Chicago Threatens to Withhold Retirement Benefits From Cops Who Retire Rather than Submit to Mayor Lightfoot’s COVID Vaccine Mandate

Chicago has upped its battle with police officers over the mandated COVID vaccine, issuing a statement Sunday night threatening the retirement benefits of officers who opt to retire from the force rather than submit to Mayor Lori Lightfoot’s COVID vaccine mandate and reporting system.

A copy of the notice was reported by WMAQ-TV reporter Mary Ann Ahern who posted a copy to Twitter:

“TO BE READ AT ALL ROLL CALLS FOR SEVEN (7) CONSECUTIVE DAYS. This AMC message informs Department members of the consequences of disobeying a direct order to comply with the City of Chicago’s Vaccination Policy issued 8 October 2021 and being the subject of the resulting disciplinary investigation. A Department member, civilian or sworn, who disobeys a direct order by a supervisor to comply with the City of Chicago’s Vaccination Policy issued 8 October 2021 will become the subject of a disciplinary investigation that could result in a penalty up to and including separation from the Chicago Police Department. Furthermore, sworn members who retire while under a disciplinary investigation may be denied retirement credentials…”

Last week a Cook County judge barred the president of the Chicago Fraternal Order of Police John Catanzara from speaking out against Chicago’s COVID vaccine mandate and vaccine status reporting portal.

The Chicago Tribune reported Monday on the FOP’s response to Sunday’s threatening statement by police brass(excerpt):

The FOP, in response, sent a document to its members that provides language officers can use should they be asked to go to Internal Affairs and given a direct order to report their vaccination status through the city portal, according to multiple law enforcement sources.

“Complying with this INVALID order and the violation of MY Bargaining, Constitutional and Civil Rights has furthermore caused me severe anxiety while challenging both my religious and moral beliefs. I am in fact complying with this because I am being forced to do so under complete duress and threats of termination,” the document reads.

The union told members who receive a direct order from a supervisor to have that supervisor add their name to the FOP-provided document and advised members to keep a copy for themselves and send another to the union. According to a law enforcement source, the union also is urging members to turn on their body cameras and record the encounters, a call Chicago police union president John Catanzara has made before.

Lightfoot ordered back in August that all city employees must be vaccinated by October 15. The deadline was later modified, after objections by the police union, to the end of the year but with a proviso that unvaccinated workers submit to twice-weekly testing at their own expense. All workers must report their vaccine status through an online portal starting this Friday or face being put on no-pay status.

A new study published in the NIH NCBI database and authored by Harvard professor S. V. Subramanian, Ph.D, and Penn State professor Akhil Kumar, Ph.D claims that vaccination rates have “no discernable relationship” with the amount of new COVID cases, and notes that “In fact, the trend line suggests a marginally positive association such that countries with higher percentage of population fully vaccinated have higher COVID-19 cases per 1 million people.”

“At the country-level, there appears to be no discernable relationship between percentage of population fully vaccinated and new COVID-19 cases in the last 7 days,” the report states. “In fact, the trend line suggests a marginally positive association such that countries with higher percentage of population fully vaccinated have higher COVID-19 cases per 1 million people. Notably, Israel with over 60% of their population fully vaccinated had the highest COVID-19 cases per 1 million people in the last 7 days.”

Additionally, the report points out that “The lack of a meaningful association between percentage population fully vaccinated and new COVID-19 cases is further exemplified, for instance, by comparison of Iceland and Portugal. Both countries have over 75% of their population fully vaccinated and have more COVID-19 cases per 1 million people than countries such as Vietnam and South Africa that have around 10% of their population fully vaccinated.”

“Across the US counties too, the median new COVID-19 cases per 100,000 people in the last 7 days is largely similar across the categories of percent population fully vaccinated (Fig. 2),” the report continues. “Notably there is also substantial county variation in new COVID-19 cases within categories of percentage population fully vaccinated. There also appears to be no significant signaling of COVID-19 cases decreasing with higher percentages of population fully vaccinated (Fig. 3).”

The study further notes that “Of the top 5 counties that have the highest percentage of population fully vaccinated (99.9–84.3%), the US Centers for Disease Control and Prevention (CDC) identifies 4 of them as ‘High’ Transmission counties. Chattahoochee (Georgia), McKinley (New Mexico), and Arecibo (Puerto Rico) counties have above 90% of their population fully vaccinated with all three being classified as ‘High’ transmission. Conversely, of the 57 counties that have been classified as “low” transmission counties by the CDC, 26.3% (15) have percentage of population fully vaccinated below 20%.”

(Reuters) - The 5th U.S. Circuit Court of Appeals said Wednesday that it will not drop sanctions it levied in March against famed Democrat lawyer Marc Elias, but it will vacate sanctions against three other Perkins Coie lawyers who were on his team.

The court had sanctioned Elias, who became a hero of sorts to Democrats in 2020 battling lawsuits filed by Republicans seeking to overturn the results of the U.S. presidential election, and five other Perkins Coie lawyers for lack of candor.

The sanctions stem from a case over straight-ticket voting in Texas, in which Elias and his team represent Democrats fighting in favor of the practice against the state's top election official. The team had filed a supplemental motion in February that was nearly identical to one filed in September that was denied, without disclosing the previous denial.

Elias did not immediately respond to a request for comment. A Perkins Coie representative declined to comment.

The Perkins Coie lawyers asked the court to reconsider the sanctions in March. Represented by Paul Clement, a Kirkland & Ellis partner who served as U.S. Solicitor General under Republican former President George W. Bush, they argued their February motion was "not intended to conceal the denial of the initial motion to supplement the record, but reflected good faith misunderstandings."

But the 5th Circuit panel ruled Wednesday that it is "not required to find bad faith when imposing sanctions for violations of local rules."

"Our court’s local rules permit us to discipline 'any member of the bar of this Court for failure to comply with the rules of this Court, or for conduct unbecoming a member of the bar,'" the order said.

Still, it vacated sanctions against half of the lawyers on the team.

It kept sanctions against Elias and partner Bruce Spiva because both have "nearly thirty years' legal experience" and against counsel Skyler Howton because she "was the attorney who signed both the September and February motions to supplement," the order said.

Spiva and Howton did not immediately respond to requests for comment.

One judge on the panel - Judge Catharina Haynes - dissented and said she "would grant reconsideration in full rather than only to the junior attorneys."

Judges Edith Brown Clement and Jennifer Walker Elrod were also on the panel.

The case is Texas Alliance for Retired Americans v. Hughs in the 5th U.S. Circuit Court of Appeals No. 20-40643.

McAuliffe Agrees Public Schools Should Not Tell Parents If Their Child Is ‘Gender Fluid’

Hiding children's gender confusion from parents is now current policy in Virginia schools, proudly endorsed by Democrat gubernatorial candidate Terry McAuliffe.

Imagine the following as a Glenn Youngkin ad:

The number of youth confused about their gender is up over 1,000 percent.

If it’s your child, Terry McAuliffe doesn’t think you should know about their struggle. He would force schools to hide a student’s new name and pronouns from parents. He even supports policies where schools use the child’s birth name with parents but a different name at school.

New genders without parental consent. Pitting parents against children. Terry McAuliffe’s education agenda is bad for Virginia.

Shockingly, these claims are true. Virginia Gov. Ralph Northam signed a bill into law in March 2020 that mandates the Virginia Department of Education develop “model policies concerning the treatment of transgender students in public elementary and secondary schools.”

The model policies came out in April of this year, and they are frightening. McAuliffe proudly endorses them on his website. They mandate co-ed bathrooms for all, force teachers and students to accept and use new names and pronouns, and clear the way for boys to participate in girls’ sports.

All school boards in Virginia were required to have adopted the model policies by the start of the current school year. Many Virginia school boards have passed the model policies, while others have bravely rejected them.

In a high-profile case, a teacher in Loudoun County was placed on leave in May for refusing to comply with its version. The Virginia Department of Education has even threatened school superintendents that schools will be on the hook for civil damages that result from “noncompliance.”

Don’t Tell Parents If Their Child Is Gender Confused

The most pernicious aspect of the model policies is the alarming mandate that schools not tell parents if their son or daughter has adopted a new gender at school: “If a student is not ready or able to safely share with their family about their gender identity, this should be respected.”

The policies even suggest teachers use a child’s birth name with parents but a name of the opposite sex at school. Apparently, McAuliffe has no objection to schools giving teachers the green light to deceive parents about their children’s adoption of a false identity.

The article also notes that the tower in the background looks like the radar cross-section measuring tower at Lockheed's super secret (and mostly underground) facility in Helendale, California, and having driven near there a couple of times in the last few years, I'd have to concur. And it's that odd fact that raises a few intriguing questions. If one looks at the picture carefully, one notices something very odd: there appear to be no jet or rocket exhaust ports. There are three possible explanations for this: (1) There aren't any, because the platform is just a test bed for radar cross section analysis, and the "whatever-it-is" was not designed to fly; or (2) there are such ports, but we might not be able to see them due to the angle that the picture and video are taken, and/or because the ports are of a highly unusual nature and not easily distinguishable; or (3) there are no such ports because the "whatever-it-is" uses a completely different form of propulsion than rockets and/or jets, and that its propulsion is "exotic."

In looking at it and pondering these three options, I'm also reminded of the alleged statements of the former Lockheed skunkworks director, the late Ben Rich, whom, you might recall, stated things to the effect that "we have stuff that would make George Lucas envious" and "we found an error in the equations and now we can take ET home." The "whatever-it-is" certainly looks like something that might have come from a project that these alleged statements describe.

But there's something else about this article and accompanying pictures and video that intrigues me, and that brings me to the "high octane speculation of the day," and that's both the timing of the video, and the fact that Lockheed would be moving something like this around during the day and in view of people who can (and did) take pictures and videos of it.

Again, we're confronted by some options: General Kelly genuinely did not know what the "whatever-it-is" was, or he knew and was simply dissembling. Let's consider the first option since it's the more interesting one. General Kelly might not know what the object was, because he had no need to know; or (even worse), he didn't know because thewhatever-it-is was entirely a private project of Lockheed-Martianhaving nothing whatsoever to do with the government.

And why now? My high octane suspicion is that this act was very deliberate, and designed to send a message in the current geopolitical situation, and with the regime of President* Bidenenko being so weak and incompetent, and that message is addressed to Beijing and Moscow: think twice before becoming too adventurous…

If Polls Are Right, Dems Are Doomed. If They're Wrong, It's Worse.

In less than three months, President Biden’s approval rating has tumbled from a remarkable position in a polarized nation to the lowest of all but two presidents since 1945. Democrats are panicked though refusing to course-correct, hoping the pandemic will retreat, the economy will rebound, and their agenda will pass through Congress and turn out to be popular down the line.

The standing of the party with voters, at this time, isn’t in doubt. It’s awful. Biden’s average job approval rating on July 20 was 52.4% in the RealClearPolitics average before tanking precipitously and taking the party’s fortunes with him as the delta variant surged and American troops withdrew from Afghanistan in a deadly and tragic exit. RCP currently has him at 43.3%. His approval in Gallup has dropped 13 points since June, six points in this last month. The latest Quinnipiac University poll had Biden’s approval/disapproval at 38/53, down four points in three weeks. Specific findings on leadership questions were dreadful, with Biden’s numbers falling since April by nine points on the question of whether he cares about average Americans, seven points on whether he is honest, and nine points on whether he has good leadership skills.

The latest Morning Consult/Politico findings from last week showed Biden’s approval underwater across the board, at 45% approval overall, at 40% on the economy, 44% on health care, 40% on national security, 33% on immigration and 36% on foreign policy. The only number not underwater was Biden’s COVID approval of 49%-46%, 30 points lower than it was last spring. Across all polling Biden’s approval on the questions of competence and accomplishment have suffered. And that Morning Consult/Politico survey stated, “The shares of independent and Democratic voters who say Biden has underperformed expectations have doubled over the past three months.”

The decline in COVID deaths, hospitalizations and infections and the disappearance of Afghanistan from the news has done nothing to stabilize the downward trajectory. In order for Democrats to stay competitive in the midterm elections, Biden’s approval would have to get back up to 50%-52%. Low presidential approval ratings have correlated to significant losses for the president's party in the last four midterm elections of 2018, 2014, 2010 and 2006.

Meanwhile Republicans have narrowed the margin in the congressional generic ballot, and a September Morning Consult/Politico poll found “58% of GOP voters say they’re ‘extremely’ or ‘very’ enthusiastic to vote in the 2022 midterms, up 10 points since July.”

Even if their polling was good, Democrats face fierce headwinds next year: historical trends that favor the party out of power in the midterms in a president’s first term, a fragile four-seat margin in the House and no margin in the Senate, all of which can easily erase their congressional majorities, and redistricting maps that favor the GOP. In addition, the party is facing new liabilities in voter registration — it has lost registered voters in critical states in considerable numbers. The Hill reported registration is down for Democrats since 2019 in Florida by more than 200,000, in North Carolina by more than 135,000, and in Pennsylvania by more than 200,000. Democrats have seen marginal increases in party registration in Arizona and New Hampshire.

Yet while Democrats are bracing themselves for a wipeout at the ballot box next year, they may not know the true extent of their loss of support among voters. Certainly voter turnout can defy any polling predictions. But Democrats will have a rough time turning out their voters next year when the base of the party is likely to feel more disappointment than gratitude for the party’s accomplishments in 2021 and 2022, and the GOP base is likely to be highly energized.

A few weeks from now the first consequential bellwether election will take place in Virginia where former governor Terry McAuliffe, who is running again, is tied with Republican Glenn Youngkin in the polls. If McAuliffe pulls it out, Democrats will likely dismiss the scenario that polling around the rest of the country is portraying for them next year. They shouldn’t.

Much can happen in a year, Democrats hope for improvement in the economy and the pandemic, and a return on their far-reaching “infrastructure” agenda may materialize. Revelations from the select committee investigating the Jan. 6 insurrection may challenge GOP candidates trying to avoid any daylight between their campaigns and Trump. Trump’s war with the GOP, and his constant messaging to its voters that all elections are rigged, may cost the party substantial voter turnout in key districts or states.

But Democrats shouldn’t count on it. They should believe the polls and campaign like they do.

The Norwegian Nobel Committee last week awarded Maria Ressa of the Philippines and Dmitry Muratov of Russia this year’s Nobel Peace Prize.

While Ressa and Muratov’s work exposing their respective oppressive regimes should be applauded, there was a better choice for this year’s prize. Namely, the parties behind the U.S.-brokered Abraham Accords, where Israel normalized ties with the United Arab Emirates, Bahrain, Sudan, and Morocco.

The prize should have been shared between former President Donald Trump, former Israeli Prime Minister Benjamin Netanyahu, Emirati President Khalifa bin Zayed Al Nahyan, Bahraini King Hamad bin Isa Al Khalifa, Sudanese Sovereign Council Chairman Abdel Fattah al-Burhan, and Moroccan King Mohammed VI.

The accords were the first nation-to-nation Middle East peace deals in 25 years. Moreover, they mark an evolving Middle East. One that recognizes Iran, not Israel, as the greatest threat in the region. One that pursues a better, common future above the animosity and blood of the past. Other countries, including Saudi Arabia, have hinted at joining the accords.

The historic scale of the accords should not be underestimated.

Sudan was the home of the 1967 Khartoum Resolution, which included the three no’s: no peace with Israel, no recognition of Israel, and no negotiations with it. Well, today, the three no’s have become three yeses. They have unlocked countless economic, religious , security, social, and other opportunities between Israel and Muslim countries.

The outside-in approach of having Mideast countries normalize ties with Israel, as opposed to Mideast peace being contingent on Israeli-Palestinian peace, is a playbook that will be used in the future even if the Palestinians refuse to make peace with Israel.

President Joe Biden expressed his regret Monday that former Secretary of State Colin Powell died of complications from the coronavirus, despite being fully vaccinated.

Biden commented on Powell’s death after a surprise appearance at the White House honoring the State and National Teachers of the Year on Monday.

“By the way, he had serious underlying conditions, as you know, that’s the problem. It wasn’t that the vaccinations aren’t good, he had two very serious underlying conditions,” he told reporters. “And unfortunately didn’t work. God love him.”

Powell’s family did not mention any underlying conditions in their statement announcing his death.

Powell’s death from the virus, despite his being fully vaccinated, sparked immediate controversy on social media among vaccine supporters and opponents.

White House Press Secretary Jen Psaki said during the daily briefing that deaths of fully vaccinated individuals are “extremely rare.”

“That has been the case even before the death of Colin Powell, especially among people, older people over a certain age, and people who have underlying health issues or people who are battling other diseases,” she said.

California Teachers, Parents Plan Statewide Walkout Over Gov. Newsom’s Vaccine Mandate

California teachers and parents on Monday are planning a statewide walkout in protest of Governor Gavin Newsom’s vaccine mandates for public and private schools.

California became the first state to require coronavirus vaccines for grades K through 12 to attend in-person classes after Newsom announced the mandate on October 1. The order currently affects students older than 12, and it will affect children aged 5 to 11 once the vaccine gets final federal approval. Newsom’s plan impacts both public and private schools and also includes exemptions for religious and medical reasons.

Staff and teachers are also required to get the vaccine or submit to testing under the mandate.

Thousands of parents are expected to keep their children home from school, with teachers and staff being encouraged to skip out on the day as well.

One motivator for the protests is the money schools will miss out on if kids are not present in class. “We know that if our children stay home from school that that will impact the funding that schools will get for that day,” California parent Babe Prieto explained. “And we want them to know that we’re serious about not being forced to vaccinate our children.”

According to the California Department of Education, state funding per student is $13,976. With California requiring schools to teach at least 180 days of the year, schools are getting up to $78 per student daily.

One California school is canceling all classes on Monday because of the protest. Oak Run Elementary in Shasta County reportedly sent a letter to families saying, “Parents, educators, and students across the U.S. will engage in peaceful noncompliance activities to remind government officials that individuals should have the final say when it comes to their health.”

Amy Keurentjes, a doctor and mother of five, told a local newspaper, “I’m just out here fighting for freedom. I want to see freedom for health care workers. I want to see freedom for educators.”

In addition to the walkout, thousands are expected to attend a protest scheduled in Sacramento. According to CalMatters, “around 2,500 people are slated to protest in front of the state Capitol building in Sacramento for an event called ‘Our Children, Our Choice.’”

California parents and teachers are not alone in their opposition to Newsom’s vaccine mandates. According to the Sacramento Bee, nearly 40% of state workers remain unvaccinated, despite Newsom’s July order requiring all state employees to get vaccinated.

DC Suspends Most of Its Metro Trains Over Safety Issue

WASHINGTON—Washington’s regional Metro system abruptly pulled more than half its fleet of trains from service early Monday morning over a lingering problem with the wheels and axles that caused a dramatic derailing last week. The ruling promises to complicate daily travel and commutes for thousands of riders for an unspecified length of time while the National Transportation Safety Board investigates the issue.

The Metro authority’s safety commission ordered the withdrawal of the entire 7000-series line of trains overnight. The Kawasaki-made 7000—series are the newest set of trains in service and the 748 cars comprise about 60 percent of the fleet.

NTSB Chair Jennifer Homendy told reporters Monday that a design flaw had been identified which caused the trains’ wheels to spread too wide on the axles, allowing the carriage to slip off the tracks.

“We’re at the preliminary stage of our investigation—just trying to collect data and information,” Homendy said. “This could have resulted in a catastrophic event.”

The wheel issue is being blamed for an incident last week in which a train car slipped off the tracks on the Metro’s blue line near Arlington Cemetery. Homendy said the car had apparently derailed once and then re-connected with the rails by itself, before derailing a second time. Some passengers were trapped in a tunnel in a dark train car and had to be evacuated on foot.

The safety ruling had already snarled commutes across the nation’s capital and the intertwined communities of northern Virginia and southern Maryland. Passengers on social media reported widespread delays with commuters waiting up to 45 minutes between trains and crowding chaotically into whatever space was available.
