Fifth Amendment:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Although the popular term right to die has been used to describe the debate over end-of-life decisions, the underlying issues include a variety of legal concepts, some distinct and some overlapping. For instance, right to die could include issues of suicide, passive euthanasia (allowing a person to die by refusal or withdrawal of medical intervention), assisted suicide (providing a person the means of committing suicide), active euthanasia (killing another), and palliative care (providing comfort care which accelerates the death process). Recently, a new category has been suggested—physician-assisted suicide—that appears to be an uncertain blend of assisted suicide or active euthanasia undertaken by a licensed physician.

There has been little litigation of constitutional issues surrounding suicide generally, although Supreme Court dicta seems to favor the notion that the state has a constitutionally defensible interest in preserving the lives of healthy citizens.1 On the other hand, the right of a seriously ill person to terminate life-sustaining medical treatment has been addressed, but not squarely faced. In Cruzan v. Director, Missouri Department of Health,2 the Court, rather than directly addressing the issue, assume[d] that a competent person [has] a constitutionally protected right to refuse lifesaving hydration and nutrition.3 More importantly, however, a majority of the Justices separately declared that such a liberty interest exists.4 Yet, it is not clear how actively the Court would seek to protect this right from state regulation.

In Cruzan, which involved a patient in a persistent vegetative state, the Court upheld a state requirement that there must be clear and convincing evidence of a patient’s previously manifested wishes before nutrition and hydration could be withdrawn. Despite the existence of a presumed due process right, the Court held that a state is not required to follow the judgment of the family, the guardian, or anyone but the patient herself in making this decision.5 Thus, in the absence of clear and convincing evidence that the patient had expressed an interest not to be sustained in a persistent vegetative state, or that she had expressed a desire to have a surrogate make such a decision for her, the state may refuse to allow withdrawal of nutrition and hydration.6

Despite the Court’s acceptance of such state requirements, the implications of the case are significant. First, the Court appears, without extensive analysis, to have adopted the position that refusing nutrition and hydration is the same as refusing other forms of medical treatment. Also, the Court seems ready to extend such right not only to terminally ill patients, but also to severely incapacitated patients whose condition has stabilized.

Report: Establishment Media’s Readership Collapses Up to 48% Without Trump’s Presidency

The establishment media’s online readership has reportedly collapsed without the aid of Donald Trump’s America First presidency.

The Hill, Washington Post, New York Times, Politico, Wall Street Journal, CNN, and Vox Media have lost a large percentage of monthly unique visitors since Trump led the nation, according to Comscore data cited by the Journal.

“Newspapers, television, all forms of media will tank if I’m not there,” Trump predicted in 2017, “because without me, their ratings are going down the tubes.”

Politico’s readership has reportedly declined the greatest amount at 48 percent. The Post‘s page views are reportedly fewer by 28 percent, followed by the Times at 15 percent, then the Journal and Vox Media at nine percent.

As Trump is canceled on Twitter and Facebook, reducing his ability to immediately create a headline for the establishment media to print, the amount of the Post’s digital subscribers has reportedly declined by nearly 300,000.

According to the report, only three of the Post’s ten most-read articles on the home page in 2021 were political coverage. Whereas in 2019, just about all the 50 most-read articles on the home page were political “news.”

Traffic from nonsubscribers to the Post has also reportedly decreased 35 percent in the last two years. “Active subscribers are coming less often, and when they do come, they consume fewer pageviews,” a Post internal document reported stated.

“Traffic from subscribers is growing, but not fast enough to make up that difference,” the Journal analyzed. “From October 2019 to October 2021, digital subscribers increased by 56%, but subscriber page views only increased by 6% during that period.”

The Post defended their failing paper by attempting to wean itself off Trumpian headlines.

“We’ve been deliberate in our strategy work and are seeing the results of our investments across the company, particularly with the growth of the newsroom, the broadening of our coverage and the sophistication of our storytelling tools,” a Post spokesperson told the Journal.

The Post’s statement also indicated its hired a third party to audit and study the paper’s news coverage of Joe Biden’s presidency.

“This was a third-party study done to help identify potential motivations to subscribe, and we are not focused on just one of them,” the spokesperson said. “Rather, we are using the data as a whole to think about where we invest and grow in 2022.”

The study reportedly showed the publication is struggling with subscribers under the age of 55. The Journal reported only 14 percent of the Post’s subscribers are 55 or younger. “Our paid product is not attractive to younger people,” the study allegedly reads.

Among those most interested in the paper are reportedly described by the study as “affluent, urban married men with kids, more multi-ethnic, skew liberal/Democratic.”

Started coming down with a cold yesterday morning. Sneezing, nose started running like a faucet. Looked at some of the "neutraceutical" protocols and started with an extra (in addition to what my daily regimen is):

Vit C 2500mg

Echinacea 800mg

Elderberry extract 1200mg

Took this at 10am with green tea. Did it again at 3pm.By 5pm my nose had stopped running, I quit sneezing and my sinus's cleared. Slept fine, head clear. Took half of yesterdays dose this morning just in case. Only evidence is a wastebasket full of tissue and some expensive urine. This wasn't the first time, but it was the most dramatic because of the knowledge gained from covid about zinc ionophors. I'll keep supplementing for a couple days, tapering off the dosage as long as symptoms don't re-appear. Get quercetin if you haven't already.

The Senate will vote next month on legislation from Sen. Ted Cruz (R-Texas) to impose Nord Stream 2 pipeline sanctions as part of a deal that allowed Democrats to clear dozens of President Biden's nominees.

Under the agreement, locked in during a rare all-night session, the Senate will vote on Cruz's legislation on sanctions related to the construction of the pipeline, which allows Russia to deliver natural gas to Germany, by Jan. 14. It will need 60 votes to ultimately pass.

The deal comes after days of negotiations between Cruz and Senate Majority Leader Charles Schumer (D-N.Y.) that seemed to routinely yo-yo, even in the hours leading up to the agreement, from stalemate to progress and back again.

Cruz put a wide-ranging hold on Biden's State and Treasury nominees earlier this year, vowing to maintain the blockade until the Biden administration imposes congressionally mandated sanctions on the pipeline.

A hold by a senator doesn't prevent the nominees from being confirmed if they have the support of 50 senators, but it does require leadership to eat up floor time in order to get a final vote.

Cruz, even while largely maintaining his holds, has also let some nominees be cleared easily, including former Sens. Jeff Flake (R-Ariz.) and Tom Udall (D-N.M.), who were confirmed to be the ambassadors to Turkey and New Zealand, respectively.

But the stalemate on dozens of Biden nominees, which frustrated Democrats, administration officials and even some Republicans, took on more urgency as the Senate headed toward the end of its work year. Absent an agreement with Republicans, Democrats would have to send nominees back to the White House at the end of the year and force Biden to renominate them.

Schumer and Cruz had previously agreed on a vote on Nord Stream 2 sanctions as an amendment to a sweeping defense bill in exchange for Cruz dropping holds on seven ambassador nominees.

But that package of amendments was blocked by Sen. Marco Rubio (R-Fla.), who wanted a vote on his proposal on banning imports from China’s Xinjiang region, where administration officials have accused the government of carrying out genocide against Uyghur Muslims, or a vote in the House. Hang in there with prayers, anon. Same thing happened to my mom earlier this year. Five days in the COVID unit with Remdesivir and she made it. She did have to do rehab for five weeks; she's home now and has really done well with the exception of not really regaining her strength. I don't think that will ever return to normal. But she's still with us!
