Louisiana AG Jeff Landry to JP Morgan: No State Business if Your Policies Restrict 2A

Louisiana Attorney General Jeff Landry sent a letter to JP Morgan Chase letting the company know it will not be an eligible state infrastructure underwriter unless it pledges to avoid polices that restrict or discriminate against Second Amendment rights.

On October 18, 2021, the Hayride reported Landry’s letter, noting that Landry is not only Louisiana’s AG but also sits on the state’s Bond Commission.

Landry’s letter was addressed to JP Morgan chairman and CEO Jamie Dimon, and said, in part:

Your recent testimony before the United States House of Representatives, Financial Services Committee, on May 27, 2021, has called into question your ability to do business in several states, including Louisiana. In this testimony, you stated the following in response to a question from Rep. Madeleine Dean: “We do not finance the manufacture of military-style weapons for civilian use.”

He then went on to cite a Solicitation for Offers (SFO) form that JP Morgan submitted in 2020, in order to be considered for underwriting of Louisiana infrastructure projects.

Landry pointed to Question No. 15 on the SFO, noting its language:

Certify whether your firm, either itself or through its parent company has policies that: a) Restrict or would otherwise infringe on the constitutionally protected rights of the citizens of the State to lawfully keep and bear arms, b) Discriminate against citizens based on the citizens’ exercise of their constitutional rights, or c) Otherwise unlawfully discriminate against of the State.

Landry noted that JP Morgan claimed to have no policies restricting or infringing constitutionally protected Second Amendment rights in 2020, but believes the company “may wish to reconsider…[it’s] certification to the Bond Commission.”

On August 16, 2018, Breitbart News noted that Landry and the state’s Bond Commission denied $600 million to Citibank and Bank of America over the gun control stance adopted by both companies. At the time the action was taken Louisiana Executive Division press secretary Ruth Wisher told Breitbart News that Landry and State Treasurer John Schroder had been working on the state’s response to corporate gun control “for some time.” Leaving Citibank and Bank of America out of the $600 million was part of the response.

Dan Andrews FORCED to reveal health advice

The Victorian government loses fight to maintain secrecy.

The Victorian government has lost its fight to maintain a veil of secrecy over controversial Covid health orders made during the February lockdown in 2021.

Premier Daniel Andrews and Victorian Chief Health Officer Brett Sutton will be forced to release the details of secret meetings and more than 100 pages of confidential briefings from the Department of Health.

The government has 14 days to appeal the decision before the briefings become open to Freedom of Information requests.

“The secrecy, the cover-up, the resistance by Labor in blocking the release of these documents is disgraceful. Businesses slammed shut and families blocked from seeing loved ones are entitled to see the reasons behind their lockdown in full,” said David Davis, leader of the opposition in the Upper House. “It’s a scandal that these documents have been kept secret all the way through the pandemic.”

It is expected that the decision may prompt further orders to release additional secret information on the state’s other lockdowns. This information includes the rationale behind lockdowns, curfews, hospital visits, mandatory vaccination and other intrusive health orders that fundamentally changed the everyday lives of Victorians.

According to the Herald Sun, the Department of Health attempted to stop the release of material related to Covid health orders, indicating that the briefings risked jeopardising ‘public trust’ between public officials and a minister because they contained ‘high-level deliberative processes of government’.

They further argued that revealing this high-level health advice would impact the Department of Health’s ability to navigate future briefings with ‘appropriate’ advice.

This objection was overruled by the Victorian Information Commission, as Victoria's Covid health advice was seen to be of public interest.

“I consider there is significant public interest in providing members of the community the ability to participate in such processes and to hold governments to account for the decisions it has made,” said Public Access Deputy Commissioner Joanne Kummrow.

“In these circumstances, members of the community have a right to access documents that describe the background information considered, the reasons, the legal basis for, and documents that record those decisions.”

It is not the first time that a government has been reluctant to make public the health advice related to Covid directions.

National Cabinet was ordered to reveal their secret discussions between the premiers, the prime minister, and assorted health experts earlier this year and subsequently lost their appeal. Prime Minister Scott Morrison continues to fight the decision, concerned that revealing the ‘accurate and candid information and ideas’ between members of the National Cabinet might erode public trust.

The COAG Legislation Amendment Bill 2021 is specifically designed to exempt National Cabinet from Freedom of Information requests in defiance of the court ruling.

Members of Parliament returning to the House of Commons at the beginning of the 44th Parliament will have to prove their full COVID vaccination status.

The new rule was announced by the Board of Internal Economy and extends to anyone over the age of 12 entering the House starting on November 22.

According to a report in CTV,

The cross-party committee of MPs that oversees the workings of the House of Commons made this decision following a two-hour closed-door meeting on Tuesday.

…The House is considering people to be fully vaccinated 14 days after they have received the recommended doses of one or a combination of Health Canada-approved vaccines.

Individuals demonstrating a “medical contraindication” to the vaccines will have to provide COVID-19 rapid antigen tests instead.

The BOIE seats nine parliamentarians, including five Liberals, two Conservatives, one NDP and one Bloc member.

Whether all of this can potentially lead to real civil disorder and possibly even actual civil war is an interesting question. Alfa-Bank has successfully closed the book of subordinated Tier 2 Eurobonds compliant with Basel III (Central Bank Regulation 646-P). The total amount of the subordinated loan is USD 350 mln, the call option is scheduled in 5.5 years, the maturity is in 10.5 years.

The coupon rate for the first 5.5 years was fixed at 5.5% per annum payable semi-annually. This is the lowest rate on subordinated dollar-denominated loans among the Russian banks issues since 2014.

“Around 50 institutional investors from the USA, Europe, Great Britain, Switzerland, Asia and Russia took part in the deal. Investors were focused primarily on Alfa-Bank, and not on a controversial external information background, that could be an obstacle for the placement of other issuers. Alfa-Bank demonstrated strong financial results in 2020. As a result Fitch Ratings upgraded Alfa-Bank to investment grade in April and S&P revised the outlook on our ratings to Positive last week.

The placement was very successful, what once again proved Alfa-Bank’s high quality as an issuer. During the book building the rate dropped from 5.875% area IPTs to 5.5% final yield. The demand exceeded the originally announced deal size by almost 1.5 times.

The placement amount is in line with Alfa-Bank’s medium-term growth plans. Additional Tier 2 capital will enhance our development that includes strengthening our positions in both the retail and corporate markets.” – commented Alexei Tchoukhlov, Deputy Chairman of the Executive Board, Chief Financial Officer.

After the CBR’s approval the amount of the issue will be included into Tier 2 Capital of Alfa-Bank. The Notes are issued by Alfa Bond Issuance plc. The issue was arranged under the Bank LPN Programme in 144A/RegS format. The Lead Managers are Alfa-Bank and J.P. Morgan.
