Patrol: Nebraska pilot hurt in North Dakota plane crash

WEST FARGO, N.D. (AP) — Authorities have identified an Omaha, Nebraska man who was seriously hurt when he crashed a small plane west of Fargo.

The North Dakota Highway Patrol says Jeffrey Kloster had just left the West Fargo Municipal Airport Tuesday afternoon when the plane struck treetops and crashed into a soybean field.

KFGO radio reports it took fire crews about 40 minutes to free Kloster from the wreckage.

West Fargo Fire Chief Dan Fuller says it appeared Kloster suffered serious leg injuries and possible internal injuries. Kloster is hospitalized in Fargo.

Court Says Government Cannot Enforce Transgender Mandate on Doctors

It took more than five years but a federal court has ruled that a mandate issued by the Department of Health and Human Services (HHS) requiring doctors to perform transgender surgery and treatment cannot be enforced, thanks to the First Amendment to the Constitution and the Religious Freedom Restoration Act of 1993 (RFRA).

Along the way, the plaintiffs, including a religious hospital, a group of physicians, an association of more than 20,000 Christian doctors and dentists, and nine states had to fight through multiple attempts by the HHS bureaucracy to rewrite the mandate in such a way as to make it appear palatable to the courts yet preserve the government’s leverage against medical professionals whose faith precluded their compliance.

The plaintiffs have been represented throughout the case by the Beckett Fund for Religious Liberty, a public interest group that specializes in religious freedom litigation.

Originally, the case, Franciscan Alliance, et. al. v. Becerra, was filed in the U.S. District Court for the Northern District of Texas. The appeals went to the Fifth Circuit Court of Appeals, which most recently directed the lower jurisdiction to re-examine its 2019 ruling for the plaintiffs to determine whether the federal government should be permanently barred from enforcing the mandate.

And boy did he! In a decision that left no room for loopholes, District Court Judge Reed O’Connor said:

“The Court GRANTS Plaintiffs’ request for a permanent injunction and PERMANENTLY ENJOINS HHS, Secretary Becerra, their divisions, bureaus, agents, officers, commissioners, employees, and anyone acting in concert or participation with them, including their successors in office, from interpreting or enforcing Section 1557 of the Affordable Care Act, 42 U.S.C. § 18116(a), or any implementing regulations thereto against Plaintiffs, their current and future members, and those acting in concert or participation with them, including their respective health plans and any insurers or third-party administrators in connection with such health plans, in a manner that would require them to perform or provide insurance coverage for gender-transition procedures or abortions, including by denying Federal financial assistance because of their failure to perform or provide insurance coverage for such procedures or by otherwise pursuing, charging, or assessing any penalties, fines, assessments, investigations, or other enforcement actions.”

Note that O’Connor included “gender-transition procedures or abortions” within the purview of his order.

“Today’s ruling is a victory for compassion, conscience, and common sense. No doctor should be forced to perform controversial, medically unsupported procedures that are contrary to their conscience and could be deeply harmful to their patients,” said Luke Goodrich, vice president and senior counsel at Becket.

“These religious doctors and hospitals provide top-notch medical care to all patients for everything from cancer to the common cold. Everyone benefits when doctors are able to follow their professional medical judgment and their Hippocratic Oath to ‘Do No Harm,’” he continued.

Would that O’Connor’s latest decision could be the final word in the case because no individual doctor or health care provider such as a hospital should be forced to perform any medical procedure that violates a religious conviction or that is deemed either unnecessary or unhealthy for the patient. But the transgender mandate is especially egregious when children are involved.

Owner of telemedicine companies charged with $784 million Medicare fraud, tax evasion, bribery

In one of the largest schemes of Medicare fraud that the Department of Justice has ever charged, an owner of several telemedicine companies was indicted on Tuesday for $784 million of healthcare fraud, tax evasion, and illegal kickbacks.

The owner, Creaghan Harry, who is from Highland Beach, Florida, was charged in a superseding indictment by a federal grand jury in Newark, New Jersey, "with one count of conspiracy to commit health care fraud and wire fraud, and four counts of income tax evasion," the Justice Department said in a statement.

Harry was previously charged in another indictment with his co-conspirators, Lester Stockett and Elliot Loewenstern, "with one count of conspiracy to defraud the United States and to pay and receive kickbacks, four counts of receipt of kickbacks, and one count of conspiracy to commit money laundering," according to the DOJ. His co-conspirators have already pleaded guilty.

According to the indictment, along with Stockett and Loewenstern, Harry had "solicited illegal kickbacks and bribes from durable medical equipment (DME) suppliers and marketers in exchange for orders for DME braces and medications. Harry's telemedicine companies then allegedly paid physicians to write medically unnecessary orders for these braces and medications," the DOJ said.

The telemedicine companies "fraudulently billed Medicare over $784 million" through the order to DME suppliers, according to the indictment allegations, the Justice Department said. Over $247 million was paid by Medicare.

Harry had the DME suppliers and marketers pay shell companies in the U.S. and elsewhere that were opened under names of straw owners to hide the healthcare fraud and illegal kickbacks, the indictment alleges. Afterwards, Harry would transfer the money paid to the shell companies over to his telemedicine companies so he could pay the physicians to write unnecessary orders.

Also, Harry allegedly falsely told lawyers, prospective investors, and others that his telemedicine companies were not receiving kickbacks. Instead, he claimed that the revenue from the telemedicine companies, "about $10 million per year," was from patient fees for telemedicine services, according to the DOJ.

From 2015 to 2018, Harry allegedly committed income tax evasion by using the money from the shell companies to live lavishly while he didn't pay income taxes or file an income tax return.

If Harry is found guilty, he "faces a maximum penalty of 20 years' imprisonment for the conspiracy to commit health care fraud and wire fraud, five years' imprisonment on each count of tax evasion, five years' imprisonment for the conspiracy to defraud the United States and pay and receive kickbacks, 10 years' imprisonment for each count of receipt of kickbacks, and 20 years' imprisonment on the conspiracy to commit money laundering," the DOJ said.

They’re Destroying the Evidence: Lindell Symposium Reveals Voting Machine Companies Are Wiping Voting Machines Clean in Wisconsin, New Hampshire and Michigan as We Previously Reported

As The Gateway Pundit previously reported — Back in July the election firm ‘Election Source’ notified officials throughout the state of Michigan that they will discreetly break the law by eliminating election data from voting machines on the 15th.

Attorneys immediately issued them a cease and desist order to prevent this destruction of evidence from happening.

Michigan’s Secretary of State Jocelyn asked the Michigan election officials to do things to cover up the 2020 Election fraud before, so this latest action by Election Source was not so shocking.

Also in July an email was sent to the local election officials in the state from a company called Election Source that performs work on the voting machines in the state. This company would likely not send any letter like the following to election officials without Secretary of State Benson knowing about it. In a letter to the election officials around the state, the following was shared:

We will be visiting xxx County on July 15th to perform preventative maintenance on your voting equipment. There is not an upgrade this time, just preventative maintenance. During the preventative maintenance, we will be removing the ICX batteries to prevent any issues with the batteries shutting off your machines. Batteries are not necessary in Michigan due to the fact that we do not use direct-recording electronic voting in our state. “

Attorney Stephanie Lambert shared with Jim Hoft and Patty McMurray from The Gateway Pundit and 100% FedUp that she will be filing a lawsuit to prevent this destruction of evidence:

I’ve been working closely wiht Matt DePerno and with other attorneys and experts, like I said, and we’ve obtained a lot of evidence. In fact there’s going to be a lawsuit filed in the very near future against Election Source which is a contractor to Dominion. Matt Deperno sent a cease and desist letter to Election Source today because there was a letter sent out by Election Source to all of the clerks in Michigan stating that they’re coming to do preventative updates regarding removing a battery in most of the election equipment which is problematic because this would erase data [on those machines]. That’s one piece of what’s happening with Election Source.

On Tuesday at the Lindell Cyber Symposium in Sioux Falls, South Dakota, Wisconsin Rep. Timothy Ramthun told the audience that Wisconsin officials are also wiping the voting machines clean in the state.

This was after Marilyn Todd from the New Hampshire Voter Integrity Group told the audience this was also happening in New Hampshire.

They are destroying the evidence.

Ph.D.s actually the most hesitant to get COVID-19 vaccines compared to all other education levels, study finds

The left — particularly those who exude that distinctive "elite" air — have been growing more and more smug about their level of intelligence, sophistication, and adherence to following "the science" when it comes to getting the COVID-19 vaccine.

In short, they say, Republicans, residents of flyover country, fans for former President Donald Trump, evangelical Christians, and those with lower education levels are ruining things for the rest of America because they're the least likely to get the shots.

Well, the results of a recent study on vaccine hesitancy conducted by researchers at Carnegie Mellon University and the University of Pittsburgh just might toss some cold water on the left-wing elites' assumptions.

While the study hasn't been peer-reviewed, it did review survey data from over 5 million adults — and it found that when measuring vaccine hesitancy according to education level, those with Ph.D.s were the most hesitant to get the shots by the end of the survey period, which lasted from January to May.

In fact, while every other education-level group grew less hesitant over time, those with Ph.D.s never wavered in their hesitancy — and were at the top of the heap when it came to thinking twice about getting the shot by the end of the survey period.

Breaking it down further

In January, the top-three education levels from most hesitant to least hesitant were:

The least hesitant group from start to finish represented study participants with master's degrees.

"To our knowledge, no other study has evaluated education with this level of granularity, which was possible due to our unusually large sample size (>10,000 participants with PhDs)," the study said. "Further investigation into hesitancy among those with a PhD is warranted."

WebMD agreed the findings in regard to Ph.D.s was an "eye-opener." The outlet broke down other findings from the study, including:

About 50% of people in all categories of hesitancy were concerned about side effects.

Those who said they would ''definitely not" get a vaccine were more likely to say they didn't trust the vaccine or didn't trust the government.

Those who said a lack of trust was a reason they haven't been vaccinated only appeared to have doubts about the COVID-19 vaccine, not those for other diseases.

Many said they were hesitant because they wanted to wait to see if it's safe" or they were waiting on full" FDA approval, beyond the emergency use authorization the FDA has given the vaccines so far.

Biden Sued for Feeding Illegal Immigrant Children 'Raw' and 'Undercooked' Food in 'Dilapidated' Facilities

Two left-wing advocacy groups that favor mass illegal immigration are suing the Biden administration, accusing it of enabling horrifying child abuse at overcrowded migrant holding centers.

In a 276-page federal filing Monday, the National Center for Youth Law and the Center for Human Rights and Constitutional Law urged Attorney General Merrick Garland to compel the Department of Health and Human Services to stop abusing and mistreating children at migrant detention centers.

Two facilities in Texas — Fort Bliss and Pecos — were specifically named in the lawsuit.

The attorneys said children are being held in “dilapidated,” unsanitary facilities where they’re fed rotten or undercooked food, subjected to sexual advances and exposed to widespread coronavirus infestations.

“[O]ur legal team has witnessed disturbing conditions that put the health and welfare of these children in harm’s way, including food-related abdominal pain from undercooked and spoiled food, and children being kept in cage-like rooms for most of the day,” the filing alleged.

A 17-year-old Guatemalan girl said: “They did not cook the food well because they were cooking for so many thousands of kids at the emergency shelter … The chicken was raw, everything was raw. I ate it because I had no choice. I got sick from it.”

The lawsuit also referenced an explosive complaint filed last month by two federal whistleblowers who accused the Biden administration of ordering workers to cover up a COVID-19 outbreak among “hundreds of children” at the Fort Bliss facility.

“COVID was widespread among children and eventually spread to many employees,” the complaint alleges. “Hundreds of children contracted COVID in the overcrowded conditions. Adequate masks were not consistently provided to children, nor was their use consistently enforced.”

The whistleblowers said that instead of fixing the problem that exacerbated the infestation, “every effort was made to downplay the degree of COVID infection at the site, and the size of the outbreak was deliberately kept under wraps.”

In his sworn declaration, whistleblower Arthur Pearlstein, an attorney with the Federal Mediation and Conciliation Service, said the Biden administration is covering up the egregious abuse of “thousands of children.”

“Gross mismanagement, waste, and abuse of authority by those at the top who insisted on utmost secrecy led to mistreatment of thousands of children at Fort Bliss,” Pearlstein wrote.

“I was actively discouraged by management at Fort Bliss from reporting my concerns,” he underscored.

The attorneys for the migrant children said the coronavirus outbreak metastasized because of the disgusting, unhygienic conditions at the overcrowded centers.

“Filth was commonplace,” the complaint alleges. “According to one contractor: ‘I’ve been into one [tent], one time, and I was like, yeah, I’m not going back there.
