palestinian people" and said that "a negotiated two-state solution remains the best avenue to achieving a lasting peace."

On Sunday, the U.S. launched airstrikes in Iraq and Syria against Iran-backed militia groups, which it said were behind drone attacks on American personnel.

Biden "reassured" Rivlin that the U.S. "remains determined to counter Iran's malign activity and support for terrorist proxies, which have destabilizing consequences for the region."

With the More Contagious Delta Variant, Some Officials Are Issuing New Mask Guidance

 

The more dangerous and more transmissible Delta variant has spread to almost every state in the US, fueling health experts’ concerns about COVID-19 spikes.

 

The variant is expected to become the dominant coronavirus strain in the US, the director of the Centers for Disease Control and Prevention said. And with half the US still not fully vaccinated, doctors say it could cause a resurgence of Covid-19 in the fallβ€”just as children too young to get vaccinated go back to school.

 

In Los Angeles County, the pace of Delta’s spread has prompted officials to reinstate mask guidance for public indoor spacesβ€”regardless of vaccination status.

 

The new, voluntary mask guidance is necessary until health officials can β€œbetter understand how and to who the Delta variant is spreading,” the county’s department of public health said.

 

The Pfizer/BioNTech vaccine has shown to be 88 percent effective against symptomatic infections caused by the Delta variantβ€”two weeks after the second dose. Those who are only partially vaccinated have significantly less protection.

 

And Moderna’s vaccine was found in lab experiments to work against new variants such as the Delta strain, the company said Tuesday. Researchers used serum samples from eight participants taken a week after they received their second dose of vaccine.

 

But the spread of the virus is outpacing vaccinations, the World Health Organization said. And the longer the virus spreads among unvaccinated people, the more opportunities it has to mutate into more troubling variants.

 

Now the Gamma variant has been shown to be more resistant to vaccines and antibody treatments. Last week, the WHO said even those who are fully vaccinated should wear masks in places with high rates of Covid-19 spread.

 

Many states have not reinstated mask mandates for the upcoming school year, including New Jerseyβ€”where masks will not be required β€œunless the district decides to make it protocol,” Gov. Phil Murphy said Monday.

 

But that could change if the situation gets worse, he said.

Delta Variant – The COVID Sequel

 

Most successful movies try to cash in on their box office bonanza with a sequel. Some do this well, like The Godfather, with both original and sequel winning best picture. Others simply get old and tiresome, like the Star Wars or Halloween franchises.

 

COVID is no exception, after a wildly successful debut year. Success, of course, is in the eye of the beholder. For those who died or are suffering long haul symptoms, it was a disaster. Same for owners of closed businesses, those still out of work, and individuals and their families dealing with the aftershocks of depression, substance abuse, and a host of other mental health issues.

 

It was successful for those willing do absolutely anything to get rid of President Trump as well as for those standing to gain financially by destroying small businesses, creating a multi-billion-dollar COVID vaccine industry, or bowing to their Chinese and social media paymasters.

 

The COVID sequel is called the β€œDelta Variant,” a predictable mutation of the original Chinese coronavirus as it passes through hosts, replicating, and moving on to another host. From an article in Nature Microbiology,

 

Mutation. The word naturally conjures fears of unexpected and freakish changes. Ill-informed discussions of mutations thrive during virus outbreaks, including the ongoing spread of SARS-CoV-2. From corporate donors to Biden family investments to a Chinese spy compromising a sensitive intelligence position, the Democrat Party is clearly in bed with America's top adversary.

 

House Democrats shot down a GOP motion earlier this month that sought to bar corporate cooperation with Chinese slave labor.

 

The Motion to Recommit proposed by Kentucky Republican Rep. Andy Barr amending a Democrat bill on corporate disclosure would have required businesses to report to the Treasury Department if they discover a supplier or other business partner was found using forced labor.

 

Two-hundred and seventeen Democrats rejected the measure and the amendment failed. A look at their corporate donors might reveal why.

Slave Labor Profits to Campaign Coffers

 

In March last year, the Australian Strategic Policy Institute (ASPI) published a report credibly accusing 82 major brands of profiting, either directly or indirectly, from Chinese slave labor by minority Uyghur workers from the northern Xinjiang province. According to the report, investigators estimate more than 80,000 Uyghurs were taken from their native provinces to work in factories across China between 2017 and 2019, with thousands more sent straight to concentration camps.

 

Using open-source Chinese-language documents, satellite imagery, academic research, and on-the-ground reporting, ASPI linked 82 brands with forced labor operations among 27 factories across nine Chinese provinces. A Federalist analysis drawing on financial disclosure reports published in OpenSecrets found at least 44 of the 80 companies named made U.S. campaign contributions in last year’s election cycle.

 

A vast majority went to Democrats, who raked in three-quarters of all federal donations from companies credibly accused of harnessing Chinese slave labor, while less than 12 percent flowed to Republicans. Of the nearly $40 million that went to congressional candidates between the two major parties, Democrats took home more than 85 percent, as opposed to Republicans, who received less than 15.

 

Meanwhile, 39 out of the 42 companies that made donations gave more than half to Democrats, with nearly a dozen skyrocketing contributions in last fall’s contest compared to previous cycles. Apple and Nike, for example, which deployed high-powered Washington lobbyists to fight the Uyghur Forced Labor Prevention Act barring importing products from Chinese slave labor, each spiked their donations to Democrats by more than 400 percent in a year Republicans embraced a tough stance on China.

 

The chart from OpenSecrets below outlines Apple’s contributions to federal candidates, showing the company’s affiliates gave upwards of $7.5 million to Democrats in 2020 as opposed to less than $2 million in 2018.
